Don't look now but there's a real dispute emerging among judges in DC about one of the staple charges against nearly every Jan. 6 defendant:Entering and remaining in a restricted building.
Tonight,Judge Cooper acquitted a Jan. 6 defendant of two counts, saying DOJ fell short.
The heart of the dispute: Does DOJ need to show that rioters *knew* Mike Pence (or another USSS protectee) was/would be present to prove someone violated he law. Until recently, judges had all agreed that wasn't necessary.
Cooper's opinion:
Cooper (Obama) joins Judges Nichols (Trump) and Lamberth (Reagan) in taking this narrower view of the 18 USC 1752 charges, a misdemeanor that has been leveled against 1,186 of the 1,260-ish Jan. 6 defendants.

Today, the Chairman of the House Financial Services Committee, Patrick McHenry (NC-10), issued the following statement after House and Senate leadership announced an agreement on topline spending levels for Fiscal Year 2024 appropriations. The agreement reinforces the historic spending cuts and regulatory changes from the Fiscal Responsibility Act, which Chairman McHenry and Congressman Garret Graves (LA-06) negotiated with the While House in May.
“The House-Senate spending agreement announced today fulfills the Fiscal Responsibility Act from May, which I was honored to work on with Congressman Garret Graves under the leadership of former Speaker McCarthy,” said Chairman McHenry. “This deal cements the historic spending cuts and critical regulatory changes that will help unleash economic growth, while using agreed upon second year pay-fors this fiscal year. Two-thirds of both parties in the House supported the Fiscal Responsibility Act. This deal, which adheres to that framework, deserves equally as robust support. I applaud Speaker Johnson’s leadership in maintaining savings negotiated in the debt ceiling agreement and working to avoid a government shutdown.”

President Biden’s reelection campaign raised more than $1 million through online fundraising alone in the 24 hours after the president’s Jan. 6 anniversary speech, according to numbers exclusively provided to The Hill.
Biden on Friday gave a full throated attack against former President Trump, his likely GOP opponent, and warned Americans that Trump’s reelection would pose a threat to American democracy. The president zeroed in on Jan. 6 to mark the third anniversary of the U.S. Capitol riots and argued in his remarks that democracy is on the ballot in 2024.
In response to the 24-hour fundraising haul, the Biden campaign noted that they see preserving democracy as a political winner for the president in 2024.
“In election after election, democracy and freedom are mobilizing issues for the American people. In 2024, that will be no different, and we are encouraged by the strong grassroots enthusiasm we are seeing around the President’s core campaign message,” Rob Flaherty, Biden’s deputy campaign manager, told The Hill.
The speech was Biden’s first major general election speech and was delivered near Valley Forge, Pa., a significant symbol of the American Revolution. He focused on Trump — calling him a “loser” at one point — and underscored what he sees as the stakes in a rematch against Trump in November.
Trump, in response to the speech, accused Biden of “fearmongering” and suggested the president was only attacking him on the issue of democracy because he could not run on other issues.

EXCLUSIVE: Afghanistan war veteran and Republican Senate candidate Sam Brown has set a new fundraising record in his bid to flip the crucial swing state of Nevada away from Democrats in November.
According to Brown's campaign, the former U.S. Army officer raised a massive $1.85 million in the fourth quarter last year, more than any challenger to an incumbent running for re-election in Nevada history.
When combined with his third quarter fundraising, Brown's campaign brought in a whopping $3.04 million, also a record for that combined time frame.

The Phases of Venus
Venus goes through phases. Just like our Moon, Venus can appear as a full circular disk, a thin crescent, or anything in between. Venus, frequently the brightest object in the post-sunset or pre-sunrise sky, appears so small, however, that it usually requires binoculars or a small telescope to clearly see its current phase. The featured time-lapse sequence was taken over the course of six months in 2015 from Surgères, Charente-Maritime, France, and shows not only how Venus changes phase, but changes angular size as well. When Venus is on the far side of the Sun from the Earth, it appears angularly smallest and nearest to full phase, while when Venus and Earth are on the same side of the Sun, Venus appears larger, but as a crescent. This month Venus rises before dawn in waxing gibbous phases.
