Twilight Zone As ETF Provider Warns Buying Silver Will Harm Hedge Funds And Large Banks

Just over a week ago, we showed you how, following the #SilverSqueeze triggered surge in demand for physical silver, the 14 ETFs which claim to hold silver in LBMA vaults in London between them accounted for over 28,000 tonnes or 85% of all the silver said to be in those London vaults. And that the biggest of these ETFs, the infamous Blackrock managed iShares Silver Trust (SLV), which has JP Morgan London as custodian, accounted for over 70% of this total. And just a few days ago we showed you how, following the #SilverSqueeze induced surge in SLV trading from 29 January to 02 February on NYSE Arca, the very same SLV had quietly and without fanfare amended its Prospectus on 03 February conceding that there may not be enough silver bars available in London or elsewhere to add to the Trust, when it stated in its filing to the SEC that: “The demand for silver may temporarily exceed available supply that is acceptable for delivery to the Trust, which may adversely affect an investment in the Shares.

To the extent that demand for silver exceeds the available supply at that time, Authorized Participants may not be able to readily acquire sufficient amounts of silver necessary for the creation of a Basket. It is possible that Authorized Participants may be unable to acquire sufficient silver that is acceptable for delivery to the Trust for the issuance of new Baskets due to a limited then-available supply coupled with a surge in demand for the Shares.…In such circumstances, the Trust may suspend or restrict the issuance of Baskets.”

But as it turns out, as was to be expected, SLV was not the silver ETF to move to panic stations the week before last, for at the exact same time on 02 February, the Aberdeen Standard Physical Silver Shares ETF (SIVR), also using JP Morgan London as metal custodian and also traded on NYSE Arca, quietly amended it's Prospectus to both sinister and comical effect, and in stealthy fashion uploaded a new version of it’s Prospectus to the SEC website, inserting the following wording on page 6: “As of the date of this prospectus, an online campaign intended to harm hedge funds and large banks is encouraging retail investors to purchase silver and shares of Silver ETPs to intentionally increase prices. This activity may result in temporarily high prices of silver.”

But it gets better, for Aberdeen Standard, operator of SIVR (which claims to hold 1140 tonnes silver in London) and whose very rationale is to offer investors exposure to the silver price, seems to have a fundamental problem with the very silver price rising. Why else would Aberdeen Standard be afraid of a market force that “intentionally increases prices”? Unless of course that’s not what the ETF operator actually wants to happen. But it gets even better, for on page 7 of the amended SIVR Prospectus, Aberdeen Standard again confirms whose side it is really on and specifically why it is so scared of this online campaign to free the silver market from the clutches of the hedge funds and banks.

So there you have it, one of the biggest silver-backed ETFs in the world apart from SLV, with a claimed 36.7 million ozs (1140 tonnes) of silver stored in London with custodian JP Morgan, is worried not about the interests of its investors, but about the outstanding short interest silver positions of the hedge funds and large banks. And out of concern for these entities that are short, Aberdeen Standard in fearful of market forces which will 'intentionally increase silver prices'. Those with a sharp eye may also ponder why Aberdeen Standard is worried about a divergence between the trading price of SIVR and its NAV. And why would that be? Maybe it’s because the date of 03 February is the last time SIVR added any new silver holdings, a date on which it’s claimed silver holdings rose from 35.6 million ozs to 36.6 million ozs. But no increase in silver holdings since then. And also that none of the claimed SIVR silver is held in the vault of the infamous custodian JP Morgan in London, but all of the claimed silver is said to be held in the vaults of 3 SIVR sub-custodians, namely, Brinks, Malca-Amit and Loomis, the same 3 sub-custodians that SLV tapped in early February to pad out its bar list in the wake of a so called 3,400 tonnes increase in SLV silver allocations.

'Roaring Kitty' sued for securities fraud over GameStop rise

Keith Gill, one of the most influential voices that pushed GameStop on the WallStreetBets Reddit forum, was hit with a securities class action that accused him of misrepresenting himself as an amateur investor and profiting by artificially inflating the price of the stock.

The proposed class action against Gill, who adopted the online nickname “Roaring Kitty,” was filed Tuesday in federal court in Massachusetts. The suit said Gill was actually a licensed securities professional who manipulated the market to profit himself.

CNN, NBC each paid $35k for video of the recent U.S. Capitol breach from an activist charged in connection with participating in the Jan. 6 siege.

The deal was made public when attorneys for the activist, John Sullivan, provided invoices from the networks, as part of court proceeding in which federal prosecutors are trying to stop Sullivan from using social media platforms Twitter and Facebook, according to Politco.

