We reported earlier on some of the Biden connections to the Durham probe, including DNI John Ratcliffe confirming that Joe Biden had been told about the plan from the Clinton campaign to smear Donald Trump.

But, there’s another intriguing piece of information that the Free Beacon just dropped —that in 2020, the Biden campaign also paid the same internet company being talked about concerning the Durham probe.

The Biden campaign paid nearly $20,000 to a cybersecurity firm at the center of Special Counsel John Durham’s investigation into the origins of the Trump-Russia probe.

The campaign paid Neustar Information Services in 2020 for accounting and compliance work, according to Federal Election Commission records. According to Durham, Neustar’s chief technology officer, Rodney Joffe, accessed sensitive web traffic data that the company maintained on behalf of the White House executive office to collect “derogatory” information about Donald Trump. Joffe allegedly provided the information to Hillary Clinton campaign lawyer Michael Sussmann, who in turn gave it to the CIA during a meeting in February 2017. Durham charged Sussmann in September with lying to the FBI about his investigation of Trump.

That raises the question: was the same action going on against Trump in 2020?

The Biden and Clinton campaigns are the only two presidential committees to have ever paid Neustar, according to Federal Election Commission records. Biden’s campaign paid Neustar $18,819 on Sept. 29, 2020, the records show. The Clinton campaign paid the firm $3,000 in May 2015 for mobile phone services. The Democratic Congressional Campaign Committee paid $3,000 to Neustar in 2017. Neustar executives and staffers contributed $17,906 to Biden’s campaign, FEC records show.

Now, it should be noted that Durham hasn’t accused Neustar or Joffe of having done anything illegal. What has been alleged is that Joffe collected the data to find derogatory information to provide to the Clinton team that could then be used against Trump to please people in the campaign, and that he thought he might get a job in a Clinton Administration. While Neustar and Joffe were not named in the Durham filing, Joffe’s attorney has confirmed his involvement.

The Free Beacon queried the White House about this information and what was going on with this payment.The White House referred them to the DNC — and that says a lot right there.

Why can’t the White House simply answer the question, and if it’s an innocent campaign use, no problem? But given what allegedly went on with the Clinton campaign, it raises all kinds of flags as to what was going on here. The “derogatory information” – such as the debunked Alfa Bank smear – was then allegedly fed to media and to the FBI by the Clinton people. So, it wasn’t just the surveillance, it was the alleged effort to spread that information to hurt Trump, even using the power of the government against him by giving information to the FBI. Sussman is charged with lying to FBI general counsel James Baker by denying he was looking into Trump at the behest of the Clinton campaign.

So, here’s another question that media needs to be put to Biden himself — and they should not let him dodge it.

More disturbing, though, was the revelation that those who were passing her information were exploiting a prior Pentagon contract to actually monitor the Executive Office of the President after Trump’s inauguration (click here for my take on why that happened). All of that was funneled through Perkins Coie, the now-infamous law firm which employed the currently indicted Michael Sussman.

Now, a new report from Fox News says thatDurham’s investigation is “accelerating,” and that it is also targeting “other matters” outside of just Sussman (and Igor Danchenko). As an aside, the article offers a very in-depth, long-form breakdown of what has transpired with Durham.

Special Counsel John Durham’s investigation has “accelerated,” and more people are “cooperating” and coming before the federal grand jury than has previously been reported, a source familiar with the probe told Fox News…

…But a source familiar with federal investigations told Fox News that federal prosecutors cannot indict an individual and then use a grand jury to investigate matters in an existing indictment.

The source, though, said a prosecutor can indict an individual for a specific crime, and continue to use the grand jury to explore other crimes related to that individual, and beyond.

“They are looking at more than Sussmann,” the source said.

“The Government also maintains an active, ongoing criminal investigation of the defendant’s [Sussmann’s] conduct and other matters,” Durham wrote.

In other words, _they wouldn’t be using the grand jury for investigation purposes_if it wasn’t in order to investigate and charge other crimes, and the people involved in those crimes. It’s simply hard to believe that this all stops with Sussman and Danchenko, and Durham’s has been methodical so far. He’s not going to jump the gun until he’s got the goods.

Of course, with all this bouncing around in public now, the desperate attempt to quash the story has begun. After three days of not reporting on it at all, the New York Times and the Washington Post finally put out “explainers” on the situation that are filled with bias and omissions, including quoting the lawyers of some of the people possibly being targeted. Those stories were published at almost the same time, but I’m assured there was no coordination.

