Whistleblower concerns about Hunter Biden firms first surfaced in spring 2015, SEC memos show

Banking whistleblowers first began raising alarms about Hunter Biden’s business deals as long ago as Spring 2015 while his father was still serving as vice president, flagging what they feared were “suspicious” transactions and “fraudulent" schemes. One of the bankers became so concerned he eventually escalated his concerns to the U.S. Securities and Exchange Commission (SEC) only a few days before Donald Trump won the presidency in 2016, according to documents provided to Congress and obtained by Just the News.

“Due diligence on involved parties reveals less than clean records,” a Morgan Stanley investment bank compliance presentation from May 2015 stated, specifically providing a dossier about Hunter Biden’s background, his expulsion from the Navy, his association with the Ukrainian energy company Burisma Holdings and photos of the future first son with Barack Obama and Joe Biden.

CHICAGO – Police continue to search for the killer of a teacher who conducted the choir at a well-known church where presidential hopeful Barack Obama is a member.

Donald Youngwas found unresponsive by police early Sunday. The Cook County medical examiner's office ruled the death a homicide. An autopsy found the 47-year-old Young suffered multiple gunshot wounds.

Chicago Police spokesman Wayne Frisbie said Tuesday the victim's roommate returned to the apartment late Saturday and discovered Young shot in the head. The front door to the apartment was closed but unlocked, Frisbie said.

A son and a brother of Senator Joseph R. Biden Jr. of Delaware are accused in two lawsuits of defrauding a former business partner and an investor of millions of dollars in a hedge fund deal that went sour, The Washington Post reported, citing court records.

The Democratic vice presidential candidate’s son Hunter, 38, and brother James, 59, meanwhile say it was they who were defrauded by their former partner, whom they have accused of misrepresenting his experience in the hedge fund industry, The Post said.

According to the legal skirmishes, which have been playing out in New York State Supreme Court since 2007, Anthony Lotito Jr. said that he agreed to help set up Paradigm Companies, a hedge fund group for the Bidens, because the V.P. nominee was concerned on how his son Hunter’s lobbying activities would reflect on his campaign.

Hunter Biden was made president of the firm, earning with an annual salary of $1.2 million, according to the lawsuit. However, in an affidavit, Hunter Biden said his father had nothing to do with the deal and that it is Mr. Lotito who swindled the Bidens, The Post said.

Biden's Son, Brother Named in Two Suits

A son and a brother of Sen. Joseph R. Biden Jr. (D-Del.) are accused in two lawsuits of defrauding a former business partner and an investor of millions of dollars in a hedge fund deal that went sour, court records show.

The Democratic vice presidential candidate's son Hunter, 38, and brother James, 59, assert instead that their former partner defrauded them by misrepresenting his experience in the hedge fund industry and recommending that they hire a lawyer with felony convictions.

The legal actions have been playing out in New York State Supreme Court since 2007, and they focus on Hunter and James Biden's involvement in Paradigm Companies LLC, a hedge fund group. Hunter Biden, a Washington lobbyist, briefly served as president of the firm.

A lawsuit filed by their former partner Anthony Lotito Jr. asserts in court papers that the deal was crafted to get Hunter Biden out of lobbying because his father was concerned about the impact it would have on his bid for the White House. Biden was running for the Democratic nomination at the time the suit was filed.

Hunter Biden was made president with an annual salary of $1.2 million, despite his inexperience in the hedge fund industry, the lawsuit said. Before that, he had been part of the Washington law firm Oldaker, Biden & Belair, which earned $1.76 million in lobbying revenue in the first half of 2006, according to Congressional Quarterly's CQ MoneyLine. One of its biggest clients is the National Association of Shareholder and Consumer Attorneys, a District-based group representing law firms specializing in investment and corporate law.

Hunter Biden is one of many children and relatives of prominent members of Congress who have made their careers as lobbyists. He returned to lobbying after less than a year with Paradigm.

