School Employee Sues District for Israel Loyalty Oath in Contract

In a return to the bad old days of McCarthyism, Bahia Amawi, a US citizen of Palestinian descent, lost her Texas elementary school job after refusing to pledge in writing that she would not participate in the Boycott, Divestment and Sanctions (BDS) movement. Earlier this month, Amawi sued the school district that fired her.

The BDS movement against Israel has become a hot button issue in the closing month of 2018. A bipartisan group of senators tried to attach the Israel Anti-Boycott Act to the unanimous spending bill that Trump almost signed to avoid the current government shutdown. Meanwhile, Donorbox, a US software company, blocked the BDS fundraising account at the behest of a pro-Israel group.

“The language of the affirmation Amawi was told she must sign reads like Orwellian – or McCarthyite – self-parody, the classic political loyalty oath that every American should instinctively shudder upon reading,” Glenn Greenwald wrote at The Intercept.

On December 12, the Council on American-Islamic Relations filed a lawsuit on Amawi’s behalf in the US District Court for the Western District of Texas against Pflugerville Independent School District, alleging that Texas’ law requiring the oath violates the First Amendment. Amawi’s complaint says the law constitutes an impermissible attempt “to impose an ideological litmus test or compel speech related to government contractors’ political beliefs, associations, and expressions.”

Amawi had contracted with the school district for nine years to work with students with autism and developmental disabilities in Austin. This fall, for the first time, Amawi was required to sign an oath that she would not boycott Israel. When she refused to sign it, she was fired.

9th Circuit Sides With Trump On Environmental Waivers For Border Wall

The 9th Circuit Court of Appeals ruled for the Trump administration Monday in a case challenging its use of waivers to bypass environmental regulations in constructing parts of the border wall.

The state of California and several environmental groups sued President Donald Trump and the Department of Homeland Security (DHS) in September 2017 to stop construction of a border wall prototype and ongoing repairs to 14 miles of an existing barrier in San Diego. “Under the Illegal Immigration Reform and Immigrant Responsibility Act of 1996 (IIRIRA), the Secretary of the DHS has long had the authority ‘to install additional physical barriers and roads … in the vicinity of the United States border,'” the 9th Circuit’s opinion states, quoting the IIRIRA.

The IIRIRA grants the secretary of the DHS “the authority to waive all legal requirements” as is “‘necessary to ensure expeditious construction’ of those barriers and roads,” according to the 9th Circuit.

The 9th Circuit’s three-judge panel ruled 2-1 in favor of the federal government. The dissenting judge, Consuelo Callahan, wrote she supported the Trump administration’s argument, but thought the court lacked jurisdiction to review California’s appeal.

The DHS waived provisions of the National Environmental Policy Act and the Coastal Zone Management Act in 2017, expediting approval to begin construction of the border wall prototype and repairs.

The ruling is another legal victory for Trump in the case after U.S. District Judge Gonzalo Curiel ruled against California in February 2018. Curiel found “Congress delegated to its executive counterpart, the responsibility to construct border barriers as needed in areas of high illegal entry to detect and deter illegal entries.”

Banker fraud extravaganza: CumEx Files reveal 55 billion euros worth of dividend tax fraud

A cross-border collaboration of investigative journalists has revealed a major tax fraud scheme by bankers and lawyers. Although dubbed ‘the heist of the century’ because of the vastness of the scam impacting multiple countries, this story has received little attention in the mainstream media across Europe.

Mexico's state-run electric company is looking to renegotiate generous natural gas contracts it has with private sector firms that stipulate payments even when gas isn't being delivered.

Federal Electricity Commission director Manuel Bartlett said Monday the company runs the risk of bankruptcy if it doesn't reach new terms with the companies. He said that since 2015, it has paid private sector companies 62 billion pesos ($3.2 billion) under contracts for gas delivered via pipeline to generate electricity, even when the gas isn't flowing. Several projects have been blocked by community protesters.

President Andres Manuel Lopez Obrador expressed optimism that the contracts could be revised voluntarily, while lambasting their existence in the first place. Several of the companies involved have ties with former government officials in Mexico.

"They have done juicy business under the protection of public power; they have inked unfair contracts, contracts that favor individuals," Lopez Obrador said.

Lopez Obrador compared the private sector investment to a "conquest," a loaded word in Latin America that alludes to the Spanish conquistadors who laid stake to the region.

"Mexico is no longer a land of conquest, this is over," he said, adding later that the private sector incursions into the energy sector were facilitated by influence peddling and government compliance. "There were no borders," he said.

Bartlett listed three companies that he said enjoy payments from the company, known as the CFE, despite stalled gas lines. One of those companies, IEnova, said in a statement: "All of IEnova's natural gas transport pipelines with CFE were awarded through open, transparent, international public bid processes, according to international industry standards."

The company, a unit of San Diego-based Sempra Energy, said that an IEnova pipeline that began serving CFE in May 2017 went offline the following August due to "acts of sabotage" that were reported to local and federal officials.

IEnova also defended its chairman, Carlos Ruiz Sacristan, after Bartlett named him as one of several former government officials who benefited from private deals with CFE. Bartlett and Lopez Obrador blame past administrations for letting CFE infrastructure fall intro disrepair while outsourcing services.

