At least 912 killed in quake – Erdogan

The tremor has left 5,385 injured and is the most powerful in decades, the Turkish president has said

A powerful earthquake that hit Türkiye on Monday morning has killed more than 900 people, leaving more than 5,000 wounded, the nation’s President Recep Tayyip Erdogan has said.

Speaking in the aftermath of the tragedy, Erdogan said that the 7.7 magnitude earthquake that wreaked havoc in the central part of the country had claimed the lives of 912 people, with 5,385 injured. “2,470 people were rescued from the rubble, and 2,818 buildings were destroyed,” he stated.

The president noted that local authorities “had mobilized all their means,” adding that the response efforts involve not only the ten provinces hit by the disaster, but also ten other regional governors.

He said that priority had been given to search and rescue efforts aimed at freeing those who are still stuck under the rubble. In total, 9,000 personnel are involved, with this number constantly increasing, Erdogan said.

He went on to describe the tragedy as “the biggest disaster since the 1939 Erzincan earthquake” in eastern Türkiye which killed an estimated 32,000 people and injured 100,000.

The calamity has also hit neighboring Syria, with the nation’s health ministry saying that the death toll has reached 326 people across several provinces, with 1,042 injured.

Germany met with ‘silence’ over tanks for Ukraine – politician

The Bundeswehr’s weapon supplies are scarce, the Social Democratic Party leader has said

Germany’s European allies have been suspiciously “quiet” after it promised to send Western-made tanks to Ukraine, the leader of the Social Democratic Party of Germany (SPD), Kevin Kühnert, said on Sunday.Berlin is struggling to find Leopard 2s for Kievto use in the conflict with Russia, according to the politician.

“Over the last couple of weeks, there has been an impression that everyone wants to supply [Western-made tanks to Ukraine] and that Germany was the only one not doing so,”Kühnert said in a ZDF interview. “Now we see that Germany made specific obligations to deliver a tank company. And suddenly it got very silent around us.”

The SPD leader also noted Berlin’s low supplies of the Leopards and ammunition for them, explaining that there is not a “big warehouse” where all the tanks are ready and waiting to be ordered. “The supplies are scarce,” Kühnert told ZDF.

Chancellor Olaf Scholz confirmed the shipment of 14 Leopard 2 tanks to Kiev in late January. In addition to this, the government gave permission for other operators of the German-made tank to transfer their stocks.

US President Joe Biden confirmed on the same day that America would send 31 of its M1 Abrams tanks. However, as was the case with Germany, no timeline was provided for the shipments. Pentagon spokeswoman Sabrina Singh said last week that Washington simply “doesn’t have these tanks available in excess”in their stocks.

Greek Prime Minister Kyriakos Mitsotakis told Nikkei Asia last week that Athens cannot spare their Leopard 2 tanks, as they are “absolutely necessary for our defense posture.”

Kremlin spokesman Dmitry Peskov has commented on the Western tank shipments for Ukraine numerous times, saying in late January that they will “burn” like every other weapon in the conflict zone. Peskov said at a press briefing last week that the more weapons the West sends, the more Russia will utilize its military potential to counter them.

Swiss firms planning return to Russia

The initial exodus was prompted by Western sanctions pressure, according to Credit Suisse

About 6% of large Swiss companies that have left Russia amid Ukraine-related Western sanctions plan to return in the next three years, according to a survey released by the Credit Suisse Research Institute.

The report indicated that around 4% of micro-enterprises, 3% of small- and 8% of medium-sized enterprises (SMEs), and nearly one in four large Swiss companies ceased business ties with Russia in 2022.

The confrontation between the West and Russia has ended the era of multilateral trade, at least for the time being, Credit Suisse wrote, noting that geopolitical tensions have posed challenges for Swiss firms.

Companies are affected not only by sanctions but also by customs duties and other non-tariff barriers such as government procurement regulations and approval procedures, it said.

“Unsurprisingly, the list of countries from which Swiss companies have withdrawn in the last three years is headed by Russia… Even so, a few of the big companies in particular are already planning to begin or resume business activities in Russia,” the report stated, adding that “whether and when these plans will actually be implemented will depend on the further course of the Ukraine war.”

The report also highlighted that foreign companies working with Swiss firms have generally opposed the adoption of anti-Russian sanctions by Switzerland. According to the survey, around 40% of the polled companies felt negative reactions from their business partners because of their support for the international sanctions against Moscow.

“The results of the survey illustrate the importance of maintaining neutrality for Swiss companies. More than three-quarters of the firms surveyed believe that maintaining Swiss neutrality is in the interest of their own company,” wrote Credit Suisse.

The survey involved 650 Swiss companies, including 600 SMEs and 50 large companies. It is based on responses from executives whose companies do business with foreign countries.