Lotito's lawsuit alleges that James Biden called him in January 2006 to arrange a job for Hunter Biden. It says James Biden told him that his brother (Sen. Biden) "was concerned with the impact that Hunter's lobbying activities might have on his expected campaign for the 2008 Democratic presidential nomination," and, "Biden told Lotito that, in light of these concerns, his brother had asked him to seek Lotito's assistance in finding employment for Hunter in a non-lobbying capacity."

Lotito does not provide any direct evidence of the senator's involvement and offers no witnesses to the assertion.

The campaign of Sens. Barack Obama and Biden declined to comment on the case, referring questions to Nicholas Gravante Jr., a lawyer representing Hunter and James Biden. Gravante said assertions that Joseph Biden told his brother he was concerned about his son's lobbying are "absolutely false."

"This lawsuit has nothing to do with Joe Biden, and there is absolutely no truth to those allegations," Gravante said. "It is a business dispute between former partners. The suit is baseless."

Brian C. Wille, an attorney for Lotito, said the lawsuit alleges no wrongdoing by Sen. Biden, only that his concerns set in motion the business deal.

"There was a concern that Hunter Biden's role as a lobbyist would have an impact on the senator's proposed presidential run," Wille said. "That's what James Biden told Mr. Lotito. . . . Was it true? Who knows? There is no allegation the senator was involved in any of these events."

In an affidavit, Hunter Biden said his father had nothing to do with the deal and that it is Lotito who swindled the Bidens.

He said Lotito lied about being a "fully licensed and accredited securities professional" with hedge fund experience.

In addition, he said Lotito recommended a lawyer to vet the business deal who was under investigation and was ultimately convicted on several felony charges of conspiracy and wire and mail fraud in a scheme to steal millions from a computer company.

In the hedge fund business deal, Lotito and the Bidens created a company called LLB Holdings USA and together agreed to pay $21.3 million for 54 percent interest in Paradigm.

In the lawsuit, Lotito said that soon after creating LLB, the Bidens crafted a "secret deal" to create their own company that was designed to buy out his shares in Paradigm for a low rate, to which he agreed. He said he knew nothing of the secret deal until later and now believes he was defrauded out of millions of dollars and his share in the company.

In the second lawsuit against the Bidens, which was filed in June, Lotito is also named as a defendant. Stephane Farouze, now an executive with Deutsche Bank, seeks $10 million, saying the Bidens and Lotito promised to buy his shares in the hedge fund company but reneged.

CHICAGO – Police continue to search for the killer of a teacher who conducted the choir at a well-known church where presidential hopeful Barack Obama is a member.

Donald Youngwas found unresponsive by police early Sunday. The Cook County medical examiner's office ruled the death a homicide. An autopsy found the 47-year-old Young suffered multiple gunshot wounds.

Chicago Police spokesman Wayne Frisbie said Tuesday the victim's roommate returned to the apartment late Saturday and discovered Young shot in the head. The front door to the apartment was closed but unlocked, Frisbie said.

Challenges Facing the U.S. Offshore Wind Industry: Inflation, Interest Rates, and Insufficient Subsidies

Sept 6 (Reuters) – The value of Danish energy company Orsted, the world’s largest offshore wind farm developer and a big player in the U.S., has plunged about 31% since it declared $2.3 billion in U.S. impairments in late August due to supply delays, high interest rates and a lack of new tax credits.

The company is just one of several energy firms trying to build new offshore wind farms in the U.S., but the pain it is feeling is rippling across the entire industry, raising questions about the future of fleet of projects that U.S. President Joe Biden hopes can help fight climate change.

Biden’s administration wants the U.S. to deploy 30,000 megawatts (MW) of offshore wind by 2030 from a mere 41 MW now, a key part of his plan to decarbonize the power sector and revitalize domestic manufacturing, and has passed lucrative subsidies aimed at helping companies do that.

