Last week, the Trucker Commission in Canada showcased testimony from top Trudeau officials from the Privy Council Office who were forced to justify why the trucker convoy protests were designated a “threat to national security” requiring invoking the Emergencies Act.

An estimated 50,000 Canadian truckers traveled across Canada in a massive caravan protesting the COVID mandates. Canadian media tried to paint the protests as Russian propaganda.

Canadian Prime Minister Justin Trudeau unleashed his authoritarian leadership on Canadians who dared to push back against the government, including arresting two leaders of the Freedom Trucker convey protest in Ottawa.

The Liberal Government has now trotted out its criteria non of which are found in the legislation - neither the CSIS Act nor the EA. This set of criteria is political and as such uses a non-legal standard. The threshold for the EA is higher than for the CSIS Act and both are of a different kind than the set of criteria used to make the political decision to use extraordinary powers under the guise of the EA/CSIS Act legal provisions.

Note that these provisions are highly significant both in the intent of the law and in the black letter text of the law. Interpretation is not the difference between the legal criteria and the political criteria.

Difference in kind.

The Libs attempted to reduce the threshold by claiming the emergency made it necessary to "broaden" the criteria. In other words, they acted outside of the law. And their rationalizations depended on circular thinking, not reasonableness, for they began with their conclusion: that there was an emergency that triggered an emergency response and thus the emergency necessitated going outside the law to use extraordinary powers that otherwise would require meeting a set of criteria more stringent than either the threshold of the CSIS Act or the threshold of the EA.

Circular thinking is not logical. And it does not meet the test of reasonableness. As such, the rationalizations, the excuses, and (to be overly generous) the interpretation of the legal criteria for triggering emergency measures under the EA simply have not been justified under the purposeful restraints of the law.

There is more. The law entrusts the decision to invoke the EA with the Cabinet of the federal government. The Cabinet is the executive branch in the parliamentary form of representative governance. The Cabinet is not a single individual. It is comprised of members of Parliament - MPPs and Senators - and occasionally individual who are not members of parliament (traditionally appointed on the provision that they will either be elected or appointed to Parliament's House or Senate). All of the current Cabinet members are elected MPPs. The decision-making body for the executive branch is the Cabinet as a whole.

This is unlike, for instance, the executive branch in the US federal government in which the President is elected and embodies the executive branch and all members of his cabinet serve at the pleasure - the say-so - of the President. Non are elected. They are appointed with oversight in the elected congress, i.e. the legislative branch of government. The President is the decision-maker in such a form of republican governance.

The PM in Canada is not the executive branch. the PM is a member of parliament. He may or may not be the leader of a political party; he may or may not be elected to the House (however tradition has required his election as an member of parliament); and his authority is not derived of votes cast for him in his riding which is localized and is not a nation-wide precinct. In the parliamentary form of governance, the PM is not elected by a nation-wide direct vote for an individual.

These are significant differences that should not be brushed aside when considering the decision-making that happened when the Trudeau invoked the EA. It was not his decision to make alone. He is but one member in a Cabinet and as such he must be supported by a decision of the executive as a whole. Yet that is not what the fact-finding in this inquiry has found.

The undisputed fact is that while Cabinet members participated in preparations for the decision, it was left to the PM to decide after he had consulted the provinces in a single meeting. The decision was not made by the Cabinet as a whole; there was no Cabinet meeting after the provincial consultation. The invocation of the EA took place within the office of the PM rather than at the Cabinet table.

This sequence of events also highlighted the superficiality of the PM's consultation with the provinces. First, that consultation lacked advanced warning; the meeting was called without an agenda that would have brought to the provinces their own decision-making process via their own executive - their provincial cabinets as a whole. The account of the PM's meeting by various witnesses who gave firsthand testimony at the hearing indicates that the chair of the meeting was the PM and that he informed rather than consulted the cabinets of the cabinets of the provincial and territorial governments. To brush-off the significance of consultation, the Liberals have downgraded the black letter text of the EA requirement for consultation and diluted the criteria that sets the threshold for invocation of the emergency measures that are the sole reserve of the federal government, in this instance the federal executive.

While the Liberals have accused the Convoy and the rally supporters of being a threat to the form of parliamentary representative governance, it turns out that the facts show it was the PMO that has threatened legitimate governance at the federal level. They did so by trampling the Charter, trampling the EA itself, and undermining with vigor the public understanding of the constraints on the executive of the federal government. They invoked state violence in various forms against peaceful Canadians - not just those in the Convoy and rally and at the border locations, but all Canadians came under the EA measures whether or not they agreed with the invocation, whether or not they opposed the federal vax mandates, whether or not they supported the protestors. All Canadians were put under the unlawful use of extraordinary powers by the Trudeau Liberals.

Now, consider how Trudeau has mistreated Canadians, even those who may have voted for the Liberal candidates in past elections, and realize that his use of power has been arbitrary and based on his hyper-inflated self-regard as a ruler of all Canadians.

That manifested a form of national security threat that meets the threshold of an emergency that could trigger the invocation of the EA. That trigger is in the hands of the Cabinet, not the PM, and so is also, by extension, in the hands of the caucus of the Liberal Party of Canada.

As in other parliaments around the world, including the UK parliament, PMs can be invited to leave office by their own party caucus and/or by the current Cabinet as a whole. The PM is just a single member of that Cabinet and of that caucus. As such he is a member elected in a small corner of Montreal. He has no special authority outside of his membership in that Cabinet, in that caucus or faction, in the Parliament of Canada. He does not sit as a ruler outside of the parliamentary form of representative governance.

