‘It’s all fallen apart’: Newsom scrambles to save California — and his career

LOS ANGELES — California is running so low on oxygen that officials are telling emergency crews to conserve supplies. Ambulances in Los Angeles are backed up outside emergency rooms, sometimes for hours. And the coronavirus vaccine distribution remains so disjointed that a freezer failure that forced immediate inoculations of hundreds of people in Northern California — inmates, older people, and some people on the street — was hailed as an improvement.

Californians are frustrated, tired and sick. And in the midst of the unfolding catastrophe, Gov. Gavin Newsom — confronting a burgeoning recall effort, on top of a year of wildfires and civil unrest — is under siege.

“Nobody has been dealt a tougher hand than Gavin Newsom,” Gray Davis, the former California Democratic governor who was recalled in 2003, said in an interview. “Look, I had the energy crisis and a recession. He has a pandemic we haven’t seen for 100 years. He has the fallout from that pandemic, racial injustice, wildfires, and I think I’m leaving something out. But nobody, no living governor, has had to experience as many crises as him.”

Halfway through his first term, the Democratic governor of the nation’s most populous state is scrambling to control a pandemic that has crippled the southern half of California since Thanksgiving. The pandemic has given Republicans, long sidelined in this heavily Democratic state, a rare opportunity to wound him. And Newsom is laboring to keep the state — and his own political future — intact.

“People are really pissed off,” said Ted Costa, the anti-tax crusader who was the original proponent of the Davis recall. He signed Newsom recall papers last week in the parking lot of a Home Depot in Thousand Oaks. “Things can get hot quick, and I don’t know if Newsom realizes what happens when a groundswell hits.”

For Newsom, an ambitious Democrat with a national profile, the extent of the problem is unclear. The last Republican to win a gubernatorial election in California was Arnold Schwarzenegger, and that was nearly 15 years ago. When Newsom won the governorship in 2018, he carried the state by nearly 24 percentage points. His public approval rating last year stood at 60 percent.

Yet the pandemic has worsened in recent weeks. And the frame of reference through which Californians view Newsom is about to change dramatically when Joe Biden replaces Donald Trump in the White House. No longer benefiting from a reliable foil in Washington, the bar of public approval for Newsom — and for Democratic governors across the country — is likely to be raised.

“For the last couple of years during Newsom’s tenure, people have been saying the nation’s going in the wrong direction and the state, compared to the nation, is going in the right direction,” said Mark Baldassare, a veteran pollster and president of the Public Policy Institute of California. Now, without a Republican president to judge Newsom against, he said, "It certainly changes that point of contrast."

Newsom has met the surging virus and its economic fallout with a series of proposals intended to help the most vulnerable Californians and to get schoolchildren back into classrooms. Last month, he proposed a $2 billion effort to reopen elementary schools for the state’s youngest students, with additional protective equipment and testing. Earlier last week, Newsom proposed giving the state’s low-income workers $600 “rapid cash” grants. And in a boon for his political fortunes, the state’s budget, despite dire predictions, is so healthy that Newsom released a budget proposal on Friday that calls for record spending while adding billions of dollars to the state’s reserve accounts.

US Supreme Court Refuses To Fast-Track Trump's Election Appeal

In a not entirely surprising decision, the U.S. Supreme Court refused to expedite election appeals filed by President Donald Trump (including Lin Wood's suit) to overturn President-elect Joe Biden’s victories in Wisconsin and Pennsylvania.

This does not mean the cases are dismissed but the justices won’t consider them until later this winter; and, as @steve_vladeck pointed out, they should all be moot by that point, though the justices can always find a way to rule.

Without comment, #SCOTUS denies the pending motions to expedite in eight pending election-related disputes. This means it will consider the requests that it take up the cases on their regular schedule (by which point they'll be practically, if not formally, moot).

Army probing officer Emily Rainey who led group to deadly DC riots

An Army psychological warfare officer is being investigated for busing people more than 300 miles to attend the Trump rally that turned into deadly riots at the Capitol, Army officials have confirmed.

