No, The Air Force's Shadowy Surveillance Test Plane Wasn't Spying On Portland Protesters

The U.S. Air Force says that a specialized Dornier Do-328 twin-engine turboprop was not snooping on ongoing protests in Portland, Oregon during a series of flights earlier this week. Online flight tracking software had shown the aircraft, which belongs to a secretive special projects office called Big Safari and conducts research and development and test and evaluation activities in support of U.S. Special Operations Command, flying circular orbits often associated with intelligence, surveillance, and reconnaissance missions in the area. The aircraft, which carries the U.S. civil registration code N645HM and is also known by the nickname Cougar, had first arrived at Hillsboro Airport outside Portland on July 19, 2020. The plane flew patterns for three days straight, but was never actually over downtown Portland, where protests are occurring, for any protracted period of time. It left the area today for Denver, Colorado, another area where it had been observed flying similar orbits last week.

Fed's Reverse Repo Soars To Stunning $756 Billion, Spikes By $230 Billion Overnight

While it received far less attention that the Fed's dot plot, the only thing that the Fed actually did change yesterday were its administered rates, as it raised the rate on its overnight Reverse Repo facility from 0% to 0.05% and the rate on excess reserves (IOER) from 0.10% to 0.15%. Since the RRP hike meant the GC rate would also have to increase, we noted last night that "with both market rates and RRP at .05%, there's really no economic incentive for cash investors to move cash to the Repo market."

Furthermore, now that the Fed is actually paying counterparties a modest but non-negligible 5bps on reserve deposits, it has made the RRP even more attractive compared to when it paid nothing (when the RRP rate was 0.0%),as it now generates a higher risk free yield than many short-term Bills. As such, we concluded that if it was the Fed's intention to reduce participation in its Reverse Repo facility (which the Fed specifically expanded back in March knowing what was coming) it would fail. And wow, did it fail: moments ago we got the first Reverse Repo results from the new post-FOMC regime, and boy was it a whopper: coming at $755.8 Billion among 68 counterparties, there was a tsunami of new reserves parked at the Fed, as the total was a massive $235 billion more compared to the $520.9BN (among 53 counterparites) yesterday, the biggest one-day increase on record as every Tom, Dick and Harry rushed to collect the Fed's free pennies.

One explanation for the surge is that as UBS noted earlier, the Fed's adjustment "is likely to make the RRP grow even more, in part due to new usage by GSEs who can now earn more than the zero they get on their deposits at the Fed." That, UBS added, takes reserves out of the banking system, which should slightly reduce the odds of balance sheet stress at year-end." Separately, since this is the first TOMO with the new 5bps RRP rate, we could be seeing a temporary spike as market rates adjust to the new lower bound.

In any case, while the Fed has so far been ignoring the massive drain in reserves courtesy of its Reverse Repo, as this facility is headed toward $1 trillion, Powell may want to consider the continued fracture to the repo market and also the pockets of illiquidity that may be forming as some counterparties remain flooded with reserves while others have virtually no reserves intraday as they are locked up at the Fed until the next day.

Russia Blamed for Mystery Launch of Three Missile-Armed F-22s Off Hawaii

Russia’s Pacific Fleet kicked off large-scale manoeuvres last week involving 20 warships, submarines, and support vessels, as well as aircraft, with the exercises seeing ships sailing up to 4,000 km from their home bases and standard operating areas. The presence of Russian Navy vessels 500-800 km west of Hawaii are the reason why three missile-armed Hawaii Air National Guard F-22 fighter jets were scrambled on Sunday for an “irregular air patrol,” CBS News has reported, citing US defence officials. The officials, who were not named, said Russian aircraft did not enter Hawaii’s Air Defence Identification Zone (ADIZ), and were not intercepted.

A spokesman for Indo-Pacific Command did not comment on the movements of US naval and air assets, but confirmed that the command was “monitoring the Russian vessels operating in international waters in the Western Pacific,” and said the US expected them to do so “in accordance with international law.” Media inquiries to the Federal Aviation Administration, which requested the flights, prompted the agency to say only that it had “a close working relationship with the military,” with no further information given. The cryptic nature of US officials comments sparked concern from local and national media, with multiple outlets referring to the planes “mysterious” launch “in response to an unknown incident,” and The Drive’s The Warzone mystifyingly titling a piece “Hawaii-Based F-22s Scrambled on FAA’s Request But Nobody Will Say Why.”

Last month, the US was forced to delay the testing of an SM-6 missile off Kauai Island due to the presence of the Kareliya intelligence ship nearby. The rescheduled test later ended in failure. On top of its Pacific drills and intelligence-gathering operations, Russia also occasionally sends missile-carrying strategic bombers for patrols off the coast of Alaska, forcing the Air Force to maintain a large garrison there. n a related development, the US Air Force announced last month that the US was planning to retire its entire fleet of F-22s over the next decade, citing small production numbers, cost of operation, and increasingly advanced enemy air defences, as well as problems with spare parts. Biden DOJ upset that Missouri made itself a sanctuary from federal gun rules; says state lacks authority to shield against enforcement of federal laws

With the stroke of his pen, Missouri Gov. Mike Parson (R) made the Show Me State a sanctuary from federal gun laws. No longer will Missouri law enforcement officials be allowed to enforce — or help the feds enforce — federal firearms rules.

