The Supreme Court has a new ethics code, but many see it as toothless. The code comes into place after justices Samuel Alito and Clarence Thomas were heavily criticized for accepting gifts including trips from wealthy individuals.

Questions also arise about how conservative justices are selected and influenced. The story centers on a man called Leonard Leo and his web of hidden donors.

Host Scott Tong speaks to Politico's Heidi Przybyla, who has been reporting on Leo and his secretive circle. Tong then turns to Democratic Sen. Survey respondents agreed the US president is doing a good job on Israel and can tackle anti-Semitism

Jewish voters in the US overwhelmingly approve of President Joe Biden’s handling of the Israel-Gaza conflict and would support him over Donald Trump in a potential face-off at the ballot box next year, an opinion poll has suggested. They also reject the idea that criticizing West Jersualem's policies makes a person anti-Israel.

Views in the Jewish community were surveyed in early November by pollster GBAO Strategies and reported on Thursday by the Jewish Electorate Institute (JEI), a civic engagement advocacy body.

Most American Jews have historically been liberal-leaning supporters of the Democratic Party. The poll showed that 68% intend to vote for Biden, compared to 22% for Trump, who, however, has the backing of Orthodox Jews.

Biden’s handling of the Israel-Hamas conflict was supported by 74% of the people surveyed, compared to 66% overall who approve of the president. 43% said Biden’s approach to the crisis made them more positive towards him.

Almost six in ten said they trusted Biden to tackle anti-Semitism in the US, a problem that more than 90% of respondents found concerning. Younger poll respondents were also worried about other forms of bigotry, such as racism and Islamophobia.

An overwhelming 91% said a person can be critical of the Israeli government but remain “pro-Israel”. A smaller majority of 76% expressed that view in relation to Israel’s conduct of the war in Gaza.

The Israel Defense Forces besieged the Palestinian enclave in retaliation for a Hamas cross-border incursion last month, in which over 1,200 Israelis people were killed. Critics say Israel’s retaliatory military action has disproportionately killed Palestinian civilians. The death toll in Gaza has surpassed 11,000, according to local authorities.

US Democratic voters are increasingly drawn to the Palestinian cause, according to a Quinnipiac University poll published on Thursday. The share of respondents more sympathetic to Israel than to Palestine dropped from 61% to 54% between mid-October and mid-November. Democrats sided with Palestinians at a 41-to-34 rate in the latest survey.

Some US media have suggested that Biden's pro-Israel stance during the conflict may tip the scales at the ballot box next year. In 2020, he wrestled Michigan from Trump by a margin of 154,000 votes. The state’s Muslim American population of over 200,000 registered voters helped clinch the win, but may stay home in their likely rematch, NPR warned on Friday. Biden’s approval rating among Arab Americans has plunged from 59% in 2020 to 35% before the crisis, and was down to half of that by late October, according to a poll released by the Arab American Institute last month.

Supreme Court Adopts First Code Of Conduct After Clarence Thomas Controversy

This is the first time the Supreme Court has honored a code of conduct in 234 years.

The U.S. Supreme Court announced Monday that it has adopted a code of ethics for its justices. The decision to implement a code of ethics comes in response to revelations of undisclosed gifts and benefits received by several justices, including Clarence Thomas and Samuel Alito, reports Politico.

The scrutiny prompted Senate Democrats to push for a code of conduct for the court. Justices Sonia Sotomayor and Neil Gorsuch also faced criticism over book and property sales.

The discoveries came as the court faced strong criticism for overturning Roe v. Wade, banning race-based affirmative action in higher education, and rejecting the Biden administration’s student loan forgiveness plan, among other things. The public’s confidence in the court’s impartiality has reportedly declined in recent years.

The lack of a formal code was notable, as the Supreme Court was the only federal court without such guidelines. The court acknowledged that it had “common law” ethics rules, but the absence of a formal code had led to a perception that the justices considered themselves unrestricted by ethics rules.

Kiev’s budget almost completely depends on Western funding, Nikolay Azarov says

Ukraine is bankrupt and the country is unable to fill its budget deficit on its own, as it relies almost entirely on Western aid, former Prime Minister Nikolay Azarov stated on Friday.

