Overturning Chevron: A Wrong Made Right

This June, the Supreme Court struck a major blow to the bureaucratic behemoth of the administrative state by overturning Chevron. The 1984 Chevron decision had long directed courts to defer to the administrative state’s interpretation of the law, granting enormous powers, including the judicial branch’s core power of interpreting law, to an unelected, entrenched bureaucracy. As of this summer, this wrong has finally been set right.

The decision restores critical authorities to their constitutionally mandated branches of government, ensuring accountability to the American people.

What may at first seem like a mere abstract legal issue has had real world consequences for Americans. Chevron took power away from citizens, rendering them nearly defenseless against the tyranny of the administrative state. America’s Founders would be horrified by the cascading effects of this doctrine.

Take the cases that overturned Chevron: Loper Bright and Relentless. In these cases, small fishing companies challenged the National Marine Fisheries Service’s (NMFS) interpretation of the Magnuson-Stevens Act which requires fishing boats take a bureaucrat on their trips to make sure they are following the law. The question in the case was if the law required fishing companies to pay the salary of these bureaucrats – a significant expense at up to $700 per day. By overturning Chevron, the Supreme Court put these fishing companies, and anyone else fighting the administrative state in court, back on a level playing field.

Advancing American Freedom has remained laser focused on seeing Chevron overturned. In our 17 amicus briefs filed on the issue, we led a coalition of a combined 91 other organizations and individuals, arguing in both appellate courts and at the Supreme Court that Chevron was a danger to the liberties protected by the Constitution. Now that the Loper Bright decision has restored an element of judicial power to check administrative agencies, we must ensure that all branches of government reclaim their constitutional authority from the administrative state.

For this reason, our latest amicus brief, Consumers’ Research v. Consumer Product Safety Commission filed this July and joined by 36 other amici, urged the Supreme Court to return constitutional powers currently usurped by the administrative state back to the president. At issue in this case is the inability of the president to remove certain administrative agency heads, empowering these agencies to operate independently beyond the control of the chief executive. Should Congress cede further power to an agency, the agency would in effect function without any meaningful oversight from either the executive or the legislative branch. This situation spells disaster for our system of government and the freedom of all Americans, undermining the ideals and laws of the Constitution. Returning power to the president, however, would restore the Constitution’s balance between Congress and the president in overseeing the functioning of executive agencies.

It is clear that a ballooning and unaccountable administrative state throws a wrench into the constitutional balance of powers essential to the health of our nation. The Constitution creates a system of government comprised of three coequal branches, each of which can balance the power of the other two. In overturning Chevron, the Court has appropriately checked a degree of the administrative state’s power. Now, Congress must summon the courage to legislate in a way that prevents the further illegitimate expansion of federal bureaucracy. At the same time, the Supreme Court should continue to check the expansion of the administrative state at the expense of the constitutional authorities of the president.

The Founders knew that the liberty of the American people depends on limiting government power. The administrative state operates as a fourth branch of government. That problem will not begin to be solved until it is made accountable to the chief executive. Ensuring the God-given rights of the citizens of this country demands reining in the federal bureaucracy once and for all and restoring an equal balance of power among three branches of government.

Former President Donald Trump has lately been trying to distance himself from Project 2025, claiming it was cooked up by the “severe right” and that he doesn’t know anything about it.

But it turns out the severe right is coming from inside the house.

Kevin Roberts, the self-proclaimed “head” of Project 2025, has a book coming out in September — and the book’s foreword is written by Trump’s vice presidential candidate, J.D. Vance, who lavishly praises its ideas.

“Never before has a figure with Roberts’s depth and stature within the American Right tried to articulate a genuinely new future for conservatism,” Vance writes, according to the book’s Amazon page. “We are now all realizing that it’s time to circle the wagons and load the muskets. In the fights that lay ahead, these ideas are an essential weapon.”

What ideas? Like Vance, Roberts is obsessed with the idea that the left controls major American institutions — he lists Ivy League colleges, the FBI, the New York Times, the National Institute of Allergy and Infectious Diseases, the Department of Education and even the Boy Scouts of America. The book argues that “conservatives need to burn down” these institutions if “we’re to preserve the American way of life.” (Vox has requested a copy of the book, but has not yet received one at the time of this writing.)

