Advisory on the rocket launch of Long March 3B/E

The Philippine Space Agency (PhilSA) confirms the launch of the Long March 3B/E rocket of the People’s Republic of China. Expected debris from the rocket launch was projected to have fallen within the identified drop zones approximately 28 NM away from Rozul Reef and 38 NM away from Patag Island.

Long March 3B/E was launched from the Xichang Satellite Launch Center in Liangshan Yi Autonomous Prefecture, Sichuan China around 09:50 AM PhST on 09 May 2024.

Details of the rocket drop zone were disclosed through a Notice to Airmen (NOTAM) warning of an “aerospace flight activity.” PhilSA has disseminated a pre-launch report to relevant government agencies and authorities prior to the launch.

Unburned debris from rockets, such as the booster and faring, are designed to be discarded as the rocket enters outer space. While not projected to fall on land features or inhabited areas, falling debris poses danger and potential risk to ships, aircraft, fishing boats, and other vessels that will pass through the drop zone. There is also a possibility for the debris to float around the area and wash toward nearby coasts. Additionally, the possibility of an uncontrolled re-entry to the atmosphere of the rocket’s upper stages returning from outer space cannot be ruled out at this time.

PhilSA reiterates its advice for the public to inform local authorities if suspected debris is sighted. PhilSA also cautions against retrieving or coming in close contact with these materials that may contain remnants of toxic substances such as rocket fuel.

Department of the Air Force officials announced the 2023 winners of the Nuclear Deterrence Operations Awards and the Nuclear and Missile Operations functional awards.

These awards recognize the outstanding accomplishments of Airmen, Guardians, and civilians contributing to nuclear deterrence operations and the missile operations career field.

“We are proud to recognize and highlight the amazing achievements of Department of the Air Force personnel across the nuclear enterprise.” said U.S. Air Force Lt. Gen. Andrew J. Gebara, Strategic Deterrence and Nuclear Integration deputy chief of staff. “This year we introduced the Personnel Reliability and Assurance Program Manager of the Year award and expanded eligibility to our Total Force partners. Congratulations to the award earners and to all the Airmen, Guardians, civilians, and teams that were nominated.”

In St. Petersburg, a bus carrying about 20 passengers lost control and dived into the Moyka River from the Potzeluev Bridge.

At least 3 are reported killed, and multiple have been taken to the hospital.

Russian Interior Ministry:

Appeals court upholds Steve Bannon’s contempt-of-Congress conviction for defying Jan. 6 subpoena

A federal appeals court on Friday upheld the contempt-of-Congress conviction of Steve Bannon, the ex-adviser to former President Donald Trump who was found guilty after failing to comply with a subpoena from the House January 6 committee.

Bannon’s conviction — and now, the DC Circuit’s affirmation of that conviction — is a boost to Congress’ leverage in its efforts going forward to obtain cooperation in its investigations.

The US DC Circuit Court of Appeals unanimously rejected several challenges Bannon made to the case, including his claim that the trial court excluded evidence he should have been allowed to put before the jury in his defense.

Bannon was sentenced to four months in federal prison, and that sentence was also upheld Friday by the appeals court. The ruling could pave the way for Bannon to eventually report to prison, though the timing is unclear.

The judge who presided over Bannon’s trial previously agreed to let him hold off from serving his sentence while his appeal played out. In its ruling Friday, the three-judge appeals panel gave Bannon time to appeal its ruling to the full DC-based appeals court before it formally notifies the trial judge that the conviction was upheld.

Bannon could also turn directly to the Supreme Court for additional appeals, possibly further delaying when he needs to start serving his prison term.

Bannon’s attorneys did not immediately respond to CNN’s request for comment.

In the DC Circuit’s new ruling, Judge Bradley Garcia, an appointee of President Joe Biden, backed the trial judge’s exclusion of an advice-of-counsel defense, as Bannon had claimed he had rebuffed the subpoena because of supposed executive privilege concerns expressed to him by his lawyer.

“This exact ‘advice of counsel’ defense is no defense at all,” Garcia wrote, noting that the contempt law only required proof that Bannon “deliberately and intentionally” did not respond to the subpoena.

His opinion was joined by Judge Cornelia Pillard, an appointee of former President Barack Obama, and Trump-appointed Judge Justin Walker.

The appeals court noted that “the communications from former President Trump’s counsel” that Bannon had tried to rely on to defend his conduct did not purport “to authorize Bannon’s refusal to produce any documents or appear for his deposition.”

The DC Circuit also rejected Bannon’s argument that the House select committee that investigated the January 6 insurrection was improperly formed.

“These objections suffer from a common defect,” the judges wrote. “Bannon did not raise them before the Select Committee and therefore forfeited them.”

Bannon is one of two former members of Trump’s inner circle who faced prosecution for not participating in the House January 6 probe. The second, former Trump White House aide Peter Navarro, is currently serving a four-month prison sentence for his 2023 conviction.

When the now-defunct House panel sought documents and testimony from Bannon in 2021, it pointed to alleged communications between Bannon and Trump in the days leading up to the January 6 Capitol attack, as well as comments Bannon made on his podcast the day before the riot that “all hell is going to break loose tomorrow.”

