250 Years Ago Alexander Hamilton Told Us How to Handle These Anti-Trump Judges

Why, precisely, is a judge in Washington allowed to decide what illegal immigrants with alleged gang affiliations, who were being detained in Texas, are entitled to before they’re deported from the country they’ve unlawfully entered?
That’s what Alexander Hamilton might like to know.
Yes, Hamilton might be the one founding father that it’s OK for Gen Z liberals to like because they can spit verses from “My Shot” on command — likely because the hip social studies teacher in high school let them listen to the “Hamilton” soundtrack for extra credit.
But before he was a rapping puppet for Lin-Manuel Miranda’s take on revolutionary American history, he was actually writing stuff that didn’t involve hip-hop jams with the Marquis de Lafayette. In particular, he was one of the three authors of “The Federalist Papers,” a series of 85 essays that argued in favor of the U.S. Constitution at the time of its ratification.
And, lo and behold, he has something to say about the kind of activist jurists like U.S. District Court Judge James Boasberg, who temporarily blocked the Trump administration from deploying a 1798 law to summarily deport illegal immigrants associated with transnational gangs — in this case, Tren de Aragua, one of the most powerful gangs that’s thrived in the power vacuum created by the dysfunctional Maduro government.
“Given the exigent circumstances that [the court] has been made aware of this morning, it has determined that an immediate Order is warranted to maintain the status quo until a hearing can be set,” Boasberg, an Obama appointee, said in an order March 15, according to Fox News.
Boasberg continued to block any sort of removal under the Alien Enemies Act by challenging the government to prove why each individual being deported is, in fact, an “alien enemy.”
“Before they may be deported, they are entitled to individualized hearings to determine whether the Act applies to them at all,” Boasberg wrote in a Monday ruling, according to the Miami Herald. “Because the named Plaintiffs dispute that they are members of Tren de Aragua, they may not be deported until a court has been able to decide the merits of their challenge.”
It’s unclear what these individualized hearings would look like, as per the Boasberg model, or even whether he’d then acquiesce to the deportations at that point.
In fact, it’s unclear what Boasberg is doing adjudicating this case at all, given that the aliens in question were apparently detained in Raymondsville, Texas — a cool 1,700 miles from the District of Columbia — aside from naked venue-shopping from the American Civil Liberties Union, who (because of course) is representing the Venezuelan migrants. (“You can do all that, you’ve just got to do it in the right court. And the right court was in Texas,” said Judge Justin Walker, another member of the D.C. district court appeals panel, when summarizing the government’s argument against the case.)
The Trump administration has more or less telegraphed its willingness to ignore Boasberg and his ilk to the extent possible and let the Supreme Court be the final arbiter of the mess. Is this some sort of crisis for the rule of law? Not at all, if one were to read Hamilton’s thoughts on the matter.

In Federalist No. 78, one of the most influential documents pertaining to the role of the judiciary in the then-proposed Constitution, Hamilton wrote that the courts “have neither FORCE nor WILL, but merely judgment” and cannot effectuate those judgments on its own.
“Whoever attentively considers the different departments of power must perceive, that, in a government in which they are separated from each other, the judiciary, from the nature of its functions, will always be the least dangerous to the political rights of the Constitution; because it will be least in a capacity to annoy or injure them,” Hamilton wrote.
“The Executive not only dispenses the honors, but holds the sword of the community,” he continued.
“The legislature not only commands the purse, but prescribes the rules by which the duties and rights of every citizen are to be regulated. The judiciary, on the contrary, has no influence over either the sword or the purse; no direction either of the strength or of the wealth of the society; and can take no active resolution whatever.
“It may truly be said to have neither FORCE nor WILL, but merely judgment; and must ultimately depend upon the aid of the executive arm even for the efficacy of its judgments.”
This view, Hamilton said, “suggests several important consequences.
“It proves incontestably, that the judiciary is beyond comparison the weakest of the three departments of power; that it can never attack with success either of the other two; and that all possible care is requisite to enable it to defend itself against their attacks,” he wrote.
“It equally proves, that though individual oppression may now and then proceed from the courts of justice, the general liberty of the people can never be endangered from that quarter; I mean so long as the judiciary remains truly distinct from both the legislature and the Executive.”
Naturally, the argument against this would be that Hamilton was writing to a much different world and audience than these United States in the 21st century.
This isn’t an argument in favor of the anti-Trump forces if one thinks about it too deeply — for example, the fact that Hamilton couldn’t have contemplated a world in which jurists would be asked to decide on whether alleged Venezuelan transnational gang members being flown to El Salvador for detention should be returned to the U.S. for a hearing would reflect poorly not on the lack of foresight Hamilton had but to those who have let America degenerate to such a state in the first place — but these things aren’t thought about too deeply, even at the bench level, which is (alas) the point here.
The Federalist No. 78 clearly and concisely stated the limits that the founders imagined for the judiciary. Anyone who alleges an original intent that goes beyond that is simply fooling themselves — and original intent is what matters. For anti-Trumpers wondering why the administration’s response isn’t a “crisis” of the rule of law by any stretch of the imagination, perhaps try looking into some Hamilton that isn’t “My Shot.”
And no, “It’s Quiet Uptown” doesn’t count, either.

