The shooting last summer was captured on video and was widely disseminated on social media.
Powell Sr. said he served 14 years in the U.S. Navy submarine service and was performing as a street entertainer when he was approached by Timm. Powell said Timm accused him of being a “fake veteran.”
Powell Sr. said he tried to retrieve identification from his bag to prove his service, but the situation turned physical. Police said Timm ripped a military patch from Powell’s items. Powell said he took out his knife in response.
Witnesses told police that when Timm did not back away, Powell Sr. displayed a holstered airsoft gun. Timm then pulled a firearm from his backpack and shot Powell Sr. in the chest.
