Reported Justice Department Gag Orders Prevent Accountability of Controversial Obama-Era Deal with Russian Entities

WASHINGTON – Senate Judiciary Committee Chairman Chuck Grassley (R-Iowa) is calling on the Justice Department to lift a reported non-disclosure agreement preventing a former FBI confidential informant from speaking to Congress about the handling of a criminal probe linked to a controversial deal that ceded ownership of U.S. uranium assets to the Russian government. Despite an ongoing criminal investigation into officials working for subsidiaries of Rosatom, the Russian government entity seeking to acquire ownership of U.S. uranium, the Obama Administration approved the deal. The Justice Department has reportedly threatened to prosecute the informant if he discloses details of his involvement in the investigation.

“The Executive Branch does not have the authority to use non-disclosure agreements to avoid Congressional scrutiny. If the FBI is allowed to contract itself out of Congressional oversight, it would seriously undermine our Constitutional system of checks and balances. The Justice Department needs to work with the Committee to ensure that witnesses are free to speak without fear, intimidation or retaliation from law enforcement. Witnesses who want to talk to Congress should not be gagged and threatened with prosecution for talking. If that has happened, senior DOJ leadership needs to fix it and release the witness from the gag order,” Grassley said.

According to recent news reports, a U.S. businessman-turned-confidential informant documented bribes, extortion and money laundering by Russian entities that were attempting to secure U.S. government approval of a deal to acquire Uranium One, which reportedly owned 20 percent of American uranium assets at the time. According to the news reports, the informant has information regarding payments made by Russian executives to a U.S. entity that supported President Bill Clinton’s foundation. In 2010, despite an ongoing criminal investigation into officials working for Rosatom subsidiaries, the Obama Administration approved the takeover of Uranium One.

Last week, Grassley asked several federal agencies involved in approving the deal whether they had any knowledge of the ongoing criminal investigation and all communications relating to donations made to the Clinton Foundation by interested parties in the transaction. Those agencies include the Justice Department and State Department.

Grassley has previously raised concerns about the use of non-disclosure agreements by the federal government, specifically, the Justice Department and FBI, as a means of avoiding congressional oversight.

Grassley sent a letter Wednesday to the Justice Department asking for a copy of any reported non-disclosure agreement and calling for it to be lifted. Grassley also sent a letter to the attorney representing the confidential informant seeking an interview.

On October 12, 2017, I wrote to several agencies, including the Department of Justice, regarding the Uranium One/Rosatom transaction that was approved by the Committee on Foreign Investment in the United States (CFIUS) during the Obama administration. In that letter, I noted that the Department had an ongoing criminal investigation into Rosatom officials during the CFIUS approval process and asked, among other things, whether CFIUS was informed of that criminal matter.

On October 18, 2017, The Hill reported that “[a]n American businessman . . . worked for years undercover as an FBI confidential witness” to assist in the Department’s criminal investigation. [1] According to the reporting, the confidential witness “was asked by the FBI to sign a nondisclosure agreement (NDA) that prevents him from revealing what he knows to Congress.” [2] Further, the witness’ attorney said, “the Obama Justice Department threatened him with loss of freedom. They said they would bring a criminal case against him for violating an NDA.” [3]

These restrictions appear to improperly prevent the individual from making critical, good faith disclosures to Congress of potential wrongdoing. They also purport to limit the Committee’s access to information it needs to fulfill its constitutional responsibility of oversight. This Committee has oversight jurisdiction of the Justice Department, and if this NDA does in fact exist, it hinders the Committee’s ability to do its job. Accordingly, please provide a copy of the NDA by November 1, 2017. In addition, should the NDA exist, I request that you release him from it and pledge not to engage in any form of retaliation against him for good faith communications with Congress.

It appears that your client possesses unique information about the Uranium One/Rosatom transaction and how the Justice Department handled the criminal investigation into the Russian criminal conspiracy. Such information is critical to the Committee’s oversight of the Justice Department and its ongoing inquiry into the manner in which CFIUS approved the transaction. Accordingly, the Committee requests to interview your client. Please contact Committee staff by October 25, 2017, to arrange the interview.

Grassley wants answers in FBI raid on Uranium One whistleblower

Senator Chuck Grassley is demanding answers in a letter to FBI Director Christopher Wray about why a raid was conducted on the house of a Uranium One whistleblower.

Sen. Chuck Grassley, R-Iowa, has written to FBI Director Christopher Wray and the Justice Department's internal watchdog to request information about a raid on the home of a former FBI contractor who gave the watchdog documents related to former Secretary of State Hillary Clinton and the sale of Canadian mining company Uranium One to a Russian firm's subsidiary.

