The beloved 83-year-old US Air Force veteran who was randomly shoved onto subway tracks by an illegal migrant in Manhattan has died from his injuries — and his alleged killer has been charged with murder.

Grandfather and cancer survivor Richard Williams on March 17 tragically succumbed to injuries he suffered nearly 10 days earlier when he was pushed off the platform while waiting for a train at the Lexington Avenue-63rd Station, authorities and sources said.

The Manhattan District Attorney’s Office on Wednesday upgraded the charges against his alleged attacker, Honduran national Bairon Hernandez — a “serial criminal” with a lengthy rap sheet of at least 15 charges, according to the feds.

Jhon Pena, 30, was also allegedly shoved onto the tracks by Hernandez during the March 8 Upper East Side subway rampage — but ignored his own injuries and heroically helped pull Williams back onto the platform moments before a train rolled into the station.

Chilling cellphone footage of the attack, apparently shot by Pena from the train tracks, showed the suspect casually strolling along the platform after pushing both men onto the subway bed.

Pena’s mother, Claudia Pena, told The Post on Thursday his son didn’t know Williams had died.

Hernandez, 34, was arrested March 10 at a homeless shelter and initially charged with attempted murder, attempted assault, assault and reckless endangerment.

He was indicted on upgraded charges of second-degree murder following Williams’ death, and was set to be arraigned in Manhattan Supreme Court on March 30, according to DA Alvin Bragg’s office.

Prosecutors had said Williams was left “brain-dead,” following the harrowing unprovoked attack.

One of this three daughters, Debbie Williams, told The Post days after the attack her father, a retired US Air Force pilot, was not likely to pull through.

The medical examiner declared his death a homicide.

Williams “loved the streets of New York” and traveling in the transit system. He’d been happily married for 55 years and had just won a five-year battle with prostate cancer six months ago, giving him a new lease on life, his family has said.

“He overcame everything,” another daughter, Diane Williams, 58, previously said. “He got re-birthed. He felt optimistic about him and his wife, who he adores tremendously.”

“My father is a phenomenal human being and nobody deserves being pushed like that,” Debbie Williams had said — along with some choice words for his accused killer.

“I want him to go to the Venezuela prison, the worst place he could go to,” she said. “I want him to suffer for the rest of his life. Prison justice would be appropriate.”

The US Department of Homeland Security said Hernandez had past arrests for aggravated assault, possession of a weapon and domestic violence.

He had been deported from the US four times after entering the US illegally in 2008, but kept returning to the country illegally, according to the DHS.

His most recent deportation was in 2020 at the end of the first Trump administration. It’s unclear when he re-entered the country.

“We have no comment at this time,” his defense attorney Mitchell Schuman said Thursday. “We have yet to see the indictment, concluded our investigation or reviewed the expected voluminous discovery materials.”

Williams’ relatives didn’t comment on his death, but previously described his zest for life and independence, even as an octogenarian.

“He loved the city. He loved Manhattan,” Diane said. “He loved, loved traveling on the subway. He loved talking to people.”

MEMORANDUM FOR THE SECRETARY OF HOMELAND SECURITY

THE DIRECTOR OF THE OFFICE OF MANAGEMENT AND BUDGET

Paying Our Great Transportation Security Administration Officers and Employees

As the Democrat-caused shutdown of the Department of Homeland Security (DHS) continues well into its sixth week, America’s air travel system has reached its breaking point. This is an unprecedented emergency situation. Currently, more than 60,000 Transportation Security Administration (TSA) employees, including approximately 50,000 transportation security officers who perform security functions at domestic airports, are not being paid due to congressional Democrats’ reckless decision to prioritize criminal illegal aliens over American citizens and shut down DHS until their demand to prohibit enforcement of Federal immigration law is met.

Since the shutdown began, nearly 500 transportation security officers have left their positions, and thousands more have begun to call out sick at record rates due to lack of pay. As a result, security wait times at some airports have reached untenable lengths of three or more hours. These increased wait times, combined with declining morale among TSA staff, unacceptably heighten the risk of security vulnerabilities within our domestic travel system and has negatively impacted countless Americans.

If Democrats in the Congress will not act to honor the service of our TSA officers, who are now performing their critical public safety responsibilities without knowing whether they will be able to buy food for their families or pay their rent, then my Administration will take action. As President of the United States, I have determined that these circumstances constitute an emergency situation compromising the Nation’s security.

Accordingly, I hereby direct the Secretary of Homeland Security, in coordination with the Director of the Office of Management and Budget, to use funds that have a reasonable and logical nexus to TSA operations to provide TSA employees with the compensation and benefits that would have accrued to them if not for the Democrat-led DHS shutdown, consistent with applicable law, including 31 U.S.C. 1301(a).

