Three men accused of helping plot the Sept. 11 terror attacks – including alleged mastermind Khalid Sheikh Mohammed –have struck plea deals that’ll allow them to skirt the death penalty, officials and sources said Wednesday.

“The Convening Authority for Military Commissions has entered into pretrial agreements with Khalid Shaikh Mohammad, Walid Muhammad Salih Mubarak Bin ‘Attash, and Mustafa Ahmed Adam al Hawsawi, three of the co-accused in the 9/11 case” being held on Guantanamo Bay, an Office of Military Commissions (OMC) spokesperson confirmed.

The terror suspects will be spared the death penalty as part of the plea agreement, according to three relatives of 9/11 victims who were told about the deal by the OMC.

Judicial Watch: Secret Service Rejects FOIA Requests for Any Records About Assassination Attempt on Former President Trump

(Washington, DC) – Judicial Watch announced today that the United States Secret Service completely denied multiple Freedom of Information Act (FOIA) requests for documents about the assassination attempt on former President Trump.

On July 16, 2024, Judicial Watch filed three comprehensive FOIA requests seeking emails, videos, and advance survey security assessments, among other documents related to the assassination attempt on Trump

The Secret Service refused to produce not one record in response:

At this time, pursuant to Title 5 U.S.C. § 552(B)(7)(A), any potentially responsive records, if they exist, are exempt as disclosure could reasonably be expected to interfere with enforcement proceedings. The citation of the above exemption is not to be construed as the only exemption which may be available under the FOIA.

Judicial Watch is pursuing the next steps in preparation for litigation.

“The Biden Secret Service is in cover-up mode on its inexcusable and epic failure to protect former President Trump and other innocents,” said Judicial Watch President Tom Fitton. “For Secret Service leaders to promise transparency to Congress while hiding every possible FOIA record from the American people is yet another indictment of this corrupt and failing agency.”

Judicial Watch has over 25 FOIA and open records currently pending on the shooting of Trump with the Biden administration and local and state officials and agencies in Pennsylvania.

In July 2024, Judicial Watch filed a Freedom of Information Act (FOIA) lawsuit against the Department of Homeland Security for records relating to an incident at Joint Base Andrews in Maryland in which a Secret Service agent assigned to protect Vice President Kamala Harris reportedly got into a scuffle with colleagues.

In June 2024, Judicial Watch received 116 pages of United States Secret Service records from the Department of Homeland Security through the Freedom of Information Act that reveal the details about several incidents in which Secret Service personnel were bitten by President Biden’s dog Commander, sometimes requiring medical attention.

In October 2022, Judicial Watch sued the Department of Homeland Security for all communications of the U.S. Secret Service internally and with the Federal Bureau of Investigation regarding the raid on President Trump’s home and for any video or audio recordings made during the raid on August 8, 2022.

The Integrity Committee has failed to root out serious allegations made against its allies while targeting others with harassment and investigations, nearly a dozen people familiar with the situation report.

When President DonaldTrump fired State Department Inspector General Steve Linickat the request of Secretary of State Mike Pompeo in May of 2020,all hell broke loose. Left-wing media and Democrats were outraged that he was removed, even as Pompeo said he should have fired Linick much earlier than he did.

The firing took place afterinformationheld by the State Department’s inspector general’s [IG] office somehowfound its way into a Daily Beastarticle headlined,“State IG Set to Recommend Discipline for Trump’s Top Iran Hand.”The article, sourced to “two government sources involved in carrying out the investigation,” was about theState IG’s investigation into Brian Hook, a State Department official who had ended the employment of some individuals perceived to be loyal to the Obama administration and hostile to President Trump’s Iran policy.

Because theleakof the report almost certainly camefrom Linick’s office, Linick told State Department officials he’d contact his friends at the Council of the Inspectors General on Integrity and Efficiency(CIGIE), whose Integrity Committee watches the IG watchdogs. Instead, he picked the Department of Defense IG to investigate whether any of the 15 State Department IG’s staff with access to the draft report were responsible for the leak.