But even with regulatory rules and subsidies in place, developers are facing a whole new set of headwinds.

Here is what they are:

INFLATION

The U.S. offshore wind industry has developed much more slowly than in Europe because it took years for the states and federal government to provide subsidies and draw up rules and regulations governing the industry, slowing leasing and permitting.

However, as government policies started to line up in the industry’s favor in recent years, offshore wind developers unveiled a host of new project proposals, mostly off the U.S. East Coast. Two small projects came into operation – Orsted’s five-turbine Block Island wind farm off Rhode Island and the first two test turbines of U.S. energy firm Dominion Energy’s Coastal Virginia Offshore Wind off Virginia.

Then came a hitch.

The COVID-19 pandemic gummed up supply chains and increased the cost of equipment and labor, making new projects far more expensive than initially projected.

“It appears the offshore wind industry bid aggressively for early projects to gain a foothold in a promising new industry, anticipating steep (cost) declines similar to those for onshore wind, solar and batteries over the past decade,” Eli Rubin, senior energy analyst at energy consulting firm EBW Analytics Group, told Reuters.

“Instead, steep cost gains threw project financing and development into disarray,” Rubin said, noting many contracts will likely be renegotiated as states look to decarbonize, with higher prices ultimately falling onto power customers.

INTEREST RATES

Financing costs also spiraled as the U.S. Federal Reserve boosted interest rates to tame inflation.

Many contracts for offshore wind projects have no mechanism for adjustment in the case of higher interest rates or costs.

Some developers have paid to get out of their contracts rather than build them and face years of losses or low returns.

In Massachusetts, two offshore wind developers, SouthCoast Wind and Commonwealth Wind, for example, agreed to pay to terminate deals that would have delivered around 2,400 MW of energy, enough to power over one million homes.

In New York, offshore wind developers also sought to boost the price of power produced at their projects. Norway’s Equinor and its partner BP are seeking a 54% increase for the power produced at three planned offshore wind farms – Empire Wind 1 and 2 and Beacon Wind.

Orsted, meanwhile, told utility regulators in June that it would not be able to make a planned final investment decision to build its proposed 924-MW Sunrise Wind project unless its power purchase agreement was amended to factor in inflation.

INSUFFICIENT SUBSIDIES

Biden’s administration has sought to supercharge clean energy development with passage of the Inflation Reduction Act (IRA), a sweeping law that provides billions of dollars of incentives to projects that fight climate change.

Since the law passed last year, companies have announced billions of dollars in new manufacturing for solar and electric vehicle (EV) batteries across the U.S.

But the offshore wind industry is not fully satisfied.

Bonus incentives for using domestic materials and for siting projects in disadvantaged communities are too hard to secure, developers say, and they are crucial to making projects work in a high-cost environment.

The credits are each worth 10% of a project’s cost and can be claimed as bonuses on top of the IRA’s base 30% credit for renewable energy projects – bringing a project’s total subsidy to as much as 50%.

Equinor, France’s Engie, Portugal’s EDP Renewables, and trade groups representing other developers pursuing offshore wind projects in the U.S. told Reuters they are pressing officials to rewrite the requirements, and warning of lost jobs and investments otherwise.

Orsted A/S said it’s prepared to walk away from projects in America unless the White House guarantees more support, highlighting the myriad challenges facing wind-energy developers in the country.

The US, far behind Europe and China in the race to build offshore wind, is targeting a jump to 30 gigawatts by the end of the decade from next to nothing now. While the Biden administration has touted its landmark clean-energy subsidy program to kickstart projects, developers must ensure a large chunk of components are US-made, and that’s proving hard to achieve.

“We are still upholding a real option to walk away,” Orsted Chief Executive Officer Mads Nipper said in an interview in London. “But right now, we are still working towards a final investment decision” on projects in America.

