U.S. Attorney Durham Announces Departure from Office

After serving as the United States Attorney for the District of Connecticut for more than three years, and as a federal prosecutor in Connecticut for more than 38 years, John H. Durham today announced his resignation from the U.S. Attorney’s Office, effective at midnight on February 28.

“My career has been as fulfilling as I could ever have imagined when I graduated from law school way back in 1975,” said U.S. Attorney Durham. “Much of that fulfillment has come from all the people with whom I’ve been blessed to share this workplace, and in our partner law enforcement agencies. My love and respect for this Office and the vitally important work done here have never diminished. It has been a tremendous honor to serve as U.S. Attorney, and as a career prosecutor before that, and I will sorely miss it.”

Prior to his appointment as an interim U.S. Attorney in November 2017 and subsequently as the presidentially appointed U.S. Attorney in February 2018, Mr. Durham served as an Assistant U.S. Attorney in various positions in the District of Connecticut for 35 years, prosecuting complex organized crime, violent crime, public corruption and financial fraud matters. From 1978 to 1982, he served as an Assistant State’s Attorney in the New Haven State’s Attorney’s Office, and from 1977 to 1978, he served as a Deputy Assistant State’s Attorney in the Office of the Chief State’s Attorney.

First Assistant U.S. Attorney Leonard C Boyle will serve as Acting U.S. Attorney upon Mr. Durham’s departure.

“The Office will be in the extraordinarily capable hands of Len and our superb supervisory team who, together, guarantee that the proper administration of justice will continue uninterrupted in our District.”

Mr. Boyle has served as First Assistant U.S. Attorney since June 2018, when he returned to the U.S. Attorney’s Office after serving as Deputy Chief State’s Attorney in Connecticut for approximately nine years. He previously served in the U.S. Attorney’s Office from 1986 to 1998, and from 1999 to 2004.

Mr. Boyle is the 53rd U.S. Attorney for the District of Connecticut, an office that was established in 1789.

The U.S. Attorney’s Office is charged with enforcing federal criminal laws in Connecticut and representing the federal government in civil litigation. The Office is composed of approximately 68 Assistant U.S. Attorneys and approximately 54 staff members at offices in New Haven, Hartford and Bridgeport.

Short-sellers take aim at Chinese blockchain firm SOS, shares tumble

Short-sellers Hindenburg Research and Culper Research said on Friday they have taken a short position on Chinese blockchain firm SOS Ltd’s stock, sending the company’s shares down 23%.

In two separate reports, they raised concerns ranging from regulatory risk to alleged false claims by the company about its business. SOS, formerly a consumer-lending company called China Rapid Finance, could not be immediately reached for comment outside business hours in China. SOS shares have nearly doubled in value this year since it outlined plans to invest in cryptocurrency on Jan. 13, benefiting from a rise in institutional support for bitcoin and other digital assets. “Stocks tied to blockchain have been on the run lately, swept up in the euphoria of bitcoin breaking all-time highs. $SOS has ridden this wave,” short-seller Hindenburg said in a tweet.

The short-seller said it visited the address listed as headquarters in the company’s regulatory filing and found it to be a hotel. One of the allegations made by Culper is that SOS has not actually purchased the cryptocurrency mining rigs that it said it did.

U.S. SEC suspends trading in 15 securities due to 'questionable' social media activity

he U.S. securities regulator on Friday suspended trading in the securities of 15 companies because of “questionable trading and social media activity,” the latest in a string of temporary trading halts amid volatile trading in so-called “meme stocks.”

The Securities and Exchange Commission acted because none of the companies have filed any information with the regulator for over a year, it said in a statement. This is the regulator’s third and largest wave of suspensions in response to social media activity. Retail interest in certain stocks, most notably GameStop Corp, has surged in a social media frenzy, leading to volatile trading.

The SEC is continuing to review market and trading data to spot other securities to “to potential attempts to exploit investors during the recent market volatility,” the agency said on Friday.

NYSE begins move to delist Chinese state oil producer CNOOC

The New York Stock Exchange on Friday decided to begin formal delisting of Chinese state oil giant CNOOC Ltd based on an update to an executive order signed by former U.S. President Donald Trump in November last year.

Prohibitions on CNOOC will take effect on March 9, 60 days after the company was added to the list that prohibits U.S. investments, according to a guidance issued by the Treasury Department on Jan. 27. However, the exchange did not disclose a target date for the completion of the delisting.

