No person shall be held to answer for a capital, or otherwise infamous crime, unless on a presentment or indictment of a Grand Jury, except in cases arising in the land or naval forces, or in the Militia, when in actual service in time of War or public danger; nor shall any person be subject for the same offence to be twice put in jeopardy of life or limb; nor shall be compelled in any criminal case to be a witness against himself, nor be deprived of life, liberty, or property, without due process of law; nor shall private property be taken for public use, without just compensation.

Although the popular term right to die has been used to describe the debate over end-of-life decisions, the underlying issues include a variety of legal concepts, some distinct and some overlapping. For instance, right to die could include issues of suicide, passive euthanasia (allowing a person to die by refusal or withdrawal of medical intervention), assisted suicide (providing a person the means of committing suicide), active euthanasia (killing another), and palliative care (providing comfort care which accelerates the death process). Recently, a new category has been suggested—physician-assisted suicide—that appears to be an uncertain blend of assisted suicide or active euthanasia undertaken by a licensed physician.

There has been little litigation of constitutional issues surrounding suicide generally, although Supreme Court dicta seems to favor the notion that the state has a constitutionally defensible interest in preserving the lives of healthy citizens.1 On the other hand, the right of a seriously ill person to terminate life-sustaining medical treatment has been addressed, but not squarely faced. In Cruzan v. Director, Missouri Department of Health,2 the Court, rather than directly addressing the issue, assume[d] that a competent person [has] a constitutionally protected right to refuse lifesaving hydration and nutrition.3 More importantly, however, a majority of the Justices separately declared that such a liberty interest exists.4 Yet, it is not clear how actively the Court would seek to protect this right from state regulation.

In Cruzan, which involved a patient in a persistent vegetative state, the Court upheld a state requirement that there must be clear and convincing evidence of a patient’s previously manifested wishes before nutrition and hydration could be withdrawn. Despite the existence of a presumed due process right, the Court held that a state is not required to follow the judgment of the family, the guardian, or anyone but the patient herself in making this decision.5 Thus, in the absence of clear and convincing evidence that the patient had expressed an interest not to be sustained in a persistent vegetative state, or that she had expressed a desire to have a surrogate make such a decision for her, the state may refuse to allow withdrawal of nutrition and hydration.6

Despite the Court’s acceptance of such state requirements, the implications of the case are significant. First, the Court appears, without extensive analysis, to have adopted the position that refusing nutrition and hydration is the same as refusing other forms of medical treatment. Also, the Court seems ready to extend such right not only to terminally ill patients, but also to severely incapacitated patients whose condition has stabilized.

Under the agreement, locked in during a rare all-night session, the Senate will vote on Cruz's legislation on sanctions related to the construction of the pipeline, which allows Russia to deliver natural gas to Germany, by Jan. 14. It will need 60 votes to ultimately pass.

The deal comes after days of negotiations between Cruz and Senate Majority Leader Charles Schumer (D-N.Y.) that seemed to routinely yo-yo, even in the hours leading up to the agreement, from stalemate to progress and back again.

Cruz put a wide-ranging hold on Biden's State and Treasury nominees earlier this year, vowing to maintain the blockade until the Biden administration imposes congressionally mandated sanctions on the pipeline.

A hold by a senator doesn't prevent the nominees from being confirmed if they have the support of 50 senators, but it does require leadership to eat up floor time in order to get a final vote.

Cruz, even while largely maintaining his holds, has also let some nominees be cleared easily, including former Sens. Jeff Flake (R-Ariz.) and Tom Udall (D-N.M.), who were confirmed to be the ambassadors to Turkey and New Zealand, respectively.

US ‘Cannot Be Certain’ of Military Victory Against China: Report

The United States cannot be assured of victory in the event of war with China, according to a new report by an influential U.S. congressional advisory body.

The analysis by the U.S.-China Economic and Security Review Commission (USCC) comes amid rising concerns that the United States could be drawn into a war over the future of the self-governed island of Taiwan, which China’s communist regime considers to be a breakaway region.

The report was delivered just two days after the first virtual summit between President Joe Biden and Chinese Communist Party (CCP) General Secretary Xi Jinping, which failed to deliver any concrete breakthroughs on a range of tensions between the two countries.

“Just as General Secretary Xi and other Chinese leaders cannot be certain the PLA [People’s Liberation Army] would prevail in a war, leaders in the United States and Taiwan cannot be sure their militaries would deter or defeat the PLA,” the report said.