Bannon for some time served in Trump’s White House, but by the time of Trump’s crusade to overturn his 2020 electoral loss, Bannon had long left the federal government.

DC appellate court keeps putting on hold appellate proceedings in multiple cases pending SCOTUS decision. This motion granted Wednesday.

What this means is if SCOTUS rules against DOJ, a flood of motions to dismiss the count in pending cases, vacate existing convictions, and resentence/release J6ers imprisoned on the count.

More than 350 now chargedwith 1512(c)(2) and DOJ brazenly continues to bring the count against J6ers including a woman from California this week.

And it's even harder to describe thegratification I will feel watching these judges eat it day after day.

Holding the case in abeyance until the Supreme Court reaches an outcome in Fischer v. United States, No. 23-5572, will preserve judicial resources and avoid duplication of efforts and potentially unnecessary arguments. See Fed. R. Crim. Proc. 2 (*rules are to be interpreted to provide for the just determination of every criminal proceeding, to secure simplicity in procedure and tairness in administration, and to eliminate unjustitiable expense and delay"). JERUSALEM, May 10 (Reuters) - The main United Nations aid agency for Palestinians closed its headquarters in East Jerusalem after local Israeli residents set fire to areas at the edge of the sprawling compound on Thursday, the agency said.

Philippe Lazzarini, the head of UNWRA, said in a post on the social media platform X that he had decided to close the compound until proper security was restored. He said Thursday's incident was the second in less than a week.

"This is an outrageous development. Once again, the lives of UN staff were at a serious risk," he said.

"It is the responsibility of the State of Israel as an occupying power to ensure that United Nations personnel and facilities are protected at all times," he said.

Adam Bouloukos, director of UNRWA affairs in the occupied West Bank, said that with the aid of some colleagues, he had put out the fire which consumed around 70 metres of dry grass and scrub near the compound fence.

"We had about 100 people watching, clapping, cheering," he said, adding that most appeared to be minors.

A second fire, lit shortly afterwards, burned near the agency's fuel depot, posing a serious risk of a major explosion, he said, adding that he had been hit by stones as he sprayed the flames with a fire extinguisher.

One Obama, one Biden, and the Trump judge who screwed up the 1512c2 decision in Fischer deciding:

“GARCIA, Circuit Judge: In September 2021, the House Select Committee to Investigate the January 6th Attack on the United States Capitol issued a subpoena to appellant Stephen Bannon to testify and provide documents. Bannon did not comply he knew what the subpoena required but did not appear or provide a single document. Bannon was later convicted of violating the contempt of Congress statute, 2 U.S.C. § 192, which criminalizes "willfully" failing to

respond to a congressional subpoena. Bannon insists that "will fully" should be interpreted to require bad faith and argues that his noncompliance does not qualify because his lawyer advised him not to respond to the subpoena. This court, however, has squarely held that "willfully" in Section 192 means only that the defendant deliberately and intentionally refused to comply with a congressional subpoena, and that this exact "advice of counsel" defense is no defense at all. See Licavoli v. United States, 294 F.2d 207, 207 (D.C. Cir. 1961). As both this court and the Supreme Court have repeatedly explained, a contrary rule would contravene the text of the contempt statute and hamstring Congress's investigatory authority.Because we have no basis to depart from that binding precedent, and because none of Bannon's other challenges to his convictions have merit, we affirm.“

Appellate panel already upheld Peter Navarro's conviction.

So-a Democrat Congress can defy its own originating legislation related to a special committee; make up a crime; force Americans to comply with requests/subpoenas; use a Dem US Atty to enforce (Bannon was Matthew Graves' first indictment after taking office in Nov 2021); get a quick jury conviction in a 100% Dem city; and get a majority Dem appellate panel to affirm.

“Bannon did not comply with the subpoena in any respect. Nor, despite the Committee's warnings, did he submit by October 18 any further information bearing on the Committee's contempt deliberations. On October 19, 2021, the Select Committee informed Bannon that it had unanimously voted to recommend that the House of Representatives find him in contempt of Congress.”

“On November 12, 2021, a grand jury charged Bannon with two counts of violating 2 U.S.C. § 192. Section 192 provides that "[e]very person who having been summoned as a witness by the authority of ... any committee of either House of Congress, willfully makes default, or who, having appeared, refuses to answer any question pertinent to the question under inquiry, shall be deemed guilty" of contempt of Congress.”

To be fair,I must point out that Bannon's judge was Trump appointee Carl Nichols-who, aside from being the only judge to dismiss 1512c2 resulting in Fischer, hasn't been much better than the rest in J6 matters.

He refused to allow Bannon to subpoena members/staff of the J6 committee. Remember, folks, immunity only extends to the perps of this lawfare, not the victims.

“Finally, Bannon challenges the district court's rulings quashing trial subpoenas that he served on Select Committee members, staffers, counsel, and three House leaders. The district court held that most of the testimony and documents sought were protected by the Constitution's Speech or Debate Clause and that any information not covered by the Clause was irrelevant. Bannon then moved to dismiss, arguing that quashing resulted in a one-sided presentation of evidence that violated his Fifth and Sixth Amendment rights. The district court, after considering Bannon's detailed proffer, denied his motion because the information Bannon sought was not material to the charges or defenses properly before the jury. We again review the denial of Bannon's motion to dismiss de novo, Yakou, 428 F.3d at 246, and the district court's evidentiary rulings for abuse of discretion, Hall, 945 F.3d at 514.”

