Wisconsin's election probe zeroes in on Democrat machine tactics, rule changes

Former Supreme Court justice signals focus on whether bureaucrats improperly hijacked election rules.

Move over Arizona and hold on Pennsylvania, the next election integrity investigation to take center stage is occurring in Wisconsin, where a former state Supreme Court justice empowered by the Legislature to compel testimony and document production is gathering steam.

Interviews with more than a dozen witnesses, officials and lawyers who have interacted with retired Justice Mike Gableman and his staff suggest a strong focus on the role election bureaucracies played in changing the rules — without legislative consent — for how ballots were sent out, filled out, collected and counted.

Gableman's early investigative work as special counsel appointed by Wisconsin Assembly Speaker Robin Vos is shining a spotlight among other things on the Wisconsin Election Commission, a statewide body created by GOP lawmakers after an earlier political rigging scandal in the state known as the John Doe investigations. The commission provides guidance and rules to the 1,852 election clerks in the state on how to conduct voting.

The commission in 2020 altered numerous state voting rules and procedures during the pandemic, often without seeking legislative permission. The changes range from allowing nursing home staff to help fill out resident ballots to giving permission to election clerks to fill out missing witness information required for absentee ballots.

Those two changes alone affected thousands of ballots in a state in which Joe Biden was declared the winner with a narrow margin of just 20,600 votes.

Perhaps even more consequential, the commission gave its blessing to an idea first conceived by election clerks in the blue counties of Dane and Milwaukee that voters could claim the normally rare status of "indefinitely confined" if they were too scared to go out during the COVID outbreak. The change allowed nearly 250,000 people to vote by absentee without complying with required voter ID rules.

That advice, the Wisconsin Supreme Court ruled after the election, was unlawful. Only people who determine they have bona fide disabilities and infirmities are allowed to vote as "indefinitely confined," and regulators had no right to declare the pandemic as such a condition, the justices ruled in the only major court decision after Nov. 3 to declare a large bloc of votes as potentially illegally cast.

Gableman has the ability to determine why the rules change was made, whether it was influenced by politics and how many of the 249,769 people who voted as indefinitely confined in 2020 didn't meet the legal criteria and simply voted that way on the flawed advice of regulators.

As a point of comparison, only about 72,000 voters in 2019 sought "indefinitely confined" status, leaving open the possibility that 150,000 or more voters in 2020 did not meet the proper standards, officials told Just the News. The potential total could be seven times the vote margin of Biden's victory.

Gableman also has signaled a focus on Wisconsin's big blue urban areas of Milwaukee, Madison, Racine, Kenosha and Green Bay. Those five voting metropolises accepted more than $6 million in unprecedented donations to their election coordinators and judges in 2020 from the Center for Tech and Civic Life, a nonprofit funded almost exclusively by Facebook founder Mark Zuckerberg.

The money, which also went to other major voting jurisdictions across America in 2020, has provoked enormous controversy, as Just the News has previously reported. First, the so-called Zuckerberg bucks allowed a single billionaire to route his money outside the normal campaign finance system to election referees.

Secondly, the donations came with strings attached that influenced how elections were carried out in the municipalities that got money. Documents previously obtained by Just the News, for instance, show officials in Green Bay and Brown County were required to conduct voter registration drives among specific minority groups that tend to vote Democrat.

And former Brown County elections clerk Sandy Juno told Just the News professional elections experts like herself were sidelined in last November's election in favor of a liberal activist from the East Coast brought in with the Zuckerberg money. "We need to be really on top of this, because if this is how elections are going to go, we won't have election integrity," Juno said in a recent interview with Just the News.

Officials and witnesses familiar with Gableman's document requests indicate he also is interested in investigating two events staged by election officials in the liberal bastion of Madison under the banner of "Democracy in the Park."

Gableman is investigating allegations that poll workers were instructed to go to the city's parks on Sept. 26 and Oct. 3 and collect ballots from voters even though Wisconsin does not allow for voting in locations outside approved precinct voting stations.

Those who have interacted with Gableman's team say he appears focused on substantive issues and committed to identifying how ballot collecting and counting was improperly changed in 2020 and how it can be improved or fixed by the Legislature for future elections.

"Some of the earlier election audits and hearings have had a bit of folly to them, things that caused the media to take them less serious," said one person who has interacted with Gableman in recent weeks, whereas Gableman "seems to be serious about focusing on what matters and what can make Wisconsin elections better for the future."