The bipartisan report found that, for the first time, the Chinese military was prepared to successfully carry out an invasion of Taiwan regardless of the intervention of the United States. It also found that efforts to modernize China’s military and expand its nuclear capabilities had increased the risk of such a war.

PLA Modernizing to Annex Taiwan

“The Chinese are at or near an initial invasion capability,” said commissioner and former Senator Jim Talent during a Nov. 17 launch event for the report. “Which means the ability to conduct a land invasion of Taiwan, even assuming American intervention, albeit at very high risk.”

That conclusion is in line with other analyses, such as a recent report published by Taiwan’s Ministry of National Defense, which said that the PLA could effectively blockade the island’s ports and airports, stymieing American and allied efforts to assist the island in wartime.

Likewise, the USCC report is not the first time that the feasibility of American victory in a war with China has been called into question.

Rep. Mike Gallagher (R-Wis.) said in October that the United States would “probably lose a war” with China if such a conflict were to happen before the construction of new naval vessels slated for the 2030s.

Those comments in turn reflected findings from results of a wargame that suggested the United States would struggle to meaningfully respond to limited military action by the PLA in the Indo-Pacific. It also underscored a growing concern in the defense and security sectors with apparent U.S. military decline in the face of unprecedented PLA expansion.

Republicans introduced legislation in early November that would send billions of dollars to Taiwan every year to increase its asymmetrical military capabilities, but the likelihood that the small island could sustain a defense against a PLA invasion, much less repel it, is slim.

The report also found that the PLA’s modernization efforts, including rapid expansions of its amphibious assault and nuclear capabilities, placed the continued deterrence of conflict in the Taiwan Strait in a place of “dangerous uncertainty.”

“Improvements in China’s military capabilities have fundamentally transformed the strategic environment and weakened the military dimension of cross-strait deterrence,” the report said.

“China’s increasingly coercive approach to Taiwan puts almost daily pressure on the cross-Strait status quo and increases the potential for a military crisis.”

The report noted that China’s defense industry could surge construction of additional naval fleets. Further, it said that the PLA’s modernization was designed “with the explicit goal of developing the capability to forcibly annex Taiwan.”

The report found that, in addition to achieving initial capability for a successful invasion of Taiwan, the Chinese regime was also growing increasingly likely to pull of such move. There was a risk, it warned, that a failure by U.S. leadership to demonstrate adequate resolve could encourage just such an action.

“A deterrence failure is most likely to occur if Chinese leaders believe the United States is not militarily capable of or politically willing to intervene, or if they interpret ambiguities in U.S. policy to mean that opportunistic Chinese aggression against Taiwan will not provoke a decisive U.S. response.”

Regime’s Nuclear Arsenal Growing and Improving

The risk of a CCP-driven conflict is not limited to Taiwan, however. The report also detailed and reflected the difficulties associated with confronting a global China with increased nuclear capabilities.

Experts have warned that the CCP is in a “sprint” to nuclear superiority, and a Pentagon report released in October found that China’s military would likely have 1,000 nuclear warheads by 2030. Likewise, Sen. Angus King (I-Maine) said that the CCP was uninterested in nuclear non-proliferation.

The USCC report confirms those views and builds upon them.

“China’s nuclear buildup puts it on a path to become a qualitative nuclear peer of the United States in around a decade, with a similarly diversified, precise, and survivable force,” the report said.

The report stated that the CCP is moving beyond its former policy of minimum deterrence, seeking greater nuclear capabilities and capacity than are needed to dissuade enemies from a war. Moreover, the regime would not engage meaningfully in arms control agreements, viewing them as a “trap” designed to prevent China from achieving global dominance.

The report also noted that the regime was developing new hypersonic abilities but, likely due to time constraints on publication, did not analyze the regime’s recent test of a nuclear-capable hypersonic weapon, which one U.S. diplomat said the United States did not know how to defend against.

Risk of Nuclear War at New High

The report found that the risk of nuclear conflict was increasing, and that the development of capabilities such as the hypersonic test, as well as the regime’s military and diplomatic posture “suggests it could also be intended to support a new strategy of limited nuclear first use.”

“Such a strategy would enable Chinese leaders to leverage their nuclear forces to accomplish Chinese political objectives beyond survival, such as coercing another state or deterring U.S. intervention in a war over Taiwan,” the report said.

Recent remarks about the hypersonic weapons test by Gen. John Hyten, the outgoing vice chairman of the Joint Chiefs of Staff, echoed the findings of the report regarding nuclear first use.