The former politician argued that the economic crisis in Ukraine began a long time ago and the country’s bankruptcy had already been recorded. According to him, Ukraine’s insolvency is manifested in the fact that the country is unable to fill its budget.

“75% of the budget is borrowed or grant funds! And they got to such a point that salaries in October depended on whether the European Union would transfer on time the promised aid of €1.5 billion,” Azarov wrote on Facebook. (If the Oligarchs stopped stealing billions and perhaps trillions, the country would be fine, and getting a rid of the leaders would straighten things out.)

Meanwhile, public debt is soaring and the budget deficit is widening despite Western aid, according to Azarov. Earlier this month, Ukraine’s central bank revised this year’s budget deficit forecast to 20.4% of the gross domestic product instead of the 19.8% previously expected, in what would be the worst performance since 1992.

Ukrainian Prime Minister Denis Shmygal last week announced that Kiev was expecting a financial injection worth $30 billion from the EU, the US, and the International Monetary Fund, which would help the country plug its budget gap.

Azarov has previously warned that the country’s economy is “falling apart” as it shows signs of life only with foreign financial assistance, requiring more and more of it.

According to the Ukrainian Finance Minister Sergey Marchenko, next yearUkraine’s budget will lack $29 billion without Western financing.

Leonard Leo’s firm got nearly $500K from conservative nonprofit, tax filing shows

Leo, among the most prominent figures of the conservative legal movement, has come under scrutiny over revelations that his network of nonprofits has funneled millions of dollars to his for-profit firm. The D.C. attorney general Brian Schwalb is investigating whether Leo violated nonprofit tax laws for personal gain.

Leo presides over a multi-billion-dollar network of tax-exempt nonprofit groups and has used it, in part, to organize campaigns over the past decade to install the Supreme Court’s conservative majority.

American for Public Trust is a nonprofit group run by the former research director for the National Republican Congressional Committee. The organization often publicly criticizes progressive so-called dark money groups that do not have to disclose their donors. On Wednesday, it highlighted the tax filings for a number of progressive nonprofits, including the Sixteen Thirty Fund.

The group’s donations fell significantly between 2021 and 2022, from about $3.6 million to $1.6 million. As a 501(c)(3) charity, it does not have to disclose its donors. Meanwhile, the amount paid to CRC Advisors between 2021 and 2022 increased from $470,092 to $480,905. The payments to Leo’s firm now constitute about 28 percent of its total expenditures.

A spokesperson for the group did not immediately return a request for additional details about CRC’s work for Americans for Public Trust.

Many of Leo’s aligned groups pay his for-profit company, CRC, and they are not required to disclose what services they are purchasing.

But Leo has declined to say what services were provided in exchange for at least $43 million transferred to his company in the two years since he had come on board in 2020. Leo, through an attorney, also recently told POLITICO that he is not cooperating with the D.C. investigation.

Previously, POLITICO’s investigation found his own personal wealth appeared to have ballooned as his fundraising prowess accelerated since 2016, when he became an adviser to former President Donald Trump on judicial nominations.

In a statement, Accountable.US criticized the group for sending money from a nonprofit back to Leo’s own business.

“Americans for Public Trust’s allegiance to Leonard Leo couldn’t be more obvious — even as the group’s revenue is plummeting, it continues to funnel almost a third of its expenses straight to Leo’s firm,” said Accountable.US President Caroline Ciccone.

It also appears that nearly all of Americans for Public Trust’s contributions and grants came from DonorsTrust, a prominent conservative donor fund. It gave the group $1,579,000 in 2022, according to DonorsTrust’s recent filing.

Sen. Hawley suggests investigation of Democratic 'dark money' funding terrorism

Hawley was expressing frustration with the committee as Democrats last week wanted tosubpoena Leonard Leo and Harlan Crowto review their alleged financial assistance for Supreme Court Justices Clarence Thomas and Samuel Alito.

U.S. Sen. Josh Hawley, R-Mo., on Wednesday suggested the Senate Judiciary Committee investigate a Democratic Party-affiliated group reportedly linked to funding of Palestinian terrorism.