The Maidan sniper killings were pivotal for the 2014 Kiev coup – why is research into the massacre being censored in the West?==1 of 2

Evidence that external forces were involved has been suppressed for ‘political reasons’

Political scientist Ivan Katchanovski – of the University of Ottawa – has revealed that a paper he produced outlining evidence that the February 2014 massacre of Ukrainian protesters by sniper fire, a defining moment of the Western-backed Maidan coup, was not published by an academic journal for “political reasons.”

‘The evidence is solid’

In a lengthy Twitter thread posted on January 6, Katchanovski first laid out the circumstances behind the rejection of his article, and the bombshell evidence included in it. The paper was initially accepted with minor revisions after peer review, and the journal's editor offered a glowing appraisal of his work, writing:

“There is no doubt that this paper is exceptional in many ways. It offers evidence against the mainstream narrative of the regime change in Ukraine in 2014… It seems to me that the evidence the study produces in favour of its interpretation on who was behind the massacre of the protesters and the police during the ‘Euromaidan’ mass protests on February 18-20, 2014, in Ukraine, is solid. On this there is also consensus among the two reviewers.”

As the editor noted, the massacre was a “politically crucial development,” which led to the “transition of powers in the country” from the freely elected Viktor Yanukovich to the illegitimate and rabidly nationalistic administration of Aleksandr Turchinov, a former security services chief. It was endlessly cited in Western media as a symbol of the brutality of Ukraine’s government and an unprovoked attack on innocent pro-WesternMaidan protesters, who allegedly sought nothing more than democracy and freedom.

Rumors that the killings were a false flag intended to inflame tensions among the vast crowds filling Maidan, and provoke violence against the authorities, began circulating immediately.

No serious investigation into what happened was ever conducted by the Western media, with all claims that the sniper attacks were an inside job dismissed as Kremlin “disinformation.” However, even NATO’s Atlantic Council adjunct admitted in 2020 that the massacre was unsolved and that this “cast a shadow over Ukraine.”

Ask the witnesses

It may not remain unsolved for much longer though, due to an ongoing trial of policemen at the scene on the fateful day. The legal action has been unfolding for well over a year and has received no mainstream news attention at all outside Ukraine. Katchanovski drew heavily on witness testimony and video evidence that has emerged over the course of the trial in his suppressed paper.

For example, 51 protesters wounded during the incident testified at the trial that they were shot by snipers from Maidan-controlled buildings, and/or witnessed snipers there. Many spoke of snipers in buildings controlled by Maidan protesters shooting at police. This is consistent with other evidence collected by Katchanovski, such as 14 separate videos of snipers in protester-controlled buildings, 10 of which clearly feature far-right gunmen in the Hotel Ukraina aiming at crowds below…

In all, 300 witnesses have told much the same story.Synchronized videos show that the specific time and direction of shots fired by the police not only didn’t coincide with the killingsof specific Maidan protesters, but that authorities aimed at walls, trees, lampposts, and even the ground, simply to disperse crowds.

Among those targeted by apparently Maidan-aligned snipers were journalists at Germany’s ARD. They weren’t the only Western news station in town at the time – so too were Belgian reporters, who not only filmed Maidan protesters screaming towards Hotel Ukraina for snipers not to shoot them, but also participants being actively lured to the killing zone. This incendiary footage was never broadcast.

CNN likewise filmed far-right elements firing at police from behind Maidan barricades, then hunting for positions to shoot from the 11th floor of the Hotel Ukraina, minutes before the BBC filmed snipers shooting protesters from a room where a far-right MP was staying. The network opted not to report this at the time.

We needn’t rely purely on video footage. Over the course of the trial, no fewer than 14 self-confessed members of Maidan sniper groups testified they had explicitly received massacre orders, Katchanovski claims. By contrast, no police officer at the scene has said they were directed to kill unarmed protesters, no minister has come forward to blow the whistle on such a scheme, and no evidence Yanukovich approved of the killings has ever emerged.

Separate from the trial, leaders of the far-right Svoboda party have openly stated that Western government representatives expressly told them before the massacre that they would start calling for Yanukovich’s ouster once casualties among protesters reached a certain number. This figure was even actively discussed by both sides – were five enough, or 20? Or even 100? The latter was the final total reported, and indeed led to calls for the Ukrainian government’s abdication.

Katchanovski previously published a landmark study on the Maidan massacre in 2021, which has been referenced over 100 times by scholars and experts, already making him one of most cited political scientists specializing in Ukraine, according to Google Scholar.

Whatever the nature and source of the political pressure applied to the journal that led to the censoring of the dynamite paper, the move may well backfire massively, in the spirit of the Streisand Effect. Indeed, it could help the truth of what happened on those deadly days come out, and assist in those responsible for the killings being brought to justice.