His work, however, has not escaped criticism. The state's Democrat attorney general and a key Republican state lawmaker expressed concerns Monday about the start of the investigation and its early subpoenas and whether it should continue.

Gableman last week announced election officials who cooperate will have immunity from any prosecution and that his goal was to restore voters' confidence in their electoral system after contentious 2016 and 2020 elections in which one or the other party cried foul.

"This investigation has always been about identifying potential failures, improving election transparency and ensuring our elections are run properly, and restoring public confidence in the election process, which should be inclusive, accountable, and transparent," he said. "That's a goal that everyone should be able to support, regardless of politics."

Here are some of the questions witnesses and experts believe Gableman's investigation can answer:

How many of the nearly 250,000 people who skipped voter ID requirements by declaring themselves "indefinitely confined" did so without meeting the legal criteria because of the bad advice given by election bureaucrats?

Why did the WEC fail to deactivate before the 2020 election tens of thousands of names from voters rolls which had been identified in 2019 as having inaccurate information even though the state had taken such action in earlier elections?

Why did WEC succesfully keep the Green Party candidate off the 2020 presidential ballot after allowing the party to appear in 2016. Supporters of Hillary Clinton claimed the Green Party siphoned some 33,000 votes from her tally in 2016.

How much influence did Zuckerberg's money routed through CTCL have on election administrators, and did its grant requirements benefit one party over another?

Were events like Democracy in the Park an improper effort at vote gathering, and were any of those events coordinated with Democrats or the Biden campaign?

Why did WEC instruct election clerks they could fill out missing witness information from absentee ballots when the law requires ballots missing such information be sent back to voters to be fixed? Also, how many ballots were corrected, and in what cities?

Was it lawful for WEC to allow clerks to send absentee ballots to all nursing home residents whether they requested them or not and to allow staff to help residents fill them out, and did any abuses occur?

Were there any abuses or mishandling of ballots delivered to unmonitored drop boxes during the 2020 election, and were there proper chains of custody? Some counties in Georgia have already been found to have problems with their drop boxes.

Were any election machines allowed to be connected to the internet or left with open ports that could have created security vulnerabilities such as those recently flagged by the U.S. Election Assistance Commission.

A Closer Look At The Media’s Narrative On The Arizona Audit ResultsAfter five months of fighting the Republican Maricopa County Board of Supervisors, the Democrat Establishment, and several liberal special interest groups, the Arizona Senate finally won in court and got the “go ahead” to conduct the largest forensic election audit ever conducted in the country. They fought to re-establish their authority, and they won. Their reward was six more months of fighting the same parties, this time in the press, who ridiculed and lied about the audit process, questioned the auditors’ credibility, and smeared them across the nation calling the audit a joke.

For six more months, the auditors diligently examined every piece of information to which they could get access. Maricopa County continued to play games, hide the ball, and obstruct, all while calling the auditors names, vilifying them, and hurling insults. The auditors never retaliated, and the Arizona Senate stood its ground, determined to give the people of Arizona the audit they demanded.

Finally, once the results arrived, the auditors had proven themselves to be everything their haters said they weren’t. They were honest, transparent, and acknowledged the findings. For nearly a year, the Arizona Senate, and the auditors, withstood the barrage of attacks from Republican County officials, Democrat elected officials, and special interest groups. They didn’t know their biggest fight lay ahead of them. The media.

The Arizona Audit Report showed tens of thousands of questionable votes, illegal voting practices, and what appeared to be outright fraud. Experts reported catching people on camera deleting evidence, and intentionally trying to obstruct any investigation into the 2020 election. Ballot envelope images appeared to be manipulated or fake. The County was missing records for hundreds of thousands of votes that didn’t appear to have a corresponding voter. There was enough evidence to show that the outcome of the Arizona election could have been change at least four to five times, likely more. The report also showed that if all of the votes are counted, including those that they believe to be fraudulent, the vote comes fairly close to what the county certified. However, the report cautioned, there are likely a number of fraudulent votes, enough of which could have changed the outcome of the election.

Corporate media, the Establishment’s biggest weapon, quickly promulgated headlines touting The Arizona Audit Report Confirms a Biden Victory! That couldn’t be further from the truth. The report showed FRAUD! The report showed people cheated and manipulated information. But that doesn’t fit The Narrative. Corporate media feeds on power, and it gets its power by manipulating people into believing a version of reality that powerful people want others to accept.