A Washington, D.C.-based magistrate judge on Tuesday deny the prosecutors' request but ordered Sullivan to stop work with his Insurgence USA website and social media platforms.

Sullivan from Utah, says he was at the Capitol not as a participant but as an observer – to record video for his online platform.

Some of the video purportedly shows the deadly shooting of protester Ashli Babbitt by a U.S. Capitol Police officer.

The Justice Department argues the site promotes and glorifies violent protests. The department earlier this month charged Sullivan in connection with civil disorder, violent entry or disorderly conduct and entering a restricted building or grounds.

Twitter Cuts Bonuses By Nearly Half

Twitter is rewarding its its employees for a job well done by cutting their overall bonuses by nearly half, according to The Information. While the company said in a memo to employees that workers will still receive 100% of their bonus that's tied to personal performance - no matter how good their performance was, the company will pay just 7% of their 'corporate bonus' target, bringing the overall bonus target to 57%.

In previous years, employees received 100% of the corporate bonus target or more. According to an anonymous Twitter employee, the memo has infuriated lower-paid workers, who are more dependent on cash bonuses and won't receive the same level of stock-based compensation as upper management.

Twitter's Vice President of people and diversity, Dalana Brand, told The Information that performance bonuses are one component of an employee's overall compensation and is 'designed to be flexible.'

Meanwhile, Twitter CFO Ned Segal announced that the company is exploring whether to pay employees in bitcoin if they request it - which could mean that those with kneecapped bonuses who also want to be paid in crypto could take a significant hit in the event of a crypto crash. Kentucky County GOP Chair Calls on McConnell to Resign Since Area 'Overwhelmingly' Supports Trump

Don Thrasher, the chairman of the Nelson County Republican Party in Kentucky, called on Senate Minority Leader Mitch McConnell to resign on Tuesday.

"Given that the county party that I represent supports President Trump overwhelmingly, and your complete and total disdain for the will of your constituents here in Nelson county I am formally demanding you immediately resign your leadership position within our party's caucus in the United States Senate," Thrasher said in a statement, referring to McConnell.

"The overwhelming number of Republicans in Nelson County are not on your side on this issue, and I speak on their behalf," Thrasher continued, adding that McConnell's "leadership in the US Senate does not represent the Republican voters that put our faith in you in the last primary election."

McConnell has faced backlash from Republicans after he became a vocal critic of former President Donald Trump.

McConnell voted to acquit Trump in the Senate on the impeachment charge of inciting the mob riot that occurred at the U.S. Capitol in Washington, D.C., on January 6. The Kentucky senator, however, said he only voted to acquit because he did not believe the Senate can constitutionally convict a president no longer in office.

In a speech on the Senate floor following the vote, McConnell blamed Trump for starting the riot, saying that "there's no question—none—that President Trump is practically and morally responsible for provoking the events of the day."

Trump has since issued a scathing statement against McConnell on Monday, calling him "a dour, sullen, and unsmiling political hack"

"If Republican Senators are going to stay with him, they will not win again," Trump said of McConnell in his statement. "He will never do what needs to be done, or what is right for our country."

Thrasher told The Washington Post that McConnell "stirred up the hornets' nest even worse" with his floor speech, adding that the speech only made more people mad.

"There are people that are more mad now because it just seems kind of duplicitous to a lot of people," Thrasher said. "He is trying to straddle the fence, and he is not making anybody happy doing that."

McConnell has seen his approval rating drop 29 points among Kentucky constituents following the November election and his subsequent fallout with Trump, according to a Tuesday Morning Consult survey.

Only 41 percent of Republican voters in Kentucky now approve of McConnell—down from 70 percent before the November election.

Newsweek reached out to the Nelson County Republican Party but did not hear back in time for publication.

The biggest political scandal in America right now is playing out in New York, where Gov. Andrew Cuomo is in a lot of trouble — and rightly so. The Democratic governor did not merely wildly mismanage his state’s response to the COVID emergency, while netting himself a lucrative book deal and an Emmy. He did something worse.

In the middle of a public health emergency, he used his office to help one of his largest political donors shield itself from legal consequences as 15,000 nursing home residents died from COVID — and then he and his administration underreported that death toll, helping the same donor.

The Daily Poster had been covering the story for months before it exploded this week. The scandal is a cautionary tale of hubris, megalomania, and corruption that left a literal mountain of preventable COVID deaths in its wake. Now we are about to see whether a blue state’s democratic institutions can hold wrongdoers accountable, or whether America’s culture of impunity can once again protect the powerful from facing any consequences at all.