According to The Daily Caller, 16 FBI agents raided the Maryland home of Dennis Nathan Cain on Nov. 19. Cain's lawyer, Michael Socarras, told the website that the agent who led the raid accused his client of possessing stolen federal property. In response, Cain reportedly claimed that he was a protected whistleblower under federal law and had been recognized as such by the DOJ watchdog, Michael Horowitz.

Socarras also claimed that Horowitz had transmitted his information to the House and Senate intelligence committees.

The documents in question allegedly show that federal officials failed to investigate possible criminal activity related to Clinton, the Clinton Foundation and Rosatom, the Russian nuclear company whose subsidiary purchased Uranium One in 2013.

In his letter to Wray, Grassley asked on what basis the FBI raided Cain's home, whether the bureau was aware of Cain's disclosures to Horowitz's office; whether the bureau considered those disclosures to be protected, and whether agents seized classified information in the raid. Grassley, the chairman of the Senate Judiciary Committee, has also asked Horowitz to update the panel on "the FBI's treatment of Mr. Cain's disclosures."

Grassley has given Wray and Horowitz until Dec. 12 to respond.

Fox News has previously reported that Douglas Campbell, an FBI informant involved in the deal, has testified to lawmakers that Moscow paid millions to American lobbying firm APCO Worldwide to influence Clinton and the Obama administration.

URANIUM ONE INFORMANT SAYS MOSCOW PAID MILLIONS IN BID TO INFLUENCE CLINTON

“The contract called for four payments of $750,000 over 12 months,” Campbell said in his statement this past February. “APCO was expected to give assistance free of charge to the Clinton Global Initiative as part of their effort to create a favorable environment to ensure the Obama administration made affirmative decisions on everything from Uranium One to the US-Russia Civilian Nuclear Cooperation agreement.”

APCO has denied Campbell's claims while Clinton called any claims of wrongdoing related to the Uranium One deal "the same baloney they’ve been peddling for years, and there’s been no credible evidence by anyone.

"In fact," Clinton told C-SPAN in October of 2017, "it’s been debunked repeatedly and will continue to be debunked.”

FBI informant says Russia spent millions through the lobbying firm to assist the Clinton Global Initiative in the hopes of favorable treatment from Obama administration. 'Clinton Cash' author Peter Schweizer sounds off.

An FBI informant involved in the controversial Uranium One deal has told congressional committees that Moscow paid millions to a U.S. lobbying firm in a bid to influence then-Secretary of State Hillary Clinton by helping former President Bill Clinton’s charities during the Obama administration.

The Hill first reported late Wednesday that informant Douglas Campbell gave a 10-page statement to the Senate Judiciary Committee, House Intelligence Committee and House Oversight and Government Reform Committee, and was interviewed for several hours behind closed doors by committee staff.

In the statement, obtained by Fox News, Campbell said Russian executives told him that Moscow was hiring APCO Worldwide in an effort to influence the Obama administration and Hillary Clinton.

Campbell said Russian nuclear officials “told me at various times that they expected APCO to apply a portion of the $3 million annual lobbying fee it was receiving from the Russians to provide in-kind support for the Clinton’s Global Initiative.”

“The contract called for four payments of $750,000 over twelve months,” Campbell said in the statement. “APCO was expected to give assistance free of charge to the Clinton Global Initiative as part of their effort to create a favorable environment to ensure the Obama administration made affirmative decisions on everything from Uranium One to the US-Russia Civilian Nuclear Cooperation agreement.”

In a statement to Fox News, though, APCO called Campbell's assertion "false and unfounded."

"APCO Worldwide undertook client work on behalf of Tenex in 2010 and 2011. It undertook work for the Clinton Global Initiative from 2008-2016," APCO told Fox News. "These projects were totally separate and unconnected in any way. All APCO’s actions on these two unconnected activities were publicly documented from the outset, legally proper and entirely ethical. Any assertion otherwise is false and unfounded."

Uranium One is a Canadian mining company whose sale to a Russian firm was approved in 2010. The U.S. government was involved because the sale gave the Russians control of part of the U.S. uranium supply. The transaction has faced renewed scrutiny after The Hill reported last year that the FBI had evidence as early as 2009 that Russian operatives used bribes, kickbacks and other dirty tactics to expand Moscow’s atomic energy footprint in the U.S., related to a subsidiary of the same Russian firm.

Republican lawmakers on Capitol Hill want to know how the deal was approved the following year by an inter-agency committee.

