US deports hundreds of alleged Venezuelan gang members despite court order

More than 200 alleged Venezuelan gang members have been deported from the US to a supermax prison in El Salvador, even as a US judge blocked the removals.

El Salvadoran President Nayib Bukele wrote on social media that 238 members of the Venezuelan gang Tren de Aragua had arrived in the Central American country, along with 23 members of the international MS-13 gang, on Sunday morning.

Neither the US government nor El Salvador has identified the detainees, nor provided details of their alleged criminality or gang membership.

A federal judge's order prevented the Trump administration from invoking a centuries-old wartime law to justify the deportations, but the flights had already departed.

"Oopsie… Too late," posted Bukele on social media, making fun of the judge's ruling.

A video attached to one of his posts shows lines of people with their hands and feet shackled being escorted by armed officials from the planes.

Bukele, an ally of US President Donald Trump, wrote that the detainees were immediately transferred to El Salvador's notorious mega-jail, the Terrorism Confinement Center (Cecot).

The El Salvadoran president said they would be held there "for a period of one year", and that could be "renewable".

"The United States will pay a very low fee for them, but a high one for us," he added.

US Secretary of State Marco Rubio thanked Bukele in a post on X, calling him "the strongest security leader in our region".

White House press secretary Karoline Leavitt, meanwhile, wrote: "These heinous monsters were extracted and removed to El Salvador where they will no longer be able to pose any threat to the American People."

Trump announced on Saturday that he had signed a proclamation declaring that the Tren de Aragua gang was "conducting irregular warfare" against the US and he would deport its members under the Alien Enemies Act of 1798.

That evening, US District Judge James Boasberg in Washington DC ordered a 14-day halt to deportations covered by Trump's proclamation, pending further legal arguments.

After lawyers told him that planes with deportees had already taken off, Judge Boasberg gave a verbal order for the flights to turn back, US media reported, although that directive did not form part of his written ruling.

The written notice appeared in the case docket at 19:25 EDT on Saturday (00:25 GMT on Sunday), the Reuters news agency reports, although it is unclear when the flights carrying the alleged gang members departed from the US.

A senior official in the Trump administration said their legal advisors had determined that the judge's order was invalid because the two planes were over international waters at the time, according to Axios, a political news outlet.

"They were already outside of US airspace," a senior administration official told Axios. "We believe the order is not applicable."

The Department of Justice (DOJ) has appealed against the judge's ruling, according to the BBC's US partner CBS News. The BBC has contacted the DOJ for comment.

The American Civil Liberties Union (ACLU), which was involved in the lawsuit against the Trump administration, said the court's order may have been violated.

The case raises constitutional questions since, under the US's system of checks and balances, government agencies are expected to comply with a federal judge's ruling.

Venezuela criticised Trump invoking the Alien Enemies Act, saying it "unjustly criminalises Venezuelan migration" and "evokes the darkest episodes in the history of humanity, from slavery to the horror of the Nazi concentration camps".

Amnesty International USA wrote on X that the deportations were "yet another example of the Trump administration's racist targeting" of Venezuelans "based on sweeping claims of gang affiliation".

El Salvador's Cecot jail is part of Bukele's effort to crack down on the country's organised crime.

The newly built maximum-security facility, which can hold up to 40,000 people, has been accused by human rights groups of mistreating inmates.

The arrangement between the US and El Salvador is a sign of strengthening diplomatic ties.

El Salvador was the second country that Rubio visited as the US's top diplomat.

During that trip, which took place in February, Bukele made an initial offer to take US deportees, saying it would help pay for the massive Cecot facility.

The latest deportations under Trump's second term are part of the president's long-running campaign against illegal immigration in the US.

In January, Trump signed an executive order declaring Tren de Aragua and MS-13 foreign terrorist organisations.

He won over voters on the campaign trail, in part, by promising to enact the largest deportation operation in US history.

While illegal border crossings have plummeted to the lowest number in decades since Trump took office, the Republican president has reportedly been frustrated by the relatively slow pace of deportations so far.

Victor Davis Hanson Flags Possible Error That Could ‘Be Cause For Reversal’ In Trump’s E. Jean Carroll Case

Hoover Institution Senior Fellow Victor Davis Hanson said Friday on his podcast that President-elect Donald Trump could have a “cause for reversal” in the E. Jean Carroll case, citing the language used by the presiding judge.

In May 2023, a New York jury found Trump liable for sexual battery and defamation, but stopped short of convicting him of rape in the case brought by former Elle magazine writer E. Jean Carroll. On “The Victor Davis Hanson Show,” Hanson discussed ABC’s settlement in Trump’s defamation case against the network, following host George Stephanopoulos’ claim during a live segment of his show that Trump was “liable for rape.

“Well George Stephanopoulos gave an interview and I think on 11 occasions he said Donald Trump committed rape. In the E. Jean Carroll civil suit, she alleged that she was sexually attacked by him. The jury found that he did not commit rape but that he had committed, there was a likelihood he’d committed sexual assault,” Hanson said.