The Danish firm has had a turbulent few months, with supply-chain glitches and soaring interest rates weighing on US plans. It’s a tough time for offshore wind globally, with costs for steel and other materials spiraling higher just as countries around the world push to add more turbines. Large projects by the likes of Vattenfall AB and Iberdrola SA have already been scrapped this year.

Nipper said Orsted couldn’t have predicted the industry turmoil, yet an investor selloff saw the company lose $8 billion in value last week after impairments were booked on several US projects. Longer-term plans are also at risk, with developments near New Jersey and Delaware not investible right now, he said.

Despite shareholder concern, the CEO said he’s had the support of the board since the stock price slumped.

Subsidy rules are hampering progress in the US. While the government wants domestically produced steel to be used by companies eligible for tax credits, supply has been held up by insufficient production capacity and rising prices.

Nipper has asked the White House to guarantee subsidies without that requirement at first, and requested extra time to overcome the difficulties in sourcing American-made material.

“What we proposed was a grace period, say, so give us three to five years,” the CEO said. “Right now, it can’t deliver.”

While offshore farms are seen as critical to ridding the US power grid of fossil fuels and avoiding the worst effects of climate change, they’re also extremely capital- and labor-intensive. In order for the industry to bring future projects to fruition, consumer energy price increases are “inevitable,” Nipper said.

Now their nominee for the U.S. Senate in Illinois, Jack Ryan, is brushing off his then-wife’s allegations that he repeatedly pressured her, despite her protestations, to have sex with him in front of other people. Instead of denouncing Ryan, many Republicans are defending him.

At a press conference Monday, Jack Ryan said he had fought to keep the divorce records sealed in order to “keep information about [my] child … private.” He ducked most questions, claiming, “It’s not helpful to our son.” According to the Chicago Sun-Times, Ryan mentioned that his son had “special needs.” Ryan didn’t mention the “political aspirations” he had raised in his 2000 filing when he complained about Jeri Ryan making their marital troubles public. And according to the Chicago Tribune, “in September 2000, Anne Kiley, an attorney for Jeri Ryan, said in a court filing that one of Jack Ryan’s attorneys had told her a few months earlier that Jack Ryan wanted parts of the file blacked out, removed, or sealed because he was ‘concerned [it] would negatively impact his political aspirations.’ “

2. It wasn’t illegal. In a radio interview, Ryan said, “I think my character has been proven by this. There’s no breaking of any laws. There’s no breaking of any marriage laws. There’s no breaking of the Ten Commandments anywhere.” CNN showed Ryan saying, “No one has ever said that I haven’t abided by every single law or abided by my marriage vows.”

3. It’s irrelevant to public office. Refusing to discuss the truth or falsehood of Jeri Ryan’s account, Jack Ryan told reporters Monday, “There’s nothing there that impacts my ability to be a U.S. senator.” CNN showed him saying, “We’re in a campaign that talks about the issue that should address our country: the defense of our country or our workers or the pro-family issues or the issues in parts of the state, in the suburbs. And so, think of just—what just happened. We had someone spending a lot of money to break into a file that a mom and dad wanted to have sealed to protect their son, and now we’re asking what happened between a husband and a wife in the most intimate part of their relationship.”

4. It’s a left-wing conspiracy. According to the Tribune, Ryan’s talking points “railed against a ‘despicable’ decision by Los Angeles Superior Court Judge Robert A. Schnider to unseal portions of the divorce file” and falsely alleged, “This judge was appointed by Jerry Brown, the most liberal governor of California in history.”

5. The woman’s discomfort is no big deal. “She says three times over eight years [of marriage], we went to places that she felt uncomfortable,” Jack Ryan said Tuesday. “That’s the worst of it. I think almost any spouse would take that as, ‘Gosh, if that’s the worst someone can say about me after seeing me live my life for eight years … ’ then people say, ‘Gosh, the guy’s lived a pretty clean life.’ ” In another interview, Ryan said, “What’s in those documents at its worst is that I propositioned my wife in an inappropriate place.”