It should also prompt a wider reconsideration of the nature of Maidan too, and the government it produced. The banning of opposition parties, attacks on the Orthodox Church, the closure of dissident media outlets, and the war on Russian culture and language are all consequences.

==Quake ruptures gas pipeline in Türkiye (VIDEOS)

Key infrastructure was damaged and hundreds killed by the powerful tremor==

The powerful earthquake that struck southern Türkiye on Monday morning has damaged a natural gas pipeline in the region, state energy company BOTAS has confirmed. Videos circulating online show massive plumes of flame erupting into the air.

The 7.4-magnitude quake has killed scores of people and caused significant damage to civilian and municipal infrastructure, according to Turkish officials.

BOTAS said it has cut supply in the wake of the tremor, but the rupture in the Kilis province is being fed by the gas inside the pipeline.

Videos purportedly shot on the scene show massive plumes of fire rising high into the sky in at least two locations.

The quake hit at around 4am local time in central Türkiye. According to Turkish President Recep Tayyip Erdogan, 912 people were killed and 5,385 injured.

Microplastics found in human veins

Researchers discovered 15 particles of the contaminants per gram of vein tissue in the first study of its kind

Microplastics have been found for the first time in human vein tissue, a team of researchers from the University of Hull revealed last week. Five distinct types of microplastic were discovered in samples taken from the saphenous (leg) veins of patients undergoing heart bypass surgery.

“We were surprised to find them,” Professor Jeanette Rotchell said in a press release accompanying the paper’s publication in the journal PLoS One. “We already know microplastics are in blood…but it was not clear whether they could cross blood vessels into vascular tissue and this work would suggest they can do just that.”

The UK-based researchers found an average concentration of 15 particles of plastic per gram of vein tissue, similar to or higher than the levels found in lung and colon tissue, but observed that the shape and types of plastic found in the vascular tissue was markedly different from other tissue types.

“These first human tissue analyses suggest that the distribution of the microplastics’ predominant types may be tissue-specific,”Rotchell observed.

The most common types of plastic found in the samples include alkyd resin, which is found in synthetic paints and varnishes; polyvinyl acetate, anadhesive used in food packaging and shipping; nylon, and EVOH-EVA, used for food packaging and watertight lamination.

While Rotchell stressed that “we don’t yet know the implications of this on human health,” she acknowledged that microplastics had been shown to cause “inflammation and stress responses” in laboratory settings.

Co-author Professor Mahmoud Loubani added that the presence of the microplastics might contribute to the failure of coronary artery bypass surgery involving grafts from the saphenous veins, suggesting the contaminants “may well play a role in damaging the inside of the vein leading to it becoming blocked with the passage of time.”Removing the microplastics was a possibility, he said in the press release.

The team has previously discovered the ubiquitous pollutants in blood and lung tissue, as well as in surgical operating theaters. By some estimates, 15 tons of plastic waste enters Earth’s oceans every minute, breaking down into smaller particles and entering the body through the food chain and through the air people breathe.

Two airports closed in Turkey due to earthquake damage

Adana Airport in southeastern Turkey has decided to suspend operations due to the devastating earthquakes, reports the Turkish news agency DHA.

The airport has been closed until a new decision is made. The closure of the airport was preceded by two consecutive earthquakes of magnitude 7.7 in the morning and 7.5 in the afternoon. In Turkey, according to the latest data, the disaster killed more than 900 people. The earthquake also caused large casualties and destruction in Iraq and Syria, the tremors were also felt in Lebanon.

Earlier, Turkey's Hatay airport in the city of Antakya on the Mediterranean coast due to the destruction of the runway went out of service.

Government Reports & Pfizer Documents prove COVID Vaccination is causing Depopulation & we now have evidence it was the plan all along

https://expose-news.com/2023/02/05/depopulation-covid-vaccination-plan-all-along/

If we told you 20 million people had died across just the ‘FIve Eyes’ & 26 countries across Europe over the past two years resulting in the most excess deaths seen in half a decade wouldn’t you at least be a little bit curious to find out why?

You might be quick to blame Covid-19, but we can assure you this is not the case.

What if we then told you more excess deaths were actually recorded across the USA, the UK, Canada, Australia and New Zealand in 2021 & 2022 following several mass rollouts of the Covid-19 injections than were recorded at the height of the Covid-19 pandemic in 2020?

Would that not pique your interest to find out why?

Because we’re not just talking about a slight increase. We’re talking about increases of thousands of per cent in excess deaths.

For instance. official Government reports prove that Australia suffered a shocking 1,640% increase in excess deaths in just 39 weeks throughout 2022 compared to 53 weeks throughout 2020.

