Team Trump Updates Lawsuit Against Facebook and Twitter as 65,000 People Submit Stories of Censorship
Nearly 65,000 Americans have now submitted their stories of social media censorship in former President Donald Trump’s class-action lawsuit against Big Tech.
The America First Policy Institute, the organization representing Trump, shared a statement on Thursday regarding updates to the case.
“Late last night, Amended Complaints were filed in the Big Tech lawsuits against Facebook, Inc., Mark Zuckerberg, Twitter, Inc., Jack Dorsey, Google LLC, and Sundar Pichai. Since the initial filing on July 7, 2021, nearly 65,000 American people have submitted their stories of censorship through America First Policy Institute’s (AFPI) Constitutional Litigation Partnership (CLP) at TakeOnBigTech.com,” the statement read.
In addition to the nearly 65,000 stories, the statement also highlighted the bipartisan nature of the lawsuit.
“The Amended Complaints include additional censorship experiences and incorporates additional class representatives, including Dr. Naomi Wolf and Wayne Allyn Root – individuals on opposite ends of the political spectrum who highlight the bipartisan need to protect the thoughts and voices of all Americans, regardless of political affiliation,” it said.
Another update to the lawsuit included amended complaints following new information that the White House is working directly with Facebook and other social media platforms.
“The Amended Complaints also reflect additional causes of action under the Florida Fair Trade and Deceptive Practices Act and recent statements made by Biden White House officials, confirming the current administration’s collaboration with Big Tech platforms and their efforts to censor the American people,” it said.
Former President Donald Trump originally announced the class-action lawsuit during a news conference on July 7 against Twitter, Facebook and Google after they removed him from their platforms following the Jan. 6 Capitol incursion.
“I stand before you this morning to announce a very important … development for our freedom and freedom of speech,” he said at Trump National Golf Club in Bedminster, New Jersey.
“Today, in conjunction with the America First Policy Institute, I’m filing, as the lead class action representative, a major class-action lawsuit against the Big Tech giants, including Facebook, Google and Twitter, as well as their CEOs, Mark Zuckerberg, Sundar Pichai and Jack Dorsey,” Trump said.
“There is no better evidence that Big Tech is out of control than the fact that they banned the sitting president of the United States earlier this year,” he added.
“If they can do it to me they can do it to anyone. And in fact, that is exactly what they’re doing.”
“The American people’s birthright of freedom must prevail against Big Tech and other forces that seek to destroy it. Through this lawsuit, we are standing up for American democracy by standing up for free speech rights of every American,” Trump said.
The announcement also included the introduction of the legal effort directed by the America First Policy Institute, a nonprofit focused on “perpetuating former President Trump’s popular policies.”

Broward County Schools will implement fall mask mandate, face opposition from DeSantis
The school board in Broward County, Florida, voted Wednesday to implement a mask mandate that applies to students and faculty in all county classrooms this fall, a policy Republican Gov. Ron DeSantis fiercely opposes.
Broward County Public Schools will comply with updated Centers for Disease Control and Prevention guidance recommending that all individuals in areas with high COVID-19 transmission wear masks indoors, regardless of vaccination status, WLRN-TV reported.
According to the CDC, the entire state of Florida has a high level of community transmission. Over the past week in Broward County there have been 6,055 new COVID cases and 1,037 new hospitalizations, levels of transmission that would trigger the CDC's recommendation to wear masks indoors.
In response, though school board members had hoped to make masks optional in the fall, the board decided that mask-wearing would be mandatory.
"I really wanted to start this school year as normal as possible," board member Lori Alhadeff said, "and a few weeks ago, I thought that we were in a position to go back to school without wearing masks and giving parents a choice."
"But now with COVID soaring, and the Delta variant, a lot has changed," she said.
Parents who attended Wednesday's school board meeting voiced opposition to the mask mandates, arguing that face coverings make it hard for their kids to breathe, to learn, and to socialize with their peers.
Some of the parents voiced anger at the CDC, accusing the agency of "flip flopping" its position on masks, school board member Debbi Hixon said.
Just two months ago, the CDC issued guidance that fully vaccinated people could return to life as normal, without social distancing or mask-wearing because they were immunized. Now, because of concerns that some vaccinated people can still become infected with and transmit the Delta variant, the CDC has changed its position.
"They weren't flip flopping. They're using data and facts to make the best decisions for the time," Hixon argued. "And I think that we have to do the same thing."
Raymond Adderly, the senior class president at Fort Lauderdale High School and the student adviser to the school board, voiced support for the mask mandate.
"Although masks are super inconvenient, I'd rather see students have an inconvenience with breathing, wearing a mask — than having an inconvenience breathing on a ventilator," Adderly said, noting that a 15-year-old student at J.P. Tarvella High School was recently hospitalized with a severe case of COVID-19.
But mask mandates face opposition from the governor. DeSantis, who has received acclaim from conservatives for refusing to enact severe coronavirus restrictions, has vowed to call together a special session of the state legislature to pass a bill that would prohibit Florida school districts from imposing mask mandates. The governor believes forced masking is unnecessarily coercive.
A spokeswoman for DeSantis' office told WLRN his position on mask mandates has not changed after Broward County's decision.
"At the end of the day, the Governor trusts parents to weigh the risks and benefits and make the best choices for their own kids," DeSantis press secretary Christina Pushaw said.