These attempts to spin away the magnitude of what Durham has found are reminiscent of the Times’ attempt to whitewash the news that Michael Sussman was going to be indicted. They ran to his lawyers and other “experts” to essentially claim that Durham had nothing. Yet, once the indictment dropped, it was loaded with evidence not previously mentioned.

In my opinion, that’s what the mainstream media is doing again. They are doing their best to get out in front of this story before more evidence drops. False narratives are already spreading like wildfire, including the idea that a tech firm exploiting a government contract to spy on a president for his political opponents is somehow “normal.”

There’s also theclaim Hillary Clinton isn’t directly linked to what happened. That’s not true either. There are FEC filings that show that the Clinton campaign and the DNC made payments to Neustar, the company in question. Further, we know she paid Michael Sussman to get the data from Rodney Joffe (Neustar’s Chief Technology Officer). So, even if Joffe was promised something else (no one works for free), the fact that Sussman was paid to get the information completes the chain back to Hillary Clinton.

Because of how damning all this evidence is, the press has nowhere to go. Instead of addressing the facts as we know them, they are bringing on hacks like Jeremy Bash to spin conspiracies about Durham.

It makes perfect sense for Hillary Clinton to be spying on Trump after What that tells us is that Clinton was reaching for a way to try to overturn the election. Clearly, in my view, based on her actions and her public statements at the time, she wanted to find a way to prove Trump had been illegitimately elected. Once she did that, anything was on the table to “fix” the situation. Such a dismissal of Durham’s filing on the grounds it doesn’t make sense is a total farce. Everything lines up.

In short, don’t let anyone downplay what has been revealed here. It’s a really big deal, and it should be treated as such. The fact that the media are having so much trouble handwaving it all away only bolsters how serious it is. Durham is playing for keeps, and all the press spin in the world isn’t going to save those he indicts.

The government was proposing a complicated regulator that would try to address several kinds of online harm, like child sexual exploitation. Its thorniest and most controversial issue was that of regulating hate speech. The technical paper envisioned a body that would hear complaints about pieces of hate content and issue rulings on whether each post stays up or comes down.

The government received a lot of critical feedback on its plan. We had our issues with the technical paper too.

We urge the government to look at the convoy outside the window to understand why we cannot put this issue on the back burner. We must push forward with a better and (hopefully) more popular plan.

One in five Canadians are directly affected by online hate; harassers use hate speech to silence and scare women, BIPOC, LGBTQ+, First Nations, Métis, and Inuit peoples, and others.

It’s important to note that 80 per cent of Canadians want legislation to curb online hate. However, the average person is not writing a feedback letter to the government about a technical paper. Some of the critical letters are coming from the companies themselves, which should frankly be thrown out – they demonstrably can’t be trusted. But more of that criticism is coming from dogmatic free speech academics and organizations.

These civil liberties advocates aren't trying to do harm, or do nothing, but they seem not to understand that the prevalence of hate speech and how it silences people is the free expression issue of this generation. We would rather see a small amount of posts that are not-quite hate speech be a casualty of any legislation rather than have hate speech continue to attack and silence women, BIPOC, LGBTQ+, First Nations, Métis, and Inuit peoples, and others. It's time for the speech of equity seeking groups to be prioritized over racists, abusers, and neo-Nazis.

The remaining critics are members and groups from communities actually facing hate who are afraid of unwarranted police involvement in the process / with the regulator, and the complaints regime being wielded against them by bad actors. They’re right and we should all be listening.

Additionally, and fundamentally, the plan put forward in the technical paper seems to address the wrong problem.

The problem is not that the complaints mechanisms on Facebook and other platforms are slow and poorly adjudicated. We shouldn’t be handing victims a homework assignment to get hate content taken down long after it’s already done its damage anyway. The problem is that there are people who want to harass, abuse, and incite violence with hate speech, and that platforms have decided to allow it to be posted in the first place, and even amplify it.

A new filing from special counsel John Durham has raised major national security concerns over access to White House internet traffic.

The filing, which was submitted late on Feb. 11 in connection with the indictment of Michael Sussmann, a former attorney to Hillary Clinton’s 2016 campaign, reveals that Rodney Joffe, a tech executive who was working with Sussmann, had exploited access to domain name system (DNS) internet traffic pertaining to the Executive Office of the President of the United States (EOP) as well as Trump Tower and Donald Trump’s Central Park West apartment building.

The filing also discloses that Joffe, a private individual who has been implicated in mail order scams in the past, had access to the White House’s DNS internet traffic since at least 2014.