While New Zealand suffered a shocking 3,404% increase in excess deaths in 49 weeks throughout 2022 compared to 53 weeks throughout 2020.

Are you still not interested?

Well, what if we told you there now exists a mountain of evidence to prove that Covid-19 injections are to blame for this huge increase in deaths?

Surely now you’d want to know why?

What if we then revealed that sadly, that mountain of evidence also contains documents that prove Covid-19 vaccination is going to lead to mass depopulation?

This is of course an extremely bold claim to make.

‘Your Government is trying to kill you’ is even bolder.

But it’s the truth.

1,000+ killed, infrastructure and historic sites damaged: What is known about horrific quakes in Türkiye and Syria

Powerful tremors continue to hit both countries, compounding the death and devastation

On Monday morning, a powerful earthquake struck in southern Türkiye, causing significant destruction across the country and in neighboring Syria. Over a thousand people were reported killed, as buildings collapsed and infrastructure was damaged on both sides of the border.

Here is what is known about the disaster so far.

Worst in decades

The quake was detected at 4:17am (0117 GMT), according to the Turkish Disaster and Emergency Management Authority (AFAD). It was centered in the Pazarcik district in the southern province of Kahramanmaras at a depth of 7 kilometers.

The agency initially measured the quake at 7.4 magnitude, but later revised it to 7.7. Dozens of aftershocks were detected later in the day in southern Türkiye, the Gulf of Alexandria and Syria, according to quake monitors, with the strongest spike reported at 7.5 magnitude.

The earthquake was felt across the region, with tremors noted by people as far as Baghdad, Iraq, and Beirut, Lebanon, hundreds of kilometers away.

Hundreds killed, thousands injured

Türkiye is located in a seismically active part of the world, but Monday’s quake was one of the strongest in its history, with more than 1,000 people killed, according to Turkish authorities.

President Recept Tayyip Erdogan said the disaster left over 5,000 injured and destroyed some 2,800 buildings. He called it the worst earthquake in the country since 1939.

The wave of destruction swept through 10 Turkish provinces, including Kahramanmaras, Gaziantep, Sanliurfa, Diyarbakir, Adana, Adiyaman, Malatya, Osmaniye, Hatay, and Kilis.

In Syria, the health ministry said it recorded over 300 deaths and over 1,000 injured people, with damage reported in Northern Aleppo, Hama, Latakia, and Tartus.

Crucial infrastructure damaged

In both Türkiye and Syria, the quake caused damage to key infrastructure. In the Turkish Kilis Province, natural gas pipelines ruptured, with the fuel bursting into large plumes of flame, according to footage circulating online. Operator BOTAS said it cut the flow, but pressurized gas in the pipeline continued to feed the fires.

In Syria, a refinery in the city of Baniyas, one of the largest in the country, had to be shut down for at least 48 hours due to cracks in the chimney of its power unit, the Ministry of Oil and Mineral Resources reported.

The Syrian government also ordered all trains to be stopped as a precaution following the earthquake.

Turkish authorities closed the Hatay Airport due to the damage it sustained and suspended all civilian flights via the Gaziantep International Airport amid the emergency. The ports of Ceyhan and Iskenderun were reportedly closed too.

National heritage at risk

The Gaziantep Castle, a hilltop fort located in the center of the city of Gaziantep was heavily damaged by the quake, according to Turkish media. The structure dates to the second and third centuries, though it was repeatedly renovated over the course of history, and is considered the symbol of the city.

In Syria, the quake reportedly caused a crack to appear in the Citadel of Aleppo, a UNESCO heritage site located in Aleppo’s old city. Houmam Saad, who heads the Directorate-General of Antiquities and Museums in the Culture Ministry, told media that a team had been dispatched to assess the scale of the damage.

International assistance

Many nations, including Azerbaijan, Germany, Greece, India, Israel, Russia, Serbia, Spain, the UK and the US, have offered their assistance in responding to the disaster.

Russian President Vladimir Putin sent messages of condolence to Erdogan and Syrian President Bashar Assad and said his government was ready to help.

Russian Emergencies Ministry said it put two transport planes and some 100 highly-skilled rescue workers on alert for possible deployment to the disaster area.

Türkiye hit by second major quake

An official said a 7.5-magnitude event in the Kahramanmaras province was “not an aftershock” but a separate earthquake

Türkiye was hit by another powerful earthquake on Monday afternoon. This comes on the heels of a devastating quake in the early hours of the morning that claimed the lives of more than 1,000 people, according to local authorities.

The European-Mediterranean Seismological Center reported two more jolts with an interval of about ten minutes that sent shockwaves through the central part of the country at around 1:30pm local time. The first registered a magnitude of 7.5 and had an epicenter about 65km to northeast of the city of Kahramanmaras. This is the same region that was hard hit by the initial earthquake early this morning.

