US judge gives go-ahead to execution by new method

The state of Alabama may now put a convicted murderer to death using nitrogen gas, despite concerns voiced by UN experts

A federal judge in the US has given the green light to that country’s first-ever execution using nitrogen gas, set to be carried out later this month in the state of Alabama. The convict’s lawyers have argued that the state is planning to use their client as a “test subject.”

Kenneth Eugene Smith, now 58, is a convicted murderer who, in 1988 along with another man, stabbed a preacher’s wife to death in exchange for $1,000 each. Church of Christ pastor Charles Sennett Sr is believed to have commissioned the hit on his own spouse, in the hope of cashing in on a life-insurance policy. He died by suicide once the murder investigation focused on him as a suspect.

One of the two assassins, John Forrest Parker was put to death in 2010, with Smith’s own execution called off in 2022 after officials failed to connect the two intravenous lines required to administer a lethal injection.

In his ruling on Wednesday, US District Judge R Austin Huffaker refused to grant an injunction to stop Smith’s execution, now scheduled for January 25. During a hearing that preceded the decision, Alabama Attorney General Steve Marshall’s office argued that the novel method of execution would “cause unconsciousness within seconds, and cause death within minutes.” Officials cited industrial accidents which saw people pass out and die after being exposed to high concentrations of nitrogen gas.

The office of New Hampshire Attorney General John Formella issued a cease-and-desist order to the Democratic National Committee (DNC) on Monday after the committee purportedly violated the state’s voter suppression laws.

On Jan. 5, the co-chairs of the DNC’s Rules and Bylaws Committee submitted a letter to the New Hampshire Democratic Party (NHDP) demanding the state party comply withDNC guidance to “take steps to educate the public that January 23rd”— the date set for the jurisdiction’s Democrat presidential primary — “is a non-binding presidential preference event and is meaningless and the NHDP and presidential candidates should take all steps possible not to participate.”

The memo came nearly a year after the DNC passed a new early presidential primary calendar for 2024. The updated calendar, supported by President Biden, sought to make South Carolina the first state on the Democrat presidential primary schedule. While Iowa and New Hampshire, respectively, have historically marked the first electoral contests in the presidential primary process for both major political parties, the DNC’s decision to schedule South Carolina first was, as NBC News described, due to Iowa’s caucuses being viewed as “too white and too undemocratic.”

Despite state law mandating New Hampshire host a presidential primary “7 days or more immediately preceding the date on which any other state shall hold a similar election,” the DNC told the NHDP that the Jan. 23 primary scheduled by the New Hampshire secretary of state “cannot be used as the first determining stage of the state’s delegate selection process and is considered detrimental.”

The guidance further informed the state party that no “delegates or alternates shall be apportioned” and no “scheduling of events related to the selection of delegates or alternates in New Hampshire may be” based on the Jan. 23 election.

In his cease-and-desist order to the DNC, Assistant Attorney General Brendan O’Donnellunderscored how “[f]alsely telling New Hampshire voters that a New Hampshire election is ‘meaningless’ violates New Hampshire voter suppression laws,” and further ordered the organization to stop engaging in such “unlawful” conduct.

“Regardless of whether the DNC refuses to award delegates to the party’s national convention based on the results of the January 23, 2024, New Hampshire [D]emocratic Presidential Primary Election, that election is not ‘meaningless.’Your statements to the contrary are false, deceptive, and misleading,” O’Donnell wrote. “Telling the public or any person qualified to register to vote or vote in New Hampshire that the [aforementioned election] is ‘meaningless,’ or soliciting NHDP or any other party to make such statements, constitutes an attempt to prevent or deter another person from voting or registering to vote based on fraudulent, deceptive, misleading, or spurious grounds or information.”

O’Donnell further warned the DNC that he reserved the right to pursue further legal action.

It’s worth mentioning that theDNC’s decision to hold South Carolina’s primary before the party’s Iowa caucus and New Hampshire primary is designed to benefit Biden. During the 2020 Democrat presidential primary cycle, the Delaware Democrat lost both Iowa and New Hampshire, finishing fourth and fifth, respectively. It was his dominating victory in South Carolina’s primary that put Biden on track to become Democrats’ 2020 presidential nominee.

THE HAGUE, Jan 9 (Reuters) - The International Court of Justice will hold hearings this week on a case brought by South Africa accusing Israel of genocide in the Gaza war and seeking an emergency suspension of its military campaign.

WHAT IS THE ICJ?

The ICJ, also called the World Court, is the highest United Nations legal body, established in 1945 to deal with disputes between states. It should not be confused with the treaty-based International Criminal Court, also in The Hague, which handles war crimes cases against individuals.

The ICJ's 15-judge panel - which will be expanded by an additional judge from each side in the Israel case - deals with border disputes and increasingly cases brought by states accusing others of breaking U.N. treaty obligations.

Both South Africa and Israel are signatories to the 1948 Genocide Convention which gives the ICJ the jurisdiction to rule on disputes over the treaty. While the case revolves around the occupied Palestinian territories, Palestinians have no official role in the proceedings because they are not a United Nations member state.