A Closer Look At The Media’s Narrative On The Arizona Audit ResultsWe’re at a point now where The Narrative has become so outrageous that Americans are struggling to accept it. We used to accept The Narrative out of convenience, because we all preferred to focus on our own lives. We knew the media lied, but didn’t care that much, because everyday life mattered more. Now, the lies are to the point where willfully ignorant Americans can no longer accept The Narrative and are pushing back.

Do we honestly believe Joe Biden was the most popular President in American history, winning 80 million votes? No. Just this week, Rasmussen published a poll showing 56% of Americans believe cheating affected the outcome of the election.[1] But Americans accepted the outcome, because it’s an easier solution than having to solve an election crisis. As a result of that acceptance, 13 American heroes are dead. Hundreds, if not thousands, of Americans are stranded in Afghanistan. Pilots and healthcare workers are out of a job. The American economy is in the tank. Our Freedom of Speech is censored. The Narrative no longer works. It’s not believable.

The Narrative says that the Arizona Audit confirmed a Biden victory. That’s simply not true, and a harbinger of the bigger more unbelievable lies they will try to force us to accept if we continue to allow them to dictate an altered reality. The truth is that the report showed fraud…a lot of it. The truth is that Republicans and Democrats obstructed transparency. The truth is that Trump won, and the media doesn’t want America to figure that out.

McConnell gets GOP wake-up call

The backlash Senate Minority Leader Mitch McConnell (Ky.) received from fellow Republican senators last week is a wake-up call to the GOP leader that he doesn’t have any more political capital to spend on helping Democrats raise the debt limit again, say GOP aides and strategists.

McConnell is still secure in his position as Senate Republican leader, despite regular attacks from former President Trump, who has called for him to be replaced.

Yet at the same time, Senate Republican aides and strategists say McConnell’s reputation took a hit last week when he agreed to a two-month increase of the debt ceiling after saying for weeks that Republicans wouldn’t help Democrats on the issue.

McConnell didn’t announce his offer to Senate Majority Leader Charles Schumer (D-N.Y.) until he released a statement Wednesday, and many Senate Republicans were kept in the dark about it until the statement was made public.

Even at a Senate Republican Steering Committee lunch shortly before the statement came out, McConnell kept his plans close to his vest as fellow Senate Republicans discussed various options for getting out of the stalemate.

What made last week’s internal Republican fight different from previous intrafamily spats was that McConnell heard criticism from allies such as Senate Republican Policy Committee Chairman Roy Blunt (Mo.), a member of his leadership team, and Sen. Lindsey Graham (S.C.), the top-ranking Republican on the Senate Budget Committee who has tried to bury the hatchet between McConnell and Trump.

Even Sen. Mitt Romney (Utah), who has become known as a moderate in the Senate GOP conference, voiced his misgivings.

“I think this was a crisis entirely of McConnell’s making when he decided to announce the caucus’s position this summer. He created drama and thought it would go a lot differently than he expected and then he blinked,” said a Senate Republican aide who requested anonymity to frankly assess McConnell’s standing after the debt limit fight. “He put his caucus into a tough position.”

“He prides himself on protecting the caucus from tough votes and that obviously took a major blow,” the aide added.

Sen. Ted Cruz (R-Texas), a longtime McConnell antagonist, sensed weakness after Thursday’s Senate GOP conference meeting and immediately took to the floor to pounce on his leader.

“I believe Democratic Leader Schumer was on the verge of surrendering and then unfortunately ... Republicans blinked. I think that was a mistake,” he said on the Senate floor.

A Republican strategist allied with McConnell, however, argued that last week’s fight won’t have any lasting effect on the GOP leader.

“In the grand scheme it’s irrelevant, because we’re six weeks away from another showdown,” the strategist said, predicting that public attention will quickly shift to other issues.

“What matters is how the [Senate Republican] members feel” about McConnell, “and the members enthusiastically” support McConnell, the strategist said.

McConnell won’t be able to wrangle 10 Republican votes to help Democrats raise the debt ceiling again, something he told President Biden in a letter on Friday that was also a message to Republicans.

“I will not be a party to any future effort to mitigate the consequences of Democratic mismanagement,” he wrote. “They cannot invent another crisis and ask for my help.”

A second Senate Republican aide said McConnell didn’t have a politically viable exit plan in case Schumer refused to back down in the fight and use the budget reconciliation process to raise the debt ceiling.

“It hurts him, which is why he sent that letter to Biden saying he wouldn’t do it again. That’s because he can’t do it again. There won’t be 10 Republican votes unless we get something,” the aide said.

“McConnell was calling and begging people to do this,” the source added, describing how tough it was to round up GOP votes just for a two-month extension.