The second, with a magnitude of 5.8, had an epicenter 55km northwest of the city of Adiyaman in southeastern Türkiye.

An official from Turkey’s Disaster and Emergency Management Authority clarified that the 7.5 earthquake was “not an aftershock” but a separate quake.

The nation is already reeling from the first morning quake, which claimed the lives of over 1,100 people while injuring more than 7,000.

Footage posted on social media shows the devastation wrought by the disaster. In one clip, a building in the Sanliurfa province is seen collapsing hours after the first earthquake. It was unclear whether anyone was inside the building at the time.

Neighboring Syria, which was also struck, has also been seeing aftershocks. Speaking to the SANA news agency, Raed Ahmad, the director of the National Earthquake Center, said that jolts have occurred and more will occur, but subsequent ones will be much weaker than the initial earthquake that killed over 400 people in the country.

Startling Evidence Suggests BioNTech and Pfizer Falsified Key Data: Part 1

https://www.trialsitenews.com/a/startling-evidence-suggests-biontech-and-pfizer-falsified-key-data-part-1-e2595e7f

Evidence has emerged casting serious doubt over the authenticity of tests carried out by BioNTech (Marketing Authorisation Holder) and Pfizer to prove the fidelity of their product by demonstrating that only the spike protein of SARS-CoV-2 is expressed in cells by the nucleoside-modified mRNA Pfizer-BioNTech Covid-19 vaccine (BNT162b2).

Several Western Blot tests were conducted to evaluate the protein expression of the mRNA in HEK cells transfected with the vaccine taken from different lots. Using this technique, the expressed proteins showed up as highly unusual looking ‘bands.’

Certain independent scientific experts have described these Western blots as the “smoking gun” evidence (particularly the “duplication” of the results) which suggest that BioNTech and Pfizer falsified key data as part of their submissions to the European Medicines Agency and the Federal Drugs Agency for securing emergency use authorisation (conditional) and later marketing authorisation approval of their product.

The bombshell evidence was dropped without so much as a ripple in the sea of brewing scandals washing up on the shores of the behemoth pharmaceutical company and its partner, BioNTech. However, some in the scientific community have taken notice and written about this scandal, known on social media as #Blotgate.

The fact there could be actual evidence to prove that Pfizer and BioNTech engaged in fraud by fabricating critical data would have major ramifications. For instance, their indemnity status (protection from any legal liability resulting from deaths or injuries caused by their product) which was written into their purchasing contracts and signed by many countries, would cease to apply.

PFIZER AND THE ROYAL THAI FAMILY

There's been a lot of talk in the last few days about the possibility that the Royal Thai family will nullify the Pfizer contracts. Let's make things clear.

By Ehden Biber

Since the news of the collapse of the Thai princess came, and the revelations that the Thai royal family are furious because it seems her condition is a result of the Pfizer shot, there has been lot of chatter about the possibility that Thailand will nullify their contract with Pfizer. The purpose of this post is to help people understand the legal framework which will govern such attempt.

Sense of Awareness is a reader-supported publication. To receive new posts and support my work, consider becoming a free or paid subscriber.

First, I invite everyone who has been talking about the idea that the Thai royal family will simply nullify the agreement they signed with Pfizer to read what I've written in July 2021, after discovering THE ONLY PFIZER MANUFACTURING AND SUPPLY AGREEMENT that we can discuss in certainly as authentic, which is the Brazilian one (as part of my #PfizerLeak revelations on twitter, a day after I shared the Albanian contact).

If you want to understand the Pfizer negotiation process that led to the signing of the manufacturing and supply agreement by Thailand, read my post entitled “The Negotiations”. The highlights from Carlos Murillo's testimony are truly pivotal!

The important point is: Thailand cannot risk nullifying the contract because they put as collateral against this contract ALL OF THE COUNTRY ASSETS, including currency reserves and embassies!

If Thailand will want to dispute the contract, the need to go to an arbitration process, govern by the International Chamber of Commerce (ICC) arbitration process. Each side will nominate an arbitrator, and the ICC court will nominate the chair, who will make the decision.

Image

The problem is that since a court case against Pfizer/BioNTech regarding their product will take place in NY, it will be govern by the PREP act, conducted in an where willful misconduct requires a proof or 3 things (below). While we have evidence on #3, how exactly will anyone clearly prove #1 & #2?

Image

Practically, the ONLY WAY anyone can nullify the contracts is if they can prove that BioNTech who developed the "vaccine" knowingly planned to kill people. Why do you think the creators of this deadly shot got involved in writing a book about it? They were trying to frame their narrative.

Image

HOWEVER!!!

