77 inmates at Iowa prison incorrectly given up to six times the normal dose of Pfizer COVID vaccine

Staff from the Iowa Department of Corrections incorrectly gave 77 inmates overdoses of the Pfizer COVID-19 vaccine, the department confirmed to the Des Moines Register.

The incident happened Tuesday at the maximum-security prison at Fort Madison, according to Cord Overton, a spokesperson for the department.

Overton said Thursday that none of the inmates became ill enough to need outside medical attention, such as hospitalization.

"The large majority of inmates continue to have very minor symptoms consistent with those that receive the recommended dose of the vaccine," he wrote in an email to the Register. "These include sore arm, body aches, and one inmate has experienced a low-grade fever, which was treatable with Tylenol."

Overton said early reports indicated the inmates were given up to six times the standard dose of the vaccine. He said prison officials have consulted with experts at the University of Iowa, the federal Centers for Disease Control and Prevention and Pfizer. He said the experts recommended the patients be monitored for at least 48 hours, but "they did not expect any inmates to have severe reactions."

Sen. Kuderer, 48th District, claimed a misunderstanding that the State Patrol had asked for an Emergency Clause when it had not, restricting the citizens opportunity to gather signatures for a referendum. Sen. Mike Padden (R) argued regardless of the mistake the People were given false information and acted upon it, because of this he did no concur moving the Act forward.

History

Summary of Engrossed First Substitute Bill:

It is unlawful for any person to knowingly open carry a firearm or any weapon:

• while at any demonstration being held at a public place — this prohibition applies whether the person carries the weapon on their person or in a vehicle;

• within 250 feet of a demonstration at a public place after a duly authorized state or local law enforcement officer advises the person of the demonstration and directs the person to leave until they no longer possess or control a weapon—this prohibition does not apply to any person possessing or controlling any firearm or other weapon on private property owned or leased by that person; and

• on the west state capitol grounds, in any building on the state capitol grounds, in any state legislative office, or at any location of a public legislative hearing or meeting during the hearing or meeting.

Federal, state, and local law enforcement officers and personnel are exempt from the prohibition when carrying a firearm in conformance with their employing agency's policy.

"Permitted demonstration" means a gathering of 15 or more people at a single event in a public place for which a permit has been issued by a government agency or has been designated as permitted by certain local government officials.

"Public place" means any site accessible to the general public for business, entertainment, or other lawful purpose. It includes, but is not limited to, the front, immediate area, or parking lot of any store, shop, restaurant, tavern, shopping center, or other place of business; any public building, its grounds, or surrounding area; or any public parking lot, street, right-of-way, sidewalk, public park, or other public grounds.

A person violating these prohibitions is guilty of a gross misdemeanor.

PRO: The purpose of openly carrying a weapon at a protest is to intimidate people who are exercising their First amendment rights. It only serves to increase the risk of violence or death. We have seen armed groups engaged with peaceful protesters sometimes with deadly consequences. The most alarming trend is the increase of armed vigilante activity and intimidation with firearms. This bill is a common sense approach to ensure that weapons are not used to intimidate peaceful protesters. This bill is modeled after an existing law in the pro-gun state of Alabama. The bill does not prevent someone with a concealed carry permit to carry concealed. There is not a conflict with the Second Amendment. You are just limited to how and where you can exercise the Second Amendment similar to existing restrictions for courts, jails, and such. This is a reasonable restriction on the Second Amendment.

CON: Many citizens choose to exercise the right to open carry firearms every day without incident. Others find it necessary to openly carry in order to deter criminal behavior in their neighborhoods and businesses especially when there is an absence of law enforcement resources. The definition of demonstration is unconstitutionally vague where anyone at anytime for any reason expressing views or grievances that have the effect of attracting a crowd somehow constitutes a demonstration. There is no definition of a crowd. It is unconstitutional to remove one person's Second Amendment constitutional rights solely on the basis of another person, three football fields away, exercising their First Amendment rights. The enforcement of this new law is ripe for abuse and certain communities could be targeted.

EFFECT OF HOUSE AMENDMENT(S):Removes language "as described in this chapter" when referring to a firearm or other weapon.

•Defines a "gathering" as a demonstration, march, rally, vigil, sit-in, protest, picketing, or similar public assembly, within the definition of a "permitted demonstration."

•Conforms technical differences of language in different sections providing exemptions for law enforcement and armed forces.•Adds a severability clause.

So, while releasing violent felons on the law-abiding citizens of the state is state policy, and police resources have been stretched thin dealing with a substantial increase in crime in many parts of the state, the Governor also wants to use police powers to threaten businesses and citizens who don’t follow his proclamations – regardless of how irrational and illegal they might be. When the opportunity to join Inslee’s Informant Army was presented, thousands jumped at the chance to turn in their neighbors for being “insubordinate” to Governor Jay Inslee.

A few notes about the complaints:

● The spelling is so atrocious in many cases it makes it difficult to even understand the complaint (If you are doing that on purpose – good one, but I suspect literacy is just on the decline these days)

● Many complaints are filed by business competitors trying to harm each other

Some complaints appear to be from workers who believe they can make more on unemployment

● Often, it appears, that if someone didn’t like the business in the first place, this was a good way to pile on and throw something more at it.

● I liked the innovative complaints on all the private aircraft taking off from Renton airport (and elsewhere). Very detailed.

● It was a nice touch to see people file complaints on Inslee himself using this system (no reason to stop)

US airdropped supplies near Senkakus in China-conscious drill

U.S. forces staged a rare military exercise near the Japan-administered Senkaku Islands, going a step beyond its usual activity by airdropping supplies into waters near the islets in an apparent warning to China over recent incursions.

