Russian foreign minister says West “playing with fire"

Sergei Lavrov, who has been Russia’s foreign minister for over 20 years, mainly under current president Vladimir Putin, said this week that the West was “asking for trouble” and suggested a potential Third World War wouldn’t be confined to Europe if the U.S. agrees to Ukrainian requests to use foreign-supplied weapons on Russian soil.

Speaking to reporters in Moscow, Lavrov explained: “We are now confirming once again that playing with fire - and they are like small children playing with matches - is a very dangerous thing for grown-up uncles and aunts who are entrusted with nuclear weapons in one or another Western country.

“Americans unequivocally associate conversations about Third World War as something that, God forbid, if it happens, will affect Europe exclusively.”

Putin has consistently claimed Russia doesn’t want to become involved in a conflict with the NATO alliance, led by the United States, but has similarly fired warnings about a broader war involving the biggest nuclear powers around the globe following the Russian invasion of Ukraine in February 2022.

Lavrov’s words come after Ukraine carried out the biggest attack on Russia since the Second World War, an incursion into the Kursk region, which is to the northeast of Ukraine. Former US president Donald Trump suggested on Tuesday such an attack could lead to World War III.

U.S. restrictions on Ukrainian weapon use

So far, the United States has only allowed Ukraine to use its long-range weapons on Ukrainian soil or to defend the country from cross-border Russian attacks. Ukrainian President Volodymyr Zelenskiy has tried to convince allies to relax those restrictions, with Russia claiming British tanks and American rocket systems were used in the attack on Kursk.

Kamala Harris Plan To Tax Unrealized Capital Gain Is Scary, Here’s Why

As a presidential candidate, Vice President Harris has piggybacked on many of President Biden’s tax plans, including his pledge not to raise taxes on anyone making under $400,000 a year. But she has plenty of other big plans for your taxes listed here that reprise Biden’s tax goals, with some of her own ideas thrown in.

They include raising top marginal rates on the top earners from 37% to 39.6%. In 2019, she floated a 4% “income-based premium” on households making more than $100,000 to pay for Medicare for All, but this has not yet resurfaced in 2024. Among the more controversial of the Biden proposals—which Harris has repeated—is a tax on unrealized capital gains for taxpayers with wealth greater than $100 million. It may be labeled a “billionaire tax,” though $100 million is a tenth of a billion.

Even so, few may want to defend billionaires (or someone with a mere $100 million for that matter) in the current climate. Some argue this fairly targets extremely wealthy Americans who have taken advantage of tax rules to pay lower rates than their secretaries. For example, wealthy people can tap their resources by borrowing money rather than selling something that would trigger tax. Some attack the proposal as a wealth tax that will chill investments of capital.

Unlike an income tax, Harris’ new wealth tax would work like this. Households worth more than $100 million would pay an annual minimum tax worth 25% of their combined income and unrealized capital gains. Say you purchase stock for $10 a share. It doubles to $20 in the first year, but you still hold it. Even though you haven’t sold it, that $10 gain would be subject to the new tax.

Real estate would work the same way. You buy a house, building, or land. The increase in value over time would be taxed every year, even though you still hold it. We have never had a tax on gains that are not “realized,” meaning sold. In that sense, this new tax would be groundbreaking, a point we’ll come back to.

Apart from policy, there are administrative issues galore. How do you go about valuing everything every year to be taxed? Public company stock would be straightforward. But most assets could be a nightmare, and who in the end gets to carry the day on value? Disputes about value in tax cases are legendary and voluminous. Nearly every estate tax case with the IRS includes valuation disputes, often with competing experts. In income tax cases, charitable contributions of noncash assets such as real estate or crypto often also end up in major valuation fights.

Just imagine what annual value statements with tax returns might look like, in a world where the increase in value since last year turns into taxes. Capital gains have always been singled out for lower taxes, not higher. And except in the case of estate tax measured on death, it has been nearly sacred not to tax “earnings” you didn’t receive.

Besides, what if value spikes one year, you pay tax, and then it plummets the next year? You still have the now worthless asset and can’t sell it for much. So why the unheard-of shift to tax something before its time?

What is arguably the scariest part of this idea? What if this opens the door to a more generalized effort by the government to tax you on something that you still own? Right now the proposal is only to use this wealth tax for the truly wealthy. Not just billionaires, but also anyone with at least $100 million.

Once we start down this path, could we some years from now face a tax like this for someone with $20 million, $10 million, even $1 million? You get the idea. Even if the “billionaire’s tax” to hit anyone at $100 million passes, there could be court challenges based on what the U.S. Constitution says about the government’s taxing power. The Supreme Court has not fully ruled on a question like this, although one recent guidepost came in a 2024 tax case, Moore vs. USA, in which the Supreme Court upheld a tax on undistributed foreign assets.