In my honest opinion, countries MIGHT have ONE get-out-of-jail-ticket from these draconian contracts, as the executive branch (government) signed a SECRET commitment that the contract cannot and will not be overruled by legislative & judiciary branches. But… it’s not going to be that easy. After all, will claims of unconstitutional contract work in this court? I cannot tell. Also, as the chair decides, it's a high risk.

To understand the complexity of the international arbitration process, I STRONGLY RECOMMEND reading "What's law got to do with it? The role of governing law in international commercial arbitration" by Jennifer L. Permesly (@SkaddenArps), from 2018.

Here are some important quotes from the article:

“An arbitrator who decides according to some other law, whether a national or otherwise, presumes to rewrite the bargain”

“an arbitrator’s primary duty is to interpret the terms of the parties’ contract in accord with their expectations.”

“In the arbitrator’s decision-making process, his "reason and logic", rather than the statutory rulebook of interpretation, are considered the guiding light for his interpretation of the disputing parties’ contract.”

“arbitrators are free to consider sources of transnational and international law in addition to the national law rules chosen to govern the contract.”

“some arbitrators have resorted to a hybrid method, mixing the concepts of trade usages, general international principles, and lex mercatoria into a sort of interpretative stew”

“Most legal systems provide that that arbitrators’ determinations on the substance of the dispute are not subject to judicial review. On this premise, some have suggested that arbitrators are free to disregard certain principles of governing law, and even to replace the law chosen by the parties in favor of a different domestic law or transnational principles, without fear of repercussion.”

“One of the most contentious features of United States arbitral law is the doctrine that permits vacatur of an arbitral award based on a "manifest disregard of the law" by the arbitrators”

“most commentators concede that arbitral awards may be reviewed where the decision would violate national or international public policy, which could encompass situations where an arbitrator’s decision not to apply "mandatory rules" of national law is considered to violate a public policy of the enforcing state.”

“the privacy of the arbitral process and the absence of full scrutiny of arbitrators’ substantive decisions may incentivize some international arbitrators to depart from legal decisional norms”

“the incorporation of international arbitration in the parties’ contract may be more meaningful than their choice of governing law.”

“At its most basic, governing law can offer predictability of result, or at least a meaningful and experience rich body of law and precedent to guide the substantive result.”

“Perhaps the very lack of judicial review of arbitrators’ substantive decision-making has contributed to a lacuna in this area; we have developed clear and nearly universally accepted standards to address various procedural issues in arbitration, but leave the scope and nature of legal decision making distinctly to the individual arbitrator.

“Nearly all arbitral institutions, as well as the UNCITRAL Model Law and UNCITRAL Arbitration Rules, provide that arbitrators "shall" or "will" apply the law or rules of law designated by the parties in their agreement.”

“The ICC Rules similarly envision the application of the law chosen by the parties, stating that the "parties shall be free to agree upon the rules of law to be applied by the arbitral tribunal to the merits"”

“While it is not clear that these directives go so far as to preclude reference to principles falling outside of national law, there is no reason that they should be considered any less indicative of party intent than, for example, the "clear and unmistakable evidence" to allow arbitrators to decide their own jurisdiction that is commonly found by U.S. courts when parties refer their dispute to arbitral rules containing provisions regarding competence-competence.”

“the prevailing view is that arbitrators should not resort to lex mercatoria where not expressly authorized to do so by the parties in their contract.”

“Modern arbitral procedure tends to focus on facts and procedure over the application of legal standards; counsel and arbitrators share responsibility for this trend.”

“There are myriad ways in which these issues can be addressed, all of which first and foremost rely on attention, rigor, and care from arbitrators and counsel alike. A few specific proposals for ways in which legal decision-making might be elevated and prioritized include:

Reference to burdens/standard of proof and evidentiary standards in order to place emphasis on those facts relevant to the legal dispute at hand.

Consideration of early dismissal of claims without legal merit.

Constitution of a tribunal familiar with the law and/or reliance on legal experts, where necessary.”

“Increased attention to the governing law chosen by the parties, including by insisting that a party’s claims and defenses be framed within the applicable legal construct and by providing clear and consistent reasoning as to when and how transnational principles will be applied, are small steps that could go a long way in re-elevating the role of "law" in arbitral decision-making.”

Again - I HIGHLY RECOMMEND anyone who want to try to understand the process of challenging the Pfizer contracts to read this article !!! It’s A MUST!

Finally, if you’re interested, I’ve written a lot about the contracts multiple posts in the past, which you can find here, on Substack.

Sending love and healing to everyone who got injured by the jabs.

Sunday Talks, Cohn and Brennan Talk Gleefully About the Return of the Service Driven Economy Under Biden, Happy with No Wage Growth

February 5, 2023 | Sundance |

This is one of those interviews whereyou don’t have to take my word for what is being said, Gary Cohn and Margaret Brennan are gleeful about the January jobs reportand the overall return of the U.S. economy to a service driven system with low wages.

