In early stage of litigation, the defendants will test the complaint with a Motion to Dismiss (sometimes, "Demurrer"). However, this is before discovery, so the judge has to accept the factual allegations of the complaint to be true, when assessing the viability of the legal theories they support.
Basically, a win on this kind of motion simply means that the plaintiffs' attorney aren't complete fucking morons and don't know how to draft a complaint.
Whether or not the plaintiffs can back up their factual allegations with admissible, factual evidence, later in the case, is a whole different story.
Don't shit on the judge. (at least, not yet.)

MSNBC host Ari Melber said Wednesday on his show “The Beat” that Gov. Ron DeSantis (R-FL) was being “stupid” in his dealing with the COVID-19 pandemic.
Melber said, “This current COVID resurgence is hitting one state hard, Florida. That’s where the governor is finding his long attack for safety measures is blowing up in his face. Dan Crenshaw Tells Republicans ‘Don’t Kid Yourself’ Into Believing Trump Won, ‘Absolutely Not’ A Stolen Election

Establishment Republican Rep. Dan Crenshaw (R-TX) said tonight at a GOP fundraiser in Illinois that Republicans shouldn’t “kid” themselves into believing that President Trump won the 2020 election, and there was “absolutely not” enough voter fraud for Biden to have won illegitimately.
At the fundraiser in Cook County, described as the “home of election fraud,” Crenshaw took a Q&A question from Col. Larry Kaifesh, who asked him if he believed in election integrity efforts, and whether he believed that the November election was “rigged.” Unsurprisingly, Crenshaw, who was blasted as a coward by primary opponent Mike Billand for refusing to contest the election, denied that there was enough voter fraud for Biden and the Democrats to have stolen it.
“There’s certain states with problems, but don’t kid yourself into believing that’s why we lost, it’s not. It’s not!” Crenshaw told the crowd. However, within the crowd was Bobby Piton, the mathematician who testified at the election integrity hearing in Arizona in November last year. Piton, who attended the hearings with Rudy Giuliani and Jenna Ellis, said that he would “never ever” have certified the election results, and if he was acting in an official capacity such as the executive of a publicly traded company, he would rather have resigned than done so.
Piton challenged Crenshaw, and told him he was wrong about the extent of voter fraud in the election, starting a back and forth between the two men, with Piton, who is now running for Senate in Illinois, said that he has “plenty of proof” of the fraud, and that Arizona would soon flip back to President Trump. “It won’t, and you’ve got to flip all five states to make it happen,” Crenshaw argued. “It’s just something you’ve got to accept. Is there a lot of voter fraud? Yeah there probably is. Enough that Trump won? Absolutely not. Absolutely not,” he concluded, saying that anyone questioning the fraud was “kidding” themselves.
“It is disgusting to hear denials from a sitting do-nothing and intellectually dishonest Congressman in our House of Representatives, Crenshaw, who has done nothing but shill for the democrats and refuse to even see or hear the evidence of fraud,” said Piton in a statement posted on Facebook. “Crenshaw is so sanctimonious and cocky and represents one of many intellectually dishonest Congressmen in our party who don’t care about freedom and truth,” he added. Liberty loving patriots in Texas needs to jump in and primary Crenshaw!”
The statement further noted that before this exchange had occurred, Crenshaw was questioned about the current state of the southern border and if he “felt anything was going to happen to help solve the big border crisis,” to which he allegedly “threw the Freedom Caucus under the bus and said it was THEIR fault we have nothing done on immigration.” The caucus, currently chaired by Representative Andy Biggs, is the most pro-America First caucus currently in Congress, often focusing on illegal immigration.
Crenshaw has been well-known for previous statements that show he has little to no respect for conservatives ideas, including: standing by Liz Cheney when she called for Trump’s impeachment, cozying up to gun-grabber group Moms Demand Action and claiming critics of red flag laws are “emotional and uninformed”; suggesting Jesus Christ was a fictional character; and siding with Democrats to demand the removal of Confederate statues.