Ruiz Sacristan served as communications and transport minister for six years through 2000, under President Ernesto Zedillo.

"In his professional career in both the public and private sectors, he has conducted himself ethically, honestly, and transparently," IEnova said of Ruiz Sacristan.

During an interview with Mexican TV station Milenio, former President Felipe Calderon defended the contracts, calling them common in the energy industry. "Otherwise very complicated projects couldn't be financed," he said.

Such understandings protect the contractor in the case of community opposition or decisions on behalf of the client to, say, produce electricity by burning coal rather than natural gas.

(e) Counterclaim Maturing or Acquired After Pleading. The court may permit a party to file a supplemental pleading asserting a counterclaim that matured or was acquired by the party after serving an earlier pleading.

(g) Crossclaim Against a Coparty. A pleading may state as a crossclaim any claim by one party against a coparty if the claim arises out of the transaction or occurrence that is the subject matter of the original action or of a counterclaim, or if the claim relates to any property that is the subject matter of the original action. The crossclaim may include a claim that the coparty is or may be liable to the crossclaimant for all or part of a claim asserted in the action against the crossclaimant.

(h) Joining Additional Parties. Rules 19 and 20 govern the addition of a person as a party to a counterclaim or crossclaim.

(i) Separate Trials; Separate Judgments. If the court orders separate trials under Rule 42(b), it may enter judgment on a counterclaim or crossclaim under Rule 54(b) when it has jurisdiction to do so, even if the opposing party's claims have been dismissed or otherwise resolved.

Some of us heard—it was understood who he was referring to as giving him this great advice to recuse himself—and you could say they were in career positions. But these were not the career positions or officials of days gone by when a U.S. attorney or even somebody in the Justice Department here in Washington could be trusted to give nonpolitical advice.

But as we have seen in the Department of Justice and FBI scandals of the last few years, we have people who were disastrously political that were seeking political victories through the Justice Department and certainly were not the nonpartisan, bipartisan people of the past.

I know from working with U.S. attorneys and assistant U.S. attorneys in decades past, we knew how they voted. We knew party allegiance, whether they were Republican or Democrat, but when it came to criminal law, criminal violations, those things, they may have different personal philosophies, but justice was justice. And if somebody violated the law, they were going to pursue it. They were not going to let party affiliation or their regard or lack of regard for the President or anybody else keep them from pursuing justice.

But this has been an extraordinary time in American history when we have found a Department of Justice had officials to the very top who were far more political than they were just; where people, even an Attorney General, would say they had a chance meeting on a tarmac, when the facts of the day indicate it really could not have been a chance meeting on a tarmac. And if it hadn’t been for a reporter spotting what he thought might be former President Bill Clinton, nobody would have ever known about that meeting while, supposedly, Hillary Clinton was under investigation.

We now know there was never going to be any prosecution of Hillary Clinton, no matter how grievous or egregious any criminal violation may have been, even if it meant obstructing justice by destroying emails that had been subpoenaed and destroying with a hammer or with BleachBit cellphones or computers.

This is clearly obstruction of justice. Those would have been lay-down cases to get convictions. But it was now clear those were never going to be pursued because the people who were in position supposedly career, some political appointments, they were not going to let that happen.

Now, people like Andrew McCabe and Peter Strzok—the guy is the head of FBI counterintelligence, and he has no problem lying over and over and over again. Then he has the gall to come in and basically say as his deposition testimony ended, oh, he always tells the truth.

There were stories after the shock to the Obama administration in having Donald Trump win, the arrogance that existed in the Democratic Party that, gee, there is no way Donald Trump could win, even though it certainly appeared to be funny at the time when President Obama—I think it may have been on Letterman where he read something about a comment that Obama would go down as the worst President, and he said: Yeah, at least I will go down as having been President.

Everybody laughed because, gee, how could he ever get elected President? Well, he did.

So there were articles written and word spread that in the remaining days of the Obama administration after Donald Trump was elected President, there was a flurry of activity in November, December, and early January to move people from political appointment positions into career positions in all these different government departments and agencies, including the Department of Justice.

If you look at the person who answered to Rod Rosenstein, Tashina Gauhar—she was the liaison between the National Security Council and the Attorney General, but she answered directly to Rod Rosenstein. That was a change I understood that occurred in the organizational chart for DOJ some time back.

I tried to tell Jeff and persuade him: You need to reorganize. You need to have critical positions answering directly to you.

He didn’t know why he kept getting such late notices to NSC meetings. Everybody else got them timely What I heard was Tashina Gauhar was getting them timely like everybody else but delaying Jeff Sessions getting them, so he would either develop a conflict or he would not have time to properly prepare. He would go into the meetings looking bad before the National Security Council, because he wasn’t as prepared as others were because he didn’t get his notices timely as he should have because a person who was more—or certainly appeared to be much more—devoted to Sally Yates and her obstruction of the Trump administration was the one who was supposed to pass on those notices to Jeff Sessions.

As we are seeing, there were people who have been forced to leave the DOJ and leave the FBI in scandal for lying. I understand Andrew McCabe supposedly is currently being investigated for criminal violations. This is a guy right there close to the top, nearly the top, and he had become a political hack and a political operative.