Seriously, this is them celebrating out loud.

In order to calm the Wall Street apoplexy about his election victory, President Trump selected Gary Cohn to be an economic advisor early in the administration. However, it was also no surprise that President Trump did not follow Cohn’s advice, and quickly dispatched him after Cohn protested. In this interview the worldview of Cohn is typically globalist, multinational and Wall St centric.

Talking about the January jobs report, Cohn literally gets everything wrong from the position of Main Street USA. Cohn also celebrates what he calls the “renormalization of the new economy.” Continuing with his thought process Cohn states, “A lot of the jobs that we saw were jobs in the service industry, the service, the industries coming back very strong because we’re starting to see the economy go back to what we historically think of the economy,” he said. This is exactly how Wall Street, and the multinationals look at the U.S. economy.

The next part that both Cohn and Margaret Brennan celebrate is even more sunlight. “The interesting thing about last month’s unemployment numbers is we brought people back to work, but we did not have to entice them with pay,” Cohn stated. “So, the monthly, the month over month number in wage gains was 30 basis points. The prior month was 40 basis points. So, we’re seeing we’re getting people back into the labor force for a lower wage than we were prior to this,” he said. With higher prices (inflation) crushing the middle-class and service workers, the multinationals Cohn represents are celebrating that they don’t have to pay workers higher wages WATCH:

Western media quickly scrambling to scrub the internet of the evidence of Nazis in Ukraine…

Remember when the Nazi posts were dropped years ago and was quickly retracted??

It seems countries are financing a regime that was supposedly beaten in the 1940s

Is this the EUs last stand?? Is the EU run by Nazis??

Teresa May gone along with Merkel made the EU wobble..

@LionAdvocacy

Pfizer has been found guilty of violating three sections of the British Pharmaceuticals Code of Practice?

This seems rather newsworthy.

I’m surprised it got so little media attention, especially given the recent concerns about misinformation.

AUTH/3591/12/21 - A complaint on behalf of UsForThem v Pfizer

Case Summary

A complaint on behalf of UsForThem, a parent-led campaign group calling for children’s needs to be prioritised during the Covid pandemic response, was received about an article and video posted on the BBC news website.

The item at issue, entitled ‘Pfizer boss: Annual Covid jabs for years to come’ consisted of an interview conducted by a BBC medical editor with Pfizer’s Chief Executive Officer (CEO) and appeared in the ‘Health’ section of the BBC website on 2 December 2021.

COMPLAINT

The complainant stated that the tone, content and means of dissemination of this article and the associated video were extremely promotional in nature. The complainant strongly believed that it was not appropriate for Pfizer to promote its product in this way. The complainant referred to three earlier cases against Pfizer for promoting its Covid-19 vaccine illegitimately online (Cases AUTH/3422/11/20, AUTH/3438/12/20 and AUTH/3437/12/20). In these cases the Panel decided that Pfizer’s Covid-19 vaccine regulatory status was that of a temporary approval for emergency use only and stated that the vaccine was not a licensed medicine, and that Pfizer was guilty of promoting an unlicensed medicine in breach of the Code. The complainant was not aware that the UK regulatory status of Pfizer’s Covid-19 vaccine had changed since these cases and therefore alleged Pfizer was, with the material at issue, once again in breach of the Code. Furthermore, in view of the fact that Pfizer had had several findings of a similar nature in the past 6 months, the complainant alleged that Pfizer was also in breach of the Code for failing to comply with its undertaking.

The complainant made specific allegations about statements and claims made in the promotional piece relating to children:

1 ‘Immunising that age group [children under the age of 11] in the UK and Europe would be a very good idea.’

The complainant alleged that by recommending vaccinating healthy British children under the age of 11 against Covid-19, the Pfizer CEO was making a claim for the clinical efficacy and safety of Pfizer’s product and its risk/benefit balance, even though the vaccine had not yet been included in the emergency use temporary approval for use in children this young in the UK.

2 ‘Covid in schools was thriving’. ‘This was disturbing significantly the educational system and there were kids that would have severe symptoms.’

The complainant stated that severe Covid-19 was rare amongst children and school age in the UK and while the virus did circulate in schools, schools had typically reflected community transmission throughout the pandemic. Neither had Covid-19 itself had a significant impact on disturbing children’s education in the UK. The ‘disturbance’ to the UK educational system had resulted from political decisions made by governments, not the virus. Indeed, the complainant knew that the UK had the second highest rates of school closures in Europe, except for Italy – a result of political decisions.

The complainant stated that there was simply no evidence that healthy school children in the UK were at significant risk from the SARS COV-2 virus and to imply that they were was disgracefully misleading.