The aide noted that McConnell’s position in the conference has weakened since the last time there was a big internal fight over the debt limit in 2014, because loyal McConnell allies such as former Sens. Pat Roberts (R-Kan.) and Lamar Alexander (R-Tenn.) have retired.

Another wave of McConnell allies are due to retire at the end of next year when Sens. Rob Portman (R-Ohio), Richard Shelby (R-Ala.), Richard Burr (R-N.C.) and Blunt step down.

All of this is likely to make McConnell’s job even harder, especially as he deals with barbs from Trump, who frequently weighed in publicly on the debt fight.

The next battle will come up toward the end of November as the Senate nears a new debt ceiling deadline.

“This puts McConnell in a box canyon where he has to be tough and fight the debt limit,” said Brian Darling, a GOP strategist and former Senate aide. “He lost face during that debate and now he’s going to have to step up and actually be tougher on the second go on the debt limit and force Democrats to use reconciliation.”

McConnell and the 10 other Republicans who did vote to help raise the debt ceiling were criticized by the former president during a rally in Iowa.

“To think we had 11 Republicans go along with an extension. Headed up by Mitch McConnell, can you believe that?” Trump said before a cheering crowd in Des Moines.

McConnell, three members of his leadership team, moderate Sens. Susan Collins (R-Maine) and Lisa Murkowski (R-Alaska), and Portman and Shelby, who are both retiring, were among the 11. OSU research director charged with child sex crimes in Virginia

BENTON COUNTY, Ore. (KPTV) - An Oregon State University researcher who was serving as head of the school's Center of Quantitative Life Sciences has been charged with aggravated sex crimes against children in Virginia.

According to court documents, 66-year-old Brett Tyler was considered a fugitive from Virginia when he was arrested in Benton County Oct. 8. He's charged with two counts of forcible sodomy, two counts of taking indecent liberties with children, and aggravated sexual battery.

An OSU spokesperson said Tyler "resigned immediately" as the director of the life sciences center and will retire from the Department of Botany and Plant Pathology Nov. 30. He will work remotely until then.

“We are aware of this arrest and these serious allegations. OSU takes seriously all matters of reported misconduct, child abuse and sexual violence. As it does in other arrests involving employees or students, the university will cooperate fully with law enforcement investigations into this matter," the university said in a statement.

Tyler was released from the Benton County Jail Oct. 11 on a $200,000 bond.

John Durham & The Amazing Disappearing DNC Hack

Evidence grows that the alleged Russian hacking of the DNC server in 2016 was an inside job...

This is the fifth in a series of articles analyzing the 27 page federal grand jury indictment charging lawyer Michael Sussmann with making a false statement to the FBI.

As stated in the fourth article, when the FBI learned of the alleged hack of the Democratic National Committee’s (“DNC”) emails, it asked to examine the server.

In fact, at the same time as the alleged DNC hack, there were similar reports regarding the Democratic Congressional Campaign Committee’s (“DCCC”) server as well as DNC Chairman John Podesta’s personal email devices.

In testimony before the Senate, FBI Director James Comey stated the following:

Question (by Senator Burr): Did the FBI request access to those devices [the servers and Podesta’s devices] to perform forensics on?

A: Yes, we did.

Q: And would that access have provided intelligence or information helpful to your investigation in possibly finding … including to the Intelligence Community Assessment?

A: Our forensics folks would always prefer to get access to the original device or server that’s involved. So, it’s the best evidence.

Q: Were you given access to do the forensics on those servers?

A: We were not. We were … a highly respected private company eventually got access and shared with us what they saw there.

Q: But is that typically the way the FBI would prefer to do the forensics or would your forensic unit rather see the servers and do the forensics themselves?

A: We always prefer to have access hands on ourselves, if that’s possible.

Q: Do you know why you were denied access to those servers?

A: I don’t know for sure. Um, I don’t know for sure.

Q: Was there one request or multiple requests?

A: Multiple requests at different levels and ultimately what was agreed to is that the private company would share with us what they saw.

So, instead of using a search warrant or some other legal process to perform a direct, hands on forensic examination of the DNC server, the FBI agreed to base its investigation on the findings of a private cybersecurity company. And, as discussed in the previous article, that company, CrowdStrike, was to do the investigation pursuant to its contract with Michael Sussmann of Perkins Coie, the law firm that represented Hillary Clinton’s presidential campaign.

Think about that. When presented with allegations of a devastating foreign cyber attack on one of the two major political parties, the FBI meekly agreed to allow CrowdStrike and Perkins Coie to do the forensic examination and, for all intents and purposes, run the investigation.