“We conclude that none of the information sought in the trial subpoenaswas relevant to the elements of the contempt offense, nor to any affirmative defense Bannon was entitled to present at trial. We accordingly need not consider whether the Speech or Debate Clause also protects the sought-after information from disclosure.“

“As discussed above, Bannon sought to put to the jury several arguments that the district court properly excluded: that the underlying subpoena was invalid because of the political motives of Select Committee members and procedurally flawed based on the Select Committee's composition and Bannon's non-receipt of a copy of Rule 3(b).”

In the wake of George Floyd’s murder, a school board in Virginia stripped the names of Confederate military figures from two schools. Four years later, the board approved a motion to restore the names.

The school board in Shenandoah County, Virginia, early Friday approved a proposal that will restore the names of Confederate military leaders to two public schools.

The measure, which passed 5-1, reverses a previous board’s decision in 2020 to change the names of schools that had been linked to Stonewall Jackson, Robert E. Lee and Turner Ashby, three men who led the pro-slavery Southern states during the Civil War.

Mountain View High School will go back to the name Stonewall Jackson High School. Honey Run Elementary School will go back to the name Ashby-Lee Elementary School.

The board stripped their names after a Minneapolis police officer murdered George Floyd, fueling a national racial reckoning. The calls for racial justice and equity inspired some communities to remove Confederate symbolism and statues of Confederate generals.

But in Shenandoah County, the conservative group Coalition for Better Schools petitioned school officials to reinstate the names of Jackson, Lee and Ashby. “We believe that revisiting this decision is essential to honor our community’s heritage and respect the wishes of the majority,” the coalition wrote in an April 3 letter to the board, according to a copy posted online.

The board considered a similar motion in 2022, but it failed because of a tie vote.

Four years ago, a previous incarnation of the board moved to change the names in a 5-1 vote, according to minutes from a meeting held July 9, 2020. The minutes say that the goal of the resolution was "condemning racism and affirming the division’s commitment to an inclusive school environment for all."

The current members said the 2020 board's decision was made hastily and without appropriate community input. About 80 people spoke Thursday before the board's vote — more than 50 of them against restoring the old names.

"I am a Black student, and if the names are restored, I would have to represent a man that fought for my ancestors to be slaves," one student said in a direct appeal to the board members, later adding: "I think it is unfair to me that restoring the names is up for discussion."

In the last decade, Confederate iconography has provoked intense sociopolitical divides across the nation.

A severe solar storm is expected to supercharge the northern lights on Friday, with forecasts indicating that auroras could be seen as far south in the United States as Alabama.

The National Oceanic and Atmospheric Administration’s Space Weather Prediction Center said Thursday that a series of solar flares and eruptions from the sun could trigger severe geomagnetic storms and “spectacular displays of aurora” on Earth from Friday evening through the weekend.

It was the first severe geomagnetic storm watch the agency has issued since 2005.

“We have a rare event on our hands,” said Shawn Dahl, a service coordinator at the Space Weather Prediction Center in Boulder, Colorado. "We're a little concerned. We haven't seen this in a long time."

Because strong geomagnetic storms have the power to disrupt communications and power grids on Earth, as well as satellites in space, Dahl said satellite and grid operators have been notified to prepare.

He said forecasters predict the storm could arrive as soon as about 8 p.m. ET on Friday.

Independent presidential candidate Robert F. Kennedy Jr. has endorsed completely unrestricted abortion “even if it’s full term.”

“My belief is that we should leave it to the woman, we shouldn’t have government involved,” Kennedy said on an episode of “The Sage Steele Show” aired on Wednesday.

Steele, who is a Catholic, pressed Kennedy further on whether he holds this position for the entirety of pregnancy, saying that “as a Catholic that definitely is a concern with many practicing Catholics.”

Kennedy responded by confirming that he would leave the decision to the pregnant woman “even if it’s full term.”

“I don’t think it’s ever OK,” Kennedy added. “I think we should do everything in our power to make sure that never happens, everything that we can do. But I think ultimately, nobody sets out to do that and there are always some kind of extenuating circumstances that would make a mother make that kind of choice, a terrible, terrible choice which is, you know, you can’t overstate how bad that is, but ultimately, I think we have to trust the woman.”

He admitted that he believes “there is a very good argument that the state has an interest in protecting a fully formed fetus,” but went on to say: “I come down to the fact that I don’t trust the state and I think we need to trust the woman.”

Kennedy’s running mate, Nicole Shanahan, a tech entrepreneur and health activist, meanwhile, was surprised by this stance, saying in another episode of “The Sage Steele Show” that unrestricted abortion until birth “is not Bobby’s position as I understand it.”

“My understanding is that he absolutely believes in limits on abortion, and we’ve talked about this,” Shanahan said, adding: “I don’t know where that came from.”

Stefanie Spear, a spokesperson for Kennedy’s campaign, confirmed with CNA that though Kennedy believes “late-term abortions are horrifying,” he “believes the mother has the final say, and moral responsibility, in such decisions.”

