1,088 Chinese investors paid €1 million each to the Irish Government and were given a residency visa for them and their families.

A Government "cash for visas" scheme has distributed €179 million to investment funds since it was established in 2012. About a quarter of that figure has been given to mixed investments, bonds and real estate investment trusts (REITs). Last week new legislation was introduced to limit the ability of REITs to bulk-buy new housing developments amid public outcry that the funds were pushing first-time buyers out of the market.

The Immigrant Investor Programme (IIP) offers residency visas of an initial five years to foreign investors and their families in exchange for a donation of no less than €1 million.

The money is then distributed to projects that are "beneficial for Ireland, generate or sustain employment and are generally in the public interest", according to the Department of Justice.

The programme, launched in 2012 as a revenue-raising measure following the recession, has raised €862.5m from more than 1,000 investors since then, figures released to the PA news agency show. Of that, 21% or €179m has been given to investment funds.

A breakdown provided by the Department of Justice, which oversees the programmes, said about 15% of total funding has been given to investment funds, with 5% going to mixed investments, bonds and REITs.

Social housing projects

The figures show that the largest share of funding, €272m or 32%, was given to social housing projects. Investment funds took the second-biggest slice, with €179m, or 21% of total revenue raised under the scheme. Nursing homes received €169m, or 21%, the hospitality and tourism sector took €108.4m, or 12%, while €38.9m, or 5% went to other property and housing developments, €35.5m, or 4%, to healthcare, €24m, or 3%, to education and €35.9m, or 4% to projects described as "other".

The Department of Justice declined to release information on specific organisations which have benefited from the programme on the grounds that it was commercially sensitive. On the distribution of money to investment funds, a department spokesman said: "The monies invested by the fund on behalf of IIP applicants must be invested in a manner consistent with the programme objectives, with investment in nursing homes, social housing and hospitality projects also featuring within the funds category.

"All funds must be invested in Ireland and must represent equity stakes in Irish registered companies that are not quoted on any stock exchange.

"In addition, the funds and fund managers must be regulated by the Central Bank of Ireland to conduct business in Ireland."

Since its establishment, the IIP has approved applications from 1,088 Chinese investors, 21 from the US, seven from Vietnam, four from Saudi Arabia and 42 from "the rest of the world", the department said. Its website says it is "enhancing the due diligences processes" around the programme, in areas including money laundering and politically exposed persons (PEPs).

Two Postal Service Employees Plead Guilty to Using EDD Debit Cards to Illegally Purchase Thousands of Dollars in Postal Money Orders

LOS ANGELES – Two United States Postal Service (USPS) employees pleaded guilty today to federal criminal charges accusing them of unlawfully buying and cashing tens of thousands of dollars’ worth of Postal money orders with unemployment benefits fraudulently obtained with false claims of COVID-related job losses.

Christian Jeremyah James, 31, of South Los Angeles, who worked in the Culver City Main Post Office, and Armand Caleb Legardy, 32, of Inglewood, who worked in the La Tijera Post Office on Crenshaw Boulevard in South Los Angeles, each pleaded guilty in separate hearings to one count of use of unauthorized access devices.

According to their plea agreements, from August 2020 to February 2021, James and Legardy used debit cards that the California Employment Development Department (EDD) had issued to other people for unemployment insurance benefits – cards that were obtained by other unidentified individuals using stolen identities and false information.

James and Legardy admitted they used the EDD-issued debit cards in other people’s names to purchase or cash money orders from the USPS and to withdraw thousands of dollars in cash from bank ATMs. The defendants also admitted that they deposited multiple fraudulently purchased Postal money orders directly into their own bank accounts.

Between September 3 and September 19, 2020, James deposited more than $27,000 worth of USPS money orders into his bank account, according to his plea agreement. Legardy deposited more than $10,000 in USPS money orders that had been illegally purchased with California EDD cards in other people’s names, his plea agreement states.

James admitted to knowingly using at least eight EDD debit cards in other people’s names and causing a loss of approximately $142,652. Legardy admitted to illegally using nine EDD cards and causing a loss of approximately $160,879.

United States District Judge George H. Wu has scheduled sentencing hearings of October 7 for James and September 30 for Legardy, at which time each defendant will face a statutory maximum sentence of 10 years in federal prison.

The United States Postal Service Office of Inspector General, the United States Department of Labor Office of Inspector General, IRS Criminal Investigation, and the California Employment Development Department investigated this matter.

Assistant United States Attorney Charles E. Pell of the Santa Ana Branch Office is prosecuting these cases.

Massachusetts Man Pleads Guilty To Attempting To Steal Trade Secrets From Nevada Defense Company

RENO, Nev. – A Massachusetts man pleaded guilty today to attempting to steal trade secrets belonging to his employer, a Nevada-based defense contractor.