The Trump administration had last year moved against certain Chinese companies that Washington said were owned or controlled by the Chinese military in an effort to ramp up pressure on Beijing. The NYSE said CNOOC has the right to appeal the delisting decision. The exchange will include any appeal it receives in its application to the U.S. Securities and Exchange Commission, which will be submitted on completion of all procedures.

CNOOC could not be immediately reached for comment.

Good News: After Public Pressure New Hampshire AG’s Office Rescinds Plan to Move Voting Machines to State Capitol for Investigation

On November 3rd, Republicans won all 4 seats in the NH House of Representatives for the town of Windham. On a hand recount requested by one of the Democrats who lost, all 4 Republicans gained on average over 6% from their original vote total and the Democrat who asked for the recount, lost over 2% of her original total.

After repeated foot-dragging and refusals by the Attorney General’s office to look into this, the largest vote total discrepancy in the history of the State, last Thursday, the NH Senate voted unanimously, 24-0, to pave the way for the AG to do his job and investigate. SB43 was originally put on a fast track to go directly to the House floor for a vote, bypassing the usual committee hearing process. But, at the last minute, House Democrats refused to support such a rules change, forcing the bill to be heard in the House Election Law Committee in early March.

In the lead-up to the planned House vote this week, the AGs office, in a surprise move Monday, notified the town of Windham of their intent to take possession of the 4 voting machines, owned by the town and its citizens, even before the legislative process had been completed. The bill hasn’t passed and therefore is not even ready for signature by the Governor.

Why is the AG suddenly so anxious to take possession of these machines?

After the change in the scheduled vote and swift public outcry to this planned removal of the machines, the AGs office rescinded this notice yesterday.

As this audit is being done to reassure the citizens of Windham that their machines indeed operated properly on Nov. 3rd and that their votes were counted accurately, it is felt by most involved that this Windham audit should be done in front of its citizens, not in the distant State capital of Concord.

It makes no sense to subject sensitive electronic machinery to needless transport in winter and then leave them unattended in Concord, rather than locked in a secure vault in the town, which has ownership of the devices. In following with this sentiment, town officials indicated they would likely refuse to unlock the vault and allow this apparent confiscation of their machines.

To those advocating for this long-delayed investigation, it is clear the AGs office has lost the trust of the people to whom it is accountable, the citizens of not just Windham, but New Hampshire. They have clearly demonstrated their office to be an unwilling participant in this audit process and disrespectful to the rights of the citizens. SB43 is currently scheduled to be heard in the House Election Law Committee on March 5 at 10:30 am. Concerned citizens of the State should contact Committee members to urge support for this bill.

GA State Election Board Drinks Dominion Kool-Aid…Fatally Flawed Hand Count Audit Did NOT Prove Voting System Accurate…

Secretary of State (SOS) Brad Raffensperger invited Dominion CEO John Poulos to speak at the State Election Board (SEB) meeting today in an effort to justify the performance of their expensive, unverifiable voting system that accumulates votes hidden in QR codes voters cannot read. Ironically, Poulos said his company was a victim of “disinformation” while being quick to falsely claim that his Ballot Marking Device (BMD) system produces a “voter verified paper ballot”. If any of our readers know a voter who can verify the content of QR codes produced by the Dominion BMDs please let us know. Testimony in the Curling v. Raffensperger case against Georgia’s Dominion voting system indicates Dominion QR data is encoded but not encrypted. That means it is hackable by outside sources but the voter cannot interpret it even with a QR code reader. It is the worst of both worlds.

Mr. Poulos repeated the common talking point that “nearly 5 million paper ballots were counted three times in the state of Georgia”. That claim is cleverly misleading because:

- The original Georgia count was derived by accumulating hidden votes in the QR codes on the ballots produced by the BMDs

- The machine recount simply rescanned the same QR codes and reprinted the previous unverifiable results

- The hand count audit was too horribly flawed to verify the count of any voting system as we will explain.