But the move is not sitting well with President Joe Biden's Department of Justice, which made its displeasure known in a letter to Parson this week, telling the governor that a state does not have the authority to prevent the enforcement of federal law, the Associated Press reported.

What does the law do?

Much like cities and states that have declared they will not enforce federal immigration laws, Missouri has declared it will protect its citizens from what is sees as federal "overreach" when it comes to gun rights.

The Second Amendment Preservation Act prohibits police from enforcing or assisting federal authorities in enforcing federal gun rules. It also allows for anyone who believes his Second Amendment rights were violated by an officer enforcing federal laws to sue the relevant police department for $50,000, the Kansas City Star said.

When Parson, a former sheriff, signed the bill into law, he said he was sending a message to the feds in response to increased federal gun control regulations that are being pushed by the Biden administration.

"We're going to do things to make sure you don't overreach your authority from the federal government," he said, according to KCUR-FM.

How did the DOJ respond?

In a letter sent Wednesday night, the AP said, Justice Department officials told Missouri's elected leadership that the U.S. Constitution's Supremacy Clause supersedes Missouri's law.

Acting Assistant Attorney General Brian Boynton said in the letter that the new law "threatens to disrupt the working relationship between fedral and local authorities," the AP reported.

"The public safety of the people of the United States and citizens of Missouri is paramount," Boynton wrote.

According to the DOJ, Missouri lacks any authority to shield Missourians from federal law or to prevent law enforcement from carrying out federal laws.

Neither the DOJ letter nor the AP report on the letter bothered to mention that multiple state and local jurisdictions have declared themselves immigration sanctuary cities and are currently barring law enforcement from enforcing federal laws.

HotAir's Ed Morrissey pointed out that both the AP and DOJ were apparently incapable of understanding the point Parson was clearly making:

That's the context which the AP misses, but it as plain as the nose on one's face. If Parson had signed a bill declaring Missouri an immigration sanctuary state, Garland and the DoJ wouldn't have batted an eye about it. And yet, the same principle is true — states that ignore and refuse to cooperate with federal immigration law violate the Supremacy Clause, put public safety at risk, and should risk federal grants and technical assistance on that basis as well.

Amusingly, however, the AP never even mentions immigration or sanctuary status in its report. That is not just the clear context of Parson's move, it's also the precedent on which it's based. The Obama-Biden administration did nothing to discourage cities and states from refusing to cooperate with federal law on immigration; neither Eric Holder nor Loretta Lynch sent scolding reminders about the Supremacy Clause to the leaders of sanctuary cities and states.

The DOJ, Morrissey noted, is "awfully arbitrary about when they choose to get their panties in a twist" over the Supremacy Clause.

‘Clearly Unconstitutional’: 2 Justices Issue Dissent in Supreme Court’s Obamacare Ruling

Justices Samuel Alito and Neil Gorsuch dissented from the Supreme Court’s decision to uphold the Affordable Health Care Act, or Obamacare, describing the mandate as “clearly unconstitutional.”

The Supreme Court ruled 7–2 that the plaintiffs, 18 Republican-led states, lacked the standing to challenge the federal health care law. The states had wanted the Supreme Court to overturn the law because its “individual mandate” was set to zero by former President Donald Trump, saying that the entire law was unconstitutional.

The Department of Justice under former President Donald Trump backed the Republican-led states in urging the justices to strike down the law. The Biden administration doesn’t support the previous administration’s argument.

Justice Stephen Breyer wrote the majority opinion. He was joined by Justices Sonia Sotomayor, Elena Kagan, John Roberts, Clarence Thomas, Amy Coney Barrett, and Brett Kavanaugh.

But Alito, in his dissent (pdf), described “today’s decision is the third installment in our epic Affordable Care Act trilogy,” and he added that the decision “follows the same pattern as installments one and two. In all three episodes, with the Affordable Care Act facing a serious threat, the Court has pulled off an improbable rescue.”

“Texas and the other state plaintiffs have standing, and now that the ‘tax’ imposed by the individual mandate is set at $0, the mandate cannot be sustained under the taxing power,” he wrote. “As a result, it is clearly unconstitutional, and to the extent that the provisions of the ACA that burden the States are inextricably linked to the individual mandate, they too are unenforceable.”

The justice added that the Supreme Court was “presented with the daunting problem” of defining the “individual mandate,” which the same court redefined (pdf) in 2012 as a “tax.”

The lower courts mostly sided with the Republican states but agreed to delay enforcement while the appeals process continued. Defenders of Obamacare, which comprised about 20 Democrat-led states and the House of Representatives, also had appealed to the Supreme Court.

