Why the overturned eviction moratorium may be too little, too late for both renters, landlords

The Supreme Court’s decision last week to strike down the pandemic-era eviction moratorium may arrive too late for many struggling independent landlords, even as it appears to heighten the risk of eviction for tenants behind on their rent.

Thursday’s decision by the U.S. high court found that the Centers for Disease Control and Prevention (CDC) lacks authority under federal law to impose an eviction ban, which was set to expire on October 3. The court stressed that Congress, rather than the CDC, must specifically authorize an eviction policy.

"The federal eviction moratorium was a lifeline for millions of families, the last remaining federal protection keeping them safely and stably housed throughout the pandemic," Diane Yentel, president and CEO of the National Low Income Housing Coalition said in a statement to Yahoo.

"The tragic, consequential, and entirely avoidable outcome of this ruling will be millions of people losing their homes this fall and winter, just as the Delta variant ravages communities and lives," Yentel added.

At least half a dozen states, including New Jersey, California, New York and Washington, have policies in place to protect renters to help keep families in their homes.

“You just can't flip a switch and evict people,” said Paul Getty, CEO of First Guardian Group, a real estate investment and broker firm. The eviction process could take up months because of the backlog and the court systems, he explained.

“You still need a legitimate case to do that. It's very problematic,” Getty told Yahoo Finance.

However, the ruling doesn’t mean renters in states without protections will be immediately removed from their homes — an outcome that appears all but certain to prolong the pain for “mom and pop” landlords struggling with mounting costs, some of whom haven’t been paid by tenants in over a year.

While eviction filings are expected to ramp up, it is unclear how quickly already backlogged courts can process new filings, or how effective the remaining patchwork of state and local protections will be in keeping renters in place until they secure rent relief.

Although ample federal relief is available, the Treasury Department said recently that barely 10% of the $47 billion allocated for tenant relief has actually been distributed, with states and localities struggling to dole out the money amid insufficient infrastructure and overwhelming demand.

Meanwhile, many struggling renters were hoping to receive emergency rental assistance from the government to pay back their rent and remain in their homes. However, applying for assistance has been challenging for tenants and landlords alike.

Organizations like the National Low Income Housing Coalition and the Consumer Financial Protection Bureau have set up tools to help renters apply for assistance.

A recent survey of renters by the U.S. Census Bureau found an estimated 11.4 million were behind on rent as of early July. The pause on evictions provided a critical backstop in ensuring renters could stay in their homes until relief money was received.

To that end, the White House announced new steps to help renters and landlords hit by the pandemic. That includes help from the Treasury Department to reduce documentation requirements for hundreds of thousands of emergency rental assistance applicants.

The department has also warned state and local governments they could lose funding to jurisdictions doing a better job of providing relief payments to at-risk renters and landlords.

Some landlords, however, slammed the lifting of the ban describing it as “too late.” Many independent property owners have been swamped by rising costs associated with taxes, insurance, utilities and upkeep, even as tenants have gotten government lifelines.

“We're already been forced to sell our house so it doesn't help us,” James Bathgate, a landlord in California, told Yahoo Finance in an interview.

“I do feel sorry for the thousands of other mom and pop landlords, many of whom are retired and living on fixed incomes, just like us and rely on rental income for their retirement,” Bathgate said. “If they've been able to hold out, hopefully they can now survive.”

Abstract

Background: Data on breakthrough SARS-CoV-2 Delta variant infections are limited.

Methods: We studied breakthrough infections among healthcare workers of a major infectious diseases hospital in Vietnam. We collected demographics, vaccination history and results of PCR diagnosis alongside clinical data. We measured SARS-CoV-2 (neutralizing) antibodies at diagnosis, and at week 1, 2 and 3 after diagnosis. We sequenced the viruses using ARTIC protocol.

Findings: Between 11th–25th June 2021 (week 7–8 after dose 2), 69 healthcare workers were tested positive for SARS-CoV-2. 62 participated in the clinical study. 49 were (pre)symptomatic with one requiring oxygen supplementation. All recovered uneventfully. 23 complete-genome sequences were obtained. They all belonged to the Delta variant, and were phylogenetically distinct from the contemporary Delta variant sequences obtained from community transmission cases, suggestive of ongoing transmission between the workers. Viral loads of breakthrough Delta variant infection cases were251 times higher =than those of cases infected with old strains detected between March-April 2020. Time from diagnosis to PCR negative was 8–33 days (median: 21). Neutralizing antibody levels after vaccination and at diagnosis of the cases were lower than those in the matched uninfected controls. There was no correlation between vaccine-induced neutralizing antibody levels and viral loads or the development of symptoms.