“They look like a first-use weapon,” Hyten said during an interview with CBS. “That’s what those weapons look like to me.”

Additionally, the USCC believed that the buildup and modernization could increase the potential for conventional warfare throughout southeast Asia, as the regime’s new nuclear weapons could be used to shield it from intervention from larger nations.

“There is a concern that China’s buildup is intended, and we don’t know this, but it may be intended to make the region safe for conventional warfare or coercion on the part of China,” said Commissioner Alex Wong during the launch event.

“China’s growing nuclear arsenal could embolden it to pursue coercion or conventional aggression against U.S. allies and partners if Chinese leaders believe their nuclear arsenal will deter the United States from intervening on these countries’ behalf,” the report said.

Another problem compounding the risk of nuclear catastrophe was the CCP’s adoption of so-called “launch-on-warning” protocols, in which several nuclear warheads are prepared in advance to be launched in response to a warning that the nation is under nuclear attack.

As the name implies, launch-on-warning systems fire a retaliatory nuclear strike upon simply a warning of a nuclear strike, rather than waiting for confirmation of a nuclear detonation.

The CCP’s lack of transparency about its launch-on-warning systems or engagement in arms control talks meant that the Commission could not be sure if the Chinese regime had the appropriate technologies and protocols to prevent an accidental nuclear launch.

“It’s unclear whether China has the right protocols and command and control to prevent miscalculation, or an inadvertent launch, or a launch that’s not warranted from a perceived threat from the United States or other nuclear powers,” Wong said.

In all, the Commission recommended that the United States increase investments in developing a comprehensive diplomatic strategy, organize more nonproliferation agreements, and modernize the U.S. nuclear arsenal, in order to avoid a war the nation may not be able to win.

“The risks of a nuclear exchange between China and the United States are higher today than in the past,” the report said.

“If Chinese leaders have already changed their strategy without declaring they have done so, they could be much more likely to intentionally threaten or use nuclear weapons to achieve their regional objectives, such as deterring or degrading intervening U.S. forces in a conventional war over Taiwan they fear they could lose.”

Russia Formally Quits 'Open Skies' Treaty, Saying There's No Point Without US

On Saturday Russia's Foreign Ministry issued a statement declaring it has formally ceased participation in the 'Treaty on Open Skies' - a belated move which follows the United States already having withdrawn during the last year of the Trump administration.

The Kremlin says that without Washington, there's little reason to continue Russian participation, despite the more than two dozen other participating nations. "We respect the decision of the participating States remaining in the Treaty to continue its implementation. We wish them constructive and fruitful collaboration," a formal statement reads. "However, it is obvious that without the participation of the United States and our country, the effectiveness of the Treaty on Open Skies will decrease sharply: the area of application will drop by about 80 percent, and the number of Open Skies missions planned for 2022 will severely decrease," the ministry said.

Initiated in 1992 and then ratified in 2002, it allowed the 35 member states that eventually joined it to conduct short-notice, unarmed observation flights to monitor other countries' military operations in mutual verification of arms-control agreements. Russia says that nearly 450 reconnaissance flights were allowed over its territory since the treaty was initiated three decades ago.

The treaty even allowed Russian recon flights over tightly restricted Washington D.C. airspace — in past years Russian Tupolev Tu-154s have even flown at low altitude over such sensitive sites as Andrews Air Force Base in Maryland, the US Capitol, the Pentagon, and CIA headquarters in Langley. Starting in May 2020, when Trump first announced the US intent to withdraw, US officials previously said of Open Skies that the US essentially "get nothing out of it" while it potentially exposes national security secrets to broad Russian surveillance.

Moscow is now throwing up its hands, saying without US participation, it too really gets nothing out of it. "Decades of fruitful implementation of the Treaty on Open Skies showed that it served well as a tool for strengthening confidence and security, creating additional opportunities for an objective and unbiased assessment of the military potential and military activities of the participating States," the foreign ministry emphasized, according to an English translation of the statement in state media.

The new statement puts blame for the collapse of what was meant as a post-Cold War era 'confidence building' treaty (along with the INF Treaty, also dead), squarely on Washington's shoulders.

"Full responsibility for the degradation of the agreement lies at the feet of the initiator of the collapse of the Treaty on Open Skies: the United States of America," the ministry said. Interestingly, within the US government, the statement alludes further "to the internal struggle of various influence groups in the United States, in which the hawks took over."

White House May Redirect Military Equipment To Ukraine

The Biden administration is mulling a plan which would redirect helicopters and other military equipment, that was once bound for the now-defunct Afghan military, to Ukraine, in an effort to quickly bolster its defenses amid an ongoing buildup of Russian troops near the border, according to the Wall Street Journal.

