Nonprofit paid for Whitmer's chartered flight out of state

Lansing — A nonprofit organization tied to Gov. Gretchen Whitmer's administration paid to charter the flight that carried her to visit her father, but Whitmer paid for a seat, her administration said Friday.

The revelations came in an unaddressed email memo signed by Whitmer's chief of staff, JoAnne Huls, weeks into a controversy on the out-of-state trip during a pandemic.

"Due to ongoing security and public health concerns, we made a decision to use a chartered flight for this trip," Huls wrote in the memo. "The governor's flight was not a gift, not paid for at taxpayer expense and was done in compliance with the law."

The social welfare nonprofit organization Michigan Transition 2019 chartered the private plane, which took Whitmer to Florida on Friday, March 12, and returned her to Lansing, on Monday, March 15. The group spent $27,521 on travel over the first 14 days of May, according to a voluntary disclosure, which apparently covers the March flights.

The same disclosure shows Whitmer paid the nonprofit a $855 total for her seat on the flights. Michigan Information & Research Service News (MIRS News) first reported the arrangement Friday.

The nonprofit organization was formed in November 2018 to help fund Whitmer's inauguration, according to state business records. In 2019, it reported to the state that it would be using an assumed name: Executive Office Account. It's unclear how a nonprofit that falls under strict federal rules prohibiting the use of funds for personal expenses qualified to fund the travel.

The governor has said she performed duties of her office, including participation in meetings, while caring for her father, but didn't specify what she did.

Federal tax law prohibits nonprofits from the practice of inurement, which is the use of nonprofit income or assets to excessively benefit an individual who has a close relationship with the tax-exempt organization, according to the Legal Information Institute at the Cornell Law School.

The account "defrays the cost of the governor’s travel when it’s consistent with the account’s purposes," Huls said. According to a 2019 tax filing, the group's mission is to promote "civic action and social welfare."

Whitmer has repeatedly said she took the flight to visit her father. She has said there "was an important family reason for doing it."

Tori Sachs, a Republican political consultant, called for Whitmer's use of the nonprofit organization to be investigated. She said there is no legal theory where reimbursing $800 for a $27,000 flight "solves anything."

Ted Goodman, spokesman for the Michigan Republican Party, said there was a reason Whitmer's office released the news on a Friday night.

"Tonight's revelations raise additional questions and concerns surrounding the financial arrangements of Gov. Whitmer's secret, unvaccinated trip to Florida on a private jet," Goodman said.

Breitbart News caught Whitmer changing her story this week from her original claim that she traveled “at her own expense.” Thursday, she would only say the trip was “not a gift” and was not “paid for at taxpayer expense.”

Friday, Whitmer’s chief of staff, Joanne Huls, told MIRS News the flight cost $27,521 and was paid for by a so-called “dark money” 501c4 nonprofit originally set up to fund Whitmer’s transition activities in 2019. Now called “Executive Office Account,” the fund paid Air Eagle, LLC for the excursion. It is not clear if that was the intent all along, or only after the secret trip became public.

The value was previously estimated to be as much as $40,000.

According to Huls, the governor reimbursed the nonprofit $855 — the value it determined was the price of her seat. Whitmer “paid for her seat on the flight with her own personal money,” Huls told MIRS....

Whitmer’s secret Florida trip came just days before she urged Michiganders not to travel to the very same state. After that demand, two of her top aides, Chief Operations Officer Tricia Foster and Department of Health and Human Services Director went to Florida and Alabama respectively for spring break.

The governor’s claim she was tending to her ill father was possibly undermined when he was spotted shopping and driving in Lansing weeks later.

Huls addressed that Friday to MIRS, claiming Richard Whitmer’s health “deteriorated” after the mid-March trip and his physicians asked him to return to Michigan “early.”

“Michiganders are tired of the growing stream of lies coming from Gov. Whitmer,” Republican Governors Association spokesman Chris Gustafson said in a statement....

Whitmer has still not addressed who else was on the plane during the two-hour ride to Palm Beach.

Bilateral meeting with Russia's Lavrov to pave way for Biden-Putin summit.

U.S. Secretary of State Antony Blinken will soon travel to Denmark, Iceland and Greenland on a trip that spans nearly all of next week and aims to signal the Biden administration's focus on the Arctic region.

Blinken will visit Copenhagen, Reykjavik and Kangerlussuaq from Sunday to Thursday, State Department spokesperson Ned Price said in a statement. In Reykjavik, Blinken will participate in the May 19-20 Arctic Council Ministerial and hold bilateral meetings, including with Russian Foreign Minister Sergey Lavrov. The Blinken-Lavrov meeting will pave the way for a summit between U.S. President Joe Biden and Russian President Vladimir Putin, expected to take place in a European city, perhaps Vienna, after the NATO leaders' summit in Brussels on June 14. Russia will assume the two-year chairmanship of the Arctic Council from this meeting.

