Texas AG Sues Biden Administration Over ‘Power Grab’ to Rescind Healthcare Funding
Texas Attorney General Ken Paxton on Friday announced he filed a lawsuit against the Biden administration over its decision to rescind a Medicaid waiver extension that would provide billions of dollars to state hospitals.
When federal officials in April rescinded the extension, they said Texas can re-apply when the waiver extension expires in 2022. Liz Richter, the acting administrator of the Centers for Medicare and Medicaid Services, said the Trump administration “did not go through the full federal rulemaking process” and then rescinded the waiver.
Describing President Joe Biden’s decision as a “power grab,” Paxton said on Friday that the bid to stip Texas’s 1115 Medicaid waiver extension would prevent “stable funding for providers of healthcare for children, people with disabilities, and the elderly.”
“Not only does this violate agency regulations and threaten to rip a $30 billion hole in Texas’s budget, it was clearly intended to force our state into inefficiently expanding Medicaid under the Patient Protection and Affordable Care Act,” Paxton said in a statement. “This would be a disaster for our state, and yet President Biden seems intent on thrusting his bloated model of government on everyone—including Texas.”
In a lawsuit (pdf) filed against the federal government, Centers for Medicare & Medicaid Services, and the U.S. Department of Health and Human Services (HHS), Paxton’s office said Texas offers Medicaid coverage to around 4.3 million people. The lawsuit is asking the court to declare the April letter that removed the extension as “invalid” and allow the Medicaid waiver to remain in place.
If the judge doesn’t grant the extension, the Texas Healthcare Transformation and Quality Improvement Program expire on Sept. 30, 2022, according to the suit.
The Epoch Times has contacted HHS for comment.
HHS Secretary Xavier Becerra, meanwhile sent a letter to Rep. Dan Crenshaw (R-Texas), saying federal health officials are committed to providing Texas with a new waiver extension.
“We’re trying to make sure that we’re transparent and we show accountability, because we have to make sure we’re following the law,” he said, according to the Houston Chronicle. “And we’re working with your leadership in the state and along with your delegation, try to make sure that as Texas moves forward, if it wants to continue the waiver, we’re going to be working with you to make sure we can see that happen.
Paxton, a Republican, has filed several lawsuits against the Biden administration since President Joe Biden took office in January, including one (pdf) in April against the federal government’s new procedures over deportations of illegal immigrants, one that sued Biden for “disregarding COVID-19 rules” at the border, and several others.

‘Terrorist state’ Israel must be stopped, Turkish President Erdogan says, adding it has ‘crossed all limits’
Humanity should take “swift” action to resist Israel’s “aggression”, Turkish President Recep Tayyip Erdogan said as Ankara reported that Turkish news agency journalists and UN-backed schools were hit by Israeli strikes in Gaza.
“This terrorist state that tries to plunder a city like Jerusalem, which houses places that are holy for Muslims, Christians and Jews, has crossed all limits,” Erdogan said on Friday, referring to Israel.
“It is imperative that UN Security Council takes steps to ensure peace in Jerusalem in line with decisions of the General Assembly,” the president said, speaking to the members of his Justice and Development (AK) Party during a video conference. Turkey is ready to actively support any initiative announced by the UN, he said, adding that his nation “will not be silent” even if the rest of the world ignores the developments in Gaza.
His words came amid an ongoing violent standoff between Tel Aviv and the Palestinian militants in the Gaza Strip that saw the Israel Defense Forces launching massive airstrikes against Gaza in response to the Hamas militant group’s rocket attacks. The Israeli strikes claimed the lives of more than 100 Palestinians, including 27 children, according to local health officials.
Hamas militants’ rocket launches were mostly intercepted by the Israeli air defenses, resulting in the deaths of nine people, including a child.“It is a duty for all of humanity to resist [Israel’s] aggression against Palestinian cities and Jerusalem,” Erdogan said, adding that the Organization of Islamic Cooperation (OIC) should particularly take a “concrete” stance on the issue. Otherwise, the organization would simply discredit its own existence, he added.
The OIC announced earlier that it would hold an emergency meeting on Sunday to discuss the situation. The violent conflict between Israel and the Palestinian militants was sparked by an Israeli court case regarding the eviction of several Palestinian families from a neighborhood in East Jerusalem.
The move first sparked massive protests that saw clashes between the demonstrators and police in several Israeli cities as well as in Jerusalem. The tensions then led to a rocket attack by Hamas and a military response by the IDF.

They plan to set up a database and archive.
This group is developing a foundation for a very powerful worldwide effort based not just on international law but on the basic rights of man. They seem to be becoming a clearinghouse for information on how Covid restrictions are imposed in different countries. And what kind of common approach can be used to cut thru the lies (which are the same the world around).
Reiner doesn't think the int'l courts will support anything, so the "international' effort will have to focus more on what is happening in the higher courts in each country. Courts rely on the "precautionary" principle - being overly cautious because they don't know what else to do.