Spear also confirmed that if elected president, Kennedy, like Biden,would support efforts to “codify” Roe v. Wade by passing a federal law to overrule state pro-life measures.

She said that this legislation “is needed to protect body autonomy.”

Bloomberg's White House reporter Jennifer Jacobs dropped some concerning news on Thursday without any further elaboration.

News: There's a petition circulating inside the US Secret Service that flags concerns about "a number of recentSecret Service incidents indicative of inadequate training," a double standard in disciplinary actions, and avulnerability "to potential insider threats" that could pose a risk to US nat sec. It was first shared Monday,

I'm told, and has39 signaturesso far. Aim is to call for a congressional investigation, petition says.

Real Clear Politics reporter Susan Crabtree then confirmed the petition and revealed what it was about.

The petition calls for an investigationby the House Oversight Committee and theremoval of Kimberly Cheatle as the Secret Service director. It raises issues about DEIhiring superseding training and creating security issues. Whistleblowers are calling for the same type of investigation into the Secret Service that the House Judiciary just started into the FBI.

Crabtree pointed back to the incident with the agent on Kamala Harris' team, in which the agent began acting erratically and punching her superior. Concerns had been raised about her hiring and alleged DEI practices.

Obviously, this raises deep and immediate questions, not just about the safety of Joe Biden and Kamala Harris,but all Secret Service protectees, including former President Donald Trump, if you have issues involving the agents. What I find particularly disturbing in this report is the "vulnerability to potential insider threats" that Jacobs talks about. Is that talking about a specific threat?

Because it sure sounds like the whistleblowers have a concernthere that could implicate national security. And given how agencies seem to have become inundated by politics and leftists, and the animosity going into this election, that does not make me feel confident.

House Oversight needs to take an immediate look into this to ensure the safety of everyone involved and not just send a "strongly worded letter" hoping that someone answers in the next couple of months.

A Pfizer whistleblower has just leaked an internal email to the public to show that the pharmaceutical company provided employees with Covid shots that were “separate and distinct” from the injections that were rolled out for the general population.

The email suggests that high-level Pfizer employees were offered Covid shots from a batch that was reserved for a chosen few.

These doses were somehow different from the injections given to the general public.

While the email doesn’t specify how the shots were different, it emphasizes that the doses they would receive “are separate and distinct from those committed by Pfizer to governments around the world.”

These special doses would “not impact supply to national governments in any way,” the email asserts.

The email, dated January 8, 2021, was leaked to Infowars by the Pfizer insider.

The email explained to colleagues and contractors at Pfizer’s Pearl River research site that site-essential workers would be offered special doses of Covid injections.

“I am pleased to inform you that we will begin offering COVID-19 vaccinations to eligible on-site essential colleagues and contractors over the next several weeks,” reads the leaked Email.

“Eligible on-site essential contractors will be notified, either by e-mail or by their Pfizer sponsor, and will receive instructions for registering for an on-site appointment as well.”

“The vaccine doses to be used for this program are separate and distinct from those committed by Pfizer to governments around the world and will not impact supply to national governments in any way.”

The whistleblower, who has chosen to remain anonymous, told Infowars:

“I know we employees at Pfizer were receiving different vaccines and/or placebos and this was the word around my site when I worked there.”

A Boeing 737-300 aircraft suffered a significant accident during an attempted takeoff at Senegal’s Blaise Diagne International Airport early Thursday, causing serious injuries.

Air Senegal flight HC301, operated by Transair, failed to ascend and “overran the runway” around 1:14 a.m., according to a statement released by Senegal’s Ministry of Infrastructure, Land and Air Transport. The flight had been bound for Bamako, Mali, per BBC.

Of the 78 people on board, which included two pilots and four cabin crew members, eleven suffered injuries, the Senegalese military reported. Four of these passengers are in serious condition.

Videos circulating online show the aircraft with serial number 6V-AJE lying on a grassy bank, with visible damage to its left engine.

Texas Attorney General Ken Paxton has announced the arrest of Jesus Cantu-Trevino by the Medicaid Fraud Control Unit of the Texas Office of the Attorney General, in partnership with the Department of Homeland Security in Edinburg, Texas, for Conspiracy to Commit Alien Smuggling.

Cantu-Trevino orchestrated a scheme using a fictitious assisted living facility as a front and Skyline EMS ambulances to illegally transport individuals past U.S. border checkpoints. The case was investigated by Sergeant Stephen Dishong, Investigative Auditor Audra Ruble, and Captain Stacey Overbay of Paxton’s Medicaid Fraud Control Unit, in cooperation with the Department of Homeland Security and the Department of Health and Human Services. The prosecution is being handled by Assistant United States Attorney Liesel Roscher.

“To use our taxpayer-funded healthcare system as a cover for assisting illegal immigration is completely disgraceful,” said Attorney General Paxton. “As shown in this instance, exploitation of public programs for illegal alien trafficking will be met with the full force of the law.”

After weeks of drama, peace is breaking out everywhere you look across Wall Street. Even as traders have been forced to roll back their dovish monetary bets in epic fashion this year, demand to barricade portfolios from an oncoming market storm has vanished. Appetite to hedge against a stock crash has hit a nine-year low by one measure with fear fading across the options landscape big and small, from equity to fixed income.All told, a Bank of America Corp. indicator of cross-asset stress is flashing benign signals. 