Regarding today’s event:
We had technical difficulties getting started and had communication issues due to server attacks on our communication lines and instability of the public live streams.
People were asking why we didn’t run tools on the data. It is because we were not remoted into a Windows server that had the image loaded; we had just mounted a forensic image of the files and were able to view the file tree and files only. Due to the setup of the forensic image, we were not able to run tools such as regedit, event viewers, or dll analyzers. We could not run the executable files inside the forensic image.
We did not have a windows server setup with the image loaded due to obtaining the publicly-available data at the last minute. There simply was not enough time to setup a server because the show was already scheduled and we wanted to do it live.
We came across unprepared, and it is true in a sense because we had just obtained the data. It was my very first time looking at the data and I did not know what exactly would be found on the systems ahead of the event.
Interestingly, we did uncover a few critical things:
1. There appeared to be web server logs which potentially indicate that the server was accepting and executing commands remotely.
2. Election related data pre-upgrade was not present on the machine post-upgrade. This indicates that election related data was deleted or otherwise removed during the upgrade process.
3. The server had a suspicious configuration script designed to remove server security, potentially opening the machine up to a network hack.
These issues warrant additional investigation.

There seems to be nobody with common sense in governments anymore. Perhaps this is what leads to worldwide revolution and blood-bath by 2032. In Israel, they are actually confiscating children, even newborns, from parents if they were unvaccinated.

Now parents are totally confused. Many ran out and got the vaccination, but now they are told not only can they still get COVID and spread it, they begin to worry can they give COVID to their young children? Gates has put out such false propaganda that if I advised on IBM and I failed to disclose that I owned ONE SHARE and that my advice would benefit me would be 20 years in prison. Gates violates the security law all the time but nobody at the SEC will ever touch him. He has told the world that when the entire world is vaccinated, we will be back to normal by the end of 2022. He has consistently said we need 7 billion vaccine doses to end COVID-19 pandemic. There is NO ENDING COVID for it will always mutate like the Flu each year. Then we have doctors saying you may need 5 booster shots for COVID. If Bill Gates gets $1 per shot given his stake in ALL the vaccine companies, he will be the richest man not just today – but in all of recorded history!
So all this push to vaccinate and now places are becoming PUNITIVE threatening to charge employees $25 per month or more for not getting vaccinated. NEVER before in history has such inconsistent information about health ever been pressed upon the public. We were told to get vaccinated and you will never get COVID. Now it has ended up as that being a lie. So being vaccinated does not end social distancing or masks and then can you still give it to your unvaccinated children? But if the vaccine does not prevent either getting it or infecting others, then there is NEVER going to be a return to normal which may be the real objective.

U.S. Attorney General Merrick Garland and Health and Human Services Secretary Xavier Becerra violated federal conscience-protection laws when they told the Department of Justice to drop a lawsuit against a hospital that forced a nurse to assist an elective abortion, Republican lawmakers said in a Wednesday letter.
The Daily Caller News Foundation first obtained the letter to the high ranking Biden administration officials, which demands an explanation as to why Becerra and Garland acted to dismiss the lawsuit filed under former President Donald Trump’s administration in December 2020.
“Your handling of this case is a profound miscarriage of justice and a rejection of your commitment to enforce federal conscience laws for Americans of all religious beliefs and creeds—and especially for doctors, nurses, and other healthcare professionals who object to abortion,” the Republican senators and congressmen, led by Tom Cotton of Arkansas and James Lankford of Oklahoma, wrote.
“Your actions signal to employers all around the country that they don’t need to comply with the law because your agencies will not enforce it,” they continued. “They also signal that this administration would rather allow consciences to be violated at the behest of the abortion lobby rather enforce the law and protect religious liberty.”