Once regular funding for TSA has been restored, every effort should be made, as authorized by law, to adjust applicable funding accounts within DHS to ensure the continuation of DHS operations and activities consistent with planned expenditures prior to the lapse.

Nothing in this memorandum shall be construed to impair or otherwise affect the authority granted by law to an executive department or agency, or the head thereof; or the functions of the Director of the Office of Management and Budget relating to budgetary, administrative, or legislative proposals. This memorandum shall be implemented consistent with applicable law and subject to the availability of appropriations. This memorandum is not intended to, and does not, create any right or benefit, substantive or procedural, enforceable at law or in equity by any party against the United States, its departments, agencies, or entities, its officers, employees, or agents, or any other person.

Florida Democrat found guilty of House Ethics violations

Rep. Sheila Cherfilus-McCormick illicitly funneled millions of dollars to her campaign and committed various campaign finance infractions, a bipartisan House Ethics subcommittee determined Friday — likely laying the groundwork for a vote by the full legislative body to expel the embattled Florida Democrat.

The panel’s adjudicatory subcommittee, led by House Ethics Chair Michael Guest (R-Miss.), deliberated well past midnight following an hours-long hearing that served as the panel’s first public “trial” in nearly 16 years. It found “clear and convincing” evidence that Cherfilus-McCormick was guilty of all but two of the 27 counts that had been brought against her.

“Shortly after the House returns from the April recess, the full Committee will hold a hearing to determine what, if any, sanction would be appropriate for the Committee to recommend,” Guest and the panel’s top Democrat, Mark DeSaulnier of California, said in a joint statement.

“I look forward to proving my innocence,” Cherfilus-McCormick said in a statement. “Until then, my focus remains where it belongs: showing up for the great people of Florida’s 20th District who sent me to Washington to fight for them.”

The three-term lawmaker, who is also facing related criminal charges in her home state, did not vote Friday morning on the House floor.

House GOP leadership believes that they have the votes to expel Cherfilus-McCormick, should the panel recommend such a punishment. Her removal would require a two-thirds vote — meaning some Democrats would need to support that effort — as opposed to the simple majority vote required for much of the House’s business.

So Democrats will soon have to decide whether to stand with one of their members or accept the findings of the Ethics Committee and support whatever punishment it recommends. It’s possible the panel suggests the full House vote to expel the three-term lawmaker. But, if members opt for a more lenient penalty like a reprimand or a censure, Rep. Greg Steube (R-Fla.) says he’s prepared to force a vote on expulsion, anyway.

The last time the House voted to oust a colleague was with former Rep. George Santos (R-N.Y.) in 2023. He was ultimately sentenced to prison for wire fraud and aggravated identity theft only to have his sentence commuted by President Donald Trump.

House Democrats were largely silent Friday morning following the adjudicatory subcommittee’s announcement of its guilty verdict. Many said they still needed to read the findings and were otherwise unprepared to weigh in.

“As I understand it, the Ethics Committee has one final step in their process, so I’m not going to get out ahead of the Ethics Committee process that will be completed upon our return,” House Minority Leader Hakeem Jeffries (D-N.Y.) told reporters. “And then I’ll have more to say.”

Another senior member of the House Democratic leadership team, Rep. Joe Neguse of Colorado, said he “intends to review” the verdict then “issue a statement.”

The lack of immediate public outrage from inside the Democratic Caucus caught notice of the National Republican Congressional Committee: “Their silence is a choice. Democrats can stand for accountability or keep protecting a proven ethics violator, but voters won’t forget it,” said NRCC spokesperson Mike Marinella in a statement Friday.

But Rep. Marie Gluesenkamp Perez (D-Wash.), who recently led a charge to force a vote on the floor to reprimand fellow Democratic Rep. Chuy García of Illinois for orchestrating his chief of staff’s ascension to succeed him in retirement, was unequivocal.

“You can’t crime your way into legitimate power,” the moderate lawmaker wrote in a post on X. “Since she was found guilty, she should resign or be removed.”

And Rep. Mark Takano of California, the top Democrat on the Veterans’ Affairs Committee, said a bipartisan recommendation from the Ethics Committee would be “pretty compelling.”

Elijah Manley, Cherfilus-McCormick’s primary opponent, in a statement Friday was unsurprisingly unsympathetic and eager for the incumbent to now step aside.

“At this juncture, the congresswoman was found guilty by a committee of her peers in the House of serious misconduct and must resign from Congress immediately,” said Manley, who traveled to Washington to sit in the front row during Thursday’s hearing.

Cherfilus-McCormick and her attorney sat before the House Ethics adjudicatory subcommittee across more than six and a half hours Friday afternoon and evening, at which point members went into a closed session and deliberated until 2 a.m., according to a person granted anonymity to share details of the private process.