The secretary will also travel outside the Icelandic capital to make a highly symbolic visit to Keflavik Air Base, a Cold War-era U.S. Navy station that was closed in 2006. The U.S. is currently refurbishing the facilities there to house the P-8 Poseidon aircraft as it seeks to strengthen anti-submarine surveillance against Russian, and potentially Chinese, subs operating in the waters. "I was surprised at the length of the trip," said Heather Conley, senior vice president for Europe, Eurasia and the Arctic at the Washington-based Center for Strategic and International Studies, in an interview. "It just reinforces the importance of the region," she said. But the most important part of the trip will not be the Arctic Council discussion but Blinken's bilateral meeting with Lavrov, Conley said. "The Biden administration is hoping that the Arctic and climate can be positive agenda items" in the U.S.-Russia relationship, she said. By sustaining U.S.-Russia relations in a "managed space," the administration can keep all the focus on China in the Indo-Pacific, she said. Meanwhile, while trying to stabilize bilateral relations with Moscow, the U.S. will have no illusions about Russia's military intent. "We must now conduct much more vigilant anti-submarine warfare in the North Atlantic, in the Greenland-Iceland-United Kingdom gap because of Russia's military activity," Conley said. This so-called GIUK gap is a key location for Russia's Northern Fleet to enter the Atlantic Ocean. The visit to Keflavik Air Base underscores this point.

Conley spoke of speculation that Moscow is developing a nuclear-armed underwater drone that could approach U.S. shores undetected and detonate, triggering a "nuclear tsunami" of tainted water. China's military use of the Arctic is unclear at this stage. But by 2050, its submarines and growing icebreaker fleet "will spend considerable time in the Arctic Ocean, requiring the United States to focus on Chinese anti-submarine warfare in both the GIUK gap and Bering Strait," CSIS predicted in a report last year. These activities by Beijing will likely force Washington to divert a portion of its assets from the Indo-Pacific to the Arctic, said the report, of which Conley was a principal author.

The last leg of Blinken's trip will see him visit Greenland, where the U.S. reopened a consulate last year after a nearly seven-decade hiatus. As president, Donald Trump famously expressed interest in purchasing Greenland from Denmark -- a proposal dismissed out of hand by the Danish government.

Meanwhile, there has been no shortage of American interest in the High North. Various branches of the U.S. military have issued seven Arctic strategies in the past two years alone, Conley noted.

SEC’s Gensler hunts for companies not ESG woke enough

Wall Street’s top cop Gary Gensler wants to charge companies who aren’t woke enough with securities fraud.

FOX Business has learned that the Securities and Exchange Commission is launching a series of inquiries into whether corporations make proper disclosures involving so-called Environment, Social, Governance issues, known by the short-hand ESG. The purpose of the crackdown, initiated at the behest of Gensler, who became SEC chairman last month, is to prod corporate America to adopt policies that improve diversity, and other non-financial issues such as environmental concerns, securities lawyers who represent potential targets tell FOX Business. These lawyers, who spoke on the condition of anonymity, said the SEC will also look at such issues as "conflict minerals," or whether companies import raw materials from countries that use the money to finance war and adequately disclose the matter in corporate reports.

Another area of concern includes whether companies disclose if so-called forced labor is used anywhere in their global supply chains, these lawyers add. The SEC will also be monitoring the racial diversity of corporate boards, and whether companies alert investors about fully meeting environmental standards, these lawyers say. Progressives in Congress have attempted such legislation in the past only to be thwarted by the GOP majority. Now with Democrats controlling both chambers of Congress and the White House, the enforcement of so-called ESG standards on companies will likely be revived.

But the move by Gensler is politically fraught. Known as an aggressive regulator during the Obama years as the chair of the Commodity Futures Trade Commission (CFTC), Gensler’s edict will likely receive blowback by the GOP senate, which regulates the SEC.

Traditional corporate disclosures have involved matters considered "material" to an investor, such as financial issues or the health of top executives. Senator Pat Toomey, R-Pa., voted against Gensler’s nomination stating that his support of ESG issues would "advance a liberal social and cultural agenda on issues ranging from climate change to racial inequality" that is outside the purview of the SEC.

Gensler, a former Goldman Sachs banker, is close to Sen. Elizabeth Warren, D-Mass.., a polarizing figure with Republicans and business leaders because of her support of progressive causes such as enforcing ESG standards on businesses.

Biden Revokes Six Trump-Era Executive Orders, Including Planned ‘Garden of American Heroes’

President Joe Biden on Friday revoked a series of executive orders issued by former President Donald Trump, including ones targeting social media companies’ moderation policies, protecting Americans from “overcriminalization” by regulations, and seeking to establish a historical monument called the “National Garden of American Heroes.”

Biden’s executive order rescinds six of his predecessor’s presidential actions, while directing the heads of executive departments and agencies to “promptly consider taking steps” to roll back any policies that were implemented by Trump’s orders.

