Judge rules Pennsylvania county does not have to provide in-person monitoring of ballot boxes

Says boxes are "secure" and with video oversight.

A Pennsylvania judge this week ruled that a major state county does not have to provide in-person monitoring of ballot boxes there, declaring that the boxes are secure and that electronic oversight of the locations is sufficient.

Judge Thomas Capehart in his Tuesday night ruling turned down all four requests made by the plaintiffs, four Lehigh County voters, specifically that the county "provide in-person monitoring" of its ballot boxes, that the county locate its boxes "in buildings," and that the boxes only be available for deposits during certain hours of the day.

Capehart argued in the decision that all the county's drop boxes "are secure, are video monitored, and are located inside a building” except for one.

The demands from the petitioners, Capehart argued, were “likely to create confusion and uncertainty around the election” with just a few weeks to go before the midterms.The confusion, the judge claimed, would serve to “further erod[e] the public’s confidence in our election process.”

The court, Capehart said, “will not second guess the wisdom or efficacy of [the Lehigh County Board of Elections].”

Pennsylvanians next month will elect members to both the U.S. House and Senate as well as multiple state-level offices including a new governor.

A voter registration error may have caused some Arizona voters to get a mail ballot with only federal races, Secretary of State Katie Hobbs said Tuesday.

A problem with the link between voter registration and driver’s license databases may have caused as many as 6,000 voters to be improperly flagged as lacking proof of citizenship documentation on file. Election officials are sifting through the list to determine how many of the 6,000 were improperly flagged.

Approximately 1,000 of them received a mail ballot without local races, but it’s too soon to know how many of those should have received a full ballot, state Elections Director Kori Lorick said Wednesday. The others did not request a mail ballot but could vote in person.

Hobbs has staked her campaign for governor largely on her staunch defense of the 2020 election in the face of criticism from former President Donald Trump and his allies. Her Republican rival, former television news anchor Kari Lake, has spread Trump’s unsupported claims of fraud two years ago and has called on Hobbs to step aside from overseeing the midterms while she’s on the ballot.

When people register to vote in Arizona or update their registration, an election system queries Motor Vehicle Division records to verify whether the person has proven their citizenship. Those who don’t have citizenship documentation on file are not eligible to vote in state elections and are registered as “federal only” voters.

Lorick said the driver’s license query failed to properly verify the citizenship for some people, leading them to be improperly registered as federal only voters.

Federal only voters have been a subject of political wrangling since the U.S. Supreme Court ruled in 2013 that Arizona cannot require documentary proof of citizenship for people to vote in national elections. The state responded by creating two classes of voters — those who can vote in all races and those who can vote only in federal elections.

Hobbs said in her statement that the problem affected less than a quarter of 1 percent of voters. She said the database problem has been corrected.

Anyone who got the wrong ballot will be contacted and given the correct ballot, Lorick said. If they vote the truncated ballot, it will be sequestered and the voter will get a chance to cast a full ballot before polls close on Election Day.

Bellevue Independent Schools has announced the remainder of the high school football for Bellevue High School has been canceled.

Hans Niemann's king 'decapitated' in bizarre incident at the US Championship

Controversial American chess player Hans Niemann is again in the spotlight after a bizarre incident during the US Championship.

Sam Sevian picked up Hans Niemann's king and appeared to break the top off the piece

Niemann later explained that Sevian saw the top of piece was loose and wanted to fix it

Niemann has been accused of cheating more than 100 times in various chess matches

Niemann was deep in thought during the endgame of his 12th-round match against fellow grandmaster Sam Sevian, when his opponent suddenly reached across the board and grabbed Niemann's king, pulling the cross from the top of the piece.

"The disrespect just reached its peak," tweeted the tournament leader and former world championship contender Fabiano Caruana.

"Sam decapitated Hans's king."

A visibly-confused Niemann gesticulated his annoyance, before Sevian put the piece back on the wrong square.

The match was then paused as an arbiter was called to resolve the matter.

Touching an opponent's piece in chess without capturing it is highly unusual, but Niemann later said the incident wasn't as dramatic as it first seemed.

"It was just a misunderstanding, nothing too serious," Niemann said.

"We had a cordial conversation afterwards, so there are no hard feelings there."

Niemann said Sevian had noticed the top of the black king was becoming loose and he wanted to fix it.

Report: Trump Deposed in Defamation Case Filed by Rape Accuser E. Jean Carroll

Former President Donald Trump answered questions under oath in a defamation lawsuit filed by a writer who says he raped her in the mid-1990s.

The deposition gave Carroll's lawyers a chance to interrogate Trump about the assault allegations, as well as statements he made in 2019 when she told her story publicly for the first time.

Details on how the deposition went weren't immediately disclosed.

“We’re pleased that on behalf of our client, E. Jean Carroll, we were able to take Donald Trump’s deposition today. We are not able to comment further," the law firm representing her, Kaplan Hecker & Fink, said in a statement.

Trump has said Carroll's rape allegation is “a hoax and a lie.”

