This game is called "Make the other guy concede by mistake."

Prompt action makes all the difference. It won't be the only game. It may not be the most important one. But put it on your radar because it's real.

In the following two cases an artificial total was announced along with pressure to hurry up and concede.

THE PATTERN:

- Election flipped

- Winner called by mistake

- Votes slipped in and out of temporary pockets.

- Candidate pressured to concede based on false results

- In each case, false votes were injected in a small out-of-the-way county.

- In each case, false totals were exactly the amount needed to call the election.

- In each case, frenzied demands to concede followed the wrong election call.

- In each case, there were calls for recounts but the damage had been done. A presumptive winner claimed to be the victor, casting the other candidate as crooked or a loser.

- In each case, the false result was never explained at all by anyone.

- In each case, the false total was later removed. But if either candidate had conceded, it would have been moot.

DETAILS:

Example 1: Alabama, Baldwin County, Don Siegelman v. Bob Riley governor's race, 2002: 6,334 votes were added to Don Siegelman's total, producing more votes than voters.

Example 2: Florida, Volusia County, Bush v. Gore 2000: Minus 16,000 votes were injected into Al Gore's total.

BALDWIN COUNTY AL: Pocket to pocket - Thousands of votes oddly appeared for a little-known Libertarian candidate named John Sophocleus. Also, an astonishing 13,935 "write-in votes" popped up in a state senate race.

VOLUSIA COUNTY FL: Pocket to pocket - Temporarily, over 10,000 votes showed up for the Socialist Worker Party candidate, more votes than that party received nationwide.

ALABAMA - As that night wore on, votes from large urban areas were slow to come in and the pressure hit Baldwin County to report. And so it did, a bogus result with nonexistent votes.

FLORIDA - John Ellis, hired as an analyst for Fox TV News, knew exactly the margin needed to call the 2000 presidential race for Bush. He was privy to Voter News Service data, and he spoke several times during the evening to his two cousins: Jeb and George W. Bush.

At 2:09 a.m., the required vote margin appeared from Volusia County. At 2:10 a.m., this margin was enhanced by 4,000 false votes in Brevard County. At 2:16 a.m., Ellis called the race for Bush. Within four minutes, NBC, CBS and ABC followed suit.

ALABAMA - Siegelman promptly declared victory based on 6,334 impossible votes. He continued to refer to himself as "governor" long after the result had been corrected and the race declared for Riley.

FLORIDA - Under pressure, not knowing that the seemingly insurmountable lead was based on 20,000 false votes, Al Gore called George Bush to concede.

ALABAMA - A squad of Democratic lawyers showed up at the Baldwin County courthouse. By this time it was known that the 6,334 votes were incorrect.

"They were just insistent; they were going to go out there and certify those totals before there was any chance to look into this," said the probate judge whose duties included overseeing elections.

FLORIDA - While on his way to make a speech to concede to the nation, Gore learned of the Florida anomaly and withdrew his concession. He was just 500 votes behind and the race was too close to call.

Howls of anger erupted from the Bush campaign.

ALABAMA - In the end, at least three sets of vote totals and zero answers came out of Baldwin County. The only answer we got was this, from ES&S technician Mark Kelley:

"Something happened. I don’t have enough intelligence to say exactly what."

FLORIDA - Volusia County employee Lana Hires asked the technical staff for help at Global Election Systems (soon to become Diebold Election Systems).

"I need some answers!" she wrote. "Our department is being audited. I have been waiting for someone to give me an explanation as to why Precinct 216 gave Al Gore a minus 16022. Will someone please explain this?"

Global Election Systems' John McLaurin tossed the hot potato to Sophia Lee and Talbot Iredale:

"Sophia and Tab may be able to shed some light here, keeping in mind that the boogie man may be reading our mail."

Talbot Iredale, senior vice president for research and development, replied:

"Only the presidential totals were incorrect….Invalid memory card. There is always the possiblity that the 'second memory card' or 'second upload' came from an un-authorised source."

If you strip away the partisan rancor over the 2000 election, you are left with the undeniable fact that a presidential candidate conceded the election to his opponent based on results from a second memory card that mysteriously appeared, subtracted 16,022 votes, then just as mysteriously disappeared.

“God saved Trump’s life for a reason,” the chaplain said, inferencing the assassination attempts on his life, “and while He can’t save your corporeal self, He can save your soul if you repent.”

“Fuck off,” Smith told him.

