Coronavirus Patients Taken Off Ventilators and Out of ICU After Receiving Experimental Drug Leronlimab

Two patients in New York City were taken off ventilators taken out of intensive care after they received the experimental drug leronlimab.

At least two of seven patients on leronlimad saw significant improvement.

This follows the news on Friday that the renowned French epidemiologist Dr. Didier Raoult was able to repeat his findings from a previous study on the use of hdroxychloroquine on coronavirus patients.

The New York Post reported:

Two coronavirus patients in New York City are off ventilators and out of intensive care after they received an experimental drug to treat HIV and breast cancer.

As the skyrocketing number of cases stretches city hospitals to the limit, doctors are racing to find out which drugs on the market or in development might help in fighting the infection.

The drug, leronlimab, is delivered by injection twice in the abdomen, the Daily Mail reported.

Of seven critically ill patients who received the drug in New York, two were removed from ventilators and two showed significant improvement.

Turkish-Backed Police Killed Ahrar Al-Sharqiyah Security Chief Provoking New Round Of Infighting (Videos)

Security Chief of Ahrar al-Sharqiyah, one of the biggest factions of the so-called Syrian National Army (SNA), was killed on March 28 by the Free Syrian Police in the Turkish-occupied city of al-Bab in northern Aleppo.

According to many opposition sources, personnel of the Free Syrian Police, a law enforcement body backed by Turkey, were patrolling al-Bab to close shops, cafes and restaurants as a part of a plan to face the coronavirus pandemic when they were confronted by the Ahrar al-Sharqiyah’s Security Chief Elyui al-Sayah.

Al-Sayah, known by his nom de guerre Abu Rasul, engaged in a firefight with the policemen, who killed him and injured some of his militants.

In response to the death of al-Sayah, Ahrar al-Sharqiyah launched a large-scale attack inside the city of al-Bab targeting checkpoints and centers of the Free Syrian Police. The group’s militants even attempted to storm a hospital, looking for injured policemen.

The Turkish-backed group released a statement in the name of the SNA, vowing to avenge Abu Rasul and another slain militant, Mohamad Zarur.

“We are the SNA promise to hold the killers responsible,” the statement reads.

The clashes ended in the afternoon, reportedly after an intervention from Turkey. According to the London-based Syrian Observatory for Human Rights (SOHR), ten militants were injured as a result of the clashes.

A day earlier, a family feud led to similar clashes among Turkish-backed militants in the occupied city of Afrin. At least one militant was killed.

These incidents reflect the state of lawlessness in Syrian areas occupied by Turkey. Ankara is not apparently interested in changing this situation, likely to avoid involvement in the internal conflicts of its proxies.

Cuomo: Trump's quarantine would be a 'federal declaration of war,' prompting a 'civil war discussion'

New York Gov. Andrew Cuomo (D) said on Saturday that if the federal government were to enforce a quarantine of his state and the surrounding region it would amount to a "federal declaration of war."

Cuomo made the comments on CNN as President Donald Trump said earlier in the morning that he was considering a quarantine of "developing 'hot spots,'" including New York, New Jersey, and Connecticut. The president said "a decision will be made, one way or another, shortly."

The New York governor blasted the proposal as illegal.

“If you start walling off areas all across the country it would just be totally bizarre, counter-productive, anti-American, anti-social," he said.

“It makes absolutely no sense and I don't think any serious governmental personality or professional would support it," he added.

A 'temporary' quarantine

Trump briefly addressed the possible quarantine before departing the White House to bid farewell to the USNS Comfort in Norfolk, Virginia.

"Some people would like to see New York quarantined because it's a hotspot — New York, New Jersey maybe one or two other places, certain parts of Connecticut quarantined. I'm thinking about that right now," the president said on Saturday morning.

Trump added the measure would be temporary. "We might not have to do it but there's a possibility that sometime today we'll do a quarantine - short term - two weeks for New York, probably New Jersey, certain parts of Connecticut," he said

According to the Daily Mail, Trump is considering the possibility given that New York now has nearly half of the country's 113,000 confirmed coronavirus cases. In New York City's five boroughs, there are 29,766 known cases and 450 deaths related to the deadly outbreak.

'Civil war kind of discussion'

However, Cuomo said the measure would be unwarranted.

"This is a civil war kind of discussion," he said of the proposal while doubting that Trump was seriously considering it as an option. "I don't believe that any administration could be serious about physical lockdowns of states."

Several states have already imposed restrictions on travelers from New York. For instance, the governors of Rhode Island and Florida have declared a mandatory 14-day quarantine for any traveler from the Empire State. Additionally, state police officers have set-up checkpoints on I-95 in both states screening drivers with New York license plates.

"I want to be crystal clear about this: If you're coming to Rhode Island from New York you are ordered into quarantine. The reason for that is because more than half of the cases of coronavirus in America are in New York," Rhode Island Gov. Gina Raimondo said

The coronavirus outbreak is proving to be the Trojan horse that justifies increased digital surveillance via our smartphones.

All over the world, starting with China – the suspected origin of the COVID-19 outbreak – governments are increasing surveillance of citizens using their smartphones. The trend is taking off like wildfire; in China citizens now require a smartphone application’s permission to travel around the country and internationally.