Amid a cacophony of demands for Cuomo to resign, the governor and his aides are frantically trying to cover up the basic facts of what happened, and that includes launching a Nixonian campaign of intimidation and retribution against Democratic lawmakers who have for months been sounding the alarm.

Two national news outlets today detailed Cuomo’s new campaign of retribution against one lawmaker in his own party who dared to ask questions about constituents and family members who died under Cuomo’s nursing home policies. Cuomo held a press conference to publicly berate the same Democrat, while another New York news outlet reported that other lawmakers are now facing threats.

For months, these legislators’ questions were ignored by a national media that has seemed far more interested in valorizing Cuomo than in reporting inconvenient facts. But those facts are worth reviewing, because they illustrate the direct link between the underreporting of nursing home deaths and the push for corporate immunity.

They also spotlight the very real human carnage that can result when an imperious, out-of-control politician is unwilling to engage in any contrition, self-reflection, or reform.

Fact 1: Cuomo’s Machine Raked In $2 Million From Industry Group

Cuomo’s political machine received more than $2 million from the Greater New York Hospital Association (GNYHA), its executives, and its lobbying firms. The health care industry group also funneled more than $450,000 to members of the New York legislature in 2020.

The money that flowed from the group to these public officials in the middle of the pandemic was a significant increase from prior years.

Fact 2: Cuomo Helped Industry Group Shield Nursing Home Execs

Amid New York’s exploding COVID death toll in April 2020, Cuomo’s budget included a provision shielding hospital and nursing home executives from legal consequences if their corporate decisions killed people during the pandemic.

GNYHA said it “drafted” the provision, which did not merely shield frontline health care workers from lawsuits, but also extended such liability protection to top corporate officials who make staffing and safety decisions.

Critics argued that shielding hospital and nursing home executives from the threat of lawsuits would remove a deterrent to cost-cutting, profit-maximizing decisions that endanger lives. They were ignored.

Fact 3: Cuomo’s Corporate Immunity Law Went National

Cuomo’s corporate immunity provision was quickly copied and pasted into other states’ laws and into Senate Republican legislation, in near word-for-word fashion. The liability shield spread from New York to other states, even as New York Assemblyman Ron Kim released a report showing that states with liability shields were reporting higher nursing-home death rates during the pandemic.

To date, 27 states have now shielded nursing homes from lawsuits.

New York Democrats Accuse Andrew Cuomo Of Obstruction In Letter To Lawmakers

Nine Democratic state assembly members have signed a letter to colleagues accusing New York Gov. Andrew Cuomo of obstructing justice and requesting that lawmakers set aside party loyalty after a nursing-home scandal.

Cuomo’s administration recently admitted that data about COVID-19 deaths in nursing homes were intentionally withheld from New York lawmakers. Cuomo is accused of contributing to nursing home deaths after turning away people who had tested positive for the virus.

“We implore you to set aside any concerns of loyalty or disloyalty to this Governor, or that this matter is politicized,” the letter read. “We must absolutely consider above all the sanctity of the democratic institution that we call the Legislature of the State of New York, and resolutely pursue justice in the face of an executive who we can say without hesitation has engaged in intentional criminal wrongdoing.”

Along with that, the letter accused Cuomo of obstructing justice “[i]n an attempt to circumvent a United States Department of Justice probe, and despite a joint hearing held by the State Legislature last August in which representatives of the Cuomo administration were compelled to testify and answer crucial questions to our body.”

The uncle of New York Democratic assemblyman Ron Kim died in a nursing home from complications related to COVID, and Kim is introducing a bill to repeal the amendments passed last year that extended Cuomo’s emergency powers — something that was also mentioned in the letter.

" Assembly members went on to say that this alone would not be enough, stating that failure to do this “and engage in additional measures to seek the realization of justice” would make them “complicit” in the obstruction “and conscious omission of nursing home deaths data. "

Finally, the letter also suggested the possibility of starting “impeachment proceedings” against Cuomo.

A top aide to Cuomo apologized to Democratic lawmakers last week for not releasing New York’s nursing-home death toll from COVID-19.

Secretary to the Governor Melissa DeRosa stated that “we froze” out numbers that she felt would “be used against us,” and publicly apologized for putting them in a difficult position over the death toll.

DeRosa’s apology comes after the release of a report at the end of January from state Attorney General Letitia James, stating that New York State Department of Health (NYSDOH) undercounted COVID-19 deaths among residents of nursing homes by approximately 50%.