“If the Senate Judiciary Committee is going to hand out subpoenas, let’s start with this Democrat dark-money group that has poured $1 million into a Palestinian terror-tied charity,” Hawley posted on X, the platform formerly known as Twitter. The post linked to a Washington Examiner story that details a network of left-leaning groups that steered funding towards a progressive charity with ties to a terror group.

Hawley was expressing frustration with the committee as Democrats last week wanted to subpoena Leonard Leo and Harlan Crow to review their alleged financial assistance for Supreme Court Justices Clarence Thomas and Samuel Alito.

The Examiner reported two tax-exempt organizations, New Venture Fund and Windward Fund, in October stopped providing grants to the Alliance for Global Justice, based in Arizona. In September, the Examiner reported the Alliance for Global Justice switched payment processing companies after pressure from a coalition of 11 pro-Israel groups linked it to Collectif Palestine Vaincra, a French member of an Israeli-designated terror coalition, Samidoun. The French group is linked to the Popular Front for the Liberation of Palestine terror group.

D.C. attorney general hits back at Jordan, Comer in Leonard Leo probe

The investigation centers on whether the conservative judicial activist abused laws governing nonprofits.

D.C. Attorney General Brian Schwalb won’t share with Congress information about his investigation into whether judicial activist Leonard Leo abused nonprofit tax laws, according to a letter released on Monday.

Leo presides over a multi-billion-dollar network of tax-exempt nonprofit groups and used it, in part, to organize campaigns over the past decade to install the Supreme Court’s conservative majority. The question at issue is the transfer of tens of millions of dollars collected by one of his aligned nonprofit organizations to his for-profit entity.

On Oct. 30, GOP Reps. Jim Jordan (R-Ohio) and James Comer (R-Ky.), chairs of the House Judiciary and Oversight committees, respectively, demanded all materials from Schwalb related to Leo.

In his letter, Schwalb rejected both the request and its premise — that any probe might be politically motivated. “Contrary to your letter’s suggestion, [the office] is committed to the impartial pursuit of justice, without regard to political affiliation or motivation and without fear or favor,” wrote Schwalb.

It’s the latest attempt by Leo allies to throw sand in the gears of Schwalb’s investigation. (Though in keeping with law enforcement protocol, Schwalb still has not confirmed or denied its existence.) Whether the probe uncovers wrongdoing is significant given the sheer scale of Leo’s work: He is also the beneficiary of a $1.6 billion contribution, believed to be the biggest political donation in U.S. history.

Jordan and Comer had claimed it appears Schwalb does not have jurisdiction to investigate nonprofits and other entities that were incorporated outside of Washington, D.C.

“I am concerned that your letter may misapprehend jurisdiction over nonprofit organizations operating in the District,” Schwalb said. “No corporation, whether for-profit or not-for-profit, is exempt from the laws of a jurisdiction in which it chooses to be present and do business.”

Leo’s attorney previously told POLITICO his client is not cooperating with Schwalb’s investigation.

Leo’s network of nonprofits, often referred to as “dark money” groups, are exempt from tax and do not have to disclose their donors because they are registered as charitable or social welfare organizations. They spent hundreds of millions of dollars on campaigns to promote the nominations of Justices Neil Gorsuch, Brett Kavanaugh and Amy Coney Barrett. But many partisan groups operate as nonprofits shielded from federal tax, and that’s not why Schwalb is investigating.

In March. POLITICO reported that a total of $43 million flowed to Leo’s company, CRC Advisors, over two years and that the bulk of it came from one of his charitable groups, The 85 Fund. A few months later, a Democrat-aligned watchdog group filed a complaint with the IRS and with Schwalb’s office alleging the total amount of money that flowed from Leo-aligned nonprofits to his for-profit firms was $73 million over six years beginning in 2016. That’s the year Leo was tapped as an unpaid judicial adviser to former President Donald Trump.

Israel hands out gas concessions to BP, ENI as Gaza war drags on

Israel is determined to project a "business as usual" stance despite the conflict with Hamas claiming the lives of thousands of Israelis and Palestinians.

Israel’s Ministry of Energy and Infrastructure said on Sunday that it has awarded 12 licenses to six companies, including BP and ENI, for natural gas exploration off the country’s Mediterranean coast, as the war with Gaza-based Hamas entered its fourth week with no ceasefire in sight.