Not even the lowliest local police department would agree to such an absurd arrangement. What if this was a murder case? Would the Smallville PD allow a private investigator and lawyer hired by the murder victim’s family to process the crime scene, do the autopsy, and tell the police and district attorney what they supposedly found? Wouldn’t such findings be subject to attack in court as coming from sources that may have had an interest in shaping and tailoring the investigative results to suit the needs and desires of their client? Wouldn’t there be legal problems with the evidence’s provenance, chain of custody, and the reliability and comprehensiveness of the investigative work that supposedly produced it? Would the police and district attorney ever allow themselves to get roped into such a bizarre, ridiculous, nightmarish, and self-defeating arrangement?

Of course not. No rational person or organization intent on conducting a serious investigation would.

But that, in effect, is precisely what the FBI — the self-proclaimed greatest investigative agency in the world — did when faced with this purportedly monumental foreign attack on the Democrat Party apparatus.

Now keep Comey’s testimony in focus as we review the remarkable appearance of Shawn Henry, President of CrowdStrike Services, before the House Permanent Select Committee on Intelligence (“HPSCI”).

The HPSCI convened in closed executive session on December 5, 2017. Present were Henry, the Committee members and staff, as well as a lawyer representing CrowdStrike and a lawyer from Perkins Coie.

Under questioning, Henry confirmed that CrowdStrike’s examination of the DNC server was done pursuant to its contract with Michael Sussmann of Perkins Coie. Consequently, as explained by the Perkins Coie lawyer, CrowdStrike’s findings were protected by the attorney-client privilege. Therefore, it would be up to Perkins Coie, acting on behalf of the DNC, to decide what information Henry would be allowed to share with the HPSCI.

First up was Rep. Chris Stewart (R-UT) who wanted to know why the FBI hadn’t taken “the lead in this investigation.”

Clinton was hospitalized at UC Irvine in Orange County.

It wasn't immediately clear why Clinton was hospitalized, but reports said he was in "good spirits."

Biden’s Pick For Top Banking Regulator Refuses To Hand Over Thesis On Marxism

Saule Omarova, President Joe Biden’s nominee to head the Office of the Comptroller of the Currency (OCC), is refusing to hand over to the Senate Banking Committee her university thesis on Marxism written during her time in the Soviet Union.

Republican Sen. Pat Toomey, ranking member of the committee, had sent a letter to Omarova on Oct. 6 asking the Cornell Law School professor to hand over her Moscow State University thesis, titled “Karl Marx’s Economic Analysis and the Theory of Revolution in The Capital,” by Oct. 13, citing the committee’s need to “fully assess the fitness of individuals to serve in Senate-confirmed executive and independent agency positions.”

Omarova, who grew up in the Soviet Union, had scrubbed mention of the thesis from her resume, the Washington Free Beacon reported. She also praised the now-defunct socialist government for its lack of “gender pay gap” in 2019.

“What’s shocking to me is the notion that a person nominated for a very high position in our government shouldn’t be accountable for the things they have advocated for in writing themselves,” Toomey said during a committee hearing, adding that he had never “seen a more radical choice for any regulatory spot in our federal government.”

Omarova is a vocal critic of big banks and Wall Street orthodoxy, calling for a publicly-managed banking system overseen by the Federal Reserve and to end “banking as we know it.” She also opposes cryptocurrencies, calling instead for a central bank digital currency and praising China’s strict crypto regulatory regime.

Toomey and Sen. Ted Cruz, who called her a “radical threat to our economy.” Omarova defended herself in a Thursday interview with the Financial Times, saying she was an “easy target” because she was a “woman” and a “minority.”

Omarova has yet to hand over her university thesis to the committee, according to Senate Banking Committee Republicans.

“Ms. Omarova has time to attack Republicans in an interview with the Financial Times, but she can’t bother to comply with a Banking Committee requirement that nominees— regardless of their political party or ideology—submit copies of their writings,” Amanda Gonzalez Thompson, spokesperson for Senate Banking Committee Republicans, said in a statement shared with the Daily Caller News Foundation. “We certainly hope she reconsiders so Senators have the information necessary to fulfill their constitutional duty to advise and consent on appointments.”

Omarova did not immediately respond to the Daily Caller News Foundation’s request for comment.

If confirmed as head of the OCC, Omarova would oversee the regulation and management of national banks, including 1,200 financial institutions and $14 trillion in assets, according to The Wall Street Journal.
