Prince Andrew’s Lawyer Argues Virginia Giuffre Was Old Enough to Consent Under New York Law

Prince Andrew is making another effort to throw out the civil case being brought against him by Virginia Roberts Giuffre, who claims she was forced to have sex with the queen’s son.

In a filing Monday evening, Andrew, who just hours earlier was photographed horse-riding near his home in Windsor Great Park, also asked the presiding judge to keep under seal some of his responses to Giuffre’s allegations.

Andrew controversially asked Judge Lewis Kaplan to dismiss Giuffre’s complaint, arguing that New York’s Child Victims Act, the legislation under which she is suing him, is flawed because it classifies those under the age of 18 as minors, but the age of consent in New York is 17, the London Times reports. Giuffre alleges that she was 17 when she was forced to have sex with the prince multiple times and at various locations around the world in 2001

A notorious photograph of Andrew with his arm around a teenage Giuffre’s bare midriff has circulated in the media for several years, but the Duke of York claims to have never met Giuffre. The photograph, which shows Ghislaine Maxwell in the background, was reportedly taken at her London apartment by Jeffrey Epstein, who died in a jailhouse suicide in 2019.

Andrew’s allies have previously planted stories in the press saying he believes the picture is a fake, a claim that has been met with stunned disbelief by his critics.

The London Times reports the new filing from Andrew’s legal team argues the Child Victims Act is “not a reasonable mechanism to address the injustice of child sexual abuse in New York” because it classifies under-18s as minors “even though the age of consent in New York is 17.”

Andrew is arguing “the issue of consent is unsettled with regard to those—like Giuffre—who were between the ages of 17 and 18.”

The Times says Andrew’s legal team, headed by Andrew Brettler, acknowledge in the paperwork that it would be possible to prove lack of consent by showing evidence of an “implied threat” being made, but it would be difficult to prove “as memories fade, false memories are created, and witnesses die or otherwise become unavailable.”

The filing adds, they report: “Here, the only witnesses to the purported implied threats under which Giuffre allegedly engaged in unconsented sex acts with Prince Andrew are Epstein (deceased), Maxwell (incarcerated), Prince Andrew (the accused), and Giuffre herself.”

The Times also reports that Andrew says he should be protected from legal action by Giuffre under the terms of a settlement she made with Epstein in 2009.

The Times said Kaplan “agreed a delay to January 14 last night.”

Chasten Buttigieg Upset Biden’s Student Loan Freeze Ending: ‘LOL No Thank You’

Transportation Secretary Pete Buttigieg’s husband, Chasten Buttigieg, is upset the Biden administration’s freeze on student loans is soon ending.

In August, the Biden administration extended the freeze on student loans until the end of January 2022, with a zero percent interest rate, Breitbart News reported. Now that the extension is coming to an end, Chasten, 32, is upset he will have to pay off his loans.

Chasten publicly voiced his displeasure in an Instagram story post on Saturday,where he shared an image of a message he received indicating he would once again have to make payments.

“Chasten, Your student loan payments restart after Jan. 31, 2022. You’ll soon receive a bill from your student loan servicer,” the message read.

“LOL no thank you Merry Christmas next,” the transportation secretary’s husband wrote in the post.

The Instagram post has garnered criticism.

Rep. Madison Cawthorn (R-NC) weighed in on Chasten’s post in a statement to Fox News.

“Chasten Buttigieg’s personal responsibility seems to be lost in Pete Buttigieg’s supply chain crisis,” Cawthorn said.

“When the Washington elites start thinking they’re victims just because they have to pay their bills, expect that mentality to spill over into the radical socialist policies of the Biden administration,” the representative added.

“These are the guys who complained that they couldn’t afford rent in DC on Pete’s $220K salary (and all their money from writing books),” tweeted Republican communicator Matt Whitlock. “A good reminder that the left’s “cancel student loan debt” goal would overwhelmingly help financially comfortable people.”

Whitlock was alluding to a July interview with the Washington Post, in which Chasten made a fuss about Washington, DC, rental prices.

He said the transportation secretary and he “couldn’t afford the one-bedroom-plus-den,” though Sec. Buttigieg’s salary is listed at $221,400, according to the Post.

The couple settled for an 800-square-foot apartment for around $3,000 per month in the elitist Captial Hill neighborhood of Eastern Market. They chose the high-end building “because of its location and the security it offered,” the Post reports.

CNN: Devastation Awaits Democrats in 2022 Midterms

Far left CNN detailed the signs of looming defeat for Democrats in the 2022 midterms in an analysis piece on Sunday, saying pretty much “every single indicator” is pointing to a landslide victory for House Republicans.

“Pretty much every single indicator that pointed to a Democratic wave in the 2018 midterms now points to a Republican one in the 2022 midterms,” Harry Enten wrote.