Les Moonves to forgo $120M in settlement with ViacomCBS
ViacomCBS Inc. said Friday it will reclaim Les Moonves’s $120 million severance package, resolving a more than two-year dispute with the former chief executive over his termination.
Mr. Moonves resigned as chairman and CEO of CBS Corp. amid accusations of sexual harassment in September 2018. He has denied the claims. He was denied his severance after a CBS board investigation concluded that he had violated company policies, breached his employment contract and intentionally failed to fully cooperate with the investigation. In January 2019, Mr. Moonves challenged the company’s decision to withhold his $120 million severance package as part of the terms of his exit agreement. A lawyer for Mr. Moonves said at the time that the board’s reasons for denying the severance were without merit. CBS merged with Viacom Inc. in December 2019. The $120 million was held in a trust while the dispute was subject to arbitration.
ViacomCBS said in a regulatory filing Friday, "The disputes between Mr. Moonves and CBS have now been resolved, and on May 14, 2021, the parties dismissed the arbitration proceeding." Mr. Moonves forfeited nearly $34.5 million of his compensation package as part of his separation agreement.
Mr. Moonves was one of the most powerful figures in entertainment for more than three decades. At CBS, he was credited with turning around the network’s programming fortunes with hits such as "Survivor" and "The Big Bang Theory."

Lansing - Nonprofit paid for Whitmer's chartered flight out of state
Lansing — A nonprofit organization tied to Gov. Gretchen Whitmer's administration paid to charter the flight that carried her to visit her father, but Whitmer paid for a seat, her administration said Friday.
The revelations came in an unaddressed email memo signed by Whitmer's chief of staff, JoAnne Huls, weeks into a controversy on the out-of-state trip during a pandemic.
This twin-engine jet Gulfstream G280 owned by Air Eagle flew from Lansing to Palm Beach on March 12 and returned to Lansing on March 15. Whitmer's father, Richard, the retired CEO of Blue Cross Blue Shield of Michigan, owns a home in West Palm Beach.
"Due to ongoing security and public health concerns, we made a decision to use a chartered flight for this trip," Huls wrote in the memo. "The governor's flight was not a gift, not paid for at taxpayer expense and was done in compliance with the law."
The social welfare nonprofit organization Michigan Transition 2019 chartered the private plane, which took Whitmer to Florida on Friday, March 12, and returned her to Lansing, on Monday, March 15. The group spent $27,521 on travel over the first 14 days of May, according to a voluntary disclosure, which apparently covers the March flights.
The same disclosure shows Whitmer paid the nonprofit a $855 total for her seat on the flights. Michigan Information & Research Service News (MIRS News) first reported the arrangement Friday.
The nonprofit organization was formed in November 2018 to help fund Whitmer's inauguration, according to state business records. In 2019, it reported to the state that it would be using an assumed name: Executive Office Account. It's unclear how a nonprofit that falls under strict federal rules prohibiting the use of funds for personal expenses qualified to fund the travel.
The governor has said she performed duties of her office, including participation in meetings, while caring for her father, but didn't specify what she did.
Federal tax law prohibits nonprofits from the practice of inurement, which is the use of nonprofit income or assets to excessively benefit an individual who has a close relationship with the tax-exempt organization, according to the Legal Information Institute at the Cornell Law School.
The account "defrays the cost of the governor’s travel when it’s consistent with the account’s purposes," Huls said. According to a 2019 tax filing, the group's mission is to promote "civic action and social welfare."
Whitmer has repeatedly said she took the flight to visit her father. She has said there "was an important family reason for doing it."
Tori Sachs, a Republican political consultant, called for Whitmer's use of the nonprofit organization to be investigated.She said there is no legal theory where reimbursing $800 for a $27,000 flight "solves anything."
Ted Goodman, spokesman for the Michigan Republican Party, said there was a reason Whitmer's office released the news on a Friday night.
"Tonight's revelations raise additional questions and concerns surrounding the financial arrangements of Gov. Whitmer's secret, unvaccinated trip to Florida on a private jet," Goodman said.
The governor received her doses of COVID-19 vaccine in mid-April and April 29.