And, given the disruption that the PM Office under Trudeau has visited upon all Canadians, and given the very criteria used by Trudeau to rationalize his decision to take it upon himself to use extraordinary powers outside the law, and given the threat of his doing so yet again and again, the Canadian people are justified in demanding his resignation.

And they are justified in demanding of their elected representatives, especially those in the Liberal faction of the House but also those in the NDP faction in the House, to express that demand directly to the current holder of the PM Office. Further, the Cabinet members are duty bound to remove this national threat to the security of Canada.

The damage done and threatening to be done for the purpose of effecting political change to policies, as testified to by Trudeau himself and by his closest advisers, provides sufficient undisputed facts to remove him from power if he does not relent willingly. This would not be unprecedented in the parliamentary form of governance.

We have seen that already twice in a short span in the UK Parliament most recently.

To further clarify.

In most of the ridings across the country, the winning candidate garnered around 1/3rd of the votes cast and never garnered a majority of registered voters and often not even a near majority of votes cast.

So, yes, an imperfect system. But representative both in purpose and in duty. How such a system functions best is through voters holding their MPs accountable during as well as in-between election campaigns. For instance, if an MP misbehaves, he can be pressured to resign and then a by-election can be held to elect his replacement. This has been done and could be done more often if Canadians were to participate more fully in their parliamentary form of representative governance.

The Trudeau form of governance discourages such participation, as seen in the over-reaction to the Convoy and the rally in Ottawa and protests at the border locations.

So, to clarify, each elected member of Parliament derives his representative authority from votes cast in his local riding.

But the Cabinet members and the PM also gain greater authority - on a national scale - via the formation and maintenance of political factions within the elected House of Commons. Political parties are not intrinsic to the parliamentary form of governance but are a convention that has been codified in some aspects, such as public funding of some parliamentary activities and such as rules about the composition of parliamentary committees and such. The PM is a member of a faction which may be comprised of a single political party or a combination of parties and/or independent members. The faction that supports a PM is the base of which Prime Ministerial representative authority is derived.

And, as a member of Cabinet, the PM chairs the executive branch. As such he does convert his base support into executive power but the PM is subject to the counter balance of factions within the Cabinet membership and within the membership of the caucus of his own party and of other factions within the House of Commons.

It remains representative of ALL Canadians - including those who voted for other factions or who did not vote at all. The irony is that the parliamentary form of representative governance has its roots in evolving governance away from aristocratic and oligarchic forms of governance. The evolution has not been without drastic swings of the pendulum or by devastating setbacks and turmoil in most places where this form of governance has persisted and has taken deep roots.

So - again to clarify - the PM's authority is not that derived of a nation-wide vote for the individual. The PM is first a member of parliament - of the House of Commons or the legislative branch - and is next a member of Cabinet (the executive branch) - and it is this co-branch system that is intended to bring the members of the executive directly into account in the public forum of the House and its various functions and committees. The PM is elected locally to represent all of his riding constituents; and he leads a faction that represents all Canadians; and his executive role is to facilitate Cabinet decision-making - executive decision-making. The crossover with legislation reflects this leadership role of Cabinet members, not just of a single individual, the PM, in an office that is situated outside of the House of Commons.

PM Trudeau has acted unlawfully on several matters, including the latest use of extraordinary powers outside the constraints of the EA and of the Charter and of the Constitution.

In fact, the leader of CSIS acknowledged that the public service did not find a national security threat to Canada under the criteria of the CSIS Act nor under the higher standard of the EA. Yet that Director of CSIS, a member of the public service, reportedly advised that the EA be invoked anyway. This contradiction points directly to a political decision made outside of the controlling laws of the land.

The role of the executive is not to replace the rule of law with the rule of the individual who currently serves in the PM Office. For such a thing to replace the rule of law, then, the parliamentary form of governance would be distorted,

When people sometimes talk of the supremacy of Parliament, they mean representation of all Canadians, not a system of arbitrary political rule by the chair of the executive branch of government. As noted earlier, parliament has within itself the power to remove that individual from that position - parliament as well as Cabinet can replace the PM lawfully and through political representation of Canadians.

Trudeau also cited funding from foreign sources; well, he also pointed to economic interests that hold great sway over his own political interests and he specifically cited foreign interests in international trade.

Further, he and his advisers testified to the political influence of foreign governments such as Governors in the USA and the Us Presidents, to mention but a few.

If these political criteria are to be put on the table by Trudeau, then, these criteria can also be used to assess the threat that he has presented to Canada's national security interests.

It is only a very short distance to take the Party is the Country attitude to the form of national socialism and fascism that has overtaken other forms of representative governance in other countries in times past.

State-sanctioned medical authorities responded by warning physicians that if they “put the public at risk with misinformation,” they may face investigations and regulatory action. Now, just 18 months later, these threats from medical authorities have evolved into a sweeping piece of legislation that includes two-year jail sentences for doctors who are deemed to be spreading certain types of “false or misleading information.”

The new legislation, Bill 36 — Health Professions and Occupations Act (HPOA), was approved by the legislature last Thursday and immediately received Royal Assent. A Cabinet order will determine when it comes into force.

According to the Justice Centre for Constitutional Freedoms, a non-partisan, non-profit organization that defends the freedoms of Canadians, the bill will permit BC’s Health Minister to appoint College Boards who have the power to enforce many of the bill’s provisions.