Obviously, this poses a problem for Trump’s attempts to distance himself from the virally unpopular Project 2025 and its lengthy agenda for what he should do if he wins, which includes proposals to restrict abortion access and centralize executive power in the presidency.

And it’s one more indication that Trump’s pick of Vance might be politically problematic for him. Vance has a fascination with provocative and extreme far-right thinkers, and a history of praising their ideas. He is not a running mate tailored to win over swing voters who are concerned Trump might be too extreme — quite the opposite.

The book was written and announced before Vance was chosen as Trump’s running mate. But there’s some indication that people involved had some late second thoughts about it. It was originally announced as “Dawn’s Early Light: Burning Down Washington to Save America,” with a cover image showing a match over the word “Washington.”

More recently, though, the subtitle has been changed to “Taking Back Washington to Save America,” and the match has vanished from the cover.

Roberts headed Project 2025 — and contributed some of its most controversial proposals

Project 2025, which I recently wrote about at length, is the conservative movement’s detailed and specific plan for what the next Republican president should do with his power.

It was crafted by people who have long worked closely with Trump and includes many policies Trump clearly supports — like centralizing power in the presidency over career civil service professionals, slashing regulations, and abandoning efforts to fight climate change. It also contains some proposals Trump currently finds politically problematic: aggressively using federal power to prevent abortions, restricting some contraceptive coverage, and banning pornography.

Project 2025 was put together by the conservative Heritage Foundation, which worked on it with more than 100 conservative groups. Though much of its 922-page policy document is written in dry, wonkish language, Roberts wrote the fiery introduction. The porn ban is his idea specifically — he writes:

Only a couple weeks ago, Democrat leaders were discussing how to dump Kamala from the ticket. She was that big of an albatross. The most unpopular, unlikeable Vice President in modern history was an anchor on the Democrat Party and yes, even “the Biden brand.”

Only a couple of weeks ago, a crowd of Democrat consultants and donors was debating who the candidate should be. A top Democrat fundraiser actually said to the crowd,Kamala as the presidential candidate would be “more threatening” to swing voters than a dead or comatose Joe Biden. Only a week ago, the New York Times looked at the pros and cons of every possible Biden replacement and called Kamala Harris “the most unelectable” of any possible Democrat candidate.

And a quick reminder- for thepast four years, virtually every poll showed Kamala was the only politician on earth more unpopular than her boss, Joe Biden(the lowest rated president in a century). Everyone at the top levels of Washington DC agreed Kamala was thoroughly unlikeable, completely incompetent, and dim-witted. That’s a very bad combination.

Keep in mind Kamala was universally hated by even her own staff- 92% of the people working for her as Vice President quit over the past 3 ½ years. Staffers publicly called her “a toxic, soul-destroying bully.” See:

Here’s the proof the polls you’re currently seeing in the mainstream media are total fraud. For years, the most accurate poll in the country has been The Democracy Institute, run by Patrick Basham.

Democracy only polls “likely voters,” as opposed to other biased pollsters (friendly to Democrats) who choose to poll any registered voter who picks up the phone. Up to one third of registered voters are not going to vote. And they skew dramatically Democrat.

These other polls also oversample Democrats. That’s how they have come up with such absurd numbers for Kamala Harris. Of course, if you poll mostly Democrats, you’ll come up with ridiculous fake numbers in favor of the Democrat candidate.

Former President Donald Trump and Vice President Kamala Harris each unleashed a new wave of television ads Tuesday as they race to secure an advantage in a presidential campaign dramatically altered in recent weeks.

In its first major ad blitz targeting Harris, the Trump campaign is zeroing in on her immigration record in ads running across several key battleground states. It’s a sign that the former president has settled on a longstanding GOP line of attack against the vice president, after grappling with the abrupt change atop the Democratic ticket.

