Sen. Kirsten Gillibrand Says The Quiet Part About Biden’s ‘Infrastructure’ Plan Out Loud

Democratic New York Sen. Kirsten Gillibrand said Wednesday morning on Twitter that child care, paid leave and caregiving are “infrastructure” in defense of President Joe Biden’s nearly $2 trillion infrastructure package.

“Paid leave is infrastructure,” the tweet said. “Child care is infrastructure. Caregiving is infrastructure.”

Biden introduced the expansive infrastructure package, titled the American Jobs Plan, on March 31 in Pittsburgh, Pennsylvania. The bill has been criticized for including provisions seemingly unrelated to infrastructure, like paid family and medical leave.

Although it does allocate $600 billion to improve roads, bridges and public transit, a White House Fact Sheet shows that the package also includes significant funding for developments aimed at addressing climate change and “long-standing and persistent racial injustice.”

“Both our failing physical infrastructure and the impossible choices we impose on caregivers put our nation at a competitive disadvantage,” House Ways and Means Chair Richard Neal wrote in a letter to Democratic committee members pledging that paid medical and family leave would be included in the bill. “If it is the road that gets you to work, it is the child care that gets you through the day, and workers are counting on these supports.”

“Strengthening our care economy will align closely with President Biden’s American Family Plan that he is set to unveil in the coming weeks, but the urgency of this necessitates that we begin our work now.”

Morgan Stanley sold $5 billion in shares from Archegos the night BEFORE news hit the market that the private investment firm was about to collapse

Morgan Stanley sold about $5 billion of Archegos' stocks the night before the fire sale hit rivals, according to reports.

The investment bank and financial services company had the consent of Archegos, run by former Tiger Management analyst Bill Hwang, to shop around its stock late last month, according to a report by CNBC that cited people with knowledge of the trades.

The bank offered the shares at a discount, telling the hedge funds that they were part of a margin call that could prevent the collapse of an unnamed client.

Morgan Stanley has so far declined to comment on the trade which saw it quietly unload some of its risky positions to hedge funds.

In total, Morgan Stanley, who was was the biggest holder of the top 10 stocks traded by Archegos at the end of 2020 with about $18 billion in positions, sold about $5 billion in Archegos stock in order to avoid suffering losses of their own which could well have totaled more than $10 billion.

Morgan Stanley didn't share the information it had with stock buyers. The Archegos shares it was selling comprised of various names including Baidu and Tencent Music.

The sell off was the start of tens of billions of dollars in sales by Morgan Stanley and other investment banks starting the very next day.

FinCEN Begins Making Rules For Corporate Transparency Act

The U.S. Financial Crimes Enforcement Network (FinCEN) asked last week for the public to comment on a series of questions about the new beneficial ownership reporting requirements of the Corporate Transparency Act (CTA), according to an Advance Notice of Public Rulemaking (ANPR).

FinCEN.svgFinCENThe act targeted financial crimes like money laundering and terrorist financing by requiring corporations and limited liability companies to report details about their beneficial owners and thus, ending the anonymity of malign actors perpetrating these crimes.

“The ability to engage in activity and obtain financial services in the name of a legal entity without disclosing the identities of the natural persons who own or control the entity—the natural persons whose interests the legal entity most directly serves—enables those natural persons to conceal their interests,” the ANPR said.

“As FinCEN has previously highlighted, such concealment ‘facilitates crime, threatens national security, and jeopardizes the integrity of the financial system,’” it said. 

Changes in these regulations comes after an international outcry to crack down on anonymous shell companies. Led by ICIJ and Buzzfeed News, the OCCRP and several other outlets published in 2020 the FinCEN files, exposing the role of financial institutions in wide-scale money laundering. In December, more than 20 international organizations called on the United Nations to crackdown on anonymous shell companies.

The rulemaking process allows for the public to have a say in the regulations created to enforce the act. The ANPR asked the public to answer a range of questions pertaining to the CTA including how to define key terms, suggestions on reporting procedures and what type of information should go into reports.

Beneficial ownership information will be organized into a non-public database maintained by FinCEN and available to law enforcement and financial institutions bound by customer due diligence as long as they have the consent of the customer, according to the act.

Experts like Jim Richards, founder of RegTech consulting who has 20 years of experience in financial crimes, delivered praise for the new regulations with a healthy dose of skepticism. One of the stated goals of the CTA is to facilitate the sharing of information with the goal of curbing financial crime, but Richards questioned the effectiveness of a database as it is lined out so far in a recent article he wrote for RegTech.

“Financial institutions’ access to the database is severely restricted, and the punishing requirements imposed on federal, State, and Tribal government agencies to gain access to the information in the database may dissuade many of them from using it at all,” Richards said.

He also raised concerns about possible loopholes in the CTA, specifically when it comes to reporting exceptions for companies he refers to as “tall, dark, and handsome”- corporations or llcs which have a minimum of 20 employees, US$5 million in revenue and a physical office in the U.S.

Theoretically, by creating the right kind of facade criminals could create a corporation which would not be required to report its beneficial owner under the CTA.

Nothing is set in stone yet, the public is allowed and “strongly encouraged” to submit comments on the rules through May 5, 2021, according to FinCEN. The new rules which will enforce the actions required by the CTA must be finalized by January 1, 2022.

In November 2020, Michelle Vilchez was interviewed in her role as executive director of the Peninsula Conflict Resolution Center. Guess what her background is? She worked on developing the strategic plan for First 5 County San Mateo. Dr. William Ayres also worked on developing that strategic plan.

San Mateo is rife with sex scandal. In 2007, federal authorities raided a network of Las Vegas brothels in an operation called Operation Doll House, which found illegal immigrant prostitutes. The San Mateo county sheriff and undersheriff were found inside a sleazy brothel during the raid, but were not prosecuted despite media scandal. Democrat congresswoman Jackie Speier later held a gun buyback in 2013 with a sheriff who was present in the brothel, and headlined another gun buyback in 2018 with the other law enforcement officer who was present in the brothel.