That IG found, in an “exceedingly cursory” review, that whileLinick had emailed sections of the Hook report to his personal emailaccount, in violation of State Department policy, there was no specific evidence that this was related to the leak. Linick told State Under Secretary Brian Bulatao in mid-March that theDefense Department IG said it could find no evidence of any State IG staff being involvedin the leak. Bulatao asked for a copy of the report, and Linick said he’d provide it but didn’t. Two months later,Linick was put on administrative leaveand told he would be let go.He was told not tospeak to IG staff and not to enter the building.However, he communicated with IG staff and entered the building.

Bulatao sent a letter to Michael Horowitz, the Justice Department IG who at that time led CIGIE, and asked him toplease conduct a reviewof what had happened. “[T]heremay have been a significant breakdownin the typically rigorous standards of an IG investigation, warranting CIGIE review,” Bulatao pleaded.

Horowitz referredthe request toCIGIE’s Integrity Committee. That committee issued aremarkable letterin December of 2020saying everything Linick had done was reasonable, including failing to provide the leak report to State Department officials, entering the building while on leave, mailing official business to his personal account, and shopping around for his own hand-picked investigator.

Watchdog Watcher Is Failing

Thelast line of defensein preventing wrongdoing at the highest levels of the federal government is supposed to be theIntegrity Committee. Under theleadership of Kevin Winters, however, it has failed to root out serious allegations made against its allieswhile targeting otherswith endless harassment and meritless investigations, nearly a dozen individuals familiar with the situation report.

In fact, members of Congress are askingWintersto explain by June 3why he “failed to investigate serious allegations” against three senior Department of Homeland Security IG employees who were found by an independent analysis conducted byWilmerHale to have engaged in fraud, misconduct, retaliation, and abuse of authority.

The request from Rep. Andy Biggs, R-Ariz., and eight other members of Congress relates to anincident that began in 2019, before Winters was appointed.That’s when DHS IG Joseph Cuffari’s requestto the Integrity Committee to look into the three employeeswas rebuffed. Themisconduct was so severethat Cuffari was advised to engage in a formal procurement process to have an outside law firm conduct an independent and unbiased investigation. The WilmerHale firm found thatnot only were the allegations substantiated, but the then-vice chairwoman of CIGIE had encouraged the employees’ actions.That woman, Allison Lerner, struggled to answer questions about her role during a 2021 line of questioning from Sen. Josh Hawley, R-Mo.

ATLANTA — Channel 2 Action News is learning more about the victims of a tragic plane crash on Friday afternoon in Wyoming.

Three members of gospel music group The Nelons and four others died while flying west to attend a Gaither Music Cruise to Alaska.

The Gaither Management Group confirmed Friday that “Jason and Kelly Nelon Clark, Amber and Nathan Kistler and their assistant, Melodi Hodges, along with the pilot, Larry Haynie and his wife, Melissa” died Friday afternoon.

On Saturday, Georgia Gov. Brian Kemp released a statement online saying that Larry Haynie was the Georgia Department of Corrections Chairman of the Board, in addition to the pilot onboard the crashed plane.

The governor’s statement reads:

Marty, the girls, and I are truly saddened to learn of the tragic death of Larry Haynie and his wife, Lisa, along with all those lost in this horrible plane accident. As chairman of the Georgia Department of Corrections Board and through a career of valued service in public safety, Larry’s impact on our state will not be forgotten. We will continue to hold his memory and that enduring commitment to his fellow Georgians in our hearts and memories.

Our entire family is asking everyone to join us in praying for those who have been lost, for their loved ones and communities, and for those throughout the gospel music community who have lost dear friends in this heartbreaking accident.

Speaking with Channel 2 Action News, the National Transportation Safety Board confirmed agents would be at the scene of the crash on Saturday, as part of a joint investigation with the Federal Aviation Administration.

However, details of the circumstances that caused the crash were not yet available.

“It is very early in the investigation and not much information available at this time. What I can provide is the NTSB team is expected to be on scene today. The aircraft is in a remote location and once they gain access, they will begin documenting the scene, examining the aircraft. The aircraft will then be recovered and taken to a secure facility for further evaluation,” NTSB said in a statement.