Poulos continually claimed his Democracy Suite 5.5 system was proven to be accurate in the November 3rd election by the hand count audit that the state conducted for all ballots 10 days later. This might have been true had the hand count audit not been compromised with three fatal flaws in key Georgia counties. A sworn affidavit from VoterGA’s election integrity expert, Garland Favorito, who served as an audit monitor, recount monitor, State Farm Arena observer, Fulton tabulation observer and monitor coordinator, explains how the SOS and key counties subverted an otherwise beneficial audit:

Police in Nigeria’s Zamfara State have said that 317 schoolgirls were abducted in an armed raid on Friday morning, just one week after 42 people were kidnapped from a boys’ school in neighboring Niger State last week.

“The Zamfara State Police Command in collaboration with the military have commenced a joint search and rescue operation with a view to rescuing the 317 students kidnapped by the armed bandits in Government Girls Science Secondary School Jangebe,” police spokesman Mohammed Shehu said in a statement on Friday.

Speaking earlier on Friday, Sulaiman Tanau Anka, information commissioner for Zamfara State, told Reuters that the girls were taken in a midnight raid by unknown gunmen. Anka added that the attackers came with vehicles and transported the schoolgirls away.

Amnesty International Nigeria called the attack “a serious violation of international humanitarian law” and called on the authorities to do everything in their power to bring about the students’ safe return.

The predominantly Muslim state, which borders the Republic of the Niger to the north, has been repeatedly targeted by bandit groups in recent years. Officials speaking on condition of anonymity told Reuters that the rise in abductions has been fueled in part by sizable government payoffs in exchange for the children.

Just last week, gunmen attacked a boys’ school in neighboring Niger State in Nigeria and abducted 42 people. More than 300 boys were kidnapped from a school in Kankara in December, during President Muhammadu Buhari’s visit to his home state.

In 2014, ISIS-linked jihadist group Boko Haram seized 276 girls aged between 12 and 17 from the Government Girls Secondary School in the remote town of Chibok, in Nigeria’s northeastern Borno State. While a number of the girls have made successful escapes or been released, more than 100 remain missing.

Citi Says Regulators in Asia Probing Equity Sales Trading Desk

Citigroup Inc. said regulatory agencies in the Asia Pacific region are probing the firm’s equity sales trading desks. The probes are tied to facilitation trades, or transactions in which the bank “trades fully or partially as principal,” Citigroup said in its annual regulatory filing on Friday. The firm said it is cooperating with the investigation.

The bank also provided an update on the $894 million it mistakenly sent to a band of lenders to the troubled cosmetics giant Revlon Inc. in August. Some lenders opted to return roughly $389.8 million, and the bank sued 10 fund managers to recoup the remaining funds. After a trial that was closely watched across Wall Street in December, Citigroup unexpectedly lost the case earlier this month. The bank continues to believe it is entitled to the funds and has said it will appeal.

“As a result of the court’s decision, Citi now has rights as a creditor related to the Revlon loan,” Citigroup said in the filing.

I have long advocated that the practice of law is nonpartisan. There is no room for politics in a court of law. Lady Justice wears a blindfold. Every person is equal in the eyes of the law.

When politics infects the administration of justice, bad things happen. The worst being an injustice is inflicted on a party. An injustice on one is an injustice to ALL in a system based on the rule of law.

Look back earlier this week and this year to the failure of the U.S. Supreme Court to accept 2020 election cases for review and decision.

In my opinion, the Court had a duty to accept the cases and issue a ruling on the competing legal issues. The ultimate ruling should have been a legal ruling based on the law regardless of which side prevailed. The law is the law.

In my opinion, the problem with SCOTUS’ action (or inaction) is that the failure to review the cases in the first instance was a political decision.

While politics obviously plays a role in the selection and confirmation of Supreme Court justices, political considerations must END when a Justice takes the sworn oath to interpret and apply the law pursuant to the Constitution. Being faithful to that sworn oath is the ONLY safeguard to insure that we have EQUAL JUSTICE UNDER THE LAW.

Now let’s next examine the problem on a personal level.

The personal issue is the actions being taken by the State Bar of Georgia against me. Look at the Bar’s unjustified demand that I submit to a mental health examination without telling me the basis for the demand and without even identifying the examiner. Talk about a total absence of due process!

The State Bar also threatens my Bar license based on my personal expressions of free speech and my involvement in lawsuits which challenge the validity of the 2020 election. Talk about an effort to exceed the lawful scope of its duties to regulate the practice of law!

Why is the State Bar of Georgia engaging in an unjustified and unlawful witch hunt against a member of the Bar with an unblemished 43-year record?