“Can the taxing power, which saved the day in the first episode, sustain such a curious creature? In 2017, Congress reduced the ‘tax’ imposed on Americans who failed to abide by the individual mandate to $0,” Alito noted. “With that move, the slender reed that supported the decision … was seemingly cut down, but once again the Court has found a way to protect the [Afforable Care Act].”

Social Security cost-of-living adjustment could be highest in 13 years amid inflation surge

Social Security beneficiaries could see 5.3% COLA increase next year.

Social Security recipients could be in line for one of the biggest cost-of-living adjustments next year as consumer prices continue to surge. The Senior Citizens League, a nonpartisan senior group, estimated the adjustment could be as high as 5.3%, based on Consumer Price Index data recently published by the Labor Department. The data showed that consumer prices spiked 5% in May from a year prior, the fastest year-over-year jump since 2008. Should Social Security beneficiaries see a 5.3% increase to their monthly checks next year, it would mark the steepest annual adjustment since 2009, when recipients saw a 5.8% raise. n 2021, Social Security benefits increased by 1.3%.

The adjustment is calculated based on the latest Bureau of Labor Statistics data on the Consumer Price Index for Urban Wage Earners and Clerical Workers, or CPI-W. The Senior Citizens League previously predicted the COLA for 2022 could be 4.7% based on data from April. Still, the final adjustment figure ultimately hinges on the economy's performance over the next few months and whether the Federal Reserve raises interest rates to combat rising inflation.

During its two-day policy-setting meeting this week, the U.S. central bank unanimously voted to hold the benchmark federal funds rate at a range between 0% and 0.25%, where it has been since March 2020, when COVID-19 forced an unprecedented shutdown of the nation's economy. The Fed will also keep purchasing $120 billion in bonds each month, a policy known as "quantitative easing" that's designed to keep credit cheap. Updated economic projections released by the Fed show that officials do not expect to raise rates until late 2023.

The Social Security Administration will release the final adjustment percentage in October. Since 2000, Social Security benefits have lost roughly 30% of their purchasing power due to inadequate adjustments that underestimate inflation and rising health care costs, according to the Senior Citizens League. The group has pushed Congress to adopt legislation that would index the adjustment to inflation specifically for seniors, such as the Consumer Price Index for the Elderly.

Judicial Watch Files New Lawsuits for Information About the Wuhan Institute of Virology

Government watchdog Judicial Watch has filed two Freedom of Information Act lawsuits against the Office of the Director of National Intelligence and the State Department. The lawsuits seek information and documents about the Wuhan Institute of Virology, where Wuhan coronavirus is believed to have been engineered through dangerous gain-of-function experiments.

In two FOIA requests filed earlier this year, Judicial Watch requested the following information.

All reports and records of communication dating back to June 1, 2017, regarding the Wuhan Institute of Virology and/or the origins of the SARS-CoV-2 virus.

All cables/teletypes, emails, or other messages sent or received by any official or employee of the Department of State assigned to the U.S. Embassy in Beijing or any Consulate in China related to the Wuhan Institute of Virology and/or the origins of the SARSCoV-2 virus.

All records regarding meetings between any official, employee, or representative of the Department of State and any official, employee, or representative of the Wuhan Institute of Virology, including briefing materials, notes, reports, or other records related to any such meeting.

All records related to former Secretary Pompeo’s appearance on ABC’s “This Week” in May 2020 [during which he discussed concerns about the Chinese government’s handling of the COVID pandemic].

Those requests were ignored, prompting the lawsuits.

“We don’t trust either the Biden administration or the Deep State to voluntarily come clean on COVID and its possible connections to the Wuhan Institute,” Judicial Watch President Tom Fitton released in a statement. “Judicial Watch’s FOIA lawsuits could be the key to unraveling the truth about COVID and the Wuhan Institute.”

United Nations warns drought could be 'next pandemic'

Though the UN report takes a global perspective, it found U.S.states are facing worse droughts.

The United Nations Office of Disaster Risk Reduction warned Thursday that a drought could be the "next pandemic" if people do not take the such conditions seriously.

The warning came in a report by the office that found roughly 1.5 billion people have felt the effects of a drought so far this century. In the introduction to the report, the office said droughts have widespread and underestimated impacts on society.

The report also argues the impact of droughts are underreported.

"The extensive impacts of drought are consistently underreported even though they span large areas, cascade through systems and scales, and linger through time, affecting millions of people and contributing to food insecurity, poverty, and inequality," the report states.

Mami Mizutori, the U.N. secretary general’s special representative for disaster risk reduction, warned there is no vaccine for a drought, a likely reference to the outgoing COVID-19 pandemic, and that a majority of the world will be living with water stress soon, the Guardian reports.

States in southwestern U.S. are facing droughts and extreme heat advisories, with temperatures threatening to hit 120 degrees Fahrenheit. Although a drought is usual in the southwestern states during the summer season, it appears they are lasting longer and the temperatures are higher each year.
