Bane doesn't know CIA is only going to list one of the hired guns on the flight plan beforehand, right?
So why does Brother have to stay? If all three are listed in the manifest, then Bane would also need to stay in the wreckage. And if they had a body for Bane, they could have used that instead of Brother, since there are two hired guns fewer on the flight plan than expected.

Bane failed to call CIA's bluff. CIA filed them all on the flight plan.
