Statement on Incorrect Filing with the SEC

7/17/2024

The SEC filing which showed that Austin Private Wealth shorted a large number of shares of Trump Media & Technology Group Corp (DJT) was incorrect and we immediately amended it as soon as we learned of the error.

No client of APW holds, or has ever held, a put on DJT in the quantity initially reported. The correct holding amount was 12 contracts, or 1,200 shares — not 12 million shares, as was filed in error. In submitting the required report for the second quarter of 2024, a multiplier was applied by a third-party vendor that increased the number of the shares by a multiple of 10,000 for all options contracts (not just DJT). We did not catch the error before approving the filing.

We filed the report on July 12 to reflect our positions on June 28. We amended it on July 16.

We deeply regret this error and the concern it has caused, especially at such a fraught moment for our nation. We are committed to full transparency and maintaining the trust of our clients. As such, we are reviewing our internal procedures and our processes with the third-party vendor that assists with SEC filings to better understand how this happened and avoid similar issues moving forward.

Judge sets Harvey Weinstein retrial date for November

A judge in New York has set a tentative retrial date for Harvey Weinstein for 12 November after the disgraced film mogul's rape conviction was overturned in April.

New York State Supreme Court Judge Curtis Farber said during a hearing on Friday that he was open to potentially starting the trial earlier than November, as Weinstein's lawyers have requested.

Prosecutors in the Manhattan District Attorney’s Office have said that they plan to file "additional violent sexual assault" charges after other women agreed to testify against Weinstein.

The newest accusers have yet to be publicly identified.

Weinstein, 72, attended the court hearing on Friday. He is being held in New York City's notorious Rikers Island jail pending trial.

In 2020, he was sentenced to 23 years in prison. But in April, a court of appeals ruled that he did not receive a fair trial because the judge overseeing his case allowed testimony from women who made allegations about Weinstein for which he was never charged.

He was also found guilty of rape at a separate trial in California and was sentenced to 16 years in that case.

Weinstein used a wheelchair to attend proceedings at the Manhattan court. He wore a dark suit, blue tie, and thick-framed eyeglasses and was seen carrying a brown folder.

The hearing was delayed for over an hour due to a global software outage affecting Microsoft computers.

Weinstein has been accused of sexual misconduct, assault and rape by over 100 women.

The decision by his accusers to come forward, and his subsequent conviction in New York, galvanised the #MeToo movement against sex abuse by powerful men.

Weinstein co-founded Miramax film studio, whose hits included Shakespeare in Love, which won best picture at the Academy Awards, and Pulp Fiction.

His films received more than 300 Oscar nominations and 81 statuettes.

Panama to start deporting migrants from Darien Gap within months

PANAMA CITY, July 19 (Reuters) - Panama's government expects to start deportation flights for migrants who crossed the country's dangerous Darien jungle in two to three months, the country's chief of migration Roger Mojica said Friday.

The flights will be paid by the United States under a recent agreement that the two countries closed earlier this month.

"We are establishing the needs, equipment and requirements that Panama has to face in order to start the program, and we are in conversations with the United States," Mojica said during a conference call. "We estimate we should be able to start the process in two to three months."

Panama's new president, Jose Raul Mulino, has vowed to curb unlawful immigration and has started to work closely with the U.S. to control passage through the jungle that links Central America to Colombia.

Panama's Darien Gap, a jungle which bridges Central America with the South American continent, saw a record half a million migrants cross last year seeking security and better economic opportunities abroad.

Panamanian authorities estimate some 213,702 thousand crossed the Darien so far this year, many of them children.

The topic of migration has gained traction ahead of elections in the U.S., a key destination for many migrants, with Republican candidate and former President Donald Trump vowing stronger borders and mass deportations.
