the point is that TOR (with the proper encryption) makes it so that not even the NSA can create a backdoor for it. You can get traced, sure, but its nothing an ISP has the tools for

TOR makes it so that they know you use it, but they dont know what sites you went to. So if they deny you service without reasonable evidence, or a stretch of a "good" reason, then they are cornered.