The offshore tender is the fourth bidding round for natural gas exploration in Israeli waters, whereby the ministry intends to boost competition as well as grow domestic supply and exports.

Two consortia won the bids: one comprising Italy’s ENI, Scotland’s Dana Petroleum Ltd. and Israeli business Ratio Energies, while the other consists of BP, State Oil Company of the Azerbaijan Republic (SOCAR) and Israel’s NewMed Energy. The companies will explore two areas next to Israel’s Leviathan field, the country’s largest and one of the world’s biggest deep-water gas discoveries.

Israel’s war with Hamas saw the shutdown of Israel's Tamar offshore gas field, the country’s second-largest. It has yet to be reopened after being closed for security reasons on Oct. 8. The site is owned by Chevron, Dor Gas Exploration Limited Partnership, Everest Infrastructures, Isramco Negev 2, UAE-based Mubadala Investment and the Israeli company Tamar Petroleum. Before the shutdown, the field typically met around 70% of Israel’s power generation needs. The country has since been backfilling the supply from other fields to avoid disruptions to flows.

Israel is determined to diversify and develop its energy market and project a "business as usual" stance despite the war with Hamas showing no signs of abating soon, and claiming the lives of thousands of Israelis and Palestinians. Israeli Energy Minister Israel Katz said that the new investment commitment during the war was a sign of confidence in his country’s resilience.

The new licenses will “strengthen Israel’s energy security, international ties, lower the cost of living and provide energy support to accelerate the transition of the economy to renewable energies,” Katz added.

Meanwhile, Israel’s economy has been put under strain after 300,000 military reservists were called up to potentially fight in the conflict against Hamas, which many fear could spiral into a wider Middle Eastern war including other actors such as Iran and Lebanon’s Hezbollah.

CISA warns of actively exploited Windows, Sophos, and Oracle bugs

The U.S. Cybersecurity & Infrastructure Security Agency has added to its catalog of known exploited vulnerabilities (KEV) three security issues that affect Microsoft devices, a Sophos product, and an enterprise solution from Oracle.

The KEV catalog contains flaws confirmed to be exploited by hackers in attacks and serves as a repository for vulnerabilities that companies all over should treat with priority.

The agency is urging federal agencies to apply available security updates for the three issues before December 7. The three vulnerabilities are tracked as follows:

CVE-2023-36584 – "Mark of the Web" (MotW) security feature bypass on Microsoft Windows.

CVE-2023-1671 – Command injection vulnerability in Sophos Web Appliance allowing remote code execution (RCE).

CVE-2020-2551 – Unspecified vulnerability in Oracle Fusion Middleware, allowing an unauthenticated attacker with network access via IIOP to compromise the WebLogic server.

Microsoft addressed CVE-2023-36584 in the October 2023 Patch Tuesday bundle of security updates. However, it wasn't flagged as actively exploited in the disclosure and at the time of writing it's still marked as non exploited.

The critical flaw in Sophos Web Appliance, fixed on April 4, 2023, is identified as CVE-2023-1671 and has a severity score of 9.8. It can lead to remote code execution (RCE) and affects versions of the software before 4.3.10.4.

It is worth noting that Sophos Web Appliance reached end-of-life on July 20 and no longer receives any type of updates. The company notified customers that they should migrate to Sophos Firewall web protection.

Although CISA's KEV catalog is mainly aimed at federal agencies in the U.S. companies across the world are advised to use it as an alert system for exploited vulnerabilities and take the necessary steps to update their systems or apply vendor-recommended mitigations.

Update 11/17 - A Sophos spokesperson has reached out to share the following clarification about CVE-2023-1671:

More than six months ago, on April 4, 2023, we released an automatic patch to all Sophos Web Appliances, as noted in the Security Advisory on our Trust Center, and in July 2023, we’ve phased out Sophos Web Appliance as previously planned.

We appreciate CISA’s notice for any of the small number of remaining Sophos Web Appliance users who turned off auto-patch and/or missed our ongoing updates, and recommend they upgrade to Sophos Firewall for optimal network security moving forward.