According to the report, Democrats were beating Republicans by nine points in the polls by early December 2017, and “as it turned out, this was the margin by which they’d win the national House vote” the next year. In December 2021, Republicans are holding an average two-point advantage.

“Indeed, there have been ten times since 1938 when the opposition party (i.e. not in control of the presidency) led on the generic ballot this far from a midterm. They would go on to win a majority of seats in the midterm all ten of those times,” Enten continued.

Enten specifically pointed to three crucial signs a red wave could be barreling its way toward the D.C. swamp: President Joe Biden’s dismal approval ratings, special elections, and House retirements.

CNN credited Democrats’ 2018 win to then-President Donald Trump’s approval rating, which Enten said was averaging 37 percent in December 2017.

“President Joe Biden is not much better with an approval rating of about 42 [percent]. His is the second worst approval rating for an elected president at this point in their first term,” according to the analysis.

As far as special elections go, Republicans are doing an average of five points better than the 2020 presidential margin in an average of roughly 60 legislative and federal special elections. Before Democrats took the reins from Republicans in 2018, Democrat candidates were averaging about 10 points better than the 2016 presidential margin in more than 70 special legislative and federal special elections, Enten wrote. According to the report:

While we still have a ways to go until the midterms, we know that the shift from the presidential baseline in special elections has been predictive of the next election. This has been true in midterms since 1994, and a lack of a major change from the 2016 baseline during the special elections in the lead up to 2020 was a major red flag that Republicans weren’t as in much trouble as some of the polling indicated.

Similar to House Republicans in December 2017, 19 Democrats are leaving the House at the end of this Congress. Enten said, “results and polling are a big reason that politicians have or did run for the hills.” He wrote:

Retirements are not a perfect indicator of future midterm outcomes, but they’re a sign. Elected officials are looking at the same statistics we are. They aren’t likely to retire en masse, unless they sense they’re going to lose power. That’s why the party that has had more elected officials retiring from public office has lost seats in eight of the last 12 midterm cycles since 1974.

The “bottom line,” Enten concluded, is that the opposition party has “picked up 5 or more seats in 34 of 38 midterms since 1870.”

“Not a lot so far suggests that the 2022 midterms will be any different,” he wrote.

Addressing a forum in Beijing on Saturday, former finance minister Lou Jiwei said that while China had said it would “strive to” reach peak carbon emissions before 2030 and carbon neutrality before 2060, there was a difference between this and “ensuring [those targets would be achieved]”.

“We are a developing country. We should bear common but differentiated responsibilities that are different from developed countries,” Lou told the gathering organised by the China Centre for International Economic Exchanges.

Han Wenxiu, from the Central Committee for Financial and Economic Affairs, was similarly cautious, saying the two targets were complex and long-term tasks that required full consideration of the country’s energy and industrial structure.

“[The carbon targets] should not affect the country’s overall economic and social development,” Han said.

The day before those comments were made, Chinese dictator Xi Jinping and his Politburo issued a statement that said reaching carbon neutrality will require “unwavering efforts,” but success “can’t be achieved in just one battle.”

The same statement made it clear that China will not stop burning coal to generate electricity. The Chinese are currently pouring record amounts of coal into record numbers of power plants to meet the soaring energy needs of their industrial sector. As several Chinese analysts explained to the SCMP, critical power shortages in the latter half of 2021 frightened communist leaders away from any thoughts they might have been entertaining about eliminating coal.

“Wind and solar power account for about 9 percent of China’s electricity generation. The dominant role of coal in China’s power and energy structure cannot be changed in a short time,” Lin Boqiang of the China Institute for Studies in Energy Policy at Xiamen University explained.

Ma Jun of the Institute of Public and Environmental Affairs in Beijing said the statement by Xi and the Politburo on Friday was a sign that “replacements have not been building up and we cannot phase out fossil fuels in a quick way.”..

NBC’s Saturday Night Live aired a joke about members of Congress gang-raping Roger Stone’s wife, who is battling cancer. The tasteless one-liner came from “Weekend Update” anchor Michael Che, who elicited a mix of groans and guffaws from the show’s live studio audience.

In Saturday’s episode, Michael Che addressed Roger Stone’s legal battles with Congress’ partisan January 6 commission.

Former President Donald Trump was full of praise for terrorist-supporting Palestinian Authority President Mahmoud Abbas in a recent interview — while claiming that Israeli Prime Minister Benjamin Netanyahu did not want to reach a peace deal.

Axios’ Barak Ravid, who conducted the interview with Trump for a new book about Trump’s peace efforts, reported Monday:

“I don’t think Bibi ever wanted to make peace,” Trump told me in April, referring to Netanyahu by his nickname in a 90-minute, face-to-face interview for my new book, “Trump’s Peace: The Abraham Accords and the Reshaping of the Middle East.”