Pentagon officials 'generally' support giving more arms to Ukraine, however the National Security Council has yet to approve the delivery. Meanwhile, the White House continues to seek a diplomatic solution to encourage Moscow to back off, according to US officials.

The military kit previously earmarked for the Afghan National Security Forces includes Russian-made Mi-17 helicopters, U.S. officials said. The helicopters would provide more mobility for Ukrainian forces, which have a large front to defend and lost aircraft in clashes in 2014 when Russia annexed Crimea and pro-Moscow separatists rebelled in Ukraine’s east.

Ukrainian officials have also been lobbying the administration for air-defense systems, including Stinger surface-to-air missiles, that would help them defend their country against Russian aircraft, a Ukrainian official said. The country currently uses Soviet-era systems, which have been modernized but lag behind some of the high-tech equipment used by the Russian military. -WSJ

According to a NSC spokesman, "We continuously assess additional military assistance packages," adding that $2.5 billion in military aid has already been provided to Ukraine since 2014 - which includes $450 million this year.

The NSC may be cautious, however, as stepped up arms shipments may escalate tensions with Moscow, according to some members of Congress and government officials.

Last month, a bipartisan group of lawmakers traveled to Ukraine on a fact-finding mission, only to report back that Biden's threat of economic sanctions on Russia wasn't going to be enough to deter a potential Russian attack. Their solution? Sanctions and accelerated military support which would include air-defense systems and antiship missiles.

"I want to give the Ukrainians defensive weapons that will have a high cost in terms of Russian casualties," said Rep. Seth Moulton (D-MA), one of the officials on the trip who insists that the US needs to now focus "on deterring a conflict from happening versus responding to a conflict if it does happen."

"The problem is more bureaucracy. It just seems like it’s taking a long time to just deliver the damn weapons. We’re just running out of time here. We need to speed things up," he added.

Russian President Vladimir Putin, meanwhile, has been making public demands - including that NATO back off its eastward expansion which would include granting membership to Ukraine.

Russian reaction to US 'state sponsor of terrorism threat'

A leading Russian senator has responded to a new proposal from American legislators to brand Moscow a “state sponsor of terrorism,” warning that the idea would weaken cooperation between Moscow and Washington.

“This initiative will undermine dialogue between Russia and the US if it’s adopted,” Sergey Tsekov, who sits in the upper house of Russia’s parliament, told RIA Novosti on Thursday. “It is characteristic of a certain strand of the American political elite.”

Tsekov, a member of the ruling United Russia party, claimed Moscow is only interested in self-defense, adding that his country doesn’t interfere in the affairs of sovereign states and respects other nations’ rights. “And now they’re calling us a sponsor of terrorism,” he complained, insisting Washington is a greater contributor to instability.

He said the American senators’ proposal, which would provide hundreds of millions of dollars in military aid to Ukraine in an effort to contain Moscow, would be paying “not for peace, but for war,” and lamented what he sees as the powerful American government’s propensity for starting conflicts.

“Just the voicing of such proposals makes the situation in Ukraine more difficult, giving support to the ‘party of war,’” he went on.

The lawmaker said he hopes American President Joe Biden will not support the bill. He noted that the US leader recently had a video call with his Russian counterpart, Vladimir Putin, in which the two agreed to try to find a diplomatic solution to the ongoing conflict in Ukraine’s eastern Donbass region. He added that he believes there are enough intelligent people working in Biden’s administration to realize that a war in Ukraine would compromise the safety of the US itself “in the context of global security.”

On Wednesday, eight American Republican party senators submitted a bill, speculatively titled the ‘GUARD Act’, containing a range of measures designed to support Kiev. The proposed legislation would authorize an additional $450 million in military aid and impose new sanctions on Nord Stream 2, the recently constructed pipeline that will bring Russian gas to Europe through the Baltic Sea, which Ukraine and the US have strongly opposed.

The bill would also officially designate Russia as a “state sponsor of terrorism” if Moscow advances militarily on its eastern European neighbor. In recent weeks, American and Ukrainian intelligence services have accused the Kremlin of “aggressive actions” on the border with Ukraine, including troop buildup, and said they suspected a Russian invasion could be in the works.

Moscow has consistently denied the accusations, calling the reports “American disinformation,” and said pledges to support Ukraine are dangerous because they could push Kiev towards a military solution in the country’s war-torn Donbass region.