All states that signed the Genocide Convention are obliged to not commit genocide and also to prevent and punish it. The treaty defines genocide as "acts committed with intent to destroy, in whole or in part, a national, ethnical, racial or religious group".

In its 84-page filing South Africa says that by killing Palestinians in Gaza, causing them serious mental and bodily harm and by creating conditions on life "calculated to bring about their physical destruction", Israel is committing genocide against them.

THE HAGUE, Jan 9 (Reuters) - The International Court of Justice will hold hearings this week on a case brought by South Africa accusing Israel of genocide in the Gaza war and seeking an emergency suspension of its military campaign.

WHAT IS THE ICJ?

The ICJ, also called the World Court, is the highest United Nations legal body, established in 1945 to deal with disputes between states. It should not be confused with the treaty-based International Criminal Court, also in The Hague, which handles war crimes cases against individuals.

The ICJ's 15-judge panel - which will be expanded by an additional judge from each side in the Israel case - deals with border disputes and increasingly cases brought by states accusing others of breaking U.N. treaty obligations.

Both South Africa and Israel are signatories to the 1948 Genocide Convention which gives the ICJ the jurisdiction to rule on disputes over the treaty. While the case revolves around the occupied Palestinian territories, Palestinians have no official role in the proceedings because they are not a United Nations member state.

All states that signed the Genocide Convention are obliged to not commit genocide and also to prevent and punish it. The treaty defines genocide as "acts committed with intent to destroy, in whole or in part, a national, ethnical, racial or religious group".

WHAT IS ISRAEL'S RESPONSE?

Israeli President Isaac Herzog called the ICJ case "atrocious and preposterous". Israel has said it makes utmost efforts to avoid civilian casualties in Gaza.

The Israeli offensive was triggered by the Oct. 7, 2023 cross-border Hamas attacks in which Islamist fighters killed 1,200 people and abducted 240, according to Iraeli figures.

WHAT WILL HAPPEN AT THE HEARINGS?

The hearings will take place on Jan 11 and 12. South Africa and Israel will both have two hours on separate days to make their case for or against emergency measures. There will be no witness testimony and no cross-examinations. The presentation will be mostly legal arguments brought by state officials and their teams of international lawyers.

The request for emergency measures is a first step in a case that will take several years to complete. Formally called provisional measures, they are meant as a kind of restraining order to prevent a dispute from getting worse while the court looks at the full case.

The court will not make a final determination on South Africa's genocide allegations until a hearing of the case on the merits, which is likely years away.

This week's hearings are only about possibly granting emergency measures. Judges at the ICJ often grant such measures, which generally consist of asking a state to refrain from any action that could aggravate the legal dispute.

For provisional measures the court only has to decide if at first glance, or prima facie, it would have jurisdiction and the acts complained of could fall within the scope of the genocide treaty. Any measures it decides would not necessarily be those requested by the complainant.

South Africa has asked the court to order Israel to suspend its military actions in Gaza, to stop any genocidal acts or take reasonable measures to prevent genocide and issue regular reports to the ICJ about such measures.

A decision on the measures is expected in the weeks following the hearings.

The ICJ's rulings are final and without appeal, but it has no way of enforcing them. A ruling against Israel could hurt the country's international reputation and set legal precedent.

HOW LONG WILL IT BE UNTIL A FINAL RULING ?

If the court finds it has prima facie jurisdiction, the case will move forward at the ornate Peace Palace in The Hague - even if the judges decide against emergency measures.

Israel would then get another chance to argue the court has no legal grounds to look at South Africa's claim and to file a so-called preliminary objection - which can only touch on issues of jurisdiction. If the court rejects that objection, the judges could finally look at the case in further public hearings.

It is not unusual for several years to pass between the initial claim and the actual hearing of the case on its merits.

Achieving and integrating breakthroughs in all of these areas will require choreographed cooperation among researchers and engineers specializing in such areas as immunology, microbiology, virology, medical infectious diseases, molecular biology, and medical countermeasure product development and manufacturing.

DARPA-funded teams will be required to demonstrate their integrated platforms in five simulations during the planned four-year program; they will initially test their platforms using pathogens of their choice, but ultimately they will test using DARPA-selected pathogens, including two demonstrations in which the identity of the pathogen will remain opaque to the teams until the 60-day clock starts. To ensure the developed platforms can produce a quality product with a viable pathway for regulatory review, each team will be required to complete a Phase I clinical safety trial before the end of the program.

A benefit of the nucleic-acid-based approach to limiting the spread of infection is that the genetic constructs introduced to the body would be processed quickly and would not integrate into an individual’s genome. Similarly, the antibodies produced in response to the treatment would only be present in the body for weeks to months. This is consistent with DARPA's intent with P3, which is to safely deliver transient immunity to a virus, halting the spread of disease by creating a firewall.

“Our country asks our military Service members to deploy globally and provide humanitarian assistance in all manner of high-risk environments. We owe it to them to develop the best protections possible,” said Hepburn, a U.S. Army physician who previously served as Director of Medical Preparedness on the White House National Security Staff. “If we’re successful, DARPA could take viral infectious disease outbreaks off the table as a threat to U.S. troops and as a driver of global instability.”

