Article II, Section 2, Clause 1:

The President shall be Commander in Chief of the Army and Navy of the United States, and of the Militia of the several States, when called into the actual Service of the United States; he may require the Opinion, in writing, of the principal Officer in each of the executive Departments, upon any Subject relating to the Duties of their respective Offices, and he shall have Power to grant Reprieves and Pardons for Offences against the United States, except in Cases of Impeachment.

At a minimum, all agree that the Clause has two separate but related purposes: First, in response to the charge in the Declaration of Independence that the King had “affected to render the Military independent of and superior to the Civil Power,” it ensures civilian superintendence over the military—and, as such, the subordination of the military to civilian (and democratically accountable) control. Second, and in contrast to the experience under the Articles of Confederation, it places such civilian superintendence in the hands of a single person. As David Barron and Martin Lederman’s definitive academic study of the Clause explains, “the textual designation of the President as the Commander in Chief was intended to ensure that that officer, and no other, would be ultimately responsible for performing that role, whatever it was to entail.” To that end, they continue, the Clause “suggests that, at least with respect to certain functions, Congress may not (by statute or otherwise) delegate the ultimate command of the army and navy . . . to anyone other than the President.”

As Gen. Milley leaves office of the Chairman of the Joint Chiefs, on his last day he goes out ranting about his loyalty to the Constitution and not to a “dictator,”—blasting Trump without mentioning Trump, and thus trumping as it were Trump’s own excesses with those of his own.

So transits the most politicalized and weaponized 4-star CJS since the office was created.

Would that instead Milley had at least explained the 2021 historically disastrous flight from Kabul and defeat in Afghanistan, or the radical implementation of woke agendas into the Pentagon retention and promotion policies, or why he felt the illustrious and renown Professor Kendi, of current Boston University “Center for Antiracist Research” infamy, should be required reading for the U.S. military at time when its recruitment is descending into historical lows and its deterrent reputation is seriously questioned.

So what about Milley’s own “constitutional" legacy?

Is it that an officer who deems his civilian President and Commander in Chief dangerous—as diagnosed by 4-star psychiatrist, state department diplomat, and now theater commander Milley—has a right to commandeer the chain of command, usurp powers that are expressly by law denied to him, and then take it on himself in a time of Chinese-American tensions to freelance, by contacting his communist counterpart to warn him about his own president’s diagnosed volatility, and to reassure the hardened Stalinist that Dr/Gen. Milley will inform him first of any precipitate action from the White House.

Americans might ask the departing Milley, two questions, 1) if Trump is reelected in 2024, will a retired General Milley, as did his retired 4-star colleagues in 2020, violate the Uniform Code of Military Justice and repeat his current charges against a second-term President Trump—matching the previous invective of his colleagues' accusations of “liar” or “Mussolini”?.

And 2) what would Milley have done had a subordinate like himself, say a 3-star general, decided that Gen. Mark Milley’s Beijing gambit and his arrogation of command powers that were not legally his own, posed a grave threat to the republic?

And thus would such a 3-star call up theater commanders to warn them to resist Milley’s reckless orders and to report to him first, followed by his phone call to the top Chinese PLA general to assure them that if Milley somehow gave an order deemed by the 3-star to be dangerously provocative, then he would not only not obey it but rather first warn the Chinese military of Milley’s unstable state of mind.

Is that the kind of military Milley wishes to leave as his legacy, as he departs barking accusations at the moon?

On Saturday, the New York Times published a piece stating that Kennedy met with Libertarian Party chair Angela McArdle in July, at a Memphis conference.

"He emphasized that he was committed to running as a Democrat but said that he considered himself very libertarian," McArdle said, adding that "We’re aligned on a lot of issues," including the threat of the "deep state."

"My perspective is that we are going to stay in touch in case he does decide to run," Ms. McArdle said. "And he can contact me at any time if that’s the case."

"It would be very bad" if Kennedy runs as a Libertarian, said Matt Bennett, a co-founder of Third Way, a Democrat group helping coordinate efforts to stop the No Labels group who is also trying to run a third-party ticket.

"We’ve been very clear that third parties in close elections can be very dangerous and would almost certainly hurt the president. That would be true of a No Labels candidate and it would be true of RFK."

Georgia bail bondsman Scott Hall, a former Republican poll watcher and Donald Trump supporter, has pleaded guilty to five misdemeanor charges for his role in an alleged conspiracy to help overturn the then-president’s 2020 election defeat in the state.

Scott entered his plea on Friday in Atlanta’s Fulton County District Court under a deal with prosecutors that will spare him the prison time he could have faced under the felony charges that had been filed against him. He became the first Trump backer among the ex-president’s 18 Georgia co-defendants to agree to a plea bargain, and his testimony could help the district attorney’s office win convictions against his alleged co-conspirators.