US Bank executive Terry Dolan believed to be dead following plane crash near Minneapolis
A top US Bank executive is believed to be dead after a small plane registered in his name crashed into a home near Minneapolis on Saturday.
The unidentified pilot was killed in the crash and no other injuries were reported, authorities said.

Marine Le Pen, the leader of the far-right French National Rally party, has been found guilty in an embezzlement case that could see her banned from running for office.
Ms Le Pen and 24 other officials from National Rally were accused of diverting millions of euros from the European Parliament to pay for party staff.
The money was meant to be used to pay for EU aides but instead was used to pay staff working for the French party.
The defendants denied any wrongdoing.
Prosecutors pressed for Ms Le Pen to be banned from running from office for five years, which would rule her out of running in the 2027 presidential race where she would be guaranteed to be one of the favourites to win.
Ms Le Pen has said that being banned from running for office would be "political death".
The judge has yet to sentence any of the defendants.

Does this explain the FBI delay in executing an immediate presidential directive? Of course not.
Here’s the problem.
Kash Patel and Dan Bongino both fail to understand the severity of the compromise underneath them. Hence the “95% honorable” quote by Patel recently (interview with Gowdy).
♦The core issue is that institutional corruption is the status of the FBI. That is challenging to deal with and simply cannot be addressed (in any reasonable timeframe, or effect) from the top of the leadership pyramid.
The various downstream field offices of the same institution(there are hundreds) willkeep Patel/Bongino flush with busy workand positive investigative outcomes for them to announce on television. [see VA recently] That approach purposefully satiates a reviewing audience yet leaves the process under them without oversight.
Corrupt FBI officials continue operations as needed (influence selling, evidence burying, pay-to-play investigative outcomes, DC monitoring, money laundering, trafficking, drugs and generally willful blindness to their outside group partners) and simultaneously push specific attention-grabbing info up the ladder toward leadership offices in DC.

Kash Patel and Dan Bongino would likely make excellent FBI special operation compliance officers and internal auditors. That’s where the real impact can be delivered [think Elliot Ness approach].
However, as leaders of the institution, the function of their role– as outwardly prestigious as it might seem,essentially isolates them with busy work. They must assign the role of compliance and audit review below them,to the same internal silo operatorswho have previously been identified as working within a corrupted institution.
You might note that Treasury Secretary Scott Bessent noticed this need very quickly, because he was/is a subject matter expert in large institutional leadership.Bessent has experience, Patel and Bongino do not.
Secretary Bessent hired/promoted/moved the IRS whistleblowers into strategic position; to become the heads of an internal compliance and audit team, reporting almost exclusively to Bessent himself.
Bongino and Patel would have been good in similar roles within the FBI organization.However, as heads of the agency they can affect very little operational change. Yes, they can steer the ship, but it is the chief engineer who determines the speed of the vessel.The mechanics within the FBI will simply control the speed and wait out the leadership.
Kash and Dan will then play a long game of whac-a-mole,removing each identified agent stalling as they are discovered. This will take more years than they have.
Contrast that FBI approach (Patel, saying everyone is awesome) with Treasury (Bessent, saying there’s an institutional problem here), and you will understand the visible absence of accountability.
♦The issue is not Patel or Bongino’s intent or motivation. The problem is their ability.
So far, theduo has not publicly admitted the severity of the corruption they sit atop; let alone announce a plan to deal with it. Ergo the intellectually honest person who understand the silo operations, only expect soundbites and pretenses.
Or, think of the problem like President Trump and Elon Musk (DOGE) to the total executive branch.President Trump is the tip-top of the silo. Elon Musk and DOGE are the compliance/audit officers, reviewing each agency – taking action and reporting back to the principal, President Trump.

However, even with their incredible large institutional skillset, both Trump and Musk need to break down the responsibilities using DOGE. Musk hires highly competent highly motivated DOGE members to do the actual compliance and audits.