Joffe gained this access when his firm, Neustar, was hired by the government to “access and maintain dedicated servers for the EOP as part of a sensitive arrangement whereby it provided DNS resolution services” to the Executive Office of the President.

Durham doesn’t state whether Joffe’s access to the President’s Office was abused between 2014 and 2016 when Barack Obama was president. However, Durham alleges that when Trump became president, Joffe “and his associates exploited this arrangement by mining the EOP’s DNS traffic” in order to gather “derogatory information about Donald Trump.”

DNS functions as a phone book of the internet. By monitoring DNS internet traffic, Joffe would have had access to information about which websites were being accessed from the White House. But according to Durham, the DNS data was “among the Internet data” mined and exploited by Joffe, suggesting that Joffe had access to additional data about Trump’s internet activities.

Durham’s filing states that Joffe tasked a small group of university researchers to mine internet data to establish “an inference” and “narrative” tying Trump to Russia. Durham said that in doing so, Joffe “was seeking to please certain ‘VIPs.’” According to Durham, Joffe identified these VIPs as individuals at Sussmann’s law firm, Perkins Coie, and the Clinton campaign.

While Durham’s latest filing doesn’t state whether Joffe was directly paid for spying on Trump’s internet activities, an earlier Durham filing stated that in addition to Joffe’s intent to please “certain VIPs,” Joffe claimed to have been offered a high-ranking position in a Clinton administration.

Like everyone says, we really need to go after the business model of these companies, which have decided to prioritize engagement at the cost of our democracy and the safety of our neighbours. The platforms have been purposely getting people angry and funnelling them into dangerous echo chambers.

We sat with this for a while, and we think we have a solution.

We’re calling it the ombudsperson approach.

We’re recommending that the government create an ombudsperson/regulator, with broad investigatory powers. They can compel evidence and testimony from the social media companies and take a hard look at their algorithms and business practices. They can also issue recommendations.

Facebook’s own employees warned that after it changed how it measured the success of a post in 2018, it incentivized angry engagement and misinformation. In 2021, another employee found that new users were being quickly pushed by their algorithms towards QAnon groups. Internally, Facebook staff have been warning about problems and proposing solutions for years. We also know, thanks to Facebook whistle-blower Frances Haugen, that the company chooses not to implement any fixes (in any reasonable time frame) that would hurt engagement.

Meanwhile, hundreds and thousands of people were being radicalized into the far-right, estranging them from their families, and movements were recruiting people on Facebook that would culminate in murders and mass murders and incidents like January 6th and the Ottawa convoy.

If the ombudsperson had access to this information in real-time, they could, for example, issue a timely recommendation that the company has to undo the algorithmic changes that incentivized angry, divisive posts and misinformation.

We propose that if the company doesn’t want to follow a recommendation, the ombudsperson be empowered to apply to a court to make it an order. The court would apply two tests. First, is the order consistent with the goals of the regulator. Second, is it consistent with the Charter and previous rulings. Here, groups can intervene and put their arguments to the court.

If the order is granted, and the company doesn’t follow the order, we propose that they face significant fines (the same as envisioned in the technical paper).

Of course, this is just a starting point and a framework. But we would like to keep it simple and move it along.

Here’s the upside – this is way faster than putting in a complicated complaints regime, it does away with the contentious police involvement and 24-hour takedown pieces, and isolated free speech vs. hate speech arguments can be had later, in front of a court.

It is noteworthy that—despite the new information disclosed regarding Joffe—Durham’s latest filing nominally pertains to a potential conflict of interest for Sussmann’s current counsel, Latham and Watkins. Latham previously represented other parties who are included in Durham’s investigation whose interests may conflict with Sussmann’s. In addition, Latham also represented Perkins Coie “in connection with events that likely will be relevant at trial,” and was cited by Durham as having “maintained professional and/or personal relationships with individuals who could be witnesses.”

Durham is requesting an on-the-record waiver by Sussmann, which would preclude him from challenging a conviction on the grounds of having had conflicted counsel. While requesting a waiver isn’t out of the ordinary (Durham similarly requested a waiver from Igor Danchenko, Christopher Steele’s source who was indicted by Durham in November 2021), Durham effectively updated the public on the progress of his investigation.

Role of Biden National Security Adviser Jake Sullivan

Durham has implied that the efforts of Sussmann and Joffe’s team likely began sometime in April 2016. The initial indictment of Sussmann specifically notes that data had already been aggregated from “on or about May 4, 2016, through on or about July 29, 2016.”