The plea agreement calls for Hall to serve five years of probation, pay a $5,000 fine, perform 200 hours of community service, and issue an apology to the state for trying to interfere in the November 2020 election. Prosecutors are expected to use his testimony against other Trump co-defendants, such as Trump lawyer Sidney Powell, and potentially against the former president.

Hall was allegedly involved in a scheme to gain unauthorized access to voting machines in Coffee County, Georgia. The original charges against him included conspiracy to commit election fraud, conspiracy to defraud the state, and conspiracy to commit computer theft. He pleaded guilty to five misdemeanor counts of conspiracy to interfere with the performance of an election.

Late last month, Trump pleaded not guilty to the Georgia conspiracy charges against him. The Georgia indictment against former President Trump lists 30 unindicted co-conspirators, who are alleged to have aided in various efforts to overturn the 2020 election results.

The individuals were not named or charged, but the list appears to include the remaining fake electors and others who communicated with Trump’s attorneys in the wake of the election.

Based on media reports, court documents and the House Jan. 6 committee’s investigation, the descriptions make some of their identities clear.

Here’s what we know about the 30 unindicted co-conspirators.

Individual 1: Drafted Trump election speech

The first unindicted co-conspirator is mentioned only once but played a role in the first action alleged in the indictment.

On Oct. 31, 2020, the individual allegedly discussed with Trump a draft speech that falsely declared victory and claimed voter fraud.

Prosecutors listed Trump’s Nov. 4, post-Election Day speech as the first of 161 alleged actions that contributed to the months-long racketeering effort.

The House Jan. 6 committee uncovered evidence indicating Tom Fitton, the president of conservative legal group Judicial Watch, had sent a draft Oct. 31 and later discussed it with Trump.

Fitton did not return a request for comment through a spokesperson.

Individual 2: Fake elector

The identity of the second individual remains unclear.

Charging documents indicate they were one of the 16 pro-Trump individuals who signed documents purporting to be one of Georgia’s valid electors.

Unlike many of the others, however, the individual was involved in the post-election efforts much earlier.

Trump attorney Rudy Giuliani left a voicemail for the individual Nov. 15, 2020, according to the indictment. The individual also allegedly received emails about the electors plan in early December.

Individual 3: Boris Epshteyn

The third individual appears to be Epshteyn, a longtime Trump aide.

The indictment first names the individual as appearing at a Nov. 19, 2020, press conference at the Republican National Committee headquarters, at which pro-Trump speakers promoted false claims of fraud.

It lists the individual as appearing alongside Giuliani, Jenna Ellis and Sidney Powell. Giuliani at the press conference had introduced Ephsteyn and two other lawyers to the crowd.

Two emails described in the indictment make Epshteyn stand out among the three, however.

Descriptions of the emails, sent by now-indicted Trump attorneys Kenneth Chesebro and John Eastman, match ones Ephsteyn received that were previously revealed by the House Jan. 6 committee.

Epshteyn did not return a request for comment.

Individual 4: Robert Sinners

The fourth individual appears to be Sinners, who worked as the Trump campaign’s director of Election Day operations in Georgia.

The indictment details Sinners’s alleged involvement with the plot to send the false slate of electors, noting various emails and texts he sent and received.

CNN reporting last year detailed a Nov. 20, 2020, email Sinners received that appears to match that one described in the indictment.

The indictment goes on to mention additional emails on Dec. 12, 2020. When testifying to the House Jan. 6 committee, Sinners described sending what appears to be one of those emails, and the committee published another email that seemingly matches one in the indictment.

Sinners’s broader testimony to the committee also closely tracks the allegations laid out in the indictment.

Sinners now works as communications director for Secretary of State Brad Raffensperger (R). Raffensperger’s office did not return a request for comment.

Individual 5: Bernard Kerik

Kerik’s attorney, Tim Parlatore, confirmed to The Hill that his client, the former New York City police commissioner who helped lead an investigation into false claims of voter fraud, is the fifth unindicted individual.

The indictment states the individual was present for a meeting between Arizona state legislative leaders and Trump attorneys, including Giuliani and Ellis.

Military helicopter 'crashes into high-voltage transmission lines' in Grant County

A military helicopter has crashed into high-voltage transmission lines knocking out the power near Beverly, officials say.

Grant County Public Utilities shared the alert on social media - it's currently unclear if anyone was injured.

Power lines are down in the Columbia River and across SR 243, which is closed, PUD reported.

In a statement, they said: "The Grant County Sheriff's Office is reporting that a military helicopter crashed into high-voltage transmission lines near Beverly. Lines are down in the Columbia River and across SR 243, which is closed. More detail to come as we can get it."