Arizona’s Election Integrity Audit Receives $5.7M in Private Donations
“The announcement from Cyber Ninjas came as Arizona Senate President Karen Fann announced Wednesday that the audit has concluded its public efforts — ballots will be returned Thursday to Maricopa County,” the Washington Post reported.
Fann also stated the final report of Cyber Ninjas’ audit is expected in August.
The election integrity donations come from various sources. In June, former Overstock chief executive Patrick Byrne told the Post “that he had personally donated $500,000 to the Arizona effort and that his group was raising money from others, too.”
Another $605,000 was donated by Voices and Votes, a group headed by One America News host Christina Bobb.

House of Representatives leader in New Mexico, Sheryl Williams Stapleton, has been indicted in a huge embezzlement scheme. Stapleton is accused of embezzling of $954,000 in a racketeering, laundering and illegal kickbacks scheme.
The representative serves as the House Floor Leader in New Mexico and is a proud member of the Democratic party. She was elected as leader in 2017.
Law enforcement agents have executed search warrants at the home and business of state Rep. Sheryl Williams Stapleton.
According to a filed warrant, she is under investigation for racketeering, money laundering and receiving illegal kickbacks.
In April, newly-appointed Albuquerque Public Schools Superintendent Scott Elder submitted a letter to the New Mexico Attorney General Hector Balderas referencing “Suspected Violations of Governmental Conduct Act and Procurement Code.”
According to the warrant, every invoice issued by Robotics to APS was for an even dollar amount, no cents, and in unchanging amounts over the years. Most were reportedly for $40,000. In all, APS paid Robotics more than $5.3 million.
Rep. Williams Stapleton is also directly involved with four companies that received payments from Robotics: The Charlie Morrisey Center for Creative Assitance Inc., the Ujima Foundation, S. Williams and Associates, and local restaurant A Taste of The Caribbean.
Evidence suggests that she was the eventual recipient of 60% of the APS money — $954,386. Investigators are looking into additional payments that were redirected into her personal bank accounts.

Apollo Books $1.6 Billion Profit After Selling Hospital Chain To Itself
Americans are already furious that Blackstone and its private equity rivals are buying up all the good homes, helping to drive the surge in residential real-estate prices that is helping to make buying a home even more unobtainable, especially for first time buyers who don't have wealthy parents to help with the down payment.
As Apollo struggles to rehabilitate its reputation following those unseemly Epstein ties, Bloomberg reported Thursday that one of the firm's flagship funds booked a $1.6 billion profit by selling a once-struggling hospital chain to...another Apollo flagship fund? Specifically, Apollo's eighth flagship fund completed the sale of hospital chain LifePoint to its ninth fund last month for $2.6 billion after investing a total of $975MM in the Brentwood, Tennessee-based chain. In the year or so before the deal was struck in April, LifePoint received $1.6 billion lifeline from the government during the pandemic, including more than $600MM in grants, and nearly $1 billion in loans. Management stresses that the firm paid back the loans already. Still, that's a half-a-billion dollar government hand out that's padding the returns for wealthy PE investors (a group which also includes pension funds). The move isn't that surprising when one considers that costly "alternative" strategies like private equity are under immense pressure to maintain sky-high returns in an environment where good deal targets are few and far between, thanks in part to the SPAC boom (and the Fed's stimulus). The Apollo fund that bought LifePoint finished raising its capital in 2017. Given the time table for these types of funds, the timing of the sale makes sense: the original investors in the 2013 fund that initially bought the hospital chain are looking to cash out. Fortunately for them, there's plenty of new money coming in.
For what it's worth, LifePoint says that $500MM+ in pandemic grants it received didn't benefit shareholders, but instead were "applied to LifePoint's communities". Whether you believe that, or not, there are plenty of critics who say private equity doesn't belong in America's hospital system. "All grant aid we received has been applied to LifePoint's communities and only partially offset the $1.1 billion in extraordinary expenses and lost revenue that we incurred" because of the pandemic, she said. One fact that probably helped Apollo pitch the investment to backers of its 9th flagship fund is the massive cash pile that LifePoint is sitting on. The firm has already grown substantially via acquisitions since Apollo bought it back in 2013. The firm built LifePoint through the acquisition of three regional hospital chains in 2015, 2016 and 2018, and the company now operates 87 hospitals in small towns across the U.S. Apollo has said it can operate hospitals more efficiently by merging them. Technology and infrastructure upgrades are among a number of improvements LifePoint has made on Apollo’s watch, according to the private-equity giant, which is marketing the health-care firm as a socially responsible investment in its pitch to raise an inaugural impact fund. LifePoint has emerged from the pandemic in a position of strength even as many rural hospitals have struggled to survive. Its cash stockpile grew significantly during the crisis as the company tapped debt markets. Apollo told Fund IX investors that they stood to gain from their investment in LifePoint, as the hospital chain was sitting on more than $2 billion of cash that could be used to expand the business through acquisitions. And Apollo isn't the only major PE firm engaged in the practice of flipping hospital chains.