The chances of this wealth tax passing may not be high. Harris would need to win, and both the Senate and House would need to be controlled by Democrats. In any event, this proposal could signal the dawn of new taxes and more coming. You can read more about Harris’ big plans for your taxes.

ABL Space Systems lays off staff

Launch vehicle developer ABL Space Systems has laid off a significant portion of its workforce, citing the need to reduce costs after the loss of a rocket in a static-fire test.

In a post on LinkedIn Aug. 30, Harry O’Hanley, chief executive of ABL, said the company was laying off an unspecified number of people.

He included the email he sent to company staff after an all-hands meeting to discuss the layoffs.

The layoffs came after the company’s second RS1 rocket was lost in a fire after a static-fire test at the Pacific Spaceport Complex – Alaska on Kodiak Island July 19.

The company was in the final phases of testing ahead of a launch attempt when a fire broke out under the vehicle on the pad after an aborted static fire, eventually destroying the vehicle.

O’Hanley said in the email that the company had been working to reduce costs at the company even ahead of that test, citing changes in the market and access to capital.

The company had raised several hundred million dollars, including $200 million in October 2021 and $170 million in March 2021.

“In 2021, the space industry – along with nearly every industry – was a red-hot market. We faced significant pressure to scale and capital was available to support it,” O’Hanley wrote.

The company had originally planned to be a lean organization, “but to remain competitive we built a large organization capable of producing rockets at a high rate while we continued to tackle the challenges associated with launch vehicle development.”

Access to capital became more difficult in 2022, he wrote, as ABL continued development of the RS1.

The company’s first test flight of the rocket, in January 2023, failed when a loss of power caused the first stage’s engines to shut down about 10 seconds after liftoff.

Hanley wrote that, starting in 2023, “we cut costs and positioned the company for leaner operations with smaller teams, restrained hiring, and more conservative spending.”

That was working, he said, until the static-fire incident. “Through these efforts, we were able to get onto a good glidepath, but the recent staticfire issue knocked us from it.”

He did not disclose in the email how many people were being laid off, and the company did not immediately respond to questions about it.

The company listed about 170 employees on its website as of late August.

O’Hanley said that the company, moving forward, will return its roots as a lean company.

The reorganization would “reset the cost structure of the business to be sustainable in any environment” and give ABL “sufficient time to iterate and mature the technology.”

That includes, he said, an emphasis on mobility.

The company has set up ground equipment that can be easily shipped to enable launches from locations with little existing infrastructure.

He did not indicate what the layoffs meant for the schedule for RS1.

The company stated Aug. 26, when it outlined the cause of the statis-fire anomaly, that the next rocket was “well into production.”

The ground equipment, known as GS0, was being shipped back to California for repairs and refurbishment.

“In 6.5 years, you designed a launch vehicle from scratch and got two rockets onto the pad.

Few other teams have done that, let alone take on the scope that you did,” he wrote to departing employees.

“Be proud of this work because nothing can ever strip these accomplishments from you.”

A police organization backing former President Donald Trump called on Vice President Kamala Harris to apologize for remarks she made in 2020 linking slavery and Jim Crow to policing.

Man arrested after storming press area at a Trump rally will face charges, police say

Police said Saturday that a man will face misdemeanor charges after he stormed into the press area at Donald Trump’s rally in Johnstown, Pennsylvania, before being surrounded by authorities and eventually subdued with a Taser as the former president spoke at the campaign stop.

General Dynamics secures $491 million contract extension from Space Development Agency

General Dynamics Mission Systems, a unit of defense contractor General Dynamics, has been awarded a $491 million contract extension by the Space Development Agency for satellite ground systems, the Pentagon announced Aug. 30.

The modification nearly doubles the company’s existing contract with the Space Development Agency (SDA) to approximately $900 million through 2029.

General Dynamics in 2022 was selected to build the ground operations and integration segment for the SDA’s Proliferated Warfighter Space Architecture (PWSA), a mesh network of satellites in low Earth orbit designed to support global military operations.

SDA. which is under the U.S. Space Force, is building the PWSA with a dedicated tracking layer that allows for real-time detection and monitoring of ballistic missile threats.

The PWSA also is intended to provide a low-latency communication backbone for continuous data transmission, enhancing the ability to coordinate joint operations across different military branches.

General Dynamics, collaborating with Iridium Communications and other subcontractors including KSAT, Raytheon Technologies and Emergent, will develop and maintain two primary operations centers located at Grand Forks Air Force Base, North Dakota, and Redstone Arsenal in Huntsville, Alabama.

These centers will oversee network and mission management, payload data handling, and constellation monitoring.

Additionally, the companies will develop 14 ground stations to serve as data entry points.

