L'UE Ferme la Faille Russe Dans le GNL, Empêchant Les Armateurs et Acheteurs Européens Du Commerce Mondial Des Cargaisons Yamal

L'Union européenne a précisé que sa prochaine interdiction du gaz naturel liquéfié russe s'étend bien au-delà des importations en Europe, interdisant aux opérateurs de l'UE de transporter, d'échanger ou de commercialiser du GNL russe partout dans le monde, une décision aux implications majeures pour les compagnies maritimes et les acheteurs européens d'énergie.
Dans une lettre du 1er juin du bureau du commissaire européen à l'énergie Dan Jorgensen au consultant en GNL et courtier maritime Poten & Partners, Bruxelles a cherché à résoudre l'incertitude persistante sur la manière dont l'interdiction s'appliquerait aux cargaisons destinées aux marchés non européens.
“Le transport de GNL russe par des opérateurs de l'Union, quelle que soit la destination finale, est interdit dans le contexte de l'interdiction du GNL”, indique la lettre.
“Les nouvelles règles interdisent aux entreprises de commercialiser du GNL russe ou de le vendre dans des pays tiers, car peu importe que le GNL russe soit destiné à l'UE ou non”, ajoute la lettre.
La clarification règle une question clé qui était restée ouverte depuis que l'UE a adopté une législation visant à éliminer progressivement les importations de gaz russe. Alors que la loi interdisait clairement les importations dans le bloc à partir du 1er janvier 2027 en vertu des contrats de GNL à long terme existants, les entreprises avaient débattu de la question de savoir si les armateurs, négociants et acheteurs européens pouvaient continuer à manipuler des cargaisons de GNL russe destinées à l'Asie ou à d'autres marchés.
La clarification pourrait compliquer davantage la chaîne logistique arctique de la Russie. La plupart des méthaniers spécialisés de déglaçage Arc7 desservant le projet Yamal LNG sont exploités ou gérés par des sociétés basées en Europe, notamment Dynagas en Grèce et Seapeak au Royaume-Uni, tandis que d'autres navires sont exploités par le Japonais MOL.
La décision signifie que les opérateurs de méthaniers basés dans l'UE, ainsi que les acheteurs européens détenant des accords d'approvisionnement à long terme, ne pourront plus transporter, commercialiser ou rediriger les volumes de GNL russe vers des clients en dehors du bloc une fois l'interdiction entrée en vigueur.
La clarification est particulièrement significative pour le Français TotalEnergies, qui détient une participation de 20% dans Yamal LNG et une participation de 19,4% dans le producteur russe Novatek. La société française évaluait ses options avant l'échéance de 2027 en raison de l'incertitude quant à savoir si les volumes de GNL sous contrat pourraient être détournés vers des acheteurs de pays tiers.
Patrick Pouyanne, directeur général de TotalEnergies, a déclaré plus tôt ce mois-ci que l'entreprise manquait encore de clarté de la part des autorités sur la question et avait reçu des interprétations juridiques contradictoires. La société avait précédemment indiqué qu'elle pourrait envisager de vendre sa participation dans Yamal LNG si elle était empêchée de commercialiser la production du projet en dehors de l'Europe.
Les nouvelles directives pourraient accélérer un retrait plus large du secteur russe du GNL arctique. Plus tôt ce mois-ci, le président russe Vladimir Poutine a signé un décret autorisant la vente de la participation de 10% de TotalEnergies dans le projet sanctionné Arctic LNG 2, bien que le calendrier de toute transaction reste incertain.
Parmi les autres entreprises confrontées à des conséquences importantes, citons Naturgy en Espagne et SEFE en Allemagne, qui sont toutes deux devenues des acheteurs majeurs de GNL russe grâce à des contrats à long terme. Naturgy avait précédemment averti que l'élimination progressive de l'UE pourrait affecter les engagements d'achat d'une valeur de plus de 10 milliards d'euros et avait fait valoir que le détournement des cargaisons vers des marchés alternatifs pourrait aider à atténuer les dommages contractuels.
La Commission européenne a fait valoir que permettre aux entreprises de l'UE de continuer à commercialiser du GNL russe à l'étranger porterait atteinte à l'objectif de la législation.
L'interprétation de l'UE indique un désengagement global du commerce russe de GNL, obligeant potentiellement Moscou à trouver d'autres arrangements d'expédition pour l'un de ses plus importants projets d'exportation d'énergie. Cela pourrait également inciter les exploitants de navires actuels à transférer leurs méthaniers spécialisés dans le déglaçage vers des filiales ou des exploitants situés en dehors de l'UE.