Politics.

The reality is that the GA State Bar for the past many years does not represent the interests of We The Lawyers who make up the Bar of Georgia. The GA State Bar only represents and advocates the interests of the political officials who hold the key to power in the organization. In short, the State Bar of Georgia is a political organization. Not good for the practicing lawyers who should have the power to regulate themselves as members of the Bar.

Sounds kinda like what has happened to our country, doesn’t it? The government “officials” have forgotten about We The People.

It is time for We The People to clean up government and return the power to the People where it rightfully resides in the first instance.

It is time for We The Lawyers in Georgia to clean up the State Bar of Georgia and return the power to the practicing lawyers where it rightfully resides in the first instance.

The practicing lawyers in Georgia are intimidated and fearful of speaking up against the State Bar of Georgia about its clear mistreatment of me. These lawyers need to reach deep inside themselves and find the courage to fight back for me. While the GA State Bar is now coming after me, sooner as opposed to later the State Bar will be coming after them based on politics.

It is time for lawyers around the country to wake up and put aside preferences and stand for principles. It is time for ALL lawyers to take politics out of the practice of law and fight honestly for what is right.

The practice of law is nonpartisan.

Myanmar's UN envoy raises stakes, stating 'coup must fail'

Myanmar's ambassador to the United Nations gave a sweeping denunciation of the coup in his country on Friday, giving a boost to the anti-military protests at home and raised the stakes for U.N. member countries in their responses to the coup that has killed at least four civilians.

In an extraordinary speech to the General Assembly's informal plenary on Myanmar, Ambassador Kyaw Moe Tun called on the international community to reject the coup and "use any means necessary" to act against the military regime and protect the country's people, stating that "the coup must fail." His speech overshadowed, but did not outweigh, the strength of preceding remarks by Christine Schraner Burgener, the U.N. special envoy on Myanmar. For the first time since Feb. 1 coup, Burgener urged countries not to "lend legitimacy or recognition" to the military regime, saying the coup was a clear violation of Myanmar's constitution "regardless of what they claim."

She called for the restoration of democracy and gave the first high-level endorsement to a small group of National League for Democracy members of parliament, who were elected in the Nov. 8 poll but were unable to take their seats due to the putsch. The NLD is the party of Myanmar's democracy icon Aung San Suu Kyi, who was deposed as de facto leader after being arrested during the coup. The group, called the Committee to Represent the Pyidangsu Hluttaw (CRPH), is a fledgling movement that began with barely 15 MPs who held a virtual swearing-in ceremony on Feb. 4. The CRPH has since struggled for international acknowledgment. But Burgener's endorsement, which is seen as having the backing of the U.N. Secretary-General Antonio Guterres, could give the body legitimacy as a form of "parliament in exile," according to several diplomats at the U.N.

It not only provides Myanmar's vast-but-leaderless protest movement a platform to communicate with the outside world, it provides a channel for the international community to communicate with the protest movement. The CRPH on Wednesday announced it had appointed a representative to the U.N. and to handle international relations. The question now is whether the U.N. can or would accept a CRPH representative, even as an informal envoy, and whether it would stand by Myanmar's incumbent U.N. ambassador – who may be forced to seek asylum in the U.S. or elsewhere.

"The U.N. has now said that the military regime is illegitimate; Ambassador Kyaw Moe Tun's credentials were issued by the unlawfully removed NLD government," said Laetitia van den Assum, a former Dutch ambassador and former member of the Rakhine Advisory Commission led by the late U.N. Secretary-General Kofi Annan, which investigated the sectarian strife in Myanmar's Rakhine state. "If the junta tries to revoke the appointment of the ambassador and to appoint a new one, U.N. members may be forced to make a choice," she said. Burgener's remarks, she noted, indicated a "game changer" for the U.N. "She clearly stated the junta is illegitimate, while lending credibility to the CRPH. So, it is not the Tatmadaw vs. the NLD. It is the Tatmadawa vs the people of Myanmar," van den Assum added, using the name of Myanmar's military.

Junta leaders have yet to comment on Kyaw Moe Tun's status. In his address to the General Assembly, he spoke in a measured tone that occasionally faltered with emotion, and called for "further strongest possible action from the international community to immediately end the military coup, stop oppressing the innocent people… and to restore democracy."