Among Trump’s orders that are to be abolished under Biden’s action is the planned “National Garden of American Heroes,” a project that Trump sought to implement in the waning days of his presidency via a Jan. 18 directive that called on the monument to “be built to reflect the awesome splendor of our country’s timeless exceptionalism.”

“It will be a place where citizens, young and old, can renew their vision of greatness and take up the challenge that I gave every American in my first address to Congress, to ‘[b]elieve in yourselves, believe in your future, and believe, once more, in America,'” Trump wrote in his executive order, which also made mention of an “attack” on the “belief in the greatness and goodness of America” by a “dangerous anti-American extremism that seeks to dismantle our country’s history, institutions, and very identity.”

A major theme underpinning Trump’s order was the spate of incidents last year involving the destruction of monuments.

“The heroes of 1776 have been desecrated, with statues of George Washington, Thomas Jefferson, and Benjamin Franklin vandalized and toppled,” Trump wrote in the order, adding, “the brave warriors who saved freedom from Nazi fascism have been disgraced with a memorial to World War II veterans defaced with the hammer and sickle of Soviet communism.”

'Detroit Will Breathe' protester blinded flight crew, feds say

Detroit — Federal prosecutors Friday charged a "street medic" who participated in "Detroit Will Breathe” protests last year with shining a laser at a Detroit Police helicopter that temporarily blinded the crew.

Michael Sam Hurd, 32, of Fennville was charged with a felony punishable by up to five years in federal prison in one of the more serious charges to flow from protests in Detroit.

Detroit Police and an FBI Violent Crime Task Force teamed up to analyze a potentially catastrophic moment during an Aug. 23 protest, assembling grainy video and surveillance footage from the air, ground, an officer's body camera and a city bus to identify Hurd as the protester who blinded the flight crew, according to a federal criminal complaint unsealed Friday.

The criminal case illustrates the pervasive use of private surveillance cameras downtown and cooperation between law enforcement and billionaire Dan Gilbert's security network that has installed hundreds of cameras throughout downtown.

A handcuffed, shackled Hurd made a brief appearance Friday in federal court before being released on $10,000 unsecured bond.

Space Force CO Who Got Holiday Call from Trump Fired Over Comments Decrying Marxism in the Military

A commander of a U.S. Space Force unit tasked with detecting ballistic missile launches has been fired for comments made during a podcast promoting his new book, which claims Marxist ideologies are becoming prevalent in the United States military.

Lt Col. Matthew Lohmeier, commander of 11th Space Warning Squadron at Buckley Air Force Base, Colorado, was relieved from his post Friday by Lt. Gen. Stephen Whiting, the head of Space Operations Command, over a loss of confidence in his ability to lead, Military.com has exclusively learned.

"This decision was based on public comments made by Lt. Col. Lohmeier in a recent podcast," a Space Force spokesperson said in an email. "Lt. Gen. Whiting has initiated a Command Directed Investigation on whether these comments constituted prohibited partisan political activity."

Lohmeier's temporary assignment in the wake of his removal was not immediately clear.

Earlier this month, Lohmeier, a former instructor and fighter pilot who transferred into the Space Force, self-published a book titled "Irresistible Revolution: Marxism's Goal of Conquest & the Unmaking of the American Military."

"Irresistible Revolution is a timely and bold contribution from an active-duty Space Force lieutenant colonel who sees the impact of a neo-Marxist agenda at the ground level within our armed forces," a description of the book reads.

Lohmeier sat down last week with L. Todd Wood of the podcast "Information Operation," hosted by Creative Destruction, or CD, Media, to promote the book. He spoke about U.S. institutions, including universities, media and federal agencies including the military, that he said are increasingly adopting leftist practices. These practices such as diversity and inclusion training are the systemic cause for the divisive climate across America today, he said.

From his perspective as a commander, Lohmeier said he didn't seek to criticize any particular senior leader or publicly identify troops within the book. Rather, he said, he focused on the policies service members now have to adhere to to align with certain agendas "that are now affecting our culture."

Regarding Defense Secretary Lloyd Austin, he said, "I don't demonize the man, but I want to make it clear to both him and every service member this [diversity and inclusion] agenda, it will divide us, it will not unify us."

Austin on Feb. 5 ordered all military services to observe one-day stand-down on extremism in the ranks. As part of his stand-down, Lohmeier said, he was given a booklet that cited the Jan. 6 riot at the Capitol as an example of extremism, but did not mention the civil disobedience and destruction of property that took place following the death of George Flloyd, a Black man, at the hands of a white police officer in Minneapolis last May.

He also took issue with "the Pentagon spokesperson," seeming to allude to Press Secretary John Kirby. Lohmeier claimed Kirby said "there are too many white pilots," amid an ever-increasing pilot shortage.

"If you want to provide that kind of messaging to your already struggling pilot force, you can already expect to see further retention problems," he said.