It’s a sentiment shift of sorts from the higher-for-longer monetary anxiety last month that spurred investors to bid up downside protection as equity volatility rose. 

Thank a healthy earnings season(Bwahahaha…padded by the largest share buyback programs since 2018)and the enduring US economic expansion. Put another way, investors don’t see the data-dependent Federal Reserve as their enemy right now — despite their skepticism that risky assets will post big gains before the year is out. To Amy Wu Silverman at RBC Capital Markets, it’s all a little suspect – not least given the fact that the world’s most important central bank is in no rush to cut rates, among other reasons that warrant vigilance.(oh rates are going to be cut they just aren’t saying how but NYFRB Williams told ya last week the next move is to lower rates…he just didn’t say how). The serenity on Wall Street comes as the S&P 500 scored its third straight weekly advance, notching a near 1.9% gain. Treasuries climbed for a second week as credit markets advanced. The VVIX Index — which measures expected swings in the equity-volatility index itself — hit its lowest level since 2015, a sign that investor appetite to hedge against a big selloff has waned.

Next to April’s tempests, the restoration of calm suggests America’s great bull market has life. Stress started seeping out of markets right after Fed Chair Jerome Powell last week played down talk of a rate increase and eased further, as corporate earnings arrived with only a few major blemishes. The majority of S&P 500 companies have reported results and so far 79% have beaten analyst expectations, according to data compiled by Bloomberg Intelligence.

Still, removing downside protection has famously burned Wall Street bulls in the past. And economic data release after release continues to leave pros puzzled on the direction of the business cycle.

Supreme Court Justice Clarence Thomas repeatedly pushed back on his critics during remarks Friday at a judicial conference in Alabama, lamenting what he described as the “nastiness” and “lies” directed at him and calling Washington a “hideous place.”

Asked whether his jurisprudence required a degree of courage,Thomas said he didn’t view himself as courageous– particularly when compared with servicemembers, and firefighters and people who defuse bombs. Thomas said he was simply doing his job.

“Being in Washington,you have to get used to particularly people who are reckless,” Thomas, a conservative and the court’s most senior associate justice, said. “They don’t bomb you, necessarily, but they bomb your reputation or your good name or your honor. And that’s not a crime but they can do as much harm that way.”

Speaking at the 11th US Circuit Court of Appeals conference in Point Clear, Alabama, Thomas argued thatit would be a disserviceto those soldiers and first responders “not to sit at my desk and make decisions with a lifetime appointment that we know are the right decisions.”

Thomas, while not speaking directly to a series of reports about ethics that have plagued him for months, repeatedly returned to his critics without prompting from US District Judge Kathryn Kimball Mizelle, who moderated the discussion.

“My wife and I, thelast two or three years, it’s been – just the nastiness and the lies– it’s just incredible,” Thomas said.

Thomas and his wife, Ginni, have been the target of a good deal of criticism in recent years. Several of Thomas’ critics, including Democratic members of Congress, have called on him to recuse himself from Supreme Court cases involving the January 6, 2021, attack on the US Capitol because of his wife’s efforts to reverse the 2020 presidential election in former President Donald Trump’s favor.

Ginni Thomas has acknowledged attending Trump’s rally before the Capitol attack. Justice Thomas has declined to recuse himself from cases this year involving the January 6 attack, including a blockbuster appeal regarding Trump’s claims of absolute immunity from criminal charges for his efforts to overturn the election results.

Thomas has also faced criticism for accepting private jet travel and posh vacations from Republican megadonor Harlan Crow, first reported by ProPublica. In response to the blowback, Thomas updated his financial disclosure forms, and the Supreme Court adopted a code of conductfor the first time last year.

At one point on Friday, Thomas told a story about a walk he took with a friend before breaking off into an aside.

“That’s before they started attacking my friends,” Thomas said. “I hope I still have some.”

As he has in the past, Thomas also spared little criticism for Washington, DC.

“I think what you’re gonna find, and especially in Washington, [is]people pride themselves in being awful,” Thomas said one point.

The remark elicited laughter in the room, until Thomas continued.

“It is a hideous place, as far as I’m concerned,” Thomas said, noting that heliked to visit other places where people “don’t pride themselves in doing harmful thingsmerely because they have the capacity to do it.”

Thomas, 75, also appeared tolament a loss of trust within the Supreme Court, telling the conference that the stunning leak of a draft abortion opinion in 2022 wouldn’t have happened when he joined the court in 1991. It wasn’t the first time Thomas has made those points – he once likened the leak to an “infidelity” – but his remarks Friday suggested the fallout from the leak of the decision overturning Roe v. Wade may still be top of mind.

“We may have been a dysfunctional family, but we were a family,”Thomas said of the court when he first joined in 1991. “It would be inconceivable that anyone would leak an opinion of the court or do anything to intentionally harm one another.”

Thomas also became the latest justice in recent weeks to raiseconcern with the Supreme Court’s applications docket, the process the court uses to handle emergency requests. That docket has come under fierce criticism in recent years, in part because the court often decides the requests on a short timeline, usually without oral argument and often with orders that do not indicate how the justices voted.

