Federal appeals court reverses ruling on Jan. 6 subpoena to RNC, dismisses case

Appellate judges went out of way to acknowledge RNC’s appeal raised important issues and also took a dig at Democrats for vacillating.

A federal appeals court has reversed a lower court ruling ordering the Republican National Committee to comply with a subpoena from the House Jan. 6 committee, poking the Democrat-led investigation for vacillating on key issues and acknowledging there were "important and unsettled constitutional questions" about whether the panel is lawfully constituted.

The U.S. Circuit Court for Appeals or the District of Columbia said it was dismissing the case because the Jan. 6 committee withdrew the subpoena to the RNC seeking records of its dealings with a digital fund-raising vendor Salesforce.

"The RNC's appeal has become moot," the appeals court ruled in dismissing the case.

Ordinarily, when a dispute is withdrawn, a federal appeals court issues a very brief order of dismissal. But the appellate judges went out of their way to acknowledge the RNC's concerns about the subpoena raising important issues and that the lower court's ruling needed to be reversed.

"The RNC claimed that disclosure of these documents would reveal sensitive information about its digital strategy, so it sued to prevent the disclosure," the appeals judges wrote. "The RNC argued that the Committee was not lawfully constituted and that the subpoena violated the First Amendment."

They also said: "Because the Committee caused the mootness and thereby deprived us of the ability to review the district court’s decision, and given the important and unsettled constitutional questions that the appeal would have presented, we vacate the district court's judgment."

The court also took issue with the House Democrat committee for playing essentially a game of hurry up, then wait.

"The Committee has taken various positions on whether and when it needs the subpoenaed RNC documents," the judges noted, citing a history of urgent requests followed by delay and then eventually withdrawal of the subpoena.

A school resource deputy in Martin County will be given more training and is facing discipline after firing a round from his department-issued gun inside a school.

The incident occurred Monday at Treasure Coast Classical Academy.

Sheriff William Snyder said the deputy was inside his office at the school when the shooting happened.

He told his supervisor that he thought his gun was not loaded when he pulled the trigger.

Snyder said the deputy was doing what's called a dry fire — basically practicing his aim and trigger pressure.

Sheriff William Snyder says the deputy was not handling the weapon in a careless manner at the time of the shooting.

The deputy was going to go to the range after his shift at the school, officials said.

The bullet traveled through the deputy's office wall, through a hallway and into a neighboring classroom. The round was finally stopped by a bookshelf.

"He wasn't playing with the firearm. He wasn't handling it in a careless manner," Martin County Sheriff William Snyder said. "He was being conscientious about what he did, but he was doing it in the wrong place under the wrong circumstances."

Snyder said the deputy is very well-liked on campus and won't lose his job over the incident. However, he will receive more training and disciplinary measures, but that discipline is still being determined.

No one was hurt in the shooting.

Peaceful solution to Ukraine crisis currently not possible – Russia.

The armed conflict in Ukraine cannot be resolved through negotiations under current circumstances, Kremlin spokesman Dmitry Peskov said on Monday, as cited by Interfax.

Asked if there was a path towards a diplomatic settlement, Peskov said that “at the moment, such a prospect cannot be observed,” the news agency reported.

Moscow blamed Kiev for the suspension of peace talks. In late March, the two parties discussed a draft peace agreement, which would make Ukraine a neutral state in exchange for security guarantees given by major world powers. However the Ukrainian government ended talks in April, after accusing Russian troops of having committed war crimes, an allegation that Moscow said was based on falsified evidence.

Ukrainian President Vladimir Zelensky has since declared that his country will only be satisfied by defeating Russia on the battlefield and pushing its forces from the entire territory claimed by Kiev.

On one mission, they torch more than a tonne of Taliban opium.

In the video obtained by ABC Investigations, these commandos are once again preparing to head outside the wire on another dangerous mission and capture their preparations on camera for posterity.

NTSB wants all new vehicles to check drivers for alcohol use

DETROIT (AP) — The National Transportation Safety Board is recommending that all new vehicles in the U.S. be equipped with blood alcohol monitoring systems that can stop an intoxicated person from driving.

The recommendation, if enacted by the National Highway Traffic Safety Administration, could reduce the number of alcohol-related crashes, one of the biggest causes of highway deaths in the U.S.

The new push to make roads safer was included in a report released Tuesday about a horrific crash last year in which a drunk driver collided head-on with another vehicle near Fresno, California, killing both adult drivers and seven children.