Apollo wasn’t the only private-equity firm to orchestrate an uncommon exit from a for-profit hospital chain this year. Cerberus Capital Management and Leonard Green & Partners sold their remaining interests to insiders at the health-care companies they had backed, rather than selling to an industry competitor or pursuing an initial public offering. Cerberus made roughly $800 million on its investment in Boston-based Steward Health Care, after paying $246 million in 2010 for what started as a chain of struggling Catholic hospitals. With this in mind, it's perhaps not surprising that some progressive Dems are pounding the alarm about the risks of private equity firms taking over practically every hospital chain in the country. "Private equity’s growing reach into our health-care system is concerning precisely because private equity’s mission to reap enormous profits often stands in direct conflict with the Hippocratic Oath," U.S. Representative Bill Pascrell, a New Jersey Democrat, said in an emailed statement. "We need greater transparency and more cutting oversight of these private-equity firms."
But setting aside the question of medical ethics for a moment, deals like these are certainly telling. Perhaps this is a sign that after 18 months of unprecedented deal flow buoyed by Jerome Powell's money printer, the biggest PE firms might be running out of ideas.

America Thayer was found beheaded in Shakopee, Minnesota Wednesday afternoon in broad daylight.
A Minnesota woman was beheaded on the street on Wednesday in a Minneapolis suburb.
42-year-old Alexis Saborit was arrested for the crime.
Investigators believe the suspect knew the victim and this was not a random act of violence.

Trump’s emergency powers worry some senators, legal experts

The day he declared the COVID-19 pandemic a national emergency, President Donald Trump made a cryptic offhand remark.
“I have the right to do a lot of things that people don’t even know about,” he said at the White House.
Trump wasn’t just crowing. Dozens of statutory authorities become available to any president when national emergencies are declared. They are rarely used, but Trump last month stunned legal experts and others when he claimed — mistakenly — that he has “total” authority over governors in easing COVID-19 guidelines.
That prompted 10 senators to look into how sweeping Trump believes his emergency powers are.
They have asked to see this administration’sPresidential Emergency Action Documents, or PEADs. The little-known, classified documents are essentially planning papers.
The documents don’t give a president authority beyond what’s in the Constitution. But they outline what powers a president believes that the Constitution gives him to deal with national emergencies. The senators think the documents would provide them a window into how this White House interprets presidential emergency powers.
“The concern is that there could be actions taken that would violate individual rights under the Constitution,” such as limiting due process, unreasonable search and seizure and holding individuals without cause, King said.
“I’m merely speculating. It may be that we get these documents and there’s nothing untoward in their checks and balances and everything is above board and reasonable.″

