Minnesota court rules rape charge doesn't apply if the victim got willingly drunk

The Minnesota Supreme Court on Wednesday ruled that a man who had sex with a woman while she was passed out on his couch cannot be found guilty of rape because the victim got herself drunk beforehand.

The big picture: Minnesota is one of the many states that says that for a victim to be too mentally incapacitated to give consent, they must have become intoxicated against their will, such as if a person secretly drugged someone's drink, The Washington Post reports.

Context: Francios Momolu Khalil in 2017 picked up a woman from a Minneapolis bar and took her back to his home. The woman "blacked out" on Khalil's couch and woke up to find him allegedly sexually assaulting her, per The Post.

A jury in 2019 convicted Khalil of third-degree criminal sexual conduct. His lawyers appealed the decision saying that the charge was not applicable because that statute applies when the victim took drugs or alcohol without their consent, while the woman in this case had taken five vodka shots herself prior to meeting Khalil.

If a person is convicted of the third-degree charge, they could face up to 15 years in prison, pay a fine of no more than $30,000, or both.

The state Supreme Court overturned the conviction and gave Khalil a new trial, arguing that the prosecution's explanation of the charge "unreasonably strains and stretches the plain text of the statute," state Justice Paul Thissen wrote, per the Duluth News Tribune.

The court said that Khalil could be charged with fifth-degree criminal sexual conduct, a gross misdemeanor. If convicted, he would face up to one year in prison, a fine of no more than $3,000 or both.

Worth noting: The Minnesota House of Representatives is currently considering a bill that would change the language of the third-degree criminal sexual conduct statute, the Duluth News Tribune reports.

It would make it a crime to have sex with someone who is too incapacitated to give consent, regardless of how they got to that state.

The Department of Defense is embarking on one of the widest internal purges in US history.

Secretary of Defense Lloyd Austin has made "combating extremism" in the armed forces his number one priority, but Austin and his supporters in the intelligence community have been vague about what exactly they mean.

A Defense Advanced Research Projects Agency (DARPA) document leaked to Politico titled "Extremism and Insider Threat in the DoD" finally answers the question.

According to DARPA, patriots, white advocates, Christians, and "anti-feminists" all qualify as extremists subject to punishment and expulsion. Anarchists, environmentalists, animal welfare activists but not Black Lives Matter are also on the list.

The guidelines describe patriot "domestic extremists" as holding an ideology that states "the US government has become corrupt, has overstepped its constitutional boundaries or is no longer capable of protecting the people against foreign threats." Oathkeepers, Proud Boys and Boogaloo Bois are put in this category.

DARPA's "racial and ethnic supremacy" section only includes symbols belonging to white groups, many of them no longer operation, such as Identity Evropa or the Aryan Nations.

Most puzzling and overreaching is the inclusion of Christians who oppose abortion, gay marriage or transgenderism. Almost half of all US military recruits are from the South, where there are many Christians with socially conservative beliefs.

Almost amusing is the "anti-feminist" designation, which describes involuntary celibates ("incels") as a national security threat. The fixation on incels is not based on any legitimate data or intelligence assessment. It is included thanks to lobbying from the Anti-Defamation League, which reveals a lack of seriousness at the Pentagon.

It's safe to say that under these rules, the majority of Americans and thus servicemen are domestic extremists. How it is possible to boot every soldier who doesn't approve of transgenderism or has posted Pepe the Frog on their social media without basically destroying the military has not been specified by Austin or the Pentagon, but he apparently is defering to unit commanders to enforce the new rules however they see fit.

Many conservatives are complaining about the military becoming "woke," but this is just a symptom of a broader problem: every institution in American life has become woke.

Because the US armed forces are utilized by the Zionist lobby to protect Israel in the narrow sense and the Jewish liberal order in the broader sense, the military has for years been allowed to engage in "problematic" practices such as placing enlistees based on the results of their IQ tests that would lead to Civil Rights lawsuits in other areas of American life.

Now it appears that the Pentagon, forced to pull back from foreign military adventures in Asia and Africa, is transforming the military into a weapon to conscript for their culture war against the American people.

“Pfizer, Moderna, Johnson and Johnson, AstraZeneca, none of those have deferral times,” Williamson said. “So if you get it and you’re feeling healthy and well, you can give blood.”

For people who have been vaccinated and want to give blood, the Red Cross asks donors to know which vaccine they received, otherwise there could be a wait.

“The only thing that we’re asking donors to do is to know which type of vaccine they got,” Williamson said. “If you don’t know the vaccine when you show up to give blood, we’ll have to defer you for two weeks.”

He also want’s people to know that giving blood will not affect how well their vaccine works in protecting the body from the coronavirus.

“This vaccine, similar to other vaccines that we’ve had, measles and others that we’ve known, it generates an immune response,” Williamson said. “And your immune system is not impacted by blood donations.”

I think there should be moar patriots joining up rn as opposed to the notion that it's fucked and can't be fixed. The only way to solve a problem this large is from within and to think that Every single servicemember agrees with this woke wave of nonsense infesting our armed forces is kind of a stretch. Make use of camo and lie about your beleifs upon enlistment (ie "yeah I love trannys and hate anyone who is anti-feminist! Hoo-rah!"). You can still hold onto your core beleifs without telling your higher ups exactly how you feel. Work your way up and create change from within. That's what true bravery would look like in terms of joining the MIL rn, leaving it up to others who hate you for your ideas will only end badly.