NHTSA said this week that roadway deaths in the U.S. are at crisis levels. Nearly 43,000 people were killed last year, the greatest number in 16 years, as Americans returned to roads after pandemic stay-at-home orders.

Feds: 47 exploited pandemic to steal $250M from food program

MINNEAPOLIS (AP) — Federal authorities charged 47 people in Minnesota with conspiracy and other counts in what they said Tuesday was the largest fraud scheme yet to take advantage of the COVID-19 pandemic by stealing $250 million from a federal program that provides meals to low-income children.

Prosecutors say the defendants created companies that claimed to be offering food to tens of thousands of children across Minnesota, then sought reimbursement for those meals through the U.S. Department of Agriculture’s food nutrition programs. Prosecutors say few meals were actually served, and the defendants used the money to buy luxury cars, property and jewelry.

“This $250 million is the floor,” Andy Luger, the U.S. attorney for Minnesota, said at a news conference. “Our investigation continues.”

Many of the companies that claimed to be serving food were sponsored by a nonprofit called Feeding Our Future, which submitted the companies’ claims for reimbursement. Feeding Our Future’s founder and executive director, Aimee Bock, was among those indicted, and authorities say she and others in her organization submitted the fraudulent claims for reimbursement and received kickbacks.

In the past week, rumors proliferated that Iran’s Supreme Leader, Ayatollah Ali Khamenei, had died.

On September 17, however, Khamenei, eighty-three, re-emerged briefly to address a group of students, putting the rumors to rest following a two-week period in which he had not been seen in public and had canceled several scheduled appearances.

The reports about his poor health and possible demise aroused curiosity about who would succeed Khamenei and how the process might unfold.

In Iran, there are legal procedures and then there is realpolitik.

According to the constitution, the Assembly of Experts—a group of eighty-eight senior clerics vetted by another clerical body and then approved in popular elections—picks a new Supreme Leader when the incumbent dies or is otherwise incapacitated. In reality, a decision so important to the continued existence of the Islamic Republic and its elite is determined in advance and in secret.

The post of Supreme Leader is unique in the Muslim world, where secular figures are generally in charge and there is a separation between mosque and state. The position was created by and for the leader of the 1979 Islamic revolution—Ayatollah Ruhollah Khomeini—and grants massive powers to its occupant. The system, conceived by Khomeini while in exile in the 1960s and 1970s, is known as Velayat-e Faqih or rule by the jurisprudent. The leader is commander-in-chief of the armed forces, appoints the heads of all military branches and the head of the judiciary, and has the final say on all important policies. The Supreme Leader also appoints half the members of the Guardian Council, a twelve-man body that controls Iranian politics by vetting candidates for elected office, including the Assembly of Experts, presidency, and parliament.

In its forty-three-year history, the Islamic Republic has only had one prior transition for Supreme Leader, which occurred after Khomeini’s death in 1989. Khomeini had appointed a successor, Ayatollah Hossein Ali Montazeri, a respected religious authority and supporter of the revolution. But Khomeini changed his mind at the last minute after Montazeri harshly criticized the leader for authorizing the summary execution of 4,500 to five thousand political prisoners in 1988 at the end of the 1980-1988 Iran-Iraq War. Montazeri was dismissed and later put under house arrest. No new successor was named.

When Khomeini died, the Assembly of Experts was nominally tasked with choosing a successor, rather like the choice of a new pope by the Roman Catholic College of Cardinals. But Ali Akbar Hashemi Rafsanjani, the powerful speaker of the parliament at the time and a close associate of Khomeini for decades, engineered the ascension of the then president of Iran, Ali Khamenei, behind the scenes. The constitution was amended to allow for a Supreme Leader with less than stellar religious credentials (Khamenei was only a Hojatolislam or midranking cleric at the time), the post of prime minister was eliminated, and the presidency—then a weaker position—was given executive authority. The Assembly of Experts approved Khamenei, who resigned the presidency. Rafsanjani then ran successfully for president twice.

Initially the more dominant figure, Rafsanjani lost power over time, as Khamenei—elevated to “ayatollah” status after his selection—grew comfortable in his new role. Khamenei cultivated the Islamic Revolutionary Guard Corps (IRGC) in particular, compensating for his lack of clerical knowledge and popular appeal. The IRGC has since become such a major force in Iran—in the economy as well as in the security establishment—that it likely has an even bigger say in who becomes Supreme Leader than the Assembly of Experts or other elite groups.