Kentucky Senator Rand Paul confronted Dr. Anthony Fauci, the former chief White House medical adviser and former director of NIH’s National Institute of Allergy and Infectious Diseases (NIAID), saying he should “take some responsibility for funding gain-of-function research in Wuhan,” while saying “what you’ve done is change the definition on your website to try to cover your a**.”

“I don’t expect you today to admit that you approved of NIH funding for gain-of-function research in Wuhan, but your repeated denials have worn thin and a majority of Americans frankly, don’t believe you,” Paul began. “Even the NIH now admits that EcoHealth Alliance (the non-profit that collaborated with the Wuhan Institute of Virology and the nearby Wuhan University Center for Animal Experiment) did perform experiments in Wuhan that created viruses not found in nature that actually did gain in lethality. The facts are clear: The NIH did fund gain-of-function research in Wuhan, despite your protestations.”

In September 2021, The Intercept reported evidence showing that the EcoHealth Alliance, the Wuhan Institute of Virology, and the nearby Wuhan University Center for Animal Experiment had engaged in gain-of-function research “intentionally making viruses more pathogenic or transmissible in order to study them … grant money for the controversial experiment came from the National Institutes of Health’s National Institute of Allergy and Infectious Diseases, which is headed by Anthony Fauci.”

“Your persistent denials, though, are not simply a stain on your reputation, but are a clear and present danger to the country and to the world,” Paul stated.

Later in the confrontation, Paul asked, “Will you today, finally take some responsibility for funding gain-of-function research in Wuhan?”

“Senator, with all due respect, I disagree with so many of the things that you said. First of all, gain-of-function is a very nebulous term; we have spent, not us, but outside bodies, a considerable amount of effort to give a more precise definition to the type of research that is of concern that might lead to a dangerous situation. You are aware of that; that is called P3CO,” Fauci answered.

“We’re aware that you deleted gain-of-function from the NIH website,” Paul interjected.

“Well, I can get back to that in a moment if we have time, but let’s get back to the operating framework and guiderails of which we operate under,” Fauci deflected. “And you have ignored them. the guidelines are very, very clear: that you have to be dealing with a pathogen that clearly is shown and very likely to be highly transmissible in an uncontrollable way in humans and to have a high degree of morbidity and mortality and that you do experiments to enhance that, hence the word EPPP: enhanced pathogens potential pandemic.”

Paul pointed out that EcoHealth Alliance took a virus and combined it with WIV-1 to cause a “recombinant virus that doesn’t exist in nature,” adding, “and it made mice sicker — mice that had humanized cells — you’re saying that’s not gain-of-function research?”

“According to the framework and guidelines —” Fauci responded.

“So what you’re doing is defining away gain-of-function; you’re simply saying it doesn’t exist cause you changed the definition on the NIH website,” Paul accused. “This is terrible, and you’re completely trying to escape the idea that we should do something about trying to prevent a pandemic from leaking from a lab. The preponderance of evidence now points toward this coming from a lab, and what you’ve done is change the definition on your website to try to cover your a** basically. That’s what you’ve done; you’ve changed the website to have a new definition that doesn’t include the risky research that’s going on. Until you admit that it’s risky, we’re not gonna get anywhere. You have to admit that this research was risky. The NIH has now rebuked them. Your own agency has rebuked them. But the thing is you’re still unwilling to admit that they gained in function when they say that became sicker; they gained in lethality. It’s a new virus. That’s not gain-of-function?”

Nissim Vaturi, a member of the Likud party, said IDF soldiers should not have to worry about being 'humane'

A member of the Israeli Knesset has doubled down on comments he made in November when he called to “burn Gaza now” and is now claiming there are “no innocents” in areas where the Israeli military ordered evacuations.

“I stand behind what I said. It is better to burn, to take down buildings, than that our soldiers should be harmed,” said MK Nissim Vaturi, a member of Prime Minister Benjamin Netanyahu’s Likud Party.

“I said to ‘burn Gaza.’ What does it mean to burn? To go in and rip them apart. There should be no thoughts, no considerations. The soldiers of the IDF should not think for one second and be hurt because we need to be humane,” Vaturi added.

Discussing the areas where the Israeli military ordered evacuations, Vaturi said, “We evacuated them all – we succeeded in evacuating 1,900,000 in an organized fashion, and there are 100,0000 left. I don’t think that there are any innocents there now – not now, and not when I made my statement.”

Many Palestinian civilians stayed in northern Gaza and other areas following evacuation orders from the Israeli military for a multitude of reasons, including the fact that many of the so-called “safe zones” were still being bombed.

Vaturi’s comments come a day before the International Court of Justice (ICJ) will hold its first hearing on South Africa’s genocide case that it has brought against Israel. The 84-page filing submitted by South Africa cites genocidal rhetoric from Israeli officials as evidence of Israel’s intent to commit genocide against Gaza’s Palestinian population.
