Memo Key Points

Overview of Process

• The Committee has made this memo public due to the American people’s right to know

this information.

• The Committee, which is responsible for overseeing the activities of the Intelligence

Community, hopes the publication of this information will help inform the public about

abuses that have occurred at the DOJ and FBI, and spur needed reform and accountability

at those agencies so that similar abuses will not occur under any administration,

Democrat or Republican

• The government’s surveillance capabilities are extraordinary powers that must be

carefully circumscribed to protect Americans’ civil liberties. Any use of these powers for

political purposes or any purpose other than defending the American people is

intolerable.

• The decision to release the memo was procedurally sound, in accordance with House and

Committee rules, and included review by the Executive Branch and over 200 members of

the House.

• It is in the public interest to release the memo, which was carefully crafted to safeguard

national security.

Key Revelations from Declassified Memo

• The Steele dossier formed an essential part of a FISA application targeting Carter Page.

Former FBI Deputy Director McCabe confirmed that no surveillance warrant would have

been sought from the Foreign Intelligence Surveillance Court (FISC) without the Steele

dossier information.

• FBI and DOJ obtained from the FISC an initial warrant, and three FISA renewals.

o Then-FBI Director James Comey signed three FISA applications in question on

behalf of the FBI, and former Deputy Director Andrew McCabe signed one.

o Then-Deputy Attorney General (DAG) Sally Yates, then-Acting DAG Dana

Boente, and DAG Rod Rosenstein each signed one or more FISA applications on

behalf of DOJ.

• Steele was paid over $160,000 by the Democratic National Committee (DNC) and

Hillary for America (Clinton campaign) for his dossier. Neither the initial application in

October 2016, nor any of the renewals, disclose or reference the role of the DNC, Clinton

campaign, or any party/campaign in funding Steele’s efforts, even though the political

origins of the Steele dossier were then known to senior DOJ and FBI officials.

• While the FISA application relied on Steele’s past record of credible reporting on other

unrelated matters, it ignored or concealed his anti-Trump financial and ideological

motivations.

o Before and after Steele was terminated as a source, he maintained contact with

DOJ via then-Associate Deputy Attorney General Bruce Ohr. In September 2016,

Steele told Ohr, he “was desperate that Donald Trump not get elected and was

passionate about him not being president.” Ohr later relayed this evidence of

Steele’s bias to FBI, where it was recorded in official files, but not included in

any of the FISA applications.

o None of the FISA applications mention that the FBI had separately authorized

payment to Steele for the dossier information.

• According to the head of the FBI’s counterintelligence division, Assistant Director Bill

Priestap, corroboration of the Steele dossier was in its “infancy” at the time of the initial

Page FISA application. In early January 2017, Director Comey briefed President-elect

Trump on a summary of the Steele dossier, a document he later described as “salacious

and unverified.”

• The Page FISA application incorrectly assesses that Steele did not directly provide

information to Yahoo News. Steele has admitted in British court filings that he met with

Yahoo News—and several other outlets—in September 2016 at the direction of Fusion

GPS.

• Perkins Coie, the law firm that hired Fusion GPS on behalf of the DNC and Clinton

campaign, was aware of Steele’s initial media contacts, and hosted at least one meeting in

Washington D.C. in 2016 with Steele and Fusion GPS.

• Ohr’s wife was employed by Fusion GPS to assist in the cultivation of opposition

research on Trump. Ohr later provided the FBI with all of his wife’s opposition research,

paid for by the DNC and Clinton campaign via Fusion GPS.

• The Page FISA application also mentions information regarding fellow Trump campaign

advisor George Papadopoulos, but there is no evidence of any cooperation or conspiracy

between Page and Papadopoulos.

Top Ten Memo Facts

• The Memo is NOT intended to undermine the Special Counsel: It is intended to

expose past abuses of the FISA process at DOJ and FBI.

• The Memo is NOT intended to undermine DOJ or FBI: The House’s fulfillment of its

constitutional responsibilities enables effective constitutional oversight of those agencies.

• The Memo does NOT jeopardize national security: The careful release of [formerly]

classified information served the public interest, followed House rules, and included

Executive Branch review.

• The Memo does NOT undermine FISA Section 702: It has nothing to do with Section

702, which targets foreigners located overseas.

• The Memo does NOT contain any factual errors: FBI did not identify any factual

errors during its review of the memo.

• The Memo does NOT result from cooperation with the White House: No one outside

the House Intelligence Committee played any role in drafting the memo.

• The Memo is NOT a collection of partisan talking points: It lays out important facts

for the American people about FISA abuses.