His legal team worked for years to delay his deposition in the lawsuit, which was filed when the Republican was still president. A federal judge last week rejected Trump’s request for another delay, saying he couldn't “run the clock out on plaintiff’s attempt to gain a remedy for what allegedly was a serious wrong.”

Alina Habba, an attorney representing Trump, said Wednesday, “My client was pleased to set the record straight today. This case is nothing more than a political ploy like many others in the long list of witch hunts against Donald Trump.”

Carroll was to have been questioned by Trump's lawyers last Friday. Neither her attorneys nor Trump's have responded to questions about how that deposition went.

The lawyers also haven't disclosed whether Trump's deposition was done in person or remotely, over video. Trump was in Florida on Wednesday. The lawsuit is being handled in a court in New York City.

Anything Trump said during his deposition could potentially be used as evidence in an upcoming civil trial. He hasn't faced any criminal charges related to Carroll's allegations, and any prosecution is unlikely. The deadline for criminal charges over alleged sexual assaults that occurred in the 1990s has long expired.

Similar legal deadlines also applied to civil lawsuits claiming sexual assault. As a result, Carroll chose to sue Trump for defamation over comments he made in 2019 when he denied any wrongdoing. She maintains that her reputation was damaged by his denials and attacks on her credibility and character.

However, New York lawmakers recently gave people a one-year window to take old sexual assault claims to civil courts. Carroll's lawyer has told the court she intends to file such a suit against Trump after that window opens in late November.

According to Carroll's account, she bumped into Trump as the two were shopping at the Bergdorf Goodman store across Fifth Avenue from Trump Tower. At the time, Carroll was on television as the host of an advice program, “Ask E. Jean.”

She said the two engaged in friendly banter as she tried to help him pick out a gift. But when they were briefly alone in a dressing room, she said he pulled down her tights and raped her.

In a recent statement, Trump called that story “a complete con job.”

“I don’t know this woman, have no idea who she is, other than it seems she got a picture of me many years ago, with her husband, shaking my hand on a reception line at a celebrity charity event,” Trump said.

Ohio Supreme Court Suspends Democrat Judge Due to “Unprecedented” Behavior – Removes Her From Cleveland Municipal Court Bench and Temporarily Strips Law License

Judge Pinkey S. Carr, a Democrat who has served on the Cleveland Municipal Court bench for almost a decade, was removed from her position on Tuesday after the Ohio Supreme Court found that she had committed more than 100 acts of misconduct, Cleveland reported.

Pinkey Carr was removed from the bench and had her law license suspended for committing “unprecedented” levels of misconduct, according to the justices.

The misconduct includes falsifying court documents, disrespectful treatment, lies, and wearing inappropriate clothes in court, such as “spandex shorts” and tank tops, sending someone to jail for rolling their eyes, and demonstrating her “abuse” of power.

The justices voted 5-2 to indefinitely suspend Carr’s law license and to immediately “cease and desist” practicing law.

She will also be suspended from judicial office without pay.

“Carr’s unprecedented misconduct involved more than 100 stipulated incidents that occurred over a period of approximately two years and encompassed repeated acts of dishonesty; the blatant and systematic disregard of due process, the law, court orders, and local rules; the disrespectful treatment of court staff and litigants; and the abuse of capias warrants and the court’s contempt power,” the Supreme Court opinion said. “That misconduct warrants an indefinite suspension from the practice of law.”

Carr stated that her unethical behavior was the result of menopause and sleep apnea caused by a generalized anxiety illness.

According to the court’s opinion, Carr has been indefinitely suspended from practicing law in Ohio and suspended from judicial office without pay while she is suspended. In order to vacate the suspension and be reinstated, the court said Carr will be required to submit a report from a qualified healthcare professional stating that she is “able to return to the competent, ethical and professional practice of law.”

An indefinite suspension isn’t as severe as it sounds. Carr is able to reapply for her law license in two years if she proves to the supreme court she has dealt with her issues. Koblentz said he assumes she will be reapplying.

In December 2021, the Board of Professional Conduct filed a report detailing a slew of misconduct allegations that it said occurred between 2017 and 2020.

The 58-page report detailed the multiple instances of Carr’s misconduct and put everything into five categories:

Arizona has been mired in claims of voter fraud since the 2020 presidential election.

Arizona Attorney General Mark Brnovich announced on Wednesday that the state had indicted two individuals for their alleged involvement in a Yuma County ballot harvesting scheme.

Gloria Lopez Torres of San Luis, and Nadia Guadalupe Lizarraga-Mayorquin of San Luis, also known as Nadia Buchanan, face charges of conspiracy and ballot abuse, according to a Brnovich press release.

The effort consisted of gathering early ballots from other voters and placing them into a ballot box on Aug. 4, 2020, the day the City of San Luis held municipal elections.

Torres allegedly collected seven ballots from Lizarraga-Mayorquin while she in turn allegedly collected at least one from another person. The state only permits family members, household members or caregivers "to collect voted or unvoted early ballots from another person," the press release noted.

Arizona has been mired in claims of voter fraud since the 2020 presidential election during which former President Donald Trump narrowly lost the state to President Joe Biden. This case, however, slightly predates that contest.