Joshua Geltzer, visiting professor of law at Georgetown University, said there is a push to take a look at these documents because there is rising distrust for the Trump administration’s legal interpretations in a way he hasn’t seen in his lifetime.
The most publicized example was Trump’s decision last year to declare the security situation along the U.S.-Mexico border a national emergency. That decision allowed him to take up to $3.6 billion from military construction projects to finance wall construction beyond the miles that lawmakers had been willing to fund. Trump’s move skirted the authority of Congress, which by law has the power to spend money in the nation’s wallet.
“I worry about other things he might call an emergency,” Geltzer said. “I think around the election itself in November — that’s where there seems to be a lot of potential for mischief with this president.”
“When somebody’s the president of the United States, the authority is total,” Trump said, causing a backlash from some governors and legal experts. Trump later tweeted that while some people say it’s the governors, not the president’s decision, “Let it be fully understood that this is incorrect.”
Trump later backtracked on his claim of “total” authority and agreed that states have the upper hand in deciding when to end their lockdowns. But it was just the latest from a president who has been stretching existing statutory authorities “to, if not beyond, their breaking point,” said Stephen Vladeck, a law professor at the University of Texas.
Questions about Trump’sPEADswent unanswered by the Justice Department, National Security Council and the Office of the Director of National Intelligence.
Elizabeth Goitein, co-director of a national security program at the Brennan Center for Justice at New York University School of Law, said PEADs have not been subject to congressional oversight for decades. She estimates that there are 50 to 60 of these documents, which include draft proclamations, executive orders and proposed legislation that could be swiftly introduced to “assert broad presidential authority” in national emergencies.
She said the Eisenhower administration hadPEADsoutlining how it might respond to a possible Soviet nuclear attack. According to the Brennan Center, PEADs issued up through the 1970s included detention of U.S. citizens suspected of being subversives, warrantless searches and seizures and the imposition of martial law.
Goitein said she especially worries about any orders having to do with military deployment, including martial law. “You can imagine a situation where he (Trump) engineers a crisis that leads to domestic violence, which then becomes a pretext for martial law,” said Goitein, who insists she’s simply playing out worst-case scenarios.

President Harry Truman created the National Security Council (NSC) in 1947. Since its founding, every president has issued some form of national security directives. National security directives are usually directed only to the NSC and senior executive branch officials and lay out foreign and military policy-making guidance. Bill Clinton’s Presidential directive PDD-63 of May 1998 started including extensive critical infrastructure protection (CIP). PDD-63 mandated the formation of a national strategy for CIP.
In the wake of the September 11th terrorist attacks, numerous changes took place regarding how we define and operate our CIP. The Patriot Act was signed into law on October 26th, 2001 and gave the following definition for critical infrastructure:
The following year (November 25, 2002), the Homeland Security Act was signed into law creating the United States Department of Homeland Security. In 2003, President George W. Bush signed the Homeland Security Presidential Directive 7 (HSPD-7) which replaced PDD-63 and established the U.S. National Policy for identification of and prioritization of critical infrastructure. HSPD-7 called for The National Infrastructure Protection Plan (NIPP) which aims to unify Critical Infrastructure and Key Resource (CI/KR) protection efforts across the country. The NIPP's goals are to protect critical infrastructure and key resources and ensure resiliency. It was not an actual plan to be carried out in an emergency, but it was useful as a mechanism for developing coordination between government and the private sector.
The NIPP is structured to create partnerships between Government Coordinating Councils (GCC) from the public sector and Sector Coordinating Councils (SCC) from the private sector. I want to again emphasize that the SCCs are from the private sector.