A spokesman for Whitmer referred questions about why the nonprofit was able to fund the chartered flight to an attorney, who didn't immediately respond to a request for comment.
n Wednesday, the Democratic governor said her flight to visit her father was not paid for by taxpayer dollars and was not "a gift," but she declined to provide additional information about how the trip was funded.
She had refused to say which state she traveled or how the flight was arranged since news of the trip broke in April.
For the trip, Whitmer took a private plane that's usually shared by three of Michigan's most prominent political donors, The Detroit News reported last week. The Nicholson family of PVS Chemicals, the Moroun family of the trucking company Central Transport and the Cotton family, which formerly ran Meridian Health, are among those who use the Gulfstream G280 flown by Air Eagle LLC.
A Gulfstream G280 costs about $2,500 per hour to operate, according to Air Charter Advisors, a boutique jet charter broker based outside Philadelphia.
Whitmer's trip to Florida took 2 hours and 10 minutes, while the return flight to Lansing took 2 hours, 24 minutes, according to tracking data from Flight Aware. At more than four and a half hours, the flight operation would have cost at least $11,250, according to Air Charter Advisors.
During a Wednesday press conference, Whitmer noted she campaigned on stories regarding the challenge of taking care of her mom at the end of her life while rearing her daughter and serving as state representative.
"This is a part of my story," she said. "For anyone to be surprised that I have a family member who’s been having a lot of health issues that I showed up to check in … they’re obviously not paying attention to who I am or what I do.
"…I showed up when I was needed. I did a lot of cooking, a lot of cleaning. I also did my day job, meaning I was on regular calls and conferences with my team.”
In her memo Friday, Huls said the health of Whitmer's father, Richard, deteriorated after she returned to Michigan on March 15.
On Monday, Whitmer took her father to Ann Arbor, where he underwent a medical procedure to start intravenous antibiotics. His procedure was successful, Huls said.

41 CA District Attorneys Oppose Plan for Early Release of 76,000 Inmates: Puts Public at Risk
District Attorneys for jurisdictions all around California are petitioning the Department of Corrections and Rehabilitation not to put in place an upgraded good behavior credit system that could result in the release of some 76,000 inmates in state prisons.
Sacramento DA Anne Marie Schubert is spearheading the effort that seeks to repeal temporary emergency regulations.
The regulations, which were announced April 30 and went into effect May 1, are part of the state’s plan to continue trimming what was once the country’s largest state correctional system, according to the Associated Press. Under it, more than 63,000 inmates convicted of violent crimes are eligible for good behavior credits that shorten their sentences by one-third, an upgrade from the one-fifth that had been standard since 2017. The regulations were passed under a “claim of emergency” and would result in the early release of “some of California’s most violent criminals,” according to the statement from Schubert’s office.
The changes were approved by California’s Office of Administrative Law, according to the AP. The department was “granted authority” to make the changes through the rulemaking process and under the current budget. Because they were implemented as “emergency regulations,” CDCR was able to impose them without holding public comment — which angered prosecutors.
CDCR spokesperson Dana Simas said in a statement to AP:
The goal is to increase incentives for the incarcerated population to practice good behavior and follow the rules while serving their time, and participate in rehabilitative and educational programs, which will lead to safer prisons. Additionally, these changes would help to reduce the prison population by allowing incarcerated persons to earn their way home sooner.
The DAs disagree and said “the public will be put at risk.” Schubert said:
Allowing the early release of the most dangerous criminals, shortening sentences as much as 50 percent, impacts crime victims and creates a serious public safety risk. His petition asks CDCR to repeal these regulations, begin the process anew, and allow for transparency and public input. Victims, their families, and all Californians deserve a fair and honest debate about the wisdom of such drastic regulations.
Filing a petition is the first step in the process to seek a formal court order to declare the regulations illegal, according to Schubert’s office. If the DAs succeed, an order for the CDCR to put the program back in place would require the State’s Office of Administrative Law to oversee the process, which would include public input.

California's Vandenberg Air Force Base renamed to Space Force Base
California’s Vandenberg Air Force Base was renamed Friday as a U.S. Space Force Base.
The name was changed to Vandenberg Space Force Base during an afternoon ceremony on the parade field at the sprawling base on the state’s Central Coast, which tests ballistic missiles and conducts orbital launches for defense, science and commercial purposes.
The Space Force was created as the sixth uniformed military branch in 2019 during the administration of former President Donald Trump. Personnel assigned to the Air Force Space Command were reassigned to the Space Force, ending its Air Force lineage.
“Redesignating Air Force installations as Space Force installations is critical to establishing a distinct culture and identity for the Space Force,” a base statement said.
Vandenberg’s host unit, the 30th Space Wing, is being renamed Space Launch Delta 30, under Space Operations Command.
Vandenberg was originally established in 1941 as Camp Cooke, an Army garrison for tank, infantry and artillery training.
Its geographical location made it ideal for missile tests and launches into polar orbit. During the Cold War, it was relabeled Cooke Air Force Base and then Vandenberg in honor of Gen. Hoyt S. Vandenberg, the second chief of staff of the Air Force.