Real estate investor moves to ease Space Coast strain

Real estate investor Hines plans to start building a large industrial complex on Florida’s Space Coast this year to help ease strained infrastructure at the world’s busiest launch hub.

Hines aims to construct up to three rear-load buildings totaling 60,000 square meters by the end of 2025 under the first phase the project, located close to Florida’s Space Coast Regional Airport, the nearest commercial airport to the Kennedy Space Center.

The Space Coast Innovation Park (SCIP) could later span 279,000 square meters.

Ryan Wood, managing director of industrial development and acquisitions at Hines, said the company is targeting aerospace names and their suppliers that are struggling to find enough space for operations in the area.

“With all the robust growth that we’ve seen in the space industry along the Space Coast, it has certainly stretched the infrastructure,” he said.

While pressure the Cape is under to cater for a significant rise in launch has been broadly documented, Wood said the rising activity is spilling out into neighboring regions and increasing the need for more general aerospace infrastructure.

He declined to detail the companies interested in setting up operations at SCIP because of non-disclosure agreements.

“It’s a healthy mix,” he said, “of both existing companies that have a large and existing presence on the Space Coast, as well as new companies with some really innovative and exciting ideas needing access to the launch facilities and infrastructure.”

Because industrial Space Coast activity has grown so quickly, he said many existing companies occupy less efficient and older facilities and are eager to modernize their infrastructure.

SCIP would be optimized for activities such as light space hardware assembly, repair and mission-critical storage.

“Just five years ago we had maybe 30 launches a year,” Wood continued, but this is “projected to go over 100 launches this year.

With that increase in frequency, you need to have access to the key materials in close proximity to those launch facilities, and so I think that’s where we’re going to see a lot of the demand here.”

However, he noted “it takes time to develop sites in Florida.”

Hines started working with locally based real estate firm Key Group on SCIP several years ago, and initially planned to break ground early this year.

Through the Florida Job Growth Grant Fund (JGGF), Florida Governor Ron DeSantis announced a $6 million award Aug. 22 to build a road directly connecting SCIP to the Space Coast Regional Airport.

The road is slated to be completed at roughly the same time as SCIP Phase 1.

The grant “was really the catalyst to now make this into a reality to be constructed next year,” Wood said, “and not just get stuck in the design phase.”

Hines owns an operates around $93 billion of assets worldwide.

But while SCIP construction work will use similar manufacturing logistics processes Hines has used since being founded 66 years ago, he said the project is its first to focus specifically on aerospace.

Former Alaska governor and Republican vicepresidential nominee Sarah Palin won a new defamation trial against the New York Times on Wednesday, with a federal appeals court panel citing multiple legal errors in the case. The 2nd U.S. Circuit Court of Appeals rebuked the trial judge (though it didn’t remove him) in reviving Palin’s lawsuit against the paper and its former opinion editor James Bennett.

The New York-based appellate panel highlighted“several major issues” at the trial presided over byU.S. District Judge Jed Rakoff, specifically “the erroneous exclusion of evidence, an inaccurate jury instruction, a legally erroneous response to a mid-deliberation jury question, and jurors learning during deliberations of the district court’s Rule 50 dismissal ruling.”

The Times said in a statement after the ruling, “This decision is disappointing. We’re confident we will prevail in a retrial.”

The suit stemmed from a 2017 Times editorial called “America’s Lethal Politics,” which compared two political shootings: the 2011 killing of six people and the injury of 13 others in Arizona, including then-Rep. Gabrielle Giffords, a Democrat; and the 2017 Virginia shooting that seriously injured four people, including Rep. Stephen Scalise, R-La., at a congressional baseball game practice.The Times editorial argued there was a clear and direct link between the Arizona shooting and the political incitement arising from a digital graphic published in March 2010 by Palin’s political action committee. The graphic was a map that superimposed crosshairs over 20 congressional districts represented by Democrats, including Giffords’.

But a relationship between the crosshairs map and the shooting “was never established,” the circuit panel wrote, adding that the incident was rather “viewed as a tragic result” of the shooter’s serious mental illness. (A correction on the editorial currently reads: “An editorial on Thursday about the shooting of Representative Steve Scalise incorrectly stated that a link existed between political rhetoric and the 2011 shooting of Representative Gabby Giffords. In fact, no such link was established. The editorial also incorrectly described a map distributed by a political action committee before that shooting. It depicted electoral districts, not individual Democratic lawmakers, beneath stylized cross hairs.”)

Wednesday’s ruling for Palin is the latest appellate outing in her favor. In 2019, the circuit previously reversed the trial court’s dismissal of the case. This latest ruling stems from the 2022 trial.

During jury deliberations, the judge decided that he sided with the defense and would render what’s known as judgment as a matter of law (the Rule 50 dismissal to which the appeals court referred). The judge said that he would dismiss the case only after the jury had returned its verdict but wouldn’t tell the jury about his decision so as not to interfere with the verdict.