According to court documents and admissions made in court, Peter James Cariani, 58, of Boston, was employed as a systems engineer by Sierra Nevada Corporation (SNC). On April 7, 2015, without authority to do so, Cariani downloaded tens of thousands of electronic files from SNC’s computer network. The files contained trade secret information related to SNC’s Radar Enhanced Vision System: a unique onboard aircraft radar sensing system that displays digital images of the ground for pilots flying in zero-visibility conditions. Cariani transferred the files to a personal external hard drive, and later transmitted information derived from the files to others for potential economic benefit. When entering his guilty plea, Cariani admitted that he knowingly downloaded trade secret information from SNC’s network and he knew his actions would harm SNC. An investigation was initiated by the FBI’s Reno branch after SNC detected (and reported) that an unauthorized electronic device had been used to download files from its computer network.

“Theft of trade secret information is a federal crime and economically destructive, depriving companies of the fruits of their creativity,” said Acting U.S. Attorney Christopher Chiou for the District of Nevada. “Our office will continue to work closely with the FBI and Nevada businesses to hold accountable anyone trying to steal trade secret information from the innovative companies in our district, and to protect their sensitive business and technical information.”

“This case reminds all of our business partners of the need to be vigilant to prevent the insider threat from robbing them of their success,” said Special Agent in Charge Aaron C. Rouse for the FBI. “The FBI stands ready to protect businesses from those who would profit from stealing trade secrets as this case clearly shows.”

Cariani pleaded guilty to one count of attempted theft of trade secrets. U.S. District Judge Larry R. Hicks scheduled a sentencing hearing for August 31, 2021.

Cariani faces a statutory maximum penalty of 10 years in prison and $250,000 fine.

This case was investigated by the Reno Resident Agency of the Las Vegas Division of the FBI with assistance from the FBI's Boston Field Office. Assistant U.S. Attorneys Steven Myhre and Randolph St. Clair are prosecuting the case.

A private sector entity that is a victim of a cyber incident can receive assistance from government agencies, which are prepared to investigate the incident, mitigate its consequences, and help prevent future incidents. Federal Government agencies work together to leverage their collective response expertise, apply their knowledge of cyber threats, preserve key evidence, and use their combined authorities and capabilities to minimize asset vulnerability and bring malicious actors to justice. Former NGO Procurement Official Sentenced to Prison for Bribery

A former non-governmental organization (NGO) official was sentenced today to 40 months in prison for paying bribes to NGO officers in exchange for sensitive procurement information related to NGO contracts funded in part by the U.S. Agency for International Development (USAID).

According to court documents, from January 2011 through December 2016, Ernest Halilov, 43, a citizen of Turkmenistan, coordinated a bid-rigging scheme to bid on contracts procured by NGOs and funded by USAID, to support the agency’s response to various humanitarian crises. These contracts were for the procurement of food and supplies that would ultimately be provided to those affected by various humanitarian crises, including refugees displaced by the conflict in Syria. Specifically, Halilov bribed two NGO officers in order to obtain confidential procurement information, such as bid evaluation information, specifications and internal vendor rankings. In turn, Halilov would provide this information to his preferred companies in exchange for kickbacks, ensuring that the companies had an advantage over other bidders, thus increasing their ability to win NGO-procured contracts. Halilov also admitted that he instructed a witness to lie to law enforcement agents and destroy emails related to the investigation.

Acting Assistant Attorney General Nicholas L. McQuaid of the Justice Department’s Criminal Division; Acting U.S. Attorney Channing D. Phillips for the District of Columbia; and Acting Inspector General Thomas J. Ullom for the USAID Office of Inspector General (OIG) made the announcement.

USAID-OIG investigated the case.

Trial Attorney Laura Connelly of the Criminal Division’s Fraud Section and former Special Assistant U.S. Attorney Scotland Morris of the U.S. Attorney’s Office for the District of Columbia prosecuted the case.

The Justice Department’s Office of International Affairs provided critical investigative assistance in securing Halilov’s extradition from Ukraine. The Department of Justice also appreciates the significant cooperation and assistance provided by authorities in the Ukraine.

Egyptian court has allowed Suez Canal to keep holding Ever Given, says lawyer

An Egyptian court on Sunday rejected a complaint by the Japanese owner of a container ship that blocked traffic in the Suez Canal for six days in March against the vessel’s continued detention by canal authorities, a lawyer said.

The Ever Given, one of the world’s largest container ships, became jammed across the canal in high winds on March 23, halting traffic in both directions and disrupting global trade.

The complaint was attached to a case at the economic appeals court in Ismailia in which the Suez Canal Authority is seeking US$916 million in compensation from the Ever Given’s owner Shoei Kisen over the blockage and the operation to free the ship.

The court on Sunday referred the case back to a court of first instance, which is due to consider it on May 29, said Ahmed Abu Ali, one of the lawyers representing the owner.