The Campbell statement also described an earlier meeting with Russian officials outside Washington where they "boasted about how weak the U.S. government was in giving away uranium business," and referred to then-President Barack Obama "with racial epithets."

Campbell’s attorney Victoria Toensing said her client has reported a “strategic plan” by Russian President Vladimir Putin to “take over the uranium industry.”

“[The Russians] were so confident that they told Mr. Campbell with the Clinton’s help, it was a shoo-in to get CFIUS [The Committee on Foreign Investment in the United States] approval,” Toensing said on “Hannity.” “They were so confident in that that they even had him open up the new office because they were planning on the kind of business they were going to do as soon as CFIUS approved it.”

Toensing told Fox News that Campbell was told by the FBI that Obama was aware of the information.

“He was told that President Obama had it in his daily briefing twice,” Toensing said.

Congressional Republicans have called for further investigation into Uranium One. Attorney General Jeff Sessions last year directed senior federal prosecutors to evaluate “certain issues” requested by Republicans, including Uranium One and alleged dealings related to the Clinton Foundation, leaving the door open for the appointment of another special counsel.

But this week, Democrats have charged that Campbell’s statements and the Republican interest in them is a tactic to distract from the larger Russia probe clouding the Trump administration.

Democrats have accused Republicans of making “wild claims” against Clinton.

“Republicans have been talking directly to this individual while refusing to grant Democratic members access, despite multiple requests,” Ranking Members of the House oversight and intelligence committees, Elijah Cummings, D-Md., and Adam Schiff, D-Calif., said in a statement. “During this same time period, Republicans have been making wild and unsubstantiated allegations against Secretary Clinton on national television based on this individual’s information.”

Cummings and Schiff said that the Justice Department provided them with a “detailed briefing” that “directly contradicts these Republican allegations.”

Cummings and Schiff said Campbell never provided any evidence or made allegations regarding Clinton or the Clinton Foundation in any of their interactions with him.

The ranking members claimed that the Justice Department stated that “at no point did [the individual] provide any allegation of corruption, illegality, or impropriety on Clinton, the Clinton Foundation, President Clinton, the Uranium One deal, or CFIUS,” and said there were “no allegations of impropriety or illegality” regarding Clinton in the documents they reviewed.

The Justice Department told Fox News they would not confirm whether the Schiff-Cummings characterization was accurate.

Toensing disputed the Democrats' claims, calling Schiff "disingenuous."

The Clinton Global Initiative did not immediately respond to Fox News’ request for comment.

Hillary Clinton spokesman Nick Merrill panned the informant claims, likening them to the controversial "Nunes memo" on alleged surveillance abuse released last week and newly released text messages between anti-Trump FBI officials.

"Just this week the committee made clear that this secret informant charade was just that, a charade. Along with the widely debunked text-message-gate and Nunes' embarrassing memo episode, we have a trifecta of GOP-manufactured scandals designed to distract from their own President's problems and the threat to democracy he poses," he said in a statement.

Clinton Scandals: A Guide From Whitewater To The Clinton Foundation

He had previously billed the speech, which was postponed after last week's Orlando shooting, as addressing "all of the things that have taken place with the Clintons." Specifically, Trump had vowed to cover everything from what he calls the couple's "politics of personal enrichment" to Hillary Clinton's use of a private email server as secretary of state, which he argued was "designed to keep her corrupt dealings out of the public record, putting the security of the entire country at risk." Trump has previously attacked Clinton on the campaign trail for her husband's scandals with women, calling her an "enabler." And just this week, Trump referenced a new book by a former Secret Service employee who said he witnessed allegedly abusive behavior when the Clintons occupied the White House.

Whitewater, 1992

Allegation: The granddaddy of all Clinton scandals surfaced during Bill Clinton's bid for the presidency. It centered on financial contributions by Bill and Hillary Clinton into a real estate entity known as Whitewater Development Corporation during his time as an Arkansas state official. Eventually, the Justice Department and independent counsel launched investigations.

Outcome: Neither Bill nor Hillary Clinton faced prosecution for their involvement in Whitewater. But their public statements about the matter, and the handling of documents that went missing and later reappeared, came under intense scrutiny. Their partners in the real estate investment were Jim McDougal and his then-wife Susan. Jim McDougal was convicted of fraud charges for making bad loans and he died of heart disease in a Texas prison. Susan was convicted of fraud in connection with obtaining a $300,000 federally-backed small business loan. She refused to answer grand jury questions in the Whitewater affair and was held in contempt of court, spending 18 months in jail. Bill Clinton pardoned her before he left the White House in early 2001.