Harris, meanwhile, unveiled a minute-long ad entitled “Fearless” that offers highlights of her career dating to her tenure as a prosecutor in the Bay Area of California – as she scrambles to introduce herself as the prospective nominee to voters following President Joe Biden’s decision to end his reelection bid. It’s part of what the Harris campaign said will be a $50 million blitz in the run-up to next month’s Democratic National Convention – fueled, in part, by the record-breaking fundraising the Harris campaign has seen since Biden’s departure from the race and endorsement of her candidacy a little more than a week ago.

Trump, in two new campaign ads, seeks to define Harris on his terms by relying on what has been a political liability for the Biden administration: the management of the US-Mexico border.

Republicans have jumped on an assignment given to Harris – the task of addressing the root causes of migration in Central America – to cast her falsely as the nation’s “border czar” and as solely responsible for the record number of migrant arrivals at the US southern border over the last three years.

Both Trump campaign ads pull from a 2021 NBC interview during which Harris was pressed about the fact that she hadn’t yet visited the US-Mexico border and she stumbled through a response by claiming she also hadn’t yet gone to Europe – an answer that perplexed administration officials at the time.

Another shows a video of Harris dancing at an event, stating: “This is America’s border czar – and she’s failed us.”

The ads conclude with a description of Harris as “failed. Weak. Dangerously liberal.”

In response, Harris campaign spokesperson Ammar Moussa said Trump is “running on his trademark lies” and said the former president opposed a congressional border deal that would have helped with enforcement.

Harris’ root cause work dates to March 2021. During an influx of unaccompanied migrant children, Biden tasked the vice president with overseeing diplomatic efforts in Central America. While Harris focused on long-term fixes, the Department of Homeland Security remained responsible for overseeing border security.

As the vice president’s campaign takes shape and as immigration remains a top issue for voters, her team is forced to contend with an assignment that, sources say, has showed early success in Central America as a result of major private-sector investment but that’s been bundled with the administration’s larger migration issues.

The Trump campaign so far has reserved about $12.2 million in advertising across six battleground states – Arizona, Georgia, Michigan, Nevada, Pennsylvania and Wisconsin – through August 12, according to data from AdImpact, which tracks media buying.

Even as she seeks to introduce herself to voters, Harris’ new campaign ad also goes on the attack against Trump, using some of the vice president’s remarks at her first rally as the presumptive Democratic nominee for president.

“Donald Trump wants to take our country backward,” Harris can be heard saying in the ad. “To give tax breaks to billionaires and big corporations and end the Affordable Care Act. But we are not going back.”

In a statement, Harris campaign chair Jen O’Malley Dillon noted the former president’s May felony conviction for falsifying business records and said that Harris’ career – ranging from a courtroom prosecutor and California attorney general to her current role in the Biden administration – makes her “uniquely suited to take on Donald Trump.”

The new Harris ad, according to the campaign, will air during the Olympics along with other programs – such as “Love & Hip Hop: Atlanta,” “The Bachelorette” and “The Daily Show” – that target demographic groups the campaign is trying to reach.

William Laws Calley Jr., who as an Army lieutenant led the U.S. soldiers who killed hundreds of Vietnamese civilians in the My Lai massacre, the most notorious war crime in modern American military history, has died. He was 80.

Calley died April 28, according to his Florida death record, which said he had been living in an apartment in Gainesville. His death was first reported by The Washington Post on Monday, citing his death certificate.

Calley had lived in obscurity in the decades since he was court-martialed and convicted in 1971, the only one of 25 men originally charged to be found guilty in the massacre that helped turn American opinion against the war in Vietnam.

On March 16, 1968, Calley led American soldiers of the Charlie Company on a mission to confront a crack outfit of Vietcong enemies. Instead, over several hours, the soldiers killed 504 unresisting civilians, mostly women, children and elderly men, in My Lai and a neighboring community.

The men were angry: Two days earlier, a booby trap had killed a sergeant, blinded a GI and wounded several others while Charlie Company was on patrol.

Soldiers eventually testified to the U.S. Army investigating commission that the murders began soon after Calley led Charlie Company’s first platoon into My Lai that morning. Maduro has responded to the leftist leader, saying he'll release election data with full transparency to the world:

Maduro met Celso Amorim, Lula’s chief foreign affairs adviser, at the Miraflores Palace in Caracas on Monday, amid mounting pressure from Brazil, Colombia and other nations to publicly verify the results of a Sunday election in which he was declared the winner and the opposition claimed fraud.