Admiral Crandall told Smith the Deep State’s warfare and lawfare against Trump was at an end and that all like him would eventually face tribunals. He even said to Smith that the Deep State was retiring his body double and abandoning its indictment of Trump.

“You’ve lost, detainee Smith,” the admiral said. “You were destined to lose.”

Smith’s neck snapped five minutes later, his notorious career as a Deep State agent ending in grisly but justifiable fate.

President-elect Donald Trump has selected South Dakota Gov. Kristi Noem as his next secretary of the Department of Homeland Security, according to two people familiar with the selection.

Noem will be tapped to take over the agency as two key immigration hardliners — Stephen Miller and Tom Homan — are slated to serve in senior roles, signaling Trump is serious about his promise to crack down on his immigration pledges. With his selection of Noem, Trump is ensuring a loyalist will head an agency he prioritizes and that is key to his domestic agenda.

The department saw an immense amount of turmoil the last time Trump was in office. Then, DHS had five different leaders, only two of whom were Senate-confirmed. The agency has a $60 billion budget and hundreds of thousands of employees.

MIAMI (AP) — From Pennsylvania to Florida to Texas, areas with high numbers of Hispanics often had little in common on Election Day other than backing Republican Donald Trump over Democrat Kamala Harris for president.

Trump, the president-elect, made inroads in heavily Puerto Rican areas of eastern Pennsylvania where the vice president spent the last full day of her campaign. Trump turned South Texas' Rio Grande Valley, a decadeslong Democratic stronghold populated both by newer immigrants and Tejanos who trace their roots in the state for several generations.

He also improved his standing with Hispanic voters along Florida's Interstate 4 corridor linking the Tampa Bay area — home to people of Cuban, Venezuelan, Nicaraguan, Colombian and Puerto Rican origin — with Orlando, where Puerto Ricans make up about 43% of the local Hispanic population. Trump was the first Republican since 1988 to win Miami-Dade County, home to a sizable Cuban population and the country’s metropolitan area with the highest share of immigrants.

It was a realignment that, if it sticks, could change American politics.

Texas and Florida are already reliably Republican, but more Hispanics turning away from Democrats in future presidential races could further dent the party's “blue wall” of Pennsylvania, Michigan and Wisconsin, that had helped catapult it to the White House before Trump romped through all three this time. The shift might even make it harder for Democrats to win in the West, in states such as Arizona and Nevada.

Trump, in his first term, curtailed the use of Temporary Protected Status, which Democratic President Joe Biden extended to thousands of Venezuelans, and tried to terminate the Obama-era Deferred Action for Childhood Arrivals program. But the Democratic warnings did not appear to break through with enough voters for Harris. Now the party must figure out how to win back votes from a critical, fast-growing group.

“Trump, he’s a very confounding figure,” said Abel Prado, a Democratic operative and pollsterwho serves as executive director of the advocacy group Cambio Texas.“We have no idea how to organize against him. We have no idea how to respond. We have no idea how to not take the bait.”

Ultimately, concerns about immigration did not resonate as much as pocketbook issues with many Hispanics.

About 7 in 10 Hispanic voters were “very concerned” about the cost of food and groceries, slightly more than about two-thirds of voters overall,according to AP VoteCast, a survey of more than 120,000 voters nationwide. Nearly two-thirds of Hispanic voters said that they were “very concerned” about their housing costs, compared with about half of voters overall.

Trump had a clear edge among Hispanic voters who were “very concerned” about the cost of food. Half said he would better handle the economy, compared with about 4 in 10 for Harris. Among Hispanic voters who were very worried about crime in their community, Trump had a similar advantage.

“When they looked at both candidates, they saw who could improve our economy and the quality of life,” said Marcela Diaz-Myers, a Colombian immigrant who headed a Hispanic outreach task force for the Pennsylvania Republican Party. “Did he sometimes offend? Yes. But that happens in political campaigns. Many of the people who voted for President Trump were able to get past this and trust that he will move the country in the right direction.”

Harris promised to lower grocery prices by cracking down on corporate price gouging and to increase federal funding for first-time homebuyers. Also, recent violent crime rates have declined in many parts of the country.

She also spent many of the final days of the campaign trying to capitalize on remarks by a comic who spoke at a Trump rally in New Yorkand joked that Puerto Rico was a “floating island of garbage.” She even leaned on Puerto Rican celebrities — from Bad Bunny to Jennifer Lopez — to decry racism….

The same was true in South Texas, where Hispanics are largely of Mexican descent.