“I think there’s some concern about that among my colleagues – certainly with me – because it short circuits our process,” Thomas said. “The way that we’re doing it now, I think, isnot a thorough way of dealing with very, very difficult issues.”

As he returned to his critics, Thomas suggested the lesson he had taken away from the last year of controversy was thathe would not react with “nastiness for nastiness.”

“You have some choices. You don’t get to prevent people from doing horrible things or saying horrible things,” Thomas said.

But, he said, he hadcome to accept “the fact that they can’t change you unless you permit that.’

Japan joined 142 nations at the U.N. General Assembly on May 10 in approving a resolution calling on the Security Council to reconsider accepting Palestine as a full member.

In order for Palestine to become a full member of the United Nations, at least nine of the 15 members on the Security Council must approve the move and with no veto from any of the five permanent members. On Thursday a three-judge panel from the United States Court of Appeals for the Ninth Circuit decided that Steven Duarte, a felon, has a “right to possess a firearm for self-defense.”

Courthouse News Service noted Duarte has five felony convictions and was a member of a street gang in Los Angeles.

The decision upholding Duarte’s gun rights was split, with George W. Bush appointee Carlos Bea and Donald Trump appointee Lawrence VanDyke deciding in the majority.

We do not base our decision on the notion that felons should not be prohibited from possessing firearms. As a matter of policy, [the prohibition] may make a great deal of sense. But “[t]he very enumeration of the [Second Amendment] right” in our Constitution “takes out of [our] hands . . . the power to decide” for which Americans “th[at] right is really worth insisting upon.” (Heller).

Duarte is an American citizen, and thus one of “the people” whom the Second Amendment protects. The Second Amendment’s plain text and historically understood meaning therefore presumptively guarantee his individual right to possess a firearm for self-defense. The Government failed to rebut that presumption by demonstrating that permanently depriving Duarte of this fundamental right is otherwise consistent with our Nation’s history. We therefore hold that [the prohibition] violates Duarte’s Second Amendment rights and is unconstitutional as applied to him.

The case is USA v. Duarte in the U.S. Court of Appeals for the Ninth Circuit.

Former MLB player Sean Burroughs passed away on Thursday after collapsing while dropping off his son for a Little League baseball game, according to the Orange County Register.

He was just 43 years old.

Burroughs, who was an assistant coach for his 6-year-old son, Knox, reportedly fell unconscious next to his car and after he was unresponsive while CPR was administered at the scene, he was pronounced dead.

His mother, Debbie, told the OC Register that the cause of death was cardiac arrest.

The son of 1974 American League MVP Jeff Burroughs, Sean had a long history in baseball.

As a youth, Burroughs starred for his Long Beach, Calif. Little League team, leading them to two straight titles in 1992 and 1993.

In 1998, Burroughs was drafted No. 9 overall by the San Diego Padres and would make his big league debut with the team at 21 years old in 2002.

Before making it to the majors, Burroughs won a Gold Medal with the United States during the 2000 Summer Olympics in Sydney.

Burroughs would go on to play seven seasons in the big leagues, playing in 528 games overall while putting up a .278/.335/.355 slash line.

He spent his first four seasons in the show with San Diego from 2002 to 2005.

Burroughs had the best season of his career in 2003 when he hit .286/.352/.402 with seven home runs and seven stolen bases in 146 games as the Padres’ starting third baseman.

In 2006, Burroughs joined the Tampa Bay Devil Rays but played in just eight games before being released. A year later, he had a minor league stint with the Seattle Mariners but never made it out of Triple-A.

Out of baseball from 2008-10, Burroughs entered a dark place as he struggled with addiction, “abusing every substance he could ingest,” as he told ESPN, before making a triumphant comeback to the diamond.

After three years away from the field, the Arizona Diamondbacks signed Burroughs to a minor league contract ahead of the 2011 season. He would play in 78 games that season.

Burroughs got one more chance in the majors with the Minnesota Twins.

He played in 10 games during what would be his last appearances at the highest level.

“Liquid water is one of the prerequisites for the emergence of life,” said Dr. Sander Goossens from NASA’s Goddard Space Flight Center and colleagues.

“Water is rarely liquid on the surface of a planet, but a number of moons in our Solar System, such as Titan, contain underground oceans.”

“These probably formed long ago, which raises the question of why they are not yet frozen in the cold environment far from the Sun.”

“Our study supports the explanation that ammonia extended the life of the liquid ocean in Titan. In addition, it provides insight into Titan’s deeper layers.”

NASA’s Cassini mission explored Saturn and its icy moons for more than a decade.

Among its many instruments, Cassini carried a radio science subsystem that enabled Earth-based radiometric tracking of the spacecraft by the Deep Space Network.

These data were used to determine the gravity field and interior structure of several of Saturn’s moons as well as those of Saturn itself. Cassini data were also used to determine Titan’s tidal response.

“The Cassini space mission flew around Saturn between 2005 and 2017,” the researchers said.

“To precisely measure Titan’s gravity, the spacecraft was sent close to the moon several times.”

“Cassini had to skim past Titan at exactly the right time to properly map the change in gravity.”

