Here's your flaw: decontextualization.
The audience of the passage is presupposed to already be believers (v. 17, tell it to the church), so either of the people called you in "if the two of you agree" can't be an atheist.
The "anything that they may ask" is also meant to be related to church discipline, as you can tell by reading verse 18.