The U.S. military informed Japan's Self-Defense Forces shortly beforehand about plans for an exercise there involving a personnel drop, according to a senior Japanese official, though no troops were ultimately transported onto the islands. The drill took place in February, a few weeks before a summit of the Indo-Pacific security grouping known as the Quad. The tensions surrounding the Senkakus, which China claims as the Diaoyu, have taken on added significance as Beijing has ramped up pressure on Taiwan. The islands sit only about 170 km away from the Taiwan Strait, and mounting tensions with China in either area could easily come to engulf both. A Chinese fighter jet approached the islands on the day of the drill, and Japanese Air Self-Defense Force fighters were scrambled in response. Chinese naval vessels were also sighted in the vicinity. Japanese Chief Cabinet Secretary Katsunobu Kato declined Thursday to comment on the specifics of a U.S. operation, but said that "American forces conduct drills from time to time during peacetime as needed to fulfill the objectives of the Japan-U.S. Security Treaty."

Washington and Tokyo have affirmed repeatedly most recently in the joint statement issued after the April 16 summit between U.S. President Joe Biden and Japanese Prime Minister Yoshihide Suga that Article 5 of the treaty, which obligates the U.S. to defend Japan if it comes under attack, covers the Senkakus. The language of the treaty suggests that if Chinese troops landed on the islands, for example, American forces would work with the SDF to retake them or stop the invasion.

While the U.S. military and the SDF have previously conducted exercises around isolated islands for such scenarios, this appears to be the first to come to light involving the Senkakus themselves. The move reflects a shift in Washington's attitude toward Beijing. Biden has called China America's biggest rival, and his administration has made clear that it seeks to partner with allies to counter Beijing on both security and economic fronts. The decision to take action specifically related to defending the Senkakus, a major concern for Tokyo, is part of this change. The topic was raised at last week's summit, after which Suga told reporters that he and Biden agreed to "peacefully resolve" issues involving China. Beijing has acted increasingly aggressively in the area. The number of days on which Chinese vessels sailed in the territorial waters around the Senkakus between January and March doubled from the same period last year, and Chinese ships have passed through the islands' contiguous zone every day since Feb. 13.

Supreme Court Makes It Easier to Impose Life Without Parole on Juvenile Murderers

Conservative justices signal shift away from clemency for youth offenders

The Supreme Court on Thursday made it easier to sentence juvenile murderers to life in prison without parole, ruling against a Mississippi inmate who killed his grandfather when he was 15.

The question was whether courts must find that a youth offender has no capacity for change before sentencing him to life without parole. Writing for a majority of five, Justice Brett Kavanaugh said the answer is no, a defeat for defendants across the country fighting life without parole sentences imposed while they were minors.

Thursday's decision breaks with a modern trend of clemency toward youth offenders at the High Court. It also reflects a continuing rightward shift in cruel and unusual punishment cases. The conservative justices signaled a similar rupture with precedents that favor death row inmates in a 2019 case about capital punishment.

The inmate in Thursday's case, Brett Jones, murdered his 67-year-old grandfather Bertis Jones in August 2004 by stabbing him eight times with a steak knife. The pair had argued earlier in the day when Bertis discovered that Brett's girlfriend had secretly been staying at the family home in Shannon, Miss. Jones was convicted of murder and sentenced to life in prison without the possibility of parole in May 2005.

The Supreme Court ruled that mandatory life without parole sentences for juvenile murderers are unconstitutional in the 2012 case Miller v. Alabama. Miller left open the possibility of life without parole for juvenile defendants who are "permanently incorrigible." Jones caught a break four years later in 2016, when the Court in Montgomery v. Louisiana said Miller also applied to juvenile murderers sentenced before 2012. Jones obtained a second sentencing hearing.

At the resentencing, Jones told the judge he grew up to be a better person and did his best to live a decent life in prison.

"I can't change what was already done. I can just try to show … I've become a grown man," Jones said.

The judge again sentenced Jones to life in prison.

Now before the High Court, Jones said his life sentence ought to be lifted because the sentencing judge didn't make any official finding that he is "permanently incorrigible." Kavanaugh said Miller and Montgomery "squarely rejected such a requirement." As long as the sentence isn't mandated by state law and the court has the option of imposing a lesser sentence, it is constitutional, he wrote.

"The resentencing in Jones's case complied with those precedents because the sentence was not mandatory and the trial judge had discretion to impose a lesser punishment in light of Jones's youth," Kavanaugh wrote.

He also noted that judges in death penalty cases aren't required to explain on the record why they accept or reject reasons for leniency. It would be "incongruous" to require that for life sentences, he said.

Tokyo Motor Show cancelled for first time in 67 years

The Tokyo Motor Show has been cancelled for the first time in its 67-year history due to rising virus cases.

The cancellation of the event comes even as the organisers of the Summer Olympics push ahead with their plans. It comes as Japan is expected to declare a state of emergency for Tokyo, Osaka and two other prefectures from 25 April to 11 May. Japan is facing a surge in Covid-19 cases, driven by more infectious variants of the virus. The last event, which took place in 2019, attracted around 1.3 million visitors, according to the Japan Automobile Manufacturers Association. The show's organisers also said that, unlike other major industry exhibitions that have moved online during the pandemic, there were no plans to make it a virtual event. The cancellation comes as Japan's Prime Minister Yoshihide Suga is expected to declare a state of emergency in several parts of the country, including Tokyo and Osaka. These latest developments come just three months before Japan is scheduled to host the 2020 Olympics, which have already been delayed by a year. In China this week the first major global car exhibition since the start of the pandemic went ahead.

The country's biggest motor show, Auto Shanghai 2021, was open to the public but with attendees having to take Covid-19 tests to gain entry.