More than a dozen arrested in Comic-Con human trafficking sting

Authorities arrested 14 people and rescued 10 victims in a massive human trafficking sting at the San Diego Comic-Con Convention, California Attorney General Rob Bonta announced on Tuesday.

The operation took place Thursday through Saturday at the wildly popular and star-studded convention in downtown San Diego and involved local and state task force officers, Bonta’s office said.

Law enforcement personnel posed as sex buyers to identify and contact potential trafficking victims and arrest their traffickers, according to the attorney general’s office. They also posted undercover ads soliciting sex.

New Android malware wipes your device after draining bank accounts

A new Android malware that researchers call 'BingoMod' can wipe devices after successfully stealing money from the victims' bank accounts using the on-device fraud technique.

Promoted through text messages, the malware poses as a legitimate mobile security tool and can steal up to 15,000 EUR per transaction.

According to researchers analyzing it, BingoMod is currently under active development, with its author focusing on adding code obfuscation and various evasion mechanisms to drop detection rate.

BingoMod details

Researchers at Cleafy, an online fraud management and prevention solution, found that BingoMod is distributed in smishing (SMS phishing) campaigns and uses various names that typically indicate a mobile security tool (e.g. APP Protection, Antivirus Cleanup, Chrome Update, InfoWeb, SicurezzaWeb, WebSecurity, WebsInfo, WebInfo, and APKAppScudo).

In one instance, the malware uses the icon for the free AVG AntiVirus & Security tool available on Google Play.

During the installation routine, the malware requests permission to use Accessibility Services, which provides advanced features that allow extensive control of the device.

Once active, BingoMod steals any login credentials, takes screenshots, and intercepts SMS messages.

To perform on-device fraud (ODF), the malware establishes a socket-based channel to receive commands and an HTTP-based channel to send a feed of screenshots, enabling almost real-time remote operation.

Vice President Kamala Harris is a light skinned Jamaican-Indian woman married to a white man and if it weren’t for the fact that she’s a Democrat, the news media would be savagely attacking her for both until November.

Rest assured that if Harris were running for president as a Republican, calling her a “D.E.I. hire” would be the kindest thing printed about her in The New York Times. The more relentlessly vicious commentary would focus on her “proximity to whiteness” and her “light-skinned privilege.” There’s no question she’d be called a white supremacist.

Under the headline, “White men must be stopped: The very future of mankind depends on it,” the left-wing Salon in 2015 published an article by white male author Frank Joyce claiming then-Republican presidential candidate Ben Carson supports “white supremacist ideology.”

Talbert Swan, president of the NAACP, America’s premier race hustling operation, in April 2021 referred to GOP Sen. Tim Scott of South Carolina as “Uncle Tim.” Swan further described Scott as a “cunning white supremacy apologist, who demonstrated his buck dancing skills in front of the entire world.”

Earlier that year, the Washington Post ran an op-ed by New York University Professor Cristina Beltran, who explained Trump’s increased share of minority voters in 2020 as a consequence of “multiracial whiteness — the promise that they, too, can lay claim to the politics of aggression, exclusion and domination.”

NPR subsequently hosted Beltran to discuss her blatant racism, with host Lulu Garcia-Navarro helping Beltran put it another way: “So what you’re saying, essentially, is that people of other races and ethnicities want to benefit from white privilege by supporting it,” said Garcia-Navarro. “Right,” replied a chipper Beltran.

White supremacists who happen not to be white is a concept widely repeated in the media.

making allegations of misconduct and to provide evidence of malfeasance and other

improper conduct at the highest levels of the United States Capitol Police (USCP) and

within the USCP Office of the Inspector General (OIG). These include allegations of

criminal and grossly unethical conduct. The goal in writing this document is to present

allegations and overwhelming evidence of unethical and illegal conduct sufficient to

allow the United States Congress to investigate and corroborate these allegations.