• The Memo is NOT the product of “secret changes”: Minor edits were made BEFORE

the vote to publicly release the memo, which was procedurally sound.

• The Memo is NOT a staff-driven exercise: All Committee Republican Members were

engaged in the process that led to the memo.

• The Committee did NOT suppress the Democrats’ memo: It voted unanimously to

follow the same process for minority memos by first making it available to the House.

HPSCI Memo Edits

• HPSCI Ranking Member Adam Schiff has been a ceaseless opponent of the Committee’s

attempts to collect and share information on FISA abuses. He even denounced the

Committee’s issuance of subpoenas to the DOJ and FBI for information the agencies

were withholding from Congressional oversight.

• In a last-ditch effort to block publication of the HPSCI memo, Ranking Member Schiff

issued a press release complaining about minor edits the Committee made to the memo.

• The edits, implemented before HPSCI voted to make the memo public, included routine,

minor technical changes and edits suggested by the FBI and by the Committee Minority

themselves, respectively.

• Ranking Member Schiff’s press release was one in a long line of media stunts meant to

oppose transparency and stifle the Committee’s investigation of possible surveillance

abuses by top officials at the FBI and DOJ.

FISA Title I Summary

Title I of the Foreign Intelligence Surveillance Act governs the targeting of foreign powers or

agents of foreign powers for electronic surveillance by the U.S. government. Agents of foreign

powers can be either U.S. persons or non-U.S. persons. If the agent of a foreign power is a U.S.

person, the government must show that the U.S. person is engaging in espionage, terrorism, or

sabotage by or on behalf of a foreign power that involves a violation of a criminal statute.

Applications to target a U.S. person under Title I must be accompanied by a certification from a

senior national security official, which may include the Director or Deputy Director of the

FBI. They must then be approved by the Attorney General, the Deputy Attorney General, or the

Assistant Attorney General for National Security. If one of those officials approves an

application, it is then sent to the Foreign Intelligence Surveillance Court (FISC), which consists

of judges selected by the Chief Justice of the U.S. Supreme Court who serve on a rotating basis.

The FISC decides whether to approve or deny an application based on whether the government

has demonstrated probable cause to believe the proposed target is a foreign power or agent of a

foreign power, and that the facility or place where the electronic surveillance will be directed is

being used by the foreign power or agent of a foreign power. If the application is approved, the

U.S. government can conduct electronic surveillance of the target for the period of time specified

in the application. At the end of that time period, the government must stop surveilling the target

unless it goes back to the Court and applies to renew the surveillance. For targeted U.S. citizens,

FISA applications must be renewed by the FISC every 90 days with a separate finding of

probable cause to continue surveillance.

Title I is a different authority than Section 702, which Congress reauthorized several weeks ago.

Children are especially vulnerable to this evil practice, as they account for 25 percent of modern slaves.

Victims are compelled to perform labor or commercial sex acts through the use of fraud, force, or coercion, reducing the value of human lives to that of mere commodities.

The United States is a source, transit, and destination country for men, women, and children – both United States citizens and foreign nationals – victimized by human trafficking.

In FY 2017, DHS’s Immigration and Customs Enforcement Homeland Security Investigations (ICE/HSI) initiated 833 human trafficking cases, resulting in 1,602 arrests and 578 convictions, and identified 518 victims of human trafficking.

The HHS-funded National Human Trafficking Hotline (NHTH) received reports of 8,686 unique cases of potential trafficking in FY 2017, identifying 21,644 potential victims.

Annual illicit profits from human trafficking were estimated to be as high as $150 billion in 2014, demonstrating the substantial economic scale of this abhorrent criminal industry.

PROTECTING THE INNOCENT: President Donald J. Trump is taking a stand against human trafficking, dedicating our Government’s full resources towards fighting this repulsive crime.

The President’s Interagency Task Force to Monitor and Combat Trafficking in Persons (PITF) is working tirelessly to address all aspects of human trafficking.

Arizona Republican Sen. Jeff Flake surprised his colleagues on both sides of the aisle when he called for a delay in the Senate floor vote on Supreme Court nominee Brett Kavanaugh's confirmation, after releasing a statement earlier that morning saying that he would vote to confirm Kavanaugh.

Flake, a member of the Senate Judiciary Committee, voted to advance Kavanaugh's nomination for consideration by the full Senate on Friday, but said that he would not approve a motion to bring the nomination forward without an FBI investigation into allegations of sexual misconduct by Kavanaugh.

Flake was joined by Republican Sen. Lisa Murkowski and Democratic Sen. Joe Manchin, both moderates, in calling for a week-long investigation. President Trump instructed the FBI to open an investigation into allegations against Kavanaugh on Friday.