Not long ago, I had 50,000 followers. Now, it's over 700,000. For most people, that would feel like a windfall. It hasn't felt that way for me.
A few weeks ago, I was doxxed. Since then, it's been the most chaotic stretch of my life. Some of the same people I thought I was standing up for chose to side with the person who exposed a gay Deaf man—and who's harmed many other Deaf people—for ideological reasons. That betrayal shook me.
But others stood by me, and their support meant everything.
I had to relocate to another state with my kids, homeschooling them on the fly, just to get clear of the threats. Then the Salt Lake Tribune ran a piece that pulled my husband's distillery into the mess. A viral site followed, pairing the name of his business with a Molotov cocktail cursor.
I've made my own mistakes. I responded to trolls. I got pulled into bad-faith debates over technical minutiae that weren't worth the energy.
I disappeared for a week. Part of that was genuinely because I broke a writer's block. But part of it was just needing space to breathe. I've been incredibly fortunate to have the support here on X, but it's been hard to hold onto that feeling in the middle of so much hostility.
If there's one thing this month gave me, it's a deeper empathy for people who live under this kind of pressure every day. They're human. They're trying to make the world a better place, but they have their own survival to deal with. How they do it, I don't know yet, but I hope to learn from their example.
I don't know why I ended up here, and I've let the past few weeks knock me off balance. I’m sorry for that.
Next up: I'm working on making the FPDS searchable across multiple aggregations and groupings. The prototype is already making me laugh, which feels like progress.

Even if these designated foreign terrorists are entitled to individual court review before their deportation, which is disputed, the DC court is not the proper court.
Judge Boasberg did not, and does not, have the power to do what he is purporting to do. For this reason alone, everything he is doing is lawless. But it is much worse; it is also dangerous.
Judge Boasberg ran to his courtroom to hold a Saturday hearing, even though he was not even serving as the emergency judge that weekend. (How did he get this case?) He publicly exposed an ongoing U.S. military, intelligence, and law-enforcement operation with an American ally dealing with the most vicious terrorists (Tren de Aragua) and international gang member (MS13) in the Western Hemisphere.
That public exposure put American and allied lives in grave danger.
Stunningly, Judge Boasberg even ordered the President to turn around planes full of terrorists over the Gulf of America, without knowing the fuel levels, the security footprint back in America, or other crucial operational details.
We saw the enormous security footprint in El Salvador. Why would we have had that same footprint in America, as who could have ever imagined an activist DC judge could or would order the President to return planes full of terrorists?
And not completing the mission would have humiliated and politically damaged El Salvador's president, who had hundreds of military, law-enforcement, and other officials awaiting-and who took a significant political and personal risk by agreeing to take these terrorists.
Judge Boasberg's Saturday hearing and order crossed the red line. But Judge Boasberg is doubling down by demanding details about the military operation, to which he is not entitled. Judge Boasberg says he has a security clearance, but he definitely does not have the need to know. And allowing judges to meddle in military operations like this is dangerous and unacceptable.
Foreign leaders are less likely to work with the President, if they fear an activist American judge may disclose their secrets. This harms the President’s ability to conduct foreign policy and his constitutional duty to keep us safe.
The President has a constitutional duty, as the chief executive officer and commander-in-chief, to conduct international affairs, repeal foreign invasion, and protect American lives. The President has a constitutional duty to ignore any clearly unlawful court order that imminently endangers American lives, like Judge Boasberg's orders.
Judge Boasberg is refusing to back down. So the House must move forward with impeachment proceedings for his lawless and dangerous sabotage of the President's core Article II powers.

Most importantly, who exactly had Goldberg’s private number, and ostensibly (in error [?]) could have possibly inserted it into the cleared list of participants in the discussions? Why Goldberg, rather than some random person of some 345 million Americans?
So why in the world would any top Trump officials or their staffers ever even have Goldberg’s private contact information—given his quite public record of a) fabricating stories with unnamed sources, and b) suffering from a decade of chronic Trump derangement syndrome?
Did Goldberg know the mechanisms that had prompted and continued his stealthy presence on the secure discussions?
Why did citizen Goldberg not simply come clean on day one that he realized he was mistakenly included in key national security conference communications, to which he did not belong, and thus should be obviously excluded immediately? Why stealthily listen in for eleven some days? Was the idea of informing his hosts of his own improper presence too old-fashioned morality?
Did Goldberg’s publicizing these discreet discussions really affect in any way at all the otherwise completely successful mission to neutralize years of appeased Houthis aggression and begin to end their veritable destruction of Red Sea international maritime commerce?
How did this blunder rank with prior diplomatic and military screw-ups?
Did it rate with the indiscretion of Secretary of State Dean Acheson’s January 1950 Press Club speech de facto excluding South Korea from the American defense umbrella—an omission that may or may not have contributed to the June 1950 North Korean invasion of the South?
Was it comparable to Ambassador to Iraq April Glaspie’s assurance to Saddam Hussein, “We have no opinion on your Arab-Arab conflicts, such as your dispute with Kuwait”— a needless remark that may have mistakenly green-lighted his 1990 invasion of Kuwait?
Was it comparable to Barack Obama’s March 2012 “hot mic” quid-pro-quo assurance to Russian president Medvedev? Obama got caught in front of the world promising Putin that he would have “flexibility” on American-Eastern European missile defense—if Putin gave him “space” during his “last” election.