Pentagon Opens Sweeping Review of Clandestine Psychological Operations

After all, we’re currently engaged in an information war at the least, with any and all sides on the Fifth-Generation battlefield deploying both Potential (ie: narrative,) and Actual (ie: logistical) Events with the intent of furthering their own ends in the war for the Collective Mind of American society.

I believe that most of us can also agree that the communications (or comms) of the Trump team have become a little more overt of late, from hints as to our favorite letter of the alphabet to near-open questioning as to the legitimacy—or lack thereof—of the current ‘Commander-in-Chief.’

This week, in seeming response to these accelerating and threatening narratives that are emboldening and encouraging true patriots around the nation, the Biden Administration has ordered a “sweeping review of clandestine Psychological operations” implemented during the previous Administration.

Exactly what they are seeking and why remains obscured … at least to members of the general public.

Taking this into consideration, how does this Actual Event—thecommencing of a ‘sweeping review of clandestine PsyOps’—and Potential Event—the establishment media’s open and aggressive reporting of it—map onto what we believe we know of past, present and projected future trends in the Shadow War?

While I am certain that researchers such as Patel Patriot will have more in-depth Micro thoughts on this subject that will be more illuminating as additional information continues to come to light, I believe we can develop a solid framework with which to observe the current deployments on both sides of the proverbial intel war as it relates to psychological operations.

To do so, we need only ask a few pertinent questions, beginning with the surface, practical level and expanding into the increasingly more fascinating.

First up, it is pertinent to ask a broad and general ‘Why?’ regarding what would make it both logistically and practically necessary for the Biden Administration and DOD to take these overt steps. After all, should the Biden Pentagon not be aware of any such PsyOps that might have been actioned—or continue to be actioned—under the previous Admin?

Of course, even the engaged Lefty mind likely remembers the practical or surface-level answer to this question: that being the reported prospect that Kash Patel and other members ofTrump’s DOD ‘Transition Team’ made things somewhat difficult on the incoming Biden Admin, refusing to turn over material related to “ongoing special operations,” which would hypothetically include any information related to the implementation of Domestic PsyOps.

While on the surface this attempt at obfuscation takes compartmentalization to a near-treasonous level, mapping quite perfectly onto the MSM and Biden Admin characterizations of the Trump Admin, the more practical reading of the bureaucratic tension suggests that some legal or military mechanism is or was in place that allowed patriots such as Patel to obscure this information from the incoming Admin.

I believe we have a name for it, but whether you’re fully read-in on the Devolution theory or believe something else is afoot, the idea that Trump’s transition team refused to fully comply with the incoming Admin combined with the fact that—to this point—no legal or disciplinary action has resulted from this insubordination implies that a Continuity of Government plan was in effect at the time, and likely continues to this day.

Unless, of course, we are to believe that the Biden Admin cares so deeply for the unity of the American public that they would never think to prosecute members of the Trump team that knowingly and brazenly committed acts of treason in the opening days of their ‘Administration.’

Thus, if we dismiss obviously-faulty leaps in logic, we are left with the prospect that the Trump Admin actioned certain Military Intel Spec Ops that were complex enough so as to require extreme—and apparently fully legal and constitutional—compartmentalization.

Compartmentalization that seemingly continues to this day, two years into the new Admin’s reign.

If we can accept this as a likelihood, it would behoove us to consider what sort of Spec Ops would or could be withheld from the incoming Admin, and WHY they could or would be withheld, for surely the incoming Commander-in-Chief should be notified as to PsyOps being actioned either for or against the people he has been sworn in to defend and serve….

Three migrants who were part of a group that was flown from Texas to Martha’s Vineyard last week by the state of Florida are suing Gov. Ron DeSantis and other state officials, alleging they were duped into traveling to an isolated island in the northeast as part of a scheme to benefit the governor’s political career.

The suit, filed in federal court in Massachusetts, alleges that DeSantis, Florida’s Transportation Department secretary and others tricked migrants into leaving Texas by offering them McDonald’s gift cards and other items to board the flights, and by promising them assistance and employment. The plaintiffs include three anonymous Venezuelan migrants and Alianza Americas, a transnational organization that advocates on behalf of immigrants rights.

The lawsuit names five other people as defendants for allegedly participating in the scheme. Two defendants, identified by migrants as “Perla” and “Emanuel,” are believed by attorneys to have been the people recruiting migrants in San Antonio to board the planes.

“These immigrants, who are pursuing the proper channels for lawful immigration status in the United States, experienced cruelty akin to what they fled in their home country,” the lawsuit alleges.