At this moment, no less than nine Latin American countries have yet to officially declare their recognition of Maduro's third term. The White House too has said its is "reviewing" what data that it can, and that there are "signs" that the official results don't "reflect the will of the people." It has called on the government not to repress protesters.

Democrat Senator Mark Kelly is reportedly on Kamala Harris’ shortlist as a vice president pick. According to reports, Senator Kelly previously told his daughter to take down posts about weed, molly, and sex.

The Daily Mail reported that Sen. Kelly, who the Harris Campaign has already sent VP vetting papers, sent a text to his daughter Claire Kelly in 2020 warning his daughter to take down posts about drugs and sex.

In a video posted on Instagram that shows illicit drugs, Claire wrote the caption, “P***y molly weed.”The possession of Molly, which is Ecstasy/MDMA, is a felony in Arizona.

In a screenshot of the text message exchange that Claire uploaded, Sen. Kelly told his daughter, “Been busy today. Got 1 call and 2 emails about your Instagram account. I’m not interested in lookingbut I suspect what you posted would not be in anyone’s best interest. At least not yours or mine.”

Claire responded to her dad by writing, “No, my Instagram is fine.”

When Arizona Senator Mark Kelly’s daughter posted photos of illegal drugs on her Instagram story, the now-vice presidential hopeful seemed to know they would come back to haunt him.

In 2020, Claire Kelly, then 23, posted a video on Instagram of what seems to be marijuana and ecstasy, known as molly.

‘P***y molly weed,’ she captioned the video of a bag of the illicit drugs. Possession of ‘dangerous drug’ ecstasy is a felony in Arizona.

In another story, Claire screenshotted text messages sent from her dad warning her to take down her post.

The investigation into the soldiers was launched after a detained terror suspect was brought from the base to a hospital with signs of serious abuse, including to his anus. He was arrested by the IDF in the Gaza Strip several weeks ago.

The right-wing Honenu legal aid organization, which is representing four of the reservist soldiers, claimed on Monday that its clients acted in self-defense in the incident.

The group said in a statement that the detainee attacked and bit the soldiers while he was being transferred from Ofer Prison to the Sde Teiman detention facility nearly a month ago, adding that one of the reservists was injured in the incident.

According to an Army Radio report, the abuse itself took place some three weeks ago at Sde Teiman, and the terror suspect was found at the military base in critical condition and taken to a hospital for treatment and surgery. He is now no longer in life-threatening condition, the report said.

Far-right Finance Minister Bezalel Smotrich, meanwhile, issued a statement saying that the protests against the arrests of the soldiers “are justified and I support them with all my heart.”

Evidently, the case against these soldiers is extremely damning.

Nonetheless, odds are they're not going to face any punishment whatsoever. Who knows, perhaps in the future they'll be hailed as civil rights heroes!

The Democratic National Convention is set to kick off in just under three weeks, less than a month after President Joe Biden's announced the bombshell decision to end his bid for reelection and endorse his running mate, Vice President Kamala Harris.

Here's what we know about the 2024 DNC and who is expected to become the party's nominee.

When and where is the 2024 DNC?

The DNC will be held in Chicago from Aug. 19 to 22. The Republican National Convention, held in Milwaukee in mid-July, officially selected Republican presidential nominee Donald Trump and his running mate, Sen. JD Vance of Ohio.

What happens at the DNC?

Democratic delegates will travel to the DNC to officially nominate the party's presidential and vice-presidential candidates for the 2024 election. A candidate needs to secure 1,967 delegates for the Democratic party nomination.

Haris has also already secured more than half the support of Democratic delegates to be the nominee, meaning the 59-year-old vice president could become the official nominee when a virtual vote begins as soon as Thursday, according to prior reporting by USA TODAY.

Before Biden's announcement, the DNC had decided to confirm their nominee during a virtual roll call sometime before Aug. 7 to satisfy ballot deadlines in several states.