Court records filed on Dec. 14 show that ABC has been ordered to pay $15 million by Dec. 24 as a “charitable contribution” to Trump’s “presidential foundation and museum.” The former president filed a defamation suit against the network and Stephanopoulos. This, following a March segment in which Stephanopoulos repeatedly questioned Republican South Carolina Rep. Nancy Mace about her support of Trump, while claiming the former president was “liable for rape.”

“And the judge [Kaplan], as I remember his name, had misspoken and said, ‘Well’ somebody had corrected him or reminded him that he had never been convicted of rape and he said, ‘What’s the difference?’ something along that line and that I think will be cause for reversal because that’s up on appeal,” Hanson added.

“The judge basically … show[ed] pre-existing prejudice that if the judge knew that the jury had not found or was not considering rape and yet he said publicly that they were indistinguishable, then that’s going to be appealed,” Hanson said.

Following the verdict from Carroll’s May win against Trump, the former president’s team argued to presiding Judge Lewis Kapalan for a new trial, noting how the term “sexual abuse” could be limited by definition, according to The Washington Post. However, Kaplan responded in a filing that while Carroll was unable to prove she was “raped,” the term may not be commonly understood, according to the outlet.

“The finding that Ms. Carroll failed to prove that she was ‘raped’ within the meaning of the New York Penal Law does not mean that she failed to prove that Mr. Trump ‘raped’ her as many people commonly understand the word ‘rape,'” Kaplan wrote.

“Indeed, as the evidence at trial recounted below makes clear, the jury found that Mr. Trump in fact did exactly that,” Kaplan said.

Alien Enemies Act 1798, in part reads:-

“Whenever there Is a declared war between the United States and any foreign nation or government, or any invasion or predatory Incursion is perpetrated, attempted or threatened against the territory of the United States by any foreign nation or government, and the President makes public proclamation of the event, all natives, citizens, denizens, or

subjects of the hostile nation or government, being of the age of fourteen years and upward, who shall be within the United States and not actually naturalised, shall be liable to be apprehended, restrained, secured, and removed as alien enemies.”

So, invocation of the Alien Enemies Act 1798 requires either a declaration of war OR invasion etc type hostilities by a foreign powers AND a public declaration of such by the President.

If the cartels are tied to hostile foreign powers and there are actual hostilities taking place between the US and the relevant foreign powers, the Act can be legally invoked. POTUS has already made the necessary public announcements.

The hostilities we are currently witnessing by the US against various enemies may be a necessary prerequisite to invoke the Alien Enemies Act 1798.

‘Don’t You All Have Jobs?’: JD Vance Calls On Protesters Demonstrating Against His Event To Get ‘Back To Work’

Vice President J.D. Vance told workers during a speech Friday in Bay City, Michigan, that demonstrators outside the event should “get off the streets and back to work.”

Vance and U.S. Small Business Administration chief Kelly Loeffler toured Vantage Plastics, a plastic manufacturer located in Michigan, and delivered remarks on “highlighting America’s industrial resurgence.” The vice president, during a speech at the facility, said the protesters outside of the event are proof that President Donald Trump’s administration needs to bring back manufacturing to the U.S. in order for them to have less time on their hands.

“We’ve got this great event, this great facility, great business and of course, great workers and I’m sure all of us saw there were a few protesters outside and I can’t be the only person wondering, you know, it’s a little after noon on a Friday, and don’t you all have jobs?” Vance said. “I mean, who are the people? And I think that’s one of the reasons why we’ve got to rebuild American manufacturing and support great companies like Vantage Plastics because we want these people to get off the streets and back to work. It’d be good for them and it’s be good for everybody else too.”

Vantage Plastics received a $1.2 million grant from Michigan in 2023 to be based in the state and create 93 new jobs, according to Bridge Michigan. The event, attended by Vance and Loeffler, addressed the “future of American manufacturing,” which the Trump administration has strived to improve.

Trump plans to impose tariffs on Mexico, Canada and China, including 50% tariffs on Canadian aluminum and steel imported to the U.S., with the intent of returning manufacturing to the U.S. from overseas. The president also announced the creation of the “Office of Shipbuilding” with the intent to revive both commercial and military shipbuilding at a time where China has outpaced the U.S. in maritime manufacturing.

The White House celebrated the creation of 10,000 manufacturing jobs in February, particularly in the automobile industry, where 9,000 jobs were created.

Hecklers shouted at Vance during his Monday speech at the National League of Cities in Washington, D.C. for calling out the negative consequences of illegal immigration. The vice president fired back, stating that some people want the U.S. to suffer from economic consequences due to illegal immigration.

The vice president also laughed off attendees who booed him inside the John F. Kennedy Center by casually waving and sipping his beverage during a symphony orchestra performance Thursday.
