Peterson Space Force Base Dining Hall Closed Indefinitely After 'Significant Safety Incident'

Guardians and airmen stationed at Peterson Space Force Base in Colorado have been without an on-base dining hall facility for months after it was closed this summer due to a safety issue, according to an internal memo.

The Aragon Dining Facility, located on the Colorado Springs base, has been closed since July. An internal memo, marked as Controlled Unclassified Information documents that aren't classified but are still out of public view was posted on the 21st Force Support Squadron's website and detailed the closure.

"On 2 July 2024, the Aragon Dining Facility experienced a significant safety incident," the memo read. "Due to the nature of the incident, it has been determined necessary to close the facility temporarily to ensure the safety and well-being of all personnel and patrons."

The dining hall will remain closed "until further notice," the memo added. A spokesperson for Space Base Delta 1 detailed the dining hall, or DFAC, closed "due to facility infrastructure conditions” but did not provide any specific details.

Peterson, home to Space Base Delta 1, consists of 3,700 service members, according to the base's website. Guardians and airmen affected by the DFAC closure are receiving type II Basic Allowance for Subsistence, or BAS, in the amount of $920.50 a month to buy groceries and eat at restaurants nearby.

Republicans ask Supreme Court to block decision to count Pennsylvania provisional ballots

The Republican National Committee and the Republican Party of Pennsylvania came to the Supreme Court on Monday, asking the justices to block a ruling by Pennsylvania’s highest court requiring election boards to count provisional ballots submitted by voters whose mail-in ballots had been deemed invalid.

The RNC and the Pennsylvania Republicans argue that the state supreme court had “dramatically change[d] the rules governing mail voting.” And in so doing, they contend, the state court had violated the U.S. Constitution by usurping the state legislature’s role in regulating federal elections.

The Republicans’ request came just eight days before election day, with Pennsylvania expected to play a key role in the 2024 presidential race.

In 2020, then-candidate Joe Biden won Pennsylvania by just over 80,000 votes, and polls have Vice President Kamala Harris and former President Donald Trump in a dead heat in the current race. The RNC and Pennsylvania Republicans posit that the dispute could affect “tens of thousands of votes,” and possibly even the outcome of the presidential election itself, but at least one voting rights expert has suggested that the number of ballots at stake in the dispute may be relatively low.

In Pennsylvania, voters using mail-in ballots are required to seal their ballot in an envelope – known as the secrecy envelope – and then place it in a second envelope, known as the declaration envelope, that they must sign and date. If a ballot-sorting machine determines that the ballot is “naked” – that is, that it lacks a secrecy envelope – then the voters are notified that they can cast a provisional vote at their polling place on Election Day.

Two voters whose provisional ballots were not counted during the state’s 2024 primary election went to state court, arguing that the election board was required to count their ballots. By a vote of 4-3, the Pennsylvania Supreme Court agreed that as long as the mail-in ballots are not counted, the provisional ballots should be.

Represented by John Gore, who served as the acting head of the civil rights division in the Department of Justice during the Trump administration, the RNC and the Pennsylvania Republican Party asked the justices to put the state court’s ruling on hold to give them time to file a petition for review.

Last year, in Moore v. Harper, the Supreme Court rejected a broad version of what is known as the “independent state legislature” theory, holding that although the Constitution gives state legislatures the power to regulate federal elections, state courts can still supervise the legislature’s exercise of that power.

In his opinion for the majority, Chief Justice John Roberts warned that the court’s ruling did not give state courts “free rein” to invalidate state election laws. Instead, he explained, because the Constitution gives state legislatures the power to make rules for federal elections, federal courts must “ensure that state court interpretations of that law do not evade federal law.” Specifically, he continued, state courts “may not transgress the ordinary bounds of judicial review such that they arrogate to themselves the power vested in state legislatures to regulate federal elections.”

But that is precisely what the Pennsylvania Supreme Court did in this case=, the RNC and the Pennsylvania Republicans tell the justices. “When the legislature says that certain ballots can never be counted,” they say, “a state court cannot blue-pencil that clear command into always.”