Capt. Emily Rainey, 30, confirmed to the Associated Press that she led more than 100 people to Washington, DC, on Wednesday as part of a North Carolina protest group she heads called Moore County Citizens for Freedom.

While her commanders at Fort Bragg are reviewing her involvement in the rally, Rainey said she was fully up front about her plans to go — and insisted her group was not involved in storming the Capitol.

“I was a private citizen and doing everything right and within my rights,” the avid anti-masker told the AP on Sunday, saying she was on leave at the time.

“I told my bosses before I went that I was going, and I told them when I got back.”

Her group — as well as most at Wednesday’s rally — were “peace-loving, law-abiding people who were doing nothing but demonstrating our First Amendment rights,” she said.

She even shared a video on Facebook insisting that the rioters were all Antifa, saying, “I don’t know any violent Patriots. I don’t know any Patriots who would smash the windows of a National jewel like the [Capitol].”

Rainey is assigned to the 4th Psychological Operations Group at Fort Bragg, according to Maj. Daniel Lessard, a spokesman for 1st Special Forces Command.

Known as PSYOPS, the group uses information and misinformation to shape the emotions, decision-making and actions of American adversaries.

Members of the US military are permitted to take part in political organizations and events out of uniform but are prohibited from sponsoring partisan organizations.

It is unclear if Rainey’s participation with her group on Wednesday went against DOD policy.

Rainey previously made headlines last May after she posted a video online of her repeatedly pulling down caution tape at a playground that was closed under North Carolina’s COVID-19 restrictions.

Police in Southern Pines, a community about 30 miles west of Fort Bragg, charged her with injury to personal property over the incident after twice letting her off with warnings.

In Facebook posts, Rainey called her Moore County Citizens for Freedom a “movement.” In one post in November, the group bragged about having a “peaceful protest,” warning at the time, “They should pray we stay that way.”

Parler, a social network used to plan the storming of the U.S. Capitol last week, has been hit by a massive data scrape. Security researchers collected swaths of user data before the network went dark Monday morning after Amazon, Google, and Apple booted the platform.

The scrape includes user profile data, user information, and which users had administration rights for specific groups within the social network. Twitter user @donk_enby, who first announced about the scrape, claims that over a million video URLs, some deleted and private, were taken.

Security researchers claim that the scrapped posts are linked to accounts that posted them, and some of the video and image data have geolocation information. That is said also to include data from Parler’s “Verified Citizens,” users of the network who verified their identity by uploading photographs of government-issued IDs, such as a driver’s license.

The data might prove valuable to law enforcement since many who participated in the riots deleted their posts and videos afterward. The data scrape includes deleted posts, meaning that Parler stored user data after users deleted it.

Fraud in the inducement occurs when one party is tricked or deceived into signing a contract because of someone’s knowingly false statement and the other party reasonably relies on it. The misleading statement is designed to cause a person to enter into a contract they otherwise would not have entered into.

Defendant made a misrepresentation or omission of a material (important) fact, also known as a lie.

A valid injury can also include emotional distress.An individual may sue the deceiving party for fraud in the inducement. Fraud in the factum occurs when the victim enters into an agreement based on a fraudulent misrepresentation, to their detriment. Fraud in the factum commonly occurs when the victim believes the agreement is not legally binding, when in fact it is a contract.

The blind person, believing the representation that the document is a thank-you card, signs the document. The document, is in fact, a loan agreement under which the victim is required to loan the fraudster money over a period of years, to be repaid with zero interest.  

The victim may sue for fraud in the factum. Fraud in the factum can also be used as a defense to a claim of breach of contract. A contract entered into based on fraud in the factum will be set aside, on the ground that the consent obtained from the victim is legally ineffective. It could be because the victim suffers from mental incapacity, or a physical impairment, that made the victim not understand the risks, rights, and obligations created by signing the document. 

The victim may obtain damages for their injury. Damages include monetary damages to compensate the victim for money the victim gave to the fraudster. A fraud in the factum victim may also be able to recover property they gave to the fraudster.