There’s a possible constitutional path, and it has the establishment sweating.
The 22nd Amendment says a person can’t be elected president more than twice. But it doesn’t clearly say a two-term president can’t serve again through other means, like succession.
That’s where the so-called loophole begins.
Some say if Trump served as VP and the sitting president stepped down, he could legally return to the Oval Office without being “elected.”
Wild? Yes.
Impossible? Not entirely.
In fact, Rep. Andy Ogles even proposed an amendment in 2025 to formally allow a third term, if the first two weren’t consecutive.
And who would that apply to? Only one man: Trump.
Of course, this would be a legal battlefield. But the fact that it’s even being discussed tells you how deep the panic runs.
The system was never built to stop someone like Trump.

A toddler was kicked out of nursery after being accused of transphobia or homophobia, Department for Education data reveals.
The child, aged either three or four, was suspended from a state school three years ago for “abuse against sexual orientation and gender identity.”
Details of the specific school or the case during the 2022/23 academic term were not disclosed by the DfE. However, it appears that this is not an isolated case.
The Telegraph reported on Monday that 94 students at state primary schools in England were suspended, or in some cases permanently excluded, for transphobia and homophobia during the same period.
Of these, ten were from Year 1 and three were in Year 2 — where the maximum possible age of pupils is seven.
The data also shows the number of suspensions and expulsions has hiked since the coronavirus pandemic.
At least 787,221 pupils were suspended across English schools in 2022/23, more than double the number in 2016/17.
Of these, some 84,339 were primary school students, a rise of 31 per cent from 64,337.
Transphobia rows in education came to a head when feminist philosopher Kathleen Stock was forced to leave her job at the University of Sussex over her gender-critical views.
Meanwhile, pupils facing exclusions rose by 21 per cent to 9,377 in 2022/23, although the number of excluded primary school pupils fell by four per cent over that period.
Helen Joyce, director of advocacy at Sex Matters, a human rights charity that campaigns for clarity on sex in law, policy and language, said: “Every once in a while, the extremes of gender ideology throw up a story that seems too crazy to believe, and a toddler being suspended from nursery for so-called ‘transphobia’ or homophobia is one such example.
“It’s unforgivable for children’s vital early education to be so traumatically disrupted by school leaders who prioritise activists’ demands over their charges’ wellbeing.”
Lord Young, of the Free Speech Union, added: “I would have thought that if your ideology is so rigid it justifies you punishing toddlers for not complying with it, that’s a powerful argument for discarding it in favour of something less dogmatic.”
A DfE spokesman said: “All pupils and staff should feel safe and protected at school and should never face violence or abuse.
“The Education Secretary has been clear that she expects school leaders to enforce good behaviour and we are committed to a comprehensive programme of behaviour support for schools.”
Transphobia rows in education came to a head in 2021 when feminist philosopher Kathleen Stock was “cancelled” and forced to leave her job at the University of Sussex over her gender-critical views.
Last week, the university was charged £585,000 by the Office for Students — the largest fine ever given to a university — for “perpetuating the culture wars” and failing to uphold freedom of speech following the case of Ms Stock, who required a bodyguard on campus and CCTV cameras at home.

President Trump with Coronavirus Task Force Briefing
President Trump, along with members of the Coronavirus Task Force, briefed reporters on the federal government's response to the pandemic. The president spoke of the efforts governors around the country are making to mitigate the spread of the virus. He also discussed the medical equipment recently released to the states with about 10,000 ventilators being held back to accommodate needs during the surge of the pandemic. The president stressed how the next two weeks for the country would be difficult, saying that it will be "a very, very painful two weeks."

Derek Chauvin Trial for the Death of George Floyd, Day 3
This is day three of the trial of former Minneapolis police officer Derek Chauvin, who was charged with second- and third-degree murder and second-degree manslaughter in connection to the death of George Floyd. The video of Mr. Floyd's arrest sparked nationwide protests. Defense continued its cross-examination of Minneapolis firefighter Genevieve Hansen. The prosecution and defense questioned former Cup Foods store clerk Christopher Martin as well as Minneapolis residents and eyewitnesses Charles McMillian and Christopher Belfrey. Mr. McMillian during questioning broke down after watching video footage from the scene, prompting the judge to take a short break. Minneapolis police lieutenant James Jeffrey Rugel was direct examined by the prosecution. Mr. Rugel was brought in as a foundational expert witness in police technology to discuss police body cams and camera footage. There are several two-and three-minute program breaks between recesses in the trial.