Flake's decision came after he spoke to senators of both parties and withstood pressure from some Republicans not to take such a step. As he considered his course of action, Flake also had a conversation with Deputy Attorney General Rod Rosenstein, who is in charge of special counsel Robert Mueller's investigation. And, at the top of his mind was the previous day's testimony from Kavanaugh and Dr. Christine Blasey Ford, who has accused Kavanaugh of sexual assault when they were both teenagers.

Flake told reporters later in the day that while he had arrived at a decision about whether to support Kavanaugh, he was concerned about the process.

"Let me just say from the outset — Judge Kavanaugh, I agreed to support him before all of this came out. I wanted to support him — I'm a conservative. He's a conservative judge. But I want a process we can be proud of," Flake said, "I think the county needs to be behind it. And we need a more bipartisan process that's why this is important."

One of the protesters spoke emotionally about her own experience with sexual assault, while Flake looked down, ashen-faced.

"I was sexually assaulted and nobody believed me. I didn't tell anyone and you're telling all women that they don't matter, that they should just stay quiet, because if they tell you what happened to them, you're going to ignore them," the protester said.

Conversations with other senators

Several senators on the committee spoke before the vote, including Sen. Chris Coons, D-Delaware, a close friend of Flake's in the Senate. The two are the same age, born just a few months apart, and also both serve on the Senate Committee on Foreign Relations, and the Subcommittee on Africa and Global Health Policy. The two have both spent significant time in Africa, and bonded over those experiences, and have traveled together.

Coons told CBS News' Nancy Cordes that he was surprised and disappointed when he learned Flake had released a statement saying he would vote to confirm Kavanaugh, unleashing an expletive in front of reporters when a reporter showed him the headline on a phone. Coons then reworked his planned speech to the committee, in part to appeal to Republicans like Flake who were on the fence about Kavanaugh's confirmation. In a measured speech to his colleagues on the committee, Coons condemned the rank partisanship that had infected Kavanaugh's confirmation process, and quoted his Senate predecessor and the former Judiciary Committee chairman, former Vice President Joe Biden.

"I want to share one thing he said to me when I began my service here, which was: 'It is always appropriate to question another senator's policies, it is always appropriate to question another senator's priorities, but it is never appropriate to question another senator's motives,'" Coons said. "And there has been far too much of that that's happened in this process, in a way that will frankly make it very difficult for us to take off our partisan jerseys and at some point get back to the important work of finding solutions to the real challenges facing this country."

He said that after he gave his speech to the committee, Flake called him to the anteroom outside the hearing room to talk about his decision.

"He said, 'Look, I'm really having trouble with this. I think this hearing is tearing the country apart. What you're suggesting is perfectly reasonable. I think we ought to be trying to find a way to have a one-week pause,'" Coons recounted. He also said that Flake expressed some trepidation about proposing such a pause to allow the FBI to investigate the Kavanaugh allegations. "'I'm really concerned that folks on your side just want to run this out indefinitely and hold it open and hold it open and hold it open, and then it'll just lead to more, more, more," And, you know, I'm very concerned about how will this be handled? How will people talk about it?'" Coons said that he and Flake "had about a 5-minute intense and somewhat personal conversation" about the proposal.

Coons said Flake asked to speak to Feinstein. Eventually, it became a scrum where "virtually every member of the committee" gathered in the anteroom. Flake later told reporters he met with Democratic colleagues and asked them, "What would cause you to say we have a better process?"

After talking with several senators for awhile, Flake "sort of kicked everyone out," and he and Coons talked individually in the phone booth for around 15 minutes.

Soon afterward, Flake said he wanted to speak to FBI Director Christopher Wray. He ended up talking with Deputy Attorney General Rod Rosenstein for what Coons estimated was about 10 minutes. Coons had left him alone for the conversation, but when he returned, Flake was no longer by himself.

"They had a long conversation. You know, by the time I got back 10 minutes later, there were three Republican senators and staff really beating on him, really leaning in and – making their best arguments," Coons said about the scene before senators returned to reconvene in the hearing room. The vote started 20 minutes after it was scheduled.

Committee Chairman Chuck Grassley called the vote, and Flake voted to advance the nomination to the full Senate, as did all the other Republican senators. Eight Democrats voted against the motion, and two stayed silent in protest.

A personal decision

In addition to his Senate friends, Flake told reporters a few of his personal friends also recently admitted to him that they too were victims of sexual assault.

Later in the day, Flake admitted to reporters the culmination of all of these events ultimately convinced him.

"I knew…that people needed to be more comfortable moving ahead…and most of all that the country needs to feel better about this. This is ripping us apart," he told reporters.