Ultimately, this will initiate the essential reform needed within the USCP leadership,

OIG, legal offices, and oversight entities. I hope the implementation of this reform will

start with a public admission of guilt and apology by the USCP Chief and an appropriate

settlement for all victims of sustained misconduct.

The House filed a brief Monday in the appeal of Trump ally Steve Bannon that seeks toresurrect legal arguments that the House select panel investigating the Jan. 6 attack on the Capitol could not issue subpoenas because it was illegitimate.

The chamber’s filing at the full U.S. Court of Appeals for the District of Columbia Circuit takes the position of House Republican leaders toargue the panel broke the chamber’s rules when it was set up.

Bannon is currently serving a four-month sentence as he appeals his convictions on two counts of contempt of Congress, filed after he ignored a subpoena from the Jan. 6 committee seeking documents and his testimony about events leading up to the attack.

Although the brief said the House did not take a position on Bannon’s other arguments, it sought to revive legal arguments about the panel’s legitimacy that multiple courts have rejected.

Monday’s brief made two arguments: that the committee should have had 13 members, including five from the Republican minority; and that it should have had a ranking minority member, rather than a vice chair.

To issue lawful subpoenas— a requirement to find Bannon in contempt of Congress — the committee had to be set up with those features, the House argued. “In this House’s view, none of these things happened,” the brief said.

Last month, Republican House Speaker Mike Johnson, Majority Leader Steve Scalise and Majority Whip Tom Emmer said they had voted together to weigh in on Bannon’s behalf over the objection of Democratic leaders.

District Judge Carl Nichols of the District of Columbia rejected similar arguments from Bannonas part of the pretrial process. Numerous courts have upheld the committee’s composition, including the D.C. Circuit itself, following a suit by former President Donald Trump seeking to keep the House from gaining access to his presidential records.

Now-Justice Ketanji Brown Jackson joined a unanimous three-judge panel that found the committee was properly constitutedand that Trump had no legal ability to keep the Biden administration from handing over records. (They can’t decide what the rules our in the House for the Committee, it’s the House’s rules.)

Bannon was convicted on two counts of contempt of Congress in 2022 and has fought the conviction since, arguing that he relied on his attorney’s advice that executive privilege prevented him from cooperating with the subpoena.

In May, a three-judge panel of the D.C. Circuit found that there was no executive privilege involved in the subpoena and that Bannon had a duty to at least respond rather than ignoring it. Bannon has since appealed that ruling to the full D.C. Circuit, leading to the House weighing in on Monday.

The only other witness prosecuted for contempt of Congress in the Jan. 6 select panel’s investigation, former trade advisor Peter Navarro, recently finished his four-month sentence. Navarro also has a pending appeal of his conviction, on different legal arguments.

House Republicans have for years criticized the panel, including a resolution last month from Rep. Eric Burlison, R-Mo., that would purport to rescind the subpoenas issued by the panel to Bannon and other recalcitrant witnesses who refused to cooperate.

‘Over Ruled: the Human Toll of Too Much Law’

Books by Supreme Court justices usually focus on constitutional doctrine—on judicial interpretations of the Constitution. “Over Ruled: The Human Toll of Too Much Law” is, therefore, a pleasant surprise. Justice Neil Gorsuch and his former clerk Janie Nitze prioritize not legal analysis, but a series of stories about unfortunate litigants, whose experiences illuminate the dangers of administrative power and overregulation.

Most accounts of contemporary American regulation (including my own books) suffer from undue abstraction. They don’t provide enough concrete examples of how our current misrule destroys lives and livelihoods. They therefore leave readers without a visceral feel for how we are governed. Justice Gorsuch and Ms. Nitze recognize this gap and fill it with narratives, both sobering and entertaining.

We learn about individuals whose businesses were defeated, whose lives were destroyed, even one who was driven to suicide by arbitrary, unjust, and downright cruel regulation. Tragedy often intersects with comedy, as when the authors tell of an entertainer who kept a pet rabbit for his magic performances, only to find that he needed a federal license to keep a rabbit.