But there may have also been some earlier coordination that possibly involved members of the Clinton campaign in the leadup to the data collection efforts. On Feb. 26, 2016, Jennifer Palmieri, communications director for the Clinton campaign, was asked in an email by former Bill Clinton adviser Joel Johnson, “Who was in charge of the Trump swift boat project?”—a reference to smear campaigns initiated against political opponents.

That early exchange is all the more notable given that Palmieri’s name appears in Durham’s Sussmann indictment. The reference is made in connection with an email exchange regarding the allegations of a secret communications channel between the Trump Organization and Russia’s Alfa Bank. That email exchange involved former Perkins Coie attorney Marc Elias and three Clinton campaign officials: communications director Palmieri, Clinton campaign manager Robbie Mook, and Jake Sullivan, who at the time was the senior foreign policy adviser to the Clinton campaign. Sullivan now serves as President Joe Biden’s national security adviser.

The email exchange about the now-disproven Alfa Bank allegations took place on Sep. 15, 2016, only four days before Sussmann took the Alfa information to the FBI. Sussmann is charged with having misrepresented who his client was when he took the false Alfa allegations to the FBI.

When questioned by the House Intelligence Committee on Dec. 21, 2017, Sullivan implied he had no direct knowledge of these matters, telling House investigators that Elias would “occasionally give us updates on the opposition research they were conducting.” Sullivan testified that he “didn’t know what the nature of that effort was” or “who was funding it.” He also downplayed any specific insights from Elias, telling House investigators that the information provided by Elias “tended to be pieces of information that I’d heard from reporters as well.”

Despite these claims, Sullivan played a material role in disseminating information regarding the Alfa Bank allegations, a fact that undoubtedly hasn’t escaped Durham’s attention.

Alfa Bank would gain national attention on Oct. 31, 2016, when three separate articles were published. The most cited of these was an article in Slate by Franklin Foer that detailed many of Sussmann’s allegations to former FBI general counsel James Baker. Foer was one of the journalists with whom Sussmann had been in contact during the same period that he was speaking with the FBI.

Immediately following the publication of Foer’s article, Hillary Clinton sent a tweet stating that “computer scientists have apparently uncovered a covert server linking the Trump Organization to a Russian-based bank.” Clinton’s tweet included a statement from Jake Sullivan that claimed, “This could be the most direct link yet between Donald Trump and Moscow.”

Both Sullivan and Palmieri took the lead in briefing the media on the Trump–Russia collusion allegations in 2016. Palmieri wrote about their efforts in March 2017, noting that she and Sullivan “were on a mission to get the press to focus on … the prospect that Russia had not only hacked and stolen emails from the Democratic National Committee, but that it had done so to help Donald Trump and hurt Hillary Clinton.”

CIA Relayed Early Warnings on Clinton Plot to Vilify Trump

Sullivan’s role as a major promoter of the false Alfa Bank allegations is all the more notable in light of a declassified CIA memo that was sent to former FBI Director James Comey and then-Deputy Assistant Director of Counterintelligence Peter Strzok in September 2016.

That memo detailed the intercept of information that Hillary Clinton had purportedly approved “a plan concerning U.S. presidential candidate Donald Trump and Russian hackers hampering U.S. elections as a means of distracting the public from her use of a private email server.”

The contents of the memo were buttressed by the release of handwritten notes taken by then-CIA Director John Brennan at a July 28, 2016, meeting with then-President Barack Obama. The notes show that Brennan shared intelligence with Obama that Clinton had approved “a proposal from one of her foreign policy advisers to vilify Donald Trump by stirring up a scandal claiming interference by the Russian security service.” Comey appears to have been present at the briefing.

Durham’s indictment of Sussmann, along with his subsequent court filings, now confirm that the intelligence Brennan shared with Obama was correct—there was a plan to vilify Trump and that plan was being carried out by Clinton associates such as Sussmann and Joffe. And the CIA’s description of Clinton’s “foreign policy advisor” would appear to match Sullivan’s working title at the time.

The timing of Brennan’s briefing is significant because it came only three days before the FBI officially opened its Crossfire Hurricane investigation into the alleged ties between the Trump campaign and Russia. This also raises questions as to why the Clinton campaign wasn’t investigated by the FBI.

Durham’s indictment also notes that Sussmann took the Alfa Bank allegations, along with “additional allegations” which stemmed from Joffe’s surveillance of Trump’s internet activities at the White House, to the CIA on Feb. 9, 2017. That meeting, which appears to have involved several agency employees, is all the more notable given the CIA’s memo to the FBI regarding allegations that Clinton had approved the plan to vilify Trump.