Trump said that at an early stage of his presidency, he realized that Netanyahu would be a bigger obstacle to peace than Palestinian President Mahmoud Abbas.

“I thought he was terrific,” Trump told me of Abbas, reflecting on their “great” first meeting. “He was almost like a father. Couldn’t have been nicer. I thought he wanted to make a deal more than Netanyahu.”

Trump admitted to Ravid that Abbas and the Palestinians had proved to be “hardened” against the deal. Nevertheless, he said that other Israeli leaders, such as Netanyahu rival Benny Gantz, seemed to be more acceptable to the Palestinians as partners.

The Palestinian Authority government currently provides stipends to convicted Palestinian terrorists in Israeli jails, and the families of Palestinian terrorists killed by Israel. It also names public buildings and parks after famous Palestinian terrorists.

The issue came up during Trump’s presidency, when he signed the Taylor Force Act, which prevents U.S. funds from being sent to the Palestinian Authority as long as it supports terror (and which the Biden administration is trying to circumvent).

Netanyahu has, in fact, negotiated agreements with the Palestinians in the past, and embraced Trump’s framework for peace in early 2020. He has, however, resisted further removals of Jewish residents of Judea and Samaria, or security concessions.

Notably, Netanyahu refrained from annexing the West Bank to Israel under the Abraham Accords, despite domestic pressure from right-wing parties for him to do so, out of deference to the Trump Administration’s efforts to negotiate in the region.

Last week, Ravid revealed that Trump had bitter feelings toward Netanyahu over the latter’s willingness to recognize Joe Biden as the winner of the 2020 presidential election: “Fuck him,” Trump said, adding he had not spoken to Netanyahu since.

Netanyahu responded by noting that as Israel’s leader, he had no choice but to recognize the incoming U.S. government. He also thanked Trump, again, for the numerous achievements made during his presidency, including the Abraham Accords.

Some players in the diplomatic process, notably former U.S. Ambassador David Friedman, have disputed some of Ravid’s claims, saying he was never consulted for the book and that reports by Ravid should therefore be taken with “a grain of salt.”

Trump’s hostility to Netanyahu is raising questions in pro-Israel circles about his ability to manage ties with Israel if he wins in 2024, especially if Netanyahu regains office. Many potential Republican candidates for the presidency also have strong records on Israel, including Florida Gov. Ron DeSantis, Sen. Tom Cotton of Arkansas, Sen. Ted Cruz of Texas, and others.

Trump told Ravid that he still supports Israel, though in spite of Netanyahu, not because of his relationship with him.

Pfizer says COVID-19 pill near 90% effective in final analysis

NEW YORK (Reuters) -Pfizer Inc on Tuesday said final analysis of its antiviral COVID-19 pill still showed near 90% efficacy in preventing hospitalizations and deaths in high-risk patients, andrecent lab data suggests the drug retains its effectiveness against the fast spreading Omicron variant of the coronavirus.

The U.S. drugmaker last month said the oral medicine was around 89% effective in preventing hospitalizations or deaths when compared to placebo, based on interim results in around 1,200 people. The data disclosed on Tuesday includes an additional 1,000 people.

Nobody in the trial who received the Pfizer treatment died, compared with 12 deaths among placebo recipients.

The Pfizer pills are taken with the older antiviral ritonavir every 12 hours for five days beginning shortly after onset of symptoms. If authorized, the treatment will be sold as Paxlovid.

"It's a stunning outcome," Pfizer Chief Scientific Officer Mikael Dolsten said in an interview.

"We're talking about a staggering number of lives saved and hospitalizations prevented. And of course, if you deploy this quickly after infection, we are likely to reduce transmission dramatically," Dolsten said.

Pfizer also released early data from a second clinical trial suggesting that the treatment reduced hospitalizations by around 70% in a smaller trial of standard-risk adults, including some higher-risk vaccinated people. The results were not statistically significant, but Pfizer said they showed a "positive data trend for reduction in risk."The trial did not show that the drug alleviated symptoms of COVID-19 in the same population.

The results in standard-risk individuals are from interim analyses at 60% and 80% of enrollment of the now fully-enrolled trial of over 1,100 people. Pfizer will continue the trial and release more data when its done.

Dolsten said he expects authorization for use in high-risk individuals from the U.S. Food and Drug Administration and other regulatory agencies soon. He does not believe an FDA advisory panel meeting will be needed.

"We're in very advanced regulatory dialogues with both Europe and the UK, and we have dialogues with most of the major regulatory agencies globally," Dolsten said.

Pfizer submitted data to the U.S. FDA last month, asking for emergency use authorization of the drug.