Any ruling made by the lower court could trigger appeals by either side, said another lawyer on the case, Ahmed Abu Shanab, indicating that legal wrangling could drag on.

In a statement following Sunday’s ruling the SCA said it bore no responsibility for the Ever Given’s grounding, reasserting that responsibility lay with the ship’s captain alone, and rebutting arguments made a day before by Shoei Kisen’s legal team.

It also defended its $916 million claim, citing the costs of freeing the ship and a salvage bonus stipulated in maritime law, material and reputational damage, and the diversion of some shipping away from the canal.

One boat sank during the operation to free the ship, resulting in the death of a worker, the SCA said.

It was a dry basin until 1869, when the Mediterranean and Red Sea were finally linked. Today its salinity is twice as high as the seas, owing to its salt deposit bed. Almost nothing can live in it.

The main feature of the Great Bitter Lake is its width, which means ships can pass each other, unlike in the narrow confines of the canal itself.

In this lifeless aquatic layby, the giant Ever Given container ship and its 20-plus crew have languished since March 29. The 200,000-tonne vessel was freed after it spent six days wedged in the Suez Canal’s banks but is now imprisoned by a legal battle.

The Ever Given, which is operated by Taiwanese shipping line Evergreen but owned by Japanese company Shoei Kisen and Panama-flagged, is at the centre of a tussle between the Egyptian authorities and its international owner and operators.

After it was freed, the Ever Given moored in the Great Bitter Lake, where the vessel was arrested on April 14. The Suez Canal Authority (SCA), which operates the waterway, hit it with a $916m claim. The total was split almost equally there ways between salvage costs, a “salvage bonus” and a payment for “loss of reputation”.

The seizure came on the orders of a court in Ismailia - the city where the SCA is based - as the authority sought to cover costs for the salvage, damage to the canal and losses in transit fees for ships using the canal.

According to the SCA, which charges ships $100,000-plus to use the canal - it took a $15m hit per day during the closure, with 400 ships being held up and many others choosing to avoid the chaos and take the longer trip around Africa.

Ever Given’s owners and insurers are now fighting to get the claim cut to what they see as a reasonable level and free the $170m ship. Clients with cargo on board - which is estimated to be anything from $500m to $1bn - are also preparing to weigh in, as goods which should have arrived in Europe more than a month ago gather dust on board.

At the weekend, an Ismailia court heard claims from Shoei Kisen’s lawyers that a vessel as large as Ever Given should have been accompanied by two tugs because of the windy conditions.

Recordings from the ship presented to the court hint at disagreements between SCA pilots and its control centre over whether it should enter the canal.

Ultimate responsibility for a vessel lies with its master, though, with the pilots not bearing that burden. It’s no wonder maritime message boards are full of tales of ships using the canal making sure they have plentiful supplies of booze and tobacco to ease their passage.

“It’s well known you need to have a locker well stocked with whisky and cartons of cigarettes when you enter the Suez,” says one shipping source.

The court decided that a legal technicality meant it could not advance the case and it should go back to the original chamber, creating more uncertainty, not least for the crew.

They can leave, along as they are replaced on a one for one basis, while the ship’s master has to stay with the vessel.

“Littoral nations have a pretty poor record in responding to maritime claims,” he says. “With the Ever Given there was no pollution or massive damage, but there was a certain amount of loss of face with the world sniggering at the size of the diggers Egypt produced.”

Maritime law entitles salvors to claim for saving a vessel and its cargo, but the amount can’t exceed their value, and that the salvage has to be voluntary.

Jai Sharma, partner at law firm Clyde & Co which represents the interests of insurers of those with more than $100m of cargo on board Ever Given, said this presents a strong argument.

“The owners might say that the SCA wasn’t a volunteer, it was obliged to act,” he says. “The SCA has a tariff setting out the rates for equipment and Ever Given’s owners should be charged according to that - a sum which would be a fraction of what they are asking.”

While the owners work out their next legal move, those responsible for cargo on board are thought to be considering their own challenge to try to get the vessel released and their hands on the goods.

Osama Rabie, chairman of the SCA, has repeatedly insisted that the SCA acted correctly, saying that the “maritime safety of the canal is not to be questioned, nor is it subject for controversy”.

However, he has shown willingness to negotiate the amount the authority wants, having knocked $300m off the total, and in a weekend interview on local TV saying he would take $550m, with a $200m deposit securing the ship’s release.

The most likely outcome is that the stances of all parties involved are negotiating tactics, says Sharma.

“The only constructive outcome will be where an amount is agreed upon that's agreeable to all parties,” he says. "The SCA is grossly overvaluing what anyone will pay to solve the problem.”

In the meantime the Ever Given’s crew have little to do but watch the waves on the Great Bitter Lake.