The application is AliPay by Ant Financial, the finance affiliate controlled by Alibaba Group Holding Ltd. co-founder Jack Ma, and Tencent Holdings Ltd.’s WeChat. Citizens now require a green health code to travel, Yahoo News reported.

China isn’t the only country looking towards smartphones to monitor their citizens; Israel and Poland have also implemented their own spying to monitor those suspected or confirmed to be infected with the COVID-19 virus. Israel has gone the more extreme route, and has now given itself authority to surveil any citizen without a court warrant. Poland on the other hand is requiring those diagnosed with COVID-19 ordered to self-isolate to send authorities a selfie using an app. Which, if Poles don’t respond back in 20 minutes with a smiling face, they risk a visit from police, Dailymail reported.

Singapore has asked citizens to download an app which uses Bluetooth to track whether they’ve been near anyone diagnosed with the virus; and Taiwan, although not using a smartphone, has introduced “electronic fences” which alert police if suspected patients leave their homes.

Meanwhile, here in the U.S. as reported by the Washington Post, smartphones are being used by a variety of companies to “anonymously” collect user data and track if social distancing orders are being adhered to. Beyond that, the mobile phone industry is discussing how to monitor the spread of COVID-19. If that’s not enough, as this author reported for The Mind Unleashed, the government wants to work with big social tech giants like Google, Facebook, and others, to track the spread of COVID-19.

A new live index shows the increase of the police state by Top10VPN, a Digital Rights group. Top10VPN lists a total of 15 countries which have already started measures to track the phones of coronavirus patients, ranging from anonymized aggregated data to monitor the movement of people more generally, to the tracking of individual suspected patients and their contacts, known as “contact tracing.”

Pyongyang fires 2 short-range ballistic missiles into Sea of Japan – South Korea military

North Korea has reportedly conducted a new missile test, launching two projectiles off its eastern coast that fell into the Sea of Japan, the South Korean military reports. The launch marks the fourth such test in a month.

The USNS Comfort is one of two hospital ships in the Mercy-class maintained by the United States Navy. Hospital ships in service with the USN were originally assigned two mission sets that continue to this day: firstly, they serve as a large, mobile floating medical facility that provides surgical acute care in support of US military forces when operating in hostile theaters; secondly, their mission is to serve as a floating hospital for use by a number of government-supported agencies in assistance to victims of natural disasters while also providing international humanitarian relief. Comfort makes her home in port at Baltimore, Maryland, while her sister ship, USNS Mercy, is docked on the West Coast.

Comfort was originally built as an oil super tanker in 1976 in San Diego, California, and christened the SS Rose City. When purchased and delivered to the US Navy in 1987, instead of being used as an oil tanker, she was put into the yard and converted to a hospital ship as the second of such in the Mercy-class. The ship is adorned with large red crosses to distinctly and obviously paint her purpose while protecting her crew and human cargo against attack in hostile situations. The Geneva Convention protects such hospital ships if they carry no munitions or weapons and any country that fires on them is charged with an international war crime.

Schenck v. U.S. (1919)

In Schenck v. United States (1919), the Supreme Court invented the famous "clear and present danger" test to determine when a state could constitutionally limit an individual's free speech rights under the First Amendment. In reviewing the conviction of a man charged with distributing provocative flyers to draftees of World War I, the Court asserted that, in certain contexts, words can create a "clear and present danger" that Congress may constitutionally prohibit. While the ruling has since been overturned, Schenck is still significant for creating the context-based balancing tests used in reviewing freedom of speech challenges.

The case involved a prominent socialist, Charles Schenck, who attempted to distribute thousands of flyers to American servicemen recently drafted to fight in World War I. Schenck's flyers asserted that the draft amounted to "involuntary servitude" proscribed by the Constitution's Thirteenth Amendment (outlawing slavery) and that the war itself was motivated by capitalist greed, and urged draftees to petition for repeal of the draft. Schenck was charged by the U.S. government with violating the recently enacted Espionage Act. The government alleged that Schenck violated the act by conspiring "to cause insubordination … in the military and naval forces of the United States." Schenck responded that the Espionage Act violated the First Amendment of the Constitution, which forbids Congress from making any law abridging the freedom of speech. He was found guilty on all charges. The U.S. Supreme Court reviewed Schenck's conviction on appeal.

The Supreme Court, in a pioneering opinion written by Justice Oliver Wendell Holmes, upheld Schenck's conviction and ruled that the Espionage Act did not violate the First Amendment. The Court maintained that Schenck had fully intended to undermine the draft because his flyers were designed to have precisely that effect. The Court then argued that "the character of every act depends upon the circumstances in which it is done." While in peacetime such flyers could be construed as harmless speech, in times of war they could be construed as acts of national insubordination. The Court famously analogized to a man who cries "Fire!" in a crowded theater. In a quiet park or home, such a cry would be protected by the First Amendment, but "the most stringent protection of free speech would not protect a man in falsely shouting fire in a theatre and causing a panic."