Prado, the Democratic operative and pollster, lives in Hidalgo County,which is 92% Hispanic and the most populous part of the Rio Grande Valley. Trump carried it after losing by more than 40 percentage points in 2016. Trump swept all the major counties along the Texas-Mexico border.

Prado said Democratic county commissioners and state legislators helped secure funding for new bridges across the Texas-Mexico border and for other initiatives that have sparked commerce and economic and job growth in the area.Yet, he said, “the Republican Party has done a really good job of inserting themselves as an answer to nonexistent problems and then taking credit for (things) that they didn’t do.”(like what?)

Gen. Michael Flynn's Brother v. CNN "False Light" Lawsuit Dismissed

From today's decision by Judge Arun Subramanian (S.D.N.Y.) in Flynn v. CNN, Inc.:

Plaintiffs Jack and Leslie Flynn have sued Defendant Cable News Network … under Rhode Island's false-light statute. The Flynns claim $75 million in damages. The entire dispute stems from a six-minute segment and, more specifically, the segment's use of a two-second clip in which the Flynns appear. The Flynns say the segment falsely painted them as "QAnon followers."

The parties agree that QAnon is "an American conspiracy movement that began in 2017." The conspiracy centers around "Q," who is supposedly "a high-ranking government official" who "leak[s] top secret information" about the "Deep State." There have been about 5,000 of these leaks (or "Q drops"). The Flynns say that "a series of outlandish beliefs … have grown out of these Q drops." But just exactly what those beliefs are is unclear (and is one of the main subjects of this opinion). Before this suit was filed, Jack himself characterized QAnon as "[j]ust People doing their own research and learning independence of thought to find the truth."

The CNN report at issue aired in February 2021. It was framed around an October 2020 event called "Q Con Live!" The report opens with a series of short clips from the event, followed by the reporter's voiceover explaining that the footage was from a "gathering of QAnon followers in Arizona just two weeks before November's election." The video next shows the so-called QAnon Shaman, who is wrapped in a flag that says, "WHERE WE GO ONE WE GO ALL." The voiceover explains, "He's known as the QAnon Shaman, and he would go on to storm the Capitol in January." The video then cuts to someone at the event singing "where we go one, we go all." The voiceover then says, "'Where we go one, we go all': an infamous QAnon slogan promoted by Trump's first National Security Advisor, Michael Flynn."

At that point, the video cuts to the key clip. It shows a row of six people raising their right hands. Standing toward the middle of the group, Michael Flynn says, "Where we go one, we go all." Alongside Michael Flynn are Jack and Leslie, though they say nothing. The video then returns to Q Con, and the voiceover continues, "And played as an anthem at this meeting of Trump supporters." The rest of the segment discusses President Trump's refusal to disavow QAnon, the January 6 attack on the Capitol, and the QAnon movement more generally. Neither Jack nor Leslie is shown or mentioned again. Finally, for nearly the whole segment, there is a headline-style chyron that reads, "CNN GOES INSIDE A GATHERING OF QANON FOLLOWERS."

The Flynns originally had two claims: defamation per se and false light. Before this case was reassigned to me, the Court dismissed the defamation claim but not the false-light claim. CNN has now moved for summary judgment on the false-light claim….

"To recover under § 9-1-28.1(a)(4) [the Rhode Island] false light statute], [a] plaintiff must establish that there has been some publication of a false or fictitious fact which implies an association which does not exist; and the association which has been published or implied would be objectionable to the ordinary reasonable man under the circumstances." {In interpreting the statute, the Supreme Court of Rhode Island has imported many defamation doctrines, noting that plaintiffs should not be able to "evad[e] the limitations of a successful defamation action by using the alternate theory of a false-light claim."}

The Court assumes without deciding that the video was capable of implying that the Flynns were QAnon followers…. [But c] alling the Flynns "QAnon followers" was, in defamation law–speak, an opinion. And an opinion is "actionable only if it implies the allegation of undisclosed defamatory facts as the basis for the opinion." Put differently, "the dispositive inquiry here is … whether the challenged statement can reasonably be construed to be stating or implying [defamatory] facts about the [Flynns]."

Here, the statement neither stated nor implied defamatory facts, so it is a nonactionable opinion. This conclusion is based on two independent—but mutually reinforcing—grounds. First, the statement is unverifiable. And second, it was a comment on disclosed, nondefamatory facts. Both characteristics ensure that the reasonable viewer understands that the statement is the speaker's opinion (rather than stating facts) and that the speaker is not harboring additional, undisclosed facts to justify the statement. So Rhode Island law and the First Amendment demand its protection….