Travelgate, 1993

Allegation: Not long after Bill Clinton entered the White House, in May 1993, seven workers in the travel office were fired. The White House attributed the ouster to ethics and financial record-keeping problems in the office. Critics said the Clintons got rid of government workers to make room for cronies. The FBI was tapped to investigate.

Outcome: The Justice Department, at least one congressional panel, and special prosecutors all probed the reason for the firings. Independent Counsel Ken Starr found no blame rested with Bill Clinton. Another independent counsel scrutinized Hillary Clinton's involvement and statements about the firings but seven years after the event, he found no basis to bring any charges against her.

Vince Foster Death, 1993

Allegation: White House lawyer Vince Foster was found dead in a Virginia park in 1993. Republican lawmakers and conservative interest groups suggested foul play in the death, perhaps tied to swirling ethics investigations of the Clintons that Foster had handled. In a document found in his briefcase, Foster wrote, "I was not meant for the job or the spotlight of public life in Washington. Here ruining people is considered sport."

Outcome: Investigators and family members said Foster had struggled with depression and fears about keeping his security clearance if he sought help for the problem. Multiple investigations by the FBI, the Justice Department and special prosecutors concluded that Foster died at his own hand.

Allegation: Former Arkansas employee Paula Jones sued Bill Clinton for civil money damages in 1994 alleging that Clinton had propositioned her in a Little Rock hotel room years earlier. Clinton fought the case, but the Supreme Court ruled that the lawsuit could proceed. In the course of the long and bitter litigation, Jones's lawyers identified other women with whom Bill Clinton allegedly had intimate relationships. They included Gennifer Flowers, a cabaret singer whose contacts with Clinton were detailed in a tabloid report, and former White House intern Monica Lewinsky.

Outcome: In a deposition for the Jones civil lawsuit, in early 1998, Bill Clinton denied having "sexual relations" with Lewinsky. Her name had already come to the attention of Independent Counsel Ken Starr, who sought her cooperation in his own investigation. Months later, in front of a federal grand jury, Clinton acknowledged the personal relationship with Lewinsky and later appeared on television to offer a public apology. The statement failed to head off a vote in the U.S. House of Representatives to impeach the president. Clinton settled the Jones lawsuit for $850,000 but he did not acknowledge wrongdoing. In February 1999, the U.S. Senate acquitted Clinton of perjury and obstruction of justice.

Filegate, 1996

Allegation: Investigators delving into a different scandal found hundreds of FBI files on former White House workers. The information also covered the backgrounds of Republicans in Congress.

Outcome: Two staff members who obtained the files quit their jobs. An independent counsel uncovered no wrongdoing by the Clintons themselves.

Benghazi, 2012

Allegation: Extremists seized the U.S. diplomatic compound in Benghazi, Libya, in on Sept. 11, 2012, killing Ambassador Chris Stevens and three other Americans. Members of Congress have accused Clinton of offering misleading comments about the nature of the attack and failing to protect the Americans.

Outcome: The House Select Committee on Benghazi interviewed Clinton in an 11-hour-long hearing last year but it has not yet issued a public report on its findings. The work of the committee has been criticized as partisan by House Democrats. Their suspicions were fueled by remarks from House Majority Leader Rep. Kevin McCarthy, who publicly suggested the panel's work had helped drive down Clinton's poll numbers in the presidential race. An investigation by the Accountability Review Board outlined "systematic" security failings by managers at the State Department. Earlier work by other congressional committees found that intelligence analysts had shifting views about the nature and motivation for the attack.

Clinton Foundation, 2015

Allegation: Republican lawmakers and watchdog groups have asked whether Clinton Foundation, established in 1997, engaged in conflicts of interest or quid pro quo deals during Hillary Clinton's tenure as secretary of state. Speeches by both Bill and Hillary Clinton to private groups and foreign governments have also been called into question. Iowa Sen. Charles Grassley, the Republican chairman of the Judiciary Committee, and conservative watchdogs at Judicial Watch are investigating the matters.

Outcome: Congressional and outside investigations are ongoing. Republican lawmakers have asked whether the FBI is investigating dealings between the Foundation, its donors, and State Department officials, but federal authorities have not publicly confirmed those topics are under law enforcement scrutiny.

Private Email Server, 2015

Allegation: The FBI and Justice Department are investigating whether Clinton's private email server compromised government secrets during her tenure at the State Department.

Outcome: FBI agents are continuing their work on the investigation and have interviewed several of Clinton's top aides. Clinton has said she will cooperate as well. The State Department inspector general recently concluded that Clinton did not follow the rules for safeguarding information, that she had not asked for approval to use the private server, and would not have been granted permission had she sought it.