In sum, free speech rights afforded by the First Amendment, while generous, are not limitless, and context determines the limits. "The question in every case is whether the words used are used in such circumstances and are of such a nature as to create a clear and present danger that they will bring about the substantive evils that Congress has a right to prevent." Against this test, the Court upheld the Espionage Act and affirmed Schenck's conviction, finding that his speech had created a clear and present danger of insubordination in wartime.

The decision, in addition to sending Charles Schenck to jail for six months, resulted in a pragmatic "balancing test" allowing the Supreme Court to assess free speech challenges against the state's interests on a case-by-case basis. (Justice Holmes, the test's creator, however, would attempt to refine the standard less than a year later, when he famously reversed himself and dissented in a similar free speech case, Abrams v. United States.) However, the "clear and present danger" test would only last for 50 years. In 1969, the Court in Brandenburg v. Ohio replaced it with the "imminent lawless action" test, one that protects a broader range of speech. This test states that the government may only limit speech that incites unlawful action sooner than the police can arrive to prevent that action. As of 2006, the "imminent lawless action" test is still used.

Abrams v. United States (1919)

In the waning months of World War I, in August 1918, a group of Russian immigrants was arrested in New York City and charged with violating the Sedition Act of 1918, which made it a crime to "willfully utter, print, write, or publish any disloyal, profane, scurrilous, or abusive language about the form of the Government of the United States" or to "willfully urge, incite, or advocate any curtailment of the production" of the things "necessary or essential to the prosecution of the war." Their offense: distributing pamphlets that criticized the U.S. military's recent deployment of troops to Russia and that, in one case, advocated a general strike in factories producing military goods. A few months later, the group – which included a young anarchist named Jacob Abrams – was tried, convicted, and sentenced to prison terms of 15 to 20 years. Their convictions were hardly unique. Ironically, during the "war to make the world safe for democracy" the federal government enacted some of the most severe restrictions on civil liberties at home in the country's history – in 1919 and 1920, the attorney general reported 877 convictions under the 1918 Sedition Act and other similar federal laws.

In March 1919, while Abrams and his compatriots were appealing their case, the Supreme Court heard two other First Amendment cases dealing with the convictions of antiwar socialists – Schenck v. United States and Debs v. United States. In both cases the Court unanimously upheld the defendants' convictions under the 1917 Espionage Act and the 1918 Sedition Act, respectively – and in both cases Justice Oliver Wendell Holmes penned the Court's decisions. In Schenk, Holmes devised a legal test for governmental restrictions on free speech. The deciding factor, he wrote, is whether the speech in question is "of such a nature as to create a clear and present danger that [it] will bring about the substantive evils that Congress has a right to prevent. It is a question of proximity and degree."

In the Abrams decision, issued in November 1919, the Court voted 7-2 to uphold the convictions of Abrams and the other defendants. Writing for the majority, Justice John H. Clarke closely mirrored Holmes's reasoning in the first two cases, holding that "the language of these circulars was obviously intended to provoke and encourage resistance to the United States in the war" – and that the defendants' actions had therefore passed the "clear and present danger" threshold.

Over the summer of 1919, however, Holmes had undergone a serious change of heart regarding the permissibility of governmental restrictions on the First Amendment's guarantee of the right to free speech. Long held in special esteem by many of the nation's most prominent legal scholars, Holmes had been surprised by the negative reaction many had had to his opinions in Schenk and Debs. In the June 1919 issue of the HARVARD LAW REVIEW, Professor Zechariah Chaffee had published an article entitled "Freedom of Speech in War Time," which advocated a more libertarian reading of the First Amendment and appeared to be written as a personal entreaty to Holmes. Holmes not only read the article but also met with Chaffee personally, and spent time over the summer engaging with several other libertarian scholars and jurists, among them Learned Hand and Ernst Freund. By the time the Abrams case reached the Court in the fall, Holmes was prepared to rethink his earlier position.

Joined by Justice Louis Brandeis, Holmes issued a dissent that remains famous as one of the Court's most eloquent defenses of free speech. Although he maintained that his opinions in the Schenk and Debs cases had been correct, Holmes modified his standard, stating that the government could constitutionally restrict and punish "speech that produces or is intended to produce clear and imminent danger that it will bring about forthwith … substantive evils." The difference in phrasing was more than semantic. By substituting "imminent" for present and adding the qualifier "forthwith," Holmes was signaling a much stricter standard of judicial scrutiny: only when a direct and immediate connection between an act of speech and a subsequent crime existed could the speech itself be criminalized. Holmes dismissed the possibility that "the surreptitious publishing of a silly leaflet by an unknown man … would present any immediate danger," and argued for the social benefits of unrestrained free speech. "The best test of truth is the power of the thought to get itself accepted in the competition of the market, and that truth is the only ground upon which their wishes safely can be carried out," he wrote. "That at any rate is the theory of our Constitution."

Although the Court never adopted Holmes's more rigorous standard, his dissent in Abrams remains widely regarded as a defining moment in the movement towards a modern construction of the right to free expression. The Court would continue to use various reformulations of Holmes's earlier "clear and present danger" test until 1969, when it established a direct incitement standard in Brandenburg v. Ohio.