The jury found the defense not liable, but it turned out that several jurors had learned about the judge’s ruling before they reached their verdict, from push notifications on their phones.

On appeal, Palin challenged both the verdict and the Rule 50 decision, and the circuit court agreed that both must be vacated.

“Given a judge’s special position of influence with a jury, we think a jury’s verdict reached with the knowledge of the judge’s already-announced disposition of the case will rarely be untainted, no matter what the jurors say upon subsequent inquiry,” the panel wrote in its decision, authored by Judge John Walker, an appointee (and cousin) of former President George H.W. Bush. He was joined by George W. Bush appointee Reena Raggi and Donald Trump appointee Richard Sullivan.

But the panel declined to reassign the case to a new judge — a subject that is also top of mind in special counsel Jack Smith’s appeal of U.S. District Judge Aileen Cannon’s dismissal of Trump’s classified documents case.

Defamed election workers seeking Rudy Giuliani's homes and World Series rings

In a court filing, Ruby Freeman and Wandrea "Shaye" Moss also say they're entitled to Giuliani's $2 million claim for legal fees from the Trump campaign and RNC

The two Georgia election workers defamed by Rudy Giuliani are seeking to take possession of his multimillion-dollar homes in New York and Florida and some of his valuable personal property, including three Yankees World Series rings.

Ruby Freeman and her daughter, Wandrea "Shaye" Moss, were awarded $146 million in damages last year after a judge found Giuliani liable for repeatedly defaming them by falsely accusing them of election fraud during the 2020 presidential election. They filed the action seeking to get ahold of his properties in federal court in New York on Friday.

They argue the move is necessary because, "Mr. Giuliani has proven time and again that he will never voluntarily comply with court orders, much less voluntarily satisfy Plaintiffs’ judgment."

Ted Goodman, a spokesperson for Giuliani, said the appeal of the "objectively unreasonable" verdict "hasn't even been heard, yet opposing counsel continues to take steps designed to harass and intimidate" the former New York City mayor.

Freeman and Moss testified during the defamation trial that Giuliani’s lies in support of former President Donald Trump’s bogus stolen election claims subjected them to a torrent of racist and violent threats that forced them out of their jobs and homes.

Their filing Friday seeks "an order requiring Mr. Giuliani to turn over personal property in his possession in satisfaction of the judgment, and an order appointing Plaintiffs as receivers with the power to take possession of, and sell, both real and personal property that Mr. Giuliani does not turn over." That includes "cash accounts, jewelry and valuables, a legal claim for unpaid attorneys’ fees, and Mr. Giuliani’s interest in his luxury Madison Avenue co-op apartment."

Giuliani's Manhattan apartment is worth an estimated $5.7 million, while his condo in Palm Beach, which the former election workers are also trying to obtain, is valued at $3.5 million.

They're additionally laying claim to the $2 million in fees Giuliani says he's owed by Donald Trump's campaign and the Republican National Committee for his work in trying to overturn the results of the 2020 — efforts that got Giuliani disbarred in New York and that led to Moss and Freeman's lawsuit.

The mother and daughter are also seeking Giuliani's 1980 Mercedes-Benz SL500, signed Reggie Jackson picture, signed Joe DiMaggio shirt and three Yankees World Series rings he was given during his time as New York City mayor. They also want a diamond ring he owns and his collection of about two dozen luxury watches.

Giuliani filed for bankruptcy after getting hit with the judgment in December and, in that proceeding, estimated all of his jewelry was worth $30,000. Attorneys for Freeman and Moss disputed that claim, noting that just one of the World Series ringsis worth about that amount.

A New York bankruptcy judge dismissed Giuliani's case earlier this month, after citing Giuliani’s failure to turn over virtually any necessary information about his businesses while submitting incomplete or incorrect information about his personal spending.

In a separate but related filing Friday, the pair accused Giuliani of continued gamesmanship by claiming earlier this month that his permanent residence is in Florida in a "bid to qualify the Condo for homestead protection under Florida law."

That "evasive maneuver is no more valid than the last few: Mr. Giuliani’s own public internet broadcasts show that he has not actually resided in the Palm Beach Condo since purporting to establish permanent, actual residency there—and he certainly has not maintained it as a 'homestead,'" the filing said, noting there's no evidence he's even been at the condo since a brief stay in May. They also pointed out in his deposition in the bankruptcy case in February, he said his principal residence was in New York.

Freeman and Moss are seeking a judgment that their lien on the property is enforceable "and that any assertion by Mr. Giuliani of homestead status is without merit."

Goodman maintained his client is the victim and "we now live in a time where the justice system has been weaponized against Mayor Giuliani and so many others for strictly partisan political purposes."