Interpretation: Breakthrough Delta variant infections are associated with high viral loads, prolonged PCR positivity, and low levels of vaccine-induced neutralizing antibodies, explaining the transmission between the vaccinated people. Physical distancing measures remain critical to reduce SARS-CoV-2 Delta variant transmission.

Biden's HHS diverting millions of funds meant for COVID-19 vaccinations to program for unaccompanied migrant children crossing the border

The Department of Health and Human Services will reportedly take millions of dollars designated for COVID-19 vaccination efforts and divert the substantial funds to a program for sheltering unaccompanied migrant children who have entered the U.S. at the southern border.

The HHS will reallocate an additional $589 million to the agency's unaccompanied children program, some of those funds were dedicated to COVID-19 vaccinations, according to Fox News.

"HHS informed Congress that it is diverting $225 million in National Institute of Health (NIH) funding that was part of the December COVID-19 relief bill to the unaccompanied children (UAC) program, as well as $364 million in HHS funding that was passed as part of the American Rescue Plan (ARP)," a congressional source told the outlet.

The report noted that $187.5 million was set aside for the Centers for Disease Control for "vaccine planning, distribution, monitoring and tracking" and an additional $25 million for "vaccine confidence activities." There was also $151 million of the diverted funds that were to go to the "Supply Chain for Vaccines, Therapeutics and Medical Supplies."

The HHS claimed that the funds being diverted to the border crisis were not planned for any ongoing vaccine efforts, and had no impact on getting Americans vaccinated.

"The Unaccompanied Children program has long relied on funding transfers to meet its mission, and this year faces the additional expense of rebuilding a decimated system while taking pandemic-related safety precautions, such as testing and social distancing," an HHS spokesperson told Fox News.

The latest reallocation of funds means that the UAC has received over $4 billion in diverted money this year alone, according to the outlet.

A report from Politico surfaced in May that said the Biden administration pulled over $2 billion that was marked for COVID-19 health resources, and sent the money to Biden's border crisis.

"The redirected funds include $850 million that Congress originally allocated to rebuild the nation's Strategic National Stockpile, the emergency medical reserve strained by the Covid-19 response," Politico reported at the time. The HHS reportedly took approximately $436 million from a "range of existing health initiatives across the department."

Politico reported that the $2.13 billion in diverted COVID-19 funds "exceeds the government's annual budget for the unaccompanied children program in each of the last two fiscal years."

The HHS's fiscal year 2022 budget for "Refugees and Unaccompanied Migrant Children" has a total budget of $4.4 billion. In the HHS budget, they are requesting "$3.3 billion for the unaccompanied children program, an increase of $2.0 billion above the FY 2021 appropriation."

"This investment rebuilds the nation's refugee infrastructure to support resettling up to 125,000 refugees in 2022, the highest number of refugees admitted to the United States in 30 years," the HHS stated.

Biden Turned Down Taliban Offer to Allow US to Control Kabul and the Airport

We now know that several top US Generals were on vacation in early August as the Taliban took control of Kabul in just hours. Biden’s senior White House staff were also prepared to take vacation the Friday before Kabul fell to the terrorist organization. Jen Psaki left messages to any reporters who tried to contact her. She was on vacation.

US intelligence officials assessed that the Afghan government would hang on for another 6 months — Instead, the country fell within days, including Kabul.

Defense Secretary Lloyd Austin ordered US Embassy to leave the Kabul Embassy despite the fact that they had NOT destroyed all of the classified documents and equipment in the compound. The Taliban later took possession of the material.

And now we know that the Taliban offered to allow the United States to control Kabul and its airport — but Joe Biden turned them down.

In a hastily arranged in-person meeting, senior U.S. military leaders in Doha – including McKenzie, the commander of U.S. Central Command – spoke with Abdul Ghani Baradar, head of the Taliban’s political wing.

“We have a problem,” Baradar said, according to the U.S. official. “We have two options to deal with it: You [the United States military] take responsibility for securing Kabul or you have to allow us to do it.”

Throughout the day, Biden had remained resolute in his decision to withdraw all American troops from Afghanistan. The collapse of the Afghan government hadn’t changed his mind.

McKenzie, aware of those orders, told Baradar that the U.S. mission was only to evacuate American citizens, Afghan allies and others at risk. The United States, he told Baradar, needed the airport to do that.

On the spot, an understanding was reached, according to two other U.S. officials: The United States could have the airport until Aug. 31. But the Taliban would control the city.

Joe Biden was given the opportunity to contol Kabul and the Airport and turned it down.

Haven’t worn a watch for decades. Stopped wearing a watch even before the ubiquity of cell phones became so popular as a time piece.