“This is because Titan’s deformation is due to Saturn’s tidal force, which depends on the distance between Titan and Saturn.”

“By measuring at times when Titan is close and far away from Saturn, the difference in Titan’s deformation and thus its effect on gravity was maximum.”

From precise radar measurements, the scientists calculated Cassini’s velocity and then the change in gravity and Titan’s deformation associated with it.

They carefully examined the effect of tides on Titan at each location in the spacecraft’s orbit and concluded that the deformation is smaller than previously calculated.

Numerical simulations of the moon’s deformation for different internal structures show that the most likely scenario is that the ocean has a density similar to that of water with a small proportion of ammonia.

“An underground ocean can help transport organic material from a moon’s rock core to the surface,” the authors said.

“For Titan, it was assumed that a thick ice layer between the ocean and the core made this difficult.”

“Our analysis suggests that the ice layer is possibly thinner than previously thought, making exchange of material between rock and the ocean more plausible.”

“The organic molecules that this can produce are seen as important ingredients for the emergence of life.”

The study was published in the journal Nature Astronomy.

In an interview with Vatican News, this was the sentiment expressed by the Head of NASA, Administrator Bill Nelson, who discussed the ongoing collaboration between the US and Holy See in space cooperation, how space exploration contributes to human fraternity, and how Pope Francis' teachings have set a powerful example for the world.

The world-renowned space expert, who led and trained space missions, also revealed why he is in town to participate in the Vatican's Human Fraternity #BeHuman meetings this weekend, and how space, offers a valuable lesson for human fraternity.

Administrator Nelson, a former Senator, also traveled to Italy this week as part of NASA’s efforts to strengthen space relationships throughout the world and to support the peaceful exploration of space.

He met with the President of the Italian Space Agency to discuss current and future collaborations, which include the Artemis Campaign to return to the Moon, the International Space Station, the exploration of Mars and Venus, and earth science missions to study our own planet.

Q: Administrator Nelson, many may not be aware of the long-standing cooperation between the US and Holy See in space exploration. Could you shed light on the valuable collaboration between the two?

I certainly will. Most people don't even know about the Vatican Observatory and its interest in space, which goes back to the time of Copernicus and Galileo and then the advancement of science ever since.

Interestingly enough, one of the scientists at the Vatican Observatory is a participant with us at NASA, in our sample return from an asteroid.

While the mission is called OSIRIS-REx, we actually returned a sample of an asteroid called Bennu, and that sample, is now at the Johnson Space Center in Houston. It is starting to be examined by the scientists, and one of those scientists, is right here, at the Vatican.

The fact that the Vatican has an Observatory says a lot about exploring the heavens. I remember in Genesis, the first line that was repeated by our astronauts when they orbited the moon for the very first time. "In the beginning, God created the heavens and the earth."

That was Apollo 8, when they came around the back side of the moon and suddenly saw Earth, and with those words, they spoke back to the people on Earth on Christmas Day in 1968. I'm very glad the Vatican is so involved with its Observatory on matters of space.

Q: You are also in Rome for the Human Fraternity #BeHuman meetings on May 11. Why is this encounter, in your opinion, significant, and why has it attracted your attention and participation?

At the outset, they kindly invited me to make a presentation to the participants, mostly Nobel Peace Prize laureates, about the Earth, and how one perceives it, from space, namely the fact that the Earth is so beautiful, so colorful, and, at the same time, looks so fragile, suspended, in the nothingness of space.

I also observed to them from the matter as an elected official, when I flew in space 38 years ago, that I observed, as I orbited the Earth every 90 minutes, I did not see racial division. I did not see religious division. I did not see political division. When you look back at Earth, you see Earth from the perspective that we are all citizens of planet Earth.

And as they discuss matters of peace, of reconciliation, of human rights in this encounter, they invited me to make some opening comments, which I was glad to do from the perspective of seeing Earth from space.

Q: From your vast experience, which ranges from having trained and flew with the crew of the Space Shuttle Columbia, mission STS-61C, the 24th flight of the Space Shuttle, which orbited Earth 98 times over six days, to being the congressional leader for the US space program, advocating to combat climate change, and being a proponent for career training and education programs in science and technology, has there been something in Pope Francis' teachings that has struck you?

Well, Pope Francis, walks his talk. The two great commands given by Jesus of Nazareth are to love God with all your heart, mind, soul, and strength, and the second one of the great Commandments is to love your neighbor as yourself. And I think that's what Pope Francis preaches all the time. He walks his talk.

Q: Administrator Nelson, you have had a busy week. Can you share what has been drawing your attention...

This is the first stop of going on to another country, Saudi Arabia, which has participated with the United States in our space program.

HELSINKI — Serbia has signed an agreement on participating in the China-led International Lunar Research Station.

Serbia’s Ministry of Science, Technological Development and Innovation signed a memorandum of understanding with the China National Space Administration (CNSA) on cooperation on the International Lunar Research Station (ILRS) earlier this week.

The development was listed in a Chinese Ministry of Foreign Affairs document published May 9, listing outcomes following Chinese President Xi Jinping’s state visit to Serbia May 7-8. CNSA has yet to issue its own statement on the matter.