The Hemingway Museum at Key West faced the same problem because of its six-toed cats. When the museum finally applied for a license, the Department of Agriculture was not satisfied and had undercover federal agents conduct surreptitious surveillance of the cats to determine whether they were receiving the department’s standards of care. Kafka would have been proud.

The storytelling enables readers to get past the complexity of the contemporary regulatory regime and sense the underlying human stakes. Whereas the constitution provides a single system of federal lawmaking and a single judicial system, the federal administrative state consists of myriad other legislative and judicial bodies. Administrative power therefore often defies popular and even academic understanding. To get past this obstacle, the justice and his clerk tell regulatory stories.

I’ll add one of my own. When I was writing my book ”Is Administrative Law and Unlawful?” I struggled to figure out the range of different in-house judicial processes employed by different agencies. Academic scholarship was not very helpful, so I consulted a noted colleague and one of the nation’s leading administrative scholars. If anyone would know, it would be him.

My colleague’s response was telling. He could explain the judicial process employed by the agency for which he once worked, but when I pressed him for information about the vast number of other agencies, he had nothing to say—except that one has to work for an agency to understand its processes. So much for transparency!

Justice Gorsuch and Ms. Nitzi summarize: “Law is multiplying, and its demands are growing increasingly complex. So much so that ordinary people are often caught by surprise, even seasoned lawyers, lawmakers, and (yes) judges sometimes struggle to make sense of it all.” An increasingly complex world may require complex rules. The authors, though, rightly consider that no excuse for the unnecessary complexity and injustice of contemporary governance.

This isn’t just a question of liberty and due process — it’s also an equality problem. Justice Gorsuch and Ms. Nitzi write that “When law expands rapidly in size and complexity, when important rules can change (change back again) with ease and little warning, when important guidance can sometimes be found only in an official’s desk drawer, who are the winners and losers?”

Justice Gorsuch and Ms. Nitzi answer that “In one sense everyone may suffer. But who suffers the most? . . . . [S]mall and less powerful groups like the Amish often have a harder time making their case, and new rules can represent to them not just an expense or a hassle but an existential crisis.”

Justice Gorsuch and Ms. Nitzi recount the scandalous prejudice of the granddaddy of federal administrative power, President Wilson, who privately complained that “universal suffrage is at the foundation of every evil in this country” and publicly protested against the difficulty of understanding and changing the minds “of Irishmen, of Germans, of negroes.” Such were Wilson’s driving reasons for establishing administrative power.

Even without Wilson’s grotesque prejudices, administrative rulemaking reserves power to unelected educated elites and thereby dilutes voting rights. At stake, therefore, is not merely economic freedom, nor just the separation of powers, but our most fundamental civil liberties.

“Over Ruled” touches upon such dangers with a light touch. Its goal seems not to polemically persuade, but to open up questions for Americans to ponder and reconsider. If the authors can induce Americans to pay more attention to these problems, perhaps popular concern will circle back to some of Justice Gorsuch’s colleagues on the bench.

Mohammed Deif leads the Izz al-Din al-Qassam Brigades, the military arm of the Hamas movement.

He is a shadowy figure known to Palestinians as The Mastermind, and to Israelis as The Cat with Nine Lives.

Israeli authorities imprisoned him in 1989, after which he formed the al-Qassam Brigades with the aim of capturing Israeli soldiers.

After his release, he helped engineer the construction of tunnels that have allowed Hamas fighters to get inside Israel from Gaza,

Deif is one of Israel's most-wanted men, accused of planning and supervising bus bombings which killed tens of Israelis in 1996, and of involvement in the capture and killing of three Israeli soldiers in the mid-1990s.

Israel imprisoned him in 2000, but he escaped at the beginning of the second Palestinian uprising, or intifada.

Since then, he has left behind little trace. There are three known pictures of him: one is dated, he is masked in the second, and the third is of his shadow.

The most serious assassination attempts on his life were in 2002: Deif survived but lost one of his eyes. Israel says he also lost a foot and a hand, and that he has difficulty speaking.

Israeli security forces again failed to assassinate Deif during a 2014 assault on the Gaza Strip, but killed his wife and two of his children.