3 ‘So, there was no doubt in my mind that the benefits completely were in favour of doing it.’

The complainant alleged that this was probably the most egregiously false and misleading of the Pfizer’s CEO’s statements. It completely neglected to consider that there were potential risks to healthy children associated with administration of the Covid-19 vaccine. The complainant referred to a number of documents including a Pfizer leaflet listing side-effects; Latest government advice regarding myocarditis to healthcare workers detailing rates of myocarditis in hospitalised children; and Latest adverse events reported for Pfizer.

The complainant stated that the conclusion of the Joint Committee on Vaccination and Immunisation earlier in 2021 when asked to give an opinion on this very subject in relation to the older cohort of children between 12 and 15 hardly seemed to be consistent with the opinion of Pfizer’s CEO that there was ‘no doubt’ or that ‘the benefits completely were in favour’. The complainant alleged that the failure to promote the rational use of the medicine, the misleading presentation of the risk/benefit profile and the use of exaggerated, all-embracing claims (‘no doubt’ and ‘completely in favour’) was in breach of the Code.

The complainant stated whether Pfizer, or indeed the BBC, liked it or not, opinion about the benefits and risks of vaccinating healthy children against an infection which posed little risk to them, and the ethical considerations of exposing healthy children to the risks of vaccination (no matter how rare those effects might be) in order to protect adults or vulnerable members of society, was not settled. For a pharmaceutical company to be behaving on a public platform as if it was, was wrong. The complainant alleged that the material was in breach of the Code in that ‘emerging clinical and scientific opinions which had not been resolved in favour of one generally accepted viewpoint must be referred to in a balanced manner’.

The complainant understood that Pfizer’s Covid-19 vaccine fell within the clause of the Code relating to temporary authorisation for sale or supply without a marketing authorisation. The complainant stated such was the poor quality of this activity and the materials which were the subject of this complaint in terms of their lack of compliance with the Code that the complainant found it difficult to believe that Pfizer had undergone the required prior scrutiny and approval by the MHRA on behalf of the ministers as set out in Clause 11.3 of the Code.

The complainant alleged a breach of the Code as no information, whatsoever, was provided about reporting of side-effects, or indeed the side-effects themselves.

The complainant had no way of knowing whether the interview was or was not solicited by Pfizer. Similarly, the complainant had no way of knowing whether Pfizer’s CEO was formulating his answers based on briefing notes prepared by the Pfizer communications department or, indeed, whether the journalist prepared his written article with the aid of written briefing notes or press releases provided by Pfizer. This information would no doubt inform and guide judgements about this case.

In summary, the complainant alleged that the article, and associated video constituted promotion by Pfizer of its unlicensed medicine which fell within the scope of the Code. The complainant further alleged that Pfizer had failed to maintain high standards and brought discredit upon the industry. Furthermore, bearing in mind that Pfizer was found guilty of illegitimately promoting its Covid-19 vaccine using the internet less than six months ago, a breach of undertaking was alleged.

The detailed response from Pfizer is given below.

PANEL RULING

The Panel noted Pfizer’s submission that it had been approached by the BBC for an interview with its CEO which was held on 22 November 2021. The news article and associated video interview, referred to by the complainant, were produced and published by the BBC on 2 December 2021. The Panel noted Pfizer’s submission that the 45-minute interview was intended to cover news topics identified by the BBC about Pfizer’s commitment to the global Covid-19 vaccine rollout and ongoing innovation to fight the pandemic.

The Panel noted that complaints about third party articles in the press etc were judged upon the acceptability of the information provided to that third party by the pharmaceutical company, such as any press release, unedited interview etc rather than the final published article. The Panel noted Pfizer’s submission that it had no editorial control or right to review the excerpts of the interview chosen by the BBC for inclusion in their news articles and no Pfizer press briefing was issued to the BBC in association with the interview. The Panel also noted Pfizer’s submission that it had not been able to obtain a full transcript of the interview from the BBC as the BBC’s own policies did not allow this; it had, however, obtained some limited expanded excerpts from the interview. The Panel noted that it was obliged to make its rulings based on what Pfizer’s CEO had actually stated rather than the edited published article and video. The Panel noted, therefore, that in relation to the quotations cited by the complainant, these could only be considered within the context of the overall interview based on the limited BBC transcript provided by Pfizer as part of its response.

The Panel did not have the full unedited transcript of the interview or the video. Whilst the complainant referred to the published video, it appeared that the substantive allegations related to the published article.

The Panel noted Pfizer’s submission that prior to the interview, Pfizer UK had briefed the CEO who was based in the USA about the interview, the regulatory status of Covid-19 vaccines in the UK and the requirements of the ABPI Code.