Reporters' emails show "skepticism and confusion about the conclusion," Judicial Watch President Tom Fitton told Just the News.
Members of the media pressured officials when Capitol Police Officer Brian Sicknick's autopsy contravened the popular narrative that he essentially was beaten to death during the Jan. 6 Capitol riot, according to records obtained by Judicial Watch.
Journalists challenged the Washington, D.C. medical examiner's office regarding its finding that Sicknick in fact died of natural causes, according to those records.
The watchdog organization acquired the records via a Freedom of Information Act (FOIA) lawsuit, a spokesperson confirmed. The records include emails from journalists asking about the autopsy report that was released some three months after Officer Sicknick died.
"People will draw their own conclusions, but the emails suggest skepticism and confusion about the conclusion," Judicial Watch President Tom Fitton told Just the News.
Officer Sicknick died on Jan. 7, one day after the U.S. Capitol building was breached by protesters. Initial media reports stated that Sicknick was bludgeoned on the head with a fire extinguisher and that he died from his injuries. Three months later, on April 19, findings from Sicknick's autopsy were released, saying that the 42-year-old man died of "natural causes."
One day later, journalists contacted the medical examiner's office to challenge the findings.
Reporter Jen Christensen of CNN sent an email asking "how someone could die of natural causes after a traumatic event."
Reporter Sarah Mimms of BuzzFeed News sent an email asking for "clarity" on the findings. "I'm really pressing on clarity here not only because of the importance of this case but also because USCP and the Justice Department initially said that Officer Sicknick died due to injuries he sustained at the Capitol," Mimms wrote. "We want to be accurate, which may mean updating those original stories about how he died, if the ME [medical examiner] can clarify this key point."
The emails read "as if the left media had an interest in pressing the false narrative that Officer Sicknick was killed by protesters," Fitton said.
Just the News was not immediately able to reach the journalists whose emails are included in the trove.
Reporters routinely are skeptical and push government officials for information, Fitton acknowledged; but, he noted, the journalists' autopsy questions are notable for what they left out.

Bolsonaro fails in bid to change voting system & mandate paper ballots in Brazil’s elections
Brazilian President Jair Bolsonaro suffered a defeat in Congress, failing to change the country’s electronic voting system to one with a paper ballot. The leader has claimed the current system can be manipulated.
On Tuesday evening, 229 out of 519 members of the lower house of Congress voted in favor of Bolsonaro’s proposed constitutional amendment. The proposed reform – which Bolsonaro sought to change from an electronic system to one with a paper trail – needed a three-fifths majority of 308 to pass.
Bolsonaro, a former military officer, had repeatedly insulted the head of the Brazilian Supreme Electoral Court, Luis Roberto Barroso, in his push for the reform, accusing him of being biased towards Luiz Inácio Lula da Silva – the leftist former president who is Bolsonaro’s likely main opposition in next year’s elections.
The move by Bolsonaro to plant seeds of doubt around the integrity of Brazil’s voting system has been compared by The New York Times and other media to former US President Donald Trump’s controversial election fraud claims late last year following his loss to Joe Biden. The Brazilian leader’s critics say he is preparing to dispute an election loss to Lula da Silva.
He has even threatened that there will be no elections next year if “they’re not free and democratic.”
In a recent speech, Justice Barroso said that to “defile” the public debate with “disinformation, lies, hatred and conspiracy theories is undemocratic conduct.”
Barroso, who Bolsonaro at one point called a “son of b**ch” during a live social media broadcast, referenced the political situations in Turkey, Hungary and Nicaragua, where he said it had become common for leaders to “deconstruct, brick by brick, the pillars of democracy.”
The current voting system in Brazil allows citizens to cast their votes through electronic voting, without a paper trail. This has been the system since 2000 and it is generally considered legitimate, though some legislators have been trying to introduce mandatory paper ballots for years.
After winning in the first round in the 2018 election, but failing to secure enough votes to avoid a second round, Bolsonaro took issue with the voting system, claiming problems with the electronic method.
Before the vote in Congress on Tuesday, Brazil’s military put on a controversial display of force with a parade of troops and armored vehicles outside the presidential palace and the Congress. The military stated that the demonstration, consisting of dozens of army vehicles and hundreds of soldiers, had been planned for months. But critics accused the militaristic president of intimidation tactics.
Omar Aziz, the president of a senate probe into the government’s Covid-19 response, told the media the display was “a clear attempt to intimidate lawmakers and opponents. Bolsonaro imagines he is showing strength, but he is showing a president weakened by investigations.”

Photos from the scene show rescue workers navigating crushed vehicle parts, flipped cars and scattered debris, with portions of the highway blocked completely by loose earth fallen from the mountain above.
Search and rescue teams from India's National Disaster Response Force and other emergency agencies were immediately deployed to the site, with operations continuing overnight. What to make of this?
State election officials say 2.4 million ballots were returned in last November's election. That is 18% more than the 2 million ballots returned in the previous presidential election year.
According to Multnomah County Election Program Communications Specialist Eric Sample, state election rules were changed between the two elections to make it easier for voters who failed to sign their ballots to submit a new signature before the final results were certified.
The result of the change was dramatic. In Multnomah County, only 16% of voters who did not sign their envelope returned a new registration card in time in 2016. After the change, that jumped to 67%.