Even if the court does not put the Pennsylvania Supreme Court’s decision on hold, they continue, the justices could follow the same path that they used in another election case from Pennsylvania in 2020, involving the counting of mail-in ballots that arrived after election day. In that case, Justice Samuel Alito – who initially fields emergency requests from Pennsylvania – ordered election boards to keep mail-in ballots received after election day separate and, if they are counted, to count them separately.

Alito instructed the challengers and the election board to file a response to the Republicans’ request by Wednesday at 4 p.m.

Virginia asks Supreme Court to allow voter rolls purge before election

Virginia election officials on Monday asked the Supreme Court to block a ruling by a federal judge that would bar them from reviving a program put in place in August by the state’s Republican governor intended to remove suspected noncitizens from the state’s voting rolls.

U.S. District Judge Patricia Tolliver Giles on Friday ordered the state to restore the registration of more than 1600 people whom it had taken off the rolls as part of the program, and the U.S. Court of Appeals for the 4th Circuit on Sunday turned down the state’s request to step in.

In an executive order on Aug. 7, Virginia Gov. Glenn Youngkin ordered state election officials to expedite the use of data from the state’s department of motor vehicles to identify and cancel the voter registration of suspected noncitizens unless they could verify their citizenship within 14 days.

A federal court found that that the database flagged and canceled the registration of at least some eligible citizens and that those voters were unaware of the fact that they were no longer able to vote.

The Biden administration, along with civic and immigrant rights groups, went to federal court in Alexandria, Va., on Oct. 11 to challenge the voter-purge program. They argued that it violated the National Voter Registration Act, a 1993 law that generally bars states from “systematically” removing ineligible voters within 90 days of a federal election.

In an order on Oct. 25, Giles barred the state from “continuing any systematic program intended to remove the names of ineligible voters from registration lists less than 90 days before the November 5, 2024, federal General Election,” although she left open the possibility that the state could still remove some voters on a case-by-case basis – for example, those with criminal convictions and those who have died. She also ordered the state to restore the registration of voters whom it had removed from the rolls as part of the program.

The state went to the 4th Circuit, asking it to put Giles’ order on hold. But a three-judge panel made up of two Obama appointees and one Biden appointee denied (as relevant here) that request on Sunday, writing that it was “unpersuaded” that Virginia’s program complied with the NVRA.

Virginia then came to the Supreme Court on Monday morning, asking the justices to put Giles’ order on hold by Tuesday.

Erika Maley, the state’s solicitor general, told the court that Giles’ order rests on “a misinterpretation of the NVRA,” because the law’s “quiet period” provision does not prohibit the removal of noncitizens, who were never “eligible” to vote in the first place. “States are free to systematically remove noncitizens, as well as minors and fictitious persons, at any time, including within 90 days of an election, without running afoul of the NVRA.”

==But even if the “quiet period” provision did prohibit a “systematic” program that removed noncitizens, Maley continued, its program still would not violate the law because it is based on an “individualized process=+” that “begins with a personal attestation of noncitizenship” on forms filed with the Virginia DMV and “ends in the removal of that person from the voter rolls only when he is sent two individualized letters offering opportunities” to correct any mistakes about citizenship status.

The state and the public will be permanently harmed if Giles’ order is allowed to remain in effect, Maley insisted, both because the state will be unable to enforce its election laws and because of the prospect that noncitizens will be allowed to vote in the upcoming election. By contrast, Maley argued, any U.S. citizen who is erroneously removed from the rolls can still cast a provisional ballot on election day.

Giles’ order, Maley contended, also violates the Purcell principle, the idea that courts should not change election rules during the period just before an election. That principle, Maley wrote, “applies to eleventh-hour injunctions under the NVRA, particularly where, as here, they order mandatory retrospective relief of adding numerous individuals to a State’s voter rolls past the State’s deadline for doing so and imminently before an election.”