The pair also signed an MoU on cooperation in the field of innovation in the exploration and peaceful use of outer space, in addition to that on the ILRS.

The China-led ILRS envisions constructing a permanent lunar base in the 2030s. This will be constructed using a super heavy-lift launcher. China also aims to send astronauts to the moon before 2030.

It will launch precursor missions in the 2020s. These include Chang’e-7 around 2026 and the later Chang’e-8 in-situ resource utilization technology test mission. Both multi-spacecraft missions will target the lunar south pole. The Chang’e-6 sample return mission—currently in lunar orbit ahead of an expected early June landing attempt—is nominally part of the program.

Chinese officials state that ILRS has a number of scientific and engineering goals. These include lunar and Earth science, astronomy, conducting experiments and resource utilization. Others are stated to involve driving technological development and laying the foundation for further space lunar exploration.

Russia this week stated it was developing a nuclear power unit for the joint lunar station, Reuters reported, citing the RIA news agency.

It is not clear how Serbia will be involved in and contribute to the ILRS at this stage. China previously stated its intent to create the ILRS Cooperation Organization (ILRSCO) to oversee and manage the project. Its establishment and subsequent meetings will likely to begin to map out Serbia’s and other parties’ involvement in the project. The development is, however, notable for a number of reasons.

“I think it speaks to the interest in getting access to the moon and not just that, but an interest in seeking out a partner that has been very effective in using space as a form of soft power outreach: China,” Victoria Samson, chief director of Space Security and Stability at the Secure World Foundation, told SpaceNews via email.

“And while the agreement was done with China, I think you can’t overlook the historical closeness Serbia has had with Russia and the ties between the increasingly autocratic president of Serbia and Putin. So signing the ILRS allows Serbia to reconfirm its connection to Russia while getting a much more tangible benefit in terms of its relationship with China.”

“The more countries that sign onto either the Artemis Accords or the ILRS, the more it is evident that it is crucial that we figure out now—while exploration there is at the very beginning stages—how best to deconflict activities on the moon and make clear what all stakeholders believe to be responsible behavior in cislunar space so that we can ensure sustainable access to the moon and its environs for the long-term,” Samson added.

Serbia becomes the 11th country to join the ILRS, following Nicaragua and Thailand in April. China and Russia formally announced the joint ILRS project in St. Petersburg, Russia, in June 2021. Venezuela, Pakistan, Azerbaijan, Belarus, South Africa and Egypt signed up during 2023.

FAA to conduct new environmental review for SpaceX's Starship operations in Florida

SpaceX will have to clear another regulatory hurdle before ramping up work with its Starship megarocket on Florida's Space Coast.

The company currently builds, tests and launches the 400-foot-tall (122 meters) Starship, which is still in development, at its Starbase site in South Texas. But SpaceX wants to add Florida to the mix as well: It aims to fly the giant vehicle from Launch Complex 39A at NASA's Kennedy Space Center (KSC), which already hosts liftoffs of SpaceX's Falcon 9 and Falcon Heavy rockets.

In 2019, a NASA-led environmental assessment (EA) concluded that Starship operations at KSC wouldn't significantly affect the surrounding ecosystem. However, SpaceX's plans for the site have changed since then, and a more in-depth review — an environmental impact statement (EIS) — is therefore now in order, the U.S. Federal Aviation Administration (FAA) announced today (May 10).

"While the 2019 EA prepared by NASA provides an analytical baseline, the environmental impacts of these proposed changes to Starship-Super Heavy LC-39A development and operations will be specifically analyzed in this EIS," FAA officials wrote in a statement today (May 10).

Starship consists of two elements, both of which are designed to be fully and rapidly reusable — a giant first-stage booster called Super Heavy and a 165-foot-tall (50 m) upper stage known as Starship, or simply "Ship." SpaceX views the vehicle as potentially revolutionary, saying it could make Mars settlement and other ambitious exploration feats economically feasible.

A fully stacked Starship has launched three times to date. The first occurred in April 2023, the second in November 2023 and the third on March 14 of this year. Each of those flights lifted off from Starbase, and each of the latter two lasted longer and notched more milestones than its respective predecessor.

Proposed Starship activities at LC-39A that were examined by the 2019 EA involved infrastructure development, as well as approximately 24 launches per year, FAA officials explained.

"SpaceX now proposes to construct additional launch infrastructure not previously contemplated in the 2019 EA; launch an advanced design of the Starship and Super Heavy vehicle; operate at a projected higher launch tempo; and land the Super Heavy booster at LC-39A in support of the reusability concept. Starship landings are no longer proposed to occur at Landing Zone 1 at Cape Canaveral Space Force Station," the officials wrote in today's update. (Cape Canaveral Space Force Station is next door to KSC.)

The revised plan envisions up to 44 Starship launches from LC-39A per year, FAA officials added in an emailed statement today.

SpaceX is responsible for preparing the EIS, under the supervision of the FAA. The agency is inviting input on the matter; it will hold two in-person public meetings on the Space Coast on June 12 and a third on June 13, as well host as a virtual meeting on June 17. Public comments can also be submitted from today through June 24.

A positive result on the EIS would not clear SpaceX to start launching Starship from KSC, by the way; the company would still need to obtain a vehicle operator's license from the FAA.