The NIPP also discussed implementing “Advisory Councils” shown below. These councils have been used as a method to involve the private sector in matters of national security relating to critical infrastructure.
Remember that highlighted part. Read it twice if you have to. The formation of this Critical Infrastructure Partnership Advisory Council (CIPAC) as FACA-exempt is crucial and I’ll explain why later. One more thing regarding membership of CIPAC:
Again, I want to emphasize that “membership of the CIPAC will consist of: the Critical Infrastructure/Key Resource (CI/KR) owners and operators that are members of their respective sector’s recognized SCC.”
What does any of this have to do with the 2020 election?
Cybersecurity and Infrastructure Security Agency
On January 6th, 2017, Secretary of Homeland Security Jeh Johnson (Obama’s SHS) released a statement designating “Election Infrastructure” as a “critical infrastructure subsector” within the existing critical infrastructure sector titled: “Government Facilities”. This allowed Election Infrastructure Security to fall under the umbrella of the DHS.
On November 16, 2018, President Trump signed into law the Cybersecurity and Infrastructure Security Agency Act of 2018 which established the Cybersecurity and Infrastructure Security Agency (CISA). According to their own website, “The Cybersecurity and Infrastructure Security Agency (CISA) is the Nation’s risk advisor, working with partners to defend against today’s threats and collaborating to build more secure and resilient infrastructure for the future.” The CISA website lists all 16 of the critical infrastructure sectors but I want to focus on the Government Facilities Sector because that is where you can find the Election Infrastructure Subsector. The election infrastructure subsector landing page looks like this:
Here is the 2020 Charter Election Infrastructure Subsector Government Coordinating Council Charter-2-9-2020 as shown above. Keep in mind that Sector Coordinating Councils(SCC) are from the private sector and are members of Critical Infrastructure Partnership Advisory Council (CIPAC).
Essentially, the EISCC is a council made up of members from the private sector that advises and assists our government with the “physical security, cyber security, and emergency preparedness of the nations election infrastructure”. They do this through “voluntary actions of the infrastructure owners and operators REPRESENTED in the council”.
This means that the members of the EISCC are the actual election infrastructure owners and operators, and they handle the physical security along with the cybersecurity through their own “voluntary actions”.
They “coordinate with the DHS to develop, recommend, and review sector-wide plans, procedures, and effective practices in support of infrastructure protection, including training, education, and implementation”. They also “make recommendations to appropriate authorities to mitigate impediments to effective critical infrastructure security”.
Section 5 of the charter is critical. Focus on the first paragraph below. “The EISCC operates under the critical infrastructure partnership advisory council (CIPAC) framework established by the Secretary of Homeland Security pursuant to section 871 of the Homeland Security Act of 2002 (6 U.S.C. §451)”
What exactly is “section 871 of the Homeland Security Act of 2002 (6 U.S.C. §451)” I’m going to break this down the best I can.
So the EISCC which we know operates under the CIPAC framework is exempt from Public Law 92-463 (screenshot below) and that law establishes “a system governing the creation and OPERATION of advisory committees.”
So just to make sure this is clear:
DHS has submitted a notice in the federal registry in 2006 (renewed every two years) that CIPAC is exempt from oversight over its creation and operation of advisory committees
The EISCC is operating under the framework of CIPAC.
Therefore, the EISCC is exempt from oversight over its creation and operation.
Now Back to Section 871 (just read the highlighted part):
Here is the section 202 of title 18, USC (most important parts highlighted):
So because the EISCC operates under the framework of CIPAC and is exempt from Public Law 92-463, they are classified as “Special Government Employees”.

Subsection b(3) of section 208 of Title 18, United States code reads as follows:
So because the EISCC operates under the framework of CIPAC and is exempt from Public Law 92-463 (exempt from oversight), they are classified as “Special Government Employees” and they have been certified that their “services outweighs the potential for a conflict of interest created by the financial interest involved.”
This means our government knows there is a “potential for a conflict of interest created by the financial interest involved” for members of the EISCC because the “official responsible for the employee’s appointment” has to certify it. They know there is a conflict of interest for members of the EISCC yet they allow it to operate without oversight.

In recent days and weeks, President Trump has repeatedly suggested he may use unspecified emergency powers in response to the COVID-19 pandemic.On March 12, for example, that he told reporters that he has “the right to do a lot of things that people don’t even know about,” including “a lot of emergency actions that I can take.”[1]On March 16, he claimed to have “very strong emergency powers” that could be used to close the southern and northern borders of the United States.[2]During an April 14 press briefing, the President asserted “total” authority to force state and local governments to rescind public health measures.[3] When challenged about his claims, President Trump said his Administration would “write up papers” or a “legal brief” justifying these positions.[4]
While it remains unclear what the President is referring to when he describes authorities “that people don’t even know about,” his remarks suggest that his Administration has produced or may soon produce documents purporting to support the use of extraordinary legal authorities in response to the pandemic. Such documents would likely undergo review by the Justice Department’s Office of Legal Counsel (OLC). The President may also be referencing “Presidential Emergency Action Documents” (PEADs), which may contain contingency plans by this Administration or its predecessors for the government’s response to a pandemic. Public disclosures indicate that between 50 and 60 PEADs have been drafted by prior Administrations to address various emergency scenarios, and those documents are typically reviewed by OLC.[5]
In light of the President’s threats to invoke these hidden emergency powers, we request that the Department provide the Judiciary Committee with the following:
1. A briefing (by teleconference if needed) about the Administration’s anticipated use of emergency powers during the COVID-19 pandemic;
2. Any PEADs in the Department’s possession that address contingency planning for pandemics; and
3. Any other documents or communications in the Department’s possession that describe or analyze the legality of the President’s potential use of emergency authorities in response to the COVID-19 pandemic.
Thank you for your prompt attention to this important matter.While the federal government must respond swiftly and energetically to protect the public health during this pandemic, the President cannot use the current crisis to assert secret and unreviewable powers.