With his mind made up and the assurances from the Democrats and the undecided senators to politically back this deal, Sen. Flake walked into the hearing room, whispered in Chairman Grassley's ear as he passed, and sat down in his chair where he announced the nomination shakeup.

The fallout

Flake said the investigation period also soothed worries from both Murkowski and Sen. Susan Collins, two Republicans who have not announced if they will vote to confirm Kavanaugh.

Flake said that he had not discussed his decision with the president. He also assured reporters that Senate Majority Leader Mitch McConnell was not angry with his decision.

"Everyone agreed this is how to move forward," Flake said, adding that McConnell has agreed not to bring forward a motion to vote on Kavanaugh's confirmation until after an FBI report had been filed.

Flake, who has often been a vocal opponent of Mr. Trump, is set to retire at the end of this year.

Judge Napolitano's Chambers: Judge Andrew Napolitano weighs in on how an FBI investigation into the allegations against Judge Kavanaugh after he and Christine Blasey Ford testified in front of Congress is unfair to both the accused and accuser.

The atmosphere on Capitol Hill turned especially tense Wednesday amid mounting protests from demonstrators in the halls of Congress, as lawmakers await the release of the FBI’s report on its Brett Kavanaugh background investigation and prepare to vote on his polarizing nomination to the Supreme Court.

The supercharged environment on Capitol Hill led Senate Majority Leader Mitch McConnell, R-Ky., on Wednesday to decry the harassment of senators during a speech on the Senate floor.

“One of our colleagues and his family were effectively run out of a restaurant in recent days,” McConnell said. “Another reported having protesters physically block his car door. And some have seen organized far-left protesters camp out at their homes.”

An increased police presence was visible Wednesday, as officers were seen protecting Republican senators who were coming and going from their offices. Maine Sen. Susan Collins, a crucial undecided vote on Kavanaugh’s nomination, was seen being escorted to votes by a Capitol Police detail as protesters and journalists rushed the lawmaker.

Hundreds of protesters have gathered in the Russell Rotunda basement to confront senators. Protesters have also approached Republican senators at other locations – like on Monday, when video surfaced of demonstrators badgering McConnell at Ronald Reagan National Airport.

That comes days after left-wing protesters, upset over Arizona Republican Sen. Jeff Flake’s decision to support Kavanaugh, confronted the sullen-looking lawmaker as he tried to get into an elevator last week. Hours later, Flake called for a new, limited FBI investigation, effectively delaying plans to vote on Kavanaugh’s nomination.

While the pressure from the demonstrations appeared to work on Flake, McConnell vowed Wednesday that senators will not be “intimidated by these people.”

Tensions between party leaders have also been rising. Senate Democratic Leader Chuck Schumer, D-N.Y., on Wednesday nearly called McConnell a liar from the floor, which would mark a breach of custom. Schumer took issue with McConnell blaming Democrats for the delay in voting on Kavanaugh, calling that “the most blatant falsehood I’ve heard uttered on this floor in a long time.”

McConnell has accused Democrats of working to delay the nomination at any cost. Schumer said McConnell, as majority leader, schedules the votes.

“I’m so tempted to use the L-word but he’s my friend,” Schumer said of McConnell.

McConnell has repeatedly said that the Senate will vote on Kavanaugh’s nomination this week. It’s not clear when McConnell will put steps into motion for that to happen, though he would need to “file cloture” on Wednesday to trigger a procedural vote Friday and a final confirmation vote Saturday.

Affecting the timing of the vote could be the completion of the FBI report, which could come as early as Wednesday. Fox News has learned from two senior Senate sources that report isn’t expected to be released publicly: the FBI is expected to send a single copy of the supplemental report on Kavanaugh to the Hill, where it will be kept in a safe in the Senate Judiciary Committee. All 100 senators and nine staffers will be authorized to read it.

Meanwhile, President Trump ramped things up with his criticism of the sexual assault allegations made against Kavanaugh by accuser Christine Blasey Ford during a rally in Mississippi on Tuesday night.

The president, before a campaign crowd, referenced holes in Ford’s story, portraying the back-and-forth between Ford and her interviewers during last week’s congressional hearing.

"'How did you get home?' 'I don't remember.' 'How did you get there?' 'I don't remember.' 'Where is the place?' 'I don't remember.' 'How many years ago was it?' 'I don't know,'" Trump said as the crowd applauded.

Those comments were not received well by some of the undecided senators, like Collins, who said it appeared Trump was mocking Ford.

“The president’s remarks were plain wrong,” Collins told reporters Wednesday.

She declined to say if it would have an impact on her vote.
