UK Comedian Tony Knight Dies In “Freak Accident” At 54

By Denise Petski

July 5, 2024 2:32pm

UK comedian Tony Knight, also known as the Dog Listener, has died after a freak accident at a festival in France. The 54-year-old Knight was struck and killed by a large falling tree branch in June at the Rock & Cars fest in Lavaur, a family member confirmed to Fox News Digital.

According to French outlet Le Tarn Libre, two branches fell off a large tree on the festival grounds, killing Knight and injuring four others.

“He was fit, healthy, happy and had everything going for him,” wrote Joanne Allen, sister of Knight’s longtime partner Hayley Wright on Knight’s GoFundMe page. “He was charismatic, funny, passionate and so very loved by Hayley, his family and his friends all over the world.”

In addition to his work as a comedian, Knight turned his passion for dogs into a second career as a dog trainer. “He helped people all over the world with his classes both in person, online, on radio and television, ebooks, and more,” Allen wrote. “He was very well respected and admired. His method worked and he loved helping people with their dogs.”

Knight had performed his comedy show Mad Dogs and an Englishman at venues in Australia and overseas and was about to do a run of shows throughout the UK, Allen wrote.

“We are beyond devastated that his life was taken by a freak accident,” Allen added, “an accident that we are all still trying to comprehend.”

His partner Hayley penned a tribute to Knight a few days after his death on Instagram.

“He was an exceptionally talented man, with so many strings to his bow,” she wrote. “There really was nothing he couldn’t do. He was a fantastic friend to so many, an amazing dog Dad….but most of all he was my world & it will never be the same without him.”

“He would probably end this with a joke, but that was his talent & not mine….he really did see the bright side of every situation. I’m truly heartbroken & in shock,” she concluded.

Donald J. Trump

@realDonaldTrump

Crooked Joe Biden should ignore his many critics and move forward, with alacrity and strength, with his powerful and far reaching campaign. He should be sharp, precise, and energetic, just like he was in The Debate, in selling his policies of Open Borders (where millions of people, including record numbers of Terrorists, are allowed to enter our Country, from prisons and mental institutions, totally unchecked and unvetted!), to Ending Social Security, Men playing in Women’s sports, High Taxes, High Interest Rates, encouraging a Woke Military, Uncontrollable Inflation, Record Setting Crime, Only Electric Vehicles, Subservience to China and other Countries, Endless Wars, putting America Last, losing our Dollar Based Standard, and so much more. Yes, Sleepy Joe should continue his campaign of American Destruction and, MAKE CHINA GREAT AGAIN!

SSCI Chairman Senator Mark Warner Organizing Democrat Consultation on the Risk Joe Biden Represents

July 6, 2024 | Sundance | 66 Comments

The Senate Select Committee on Intelligence (SSCI) is the center of the silo network that supports the Intelligence Community control over U.S. political outcomes. SSCI Chairman MarkWarner has been the leading organizer of the IC efforts to interfere in USA politics since 2015.

Senator Mark Warner was selected by the DC system to represent the IC interests when Donald J Trump became the leading candidate for the 2016 election. Warner was quickly installed to replace Senator Dianne Feinstein on the SSCI immediately following the 2016 election outcome.

From his position within the IC silo, Warner led the legislative effort to frame Trump for the Russia Collusion hoax. His efforts to support the IC have been fully immersed thereafter and continue through today. The IC is concerned that Biden now represents a risk to their system of control.

As a direct result, Warner is now activated to lead the consultation conversation about how to mitigate damage and proactively protect the IC interests.

WASHINGTON DC – WASHINGTON (Reuters) – U.S. Senator Mark Warner on Tuesday was contacting some fellow Democratic senators to invite them to a possible meeting on Monday to discuss President Joe Biden’s presidential campaign, a source familiar told Reuters.

The source did not elaborate or say whether Warner was trying to organize a group of senators to pressure Biden to quit the race.

The Washington Post reported on Friday that Warner was trying to put together a group of Democratic senators who would ask Biden to end his presidential campaign. (READ MORE)

Ukraine The Crisis – Zelenskyy Spox Refutes Tucker Carlson Claim About Interview Agreement

July 6, 2024 | Sundance |

Tucker Carlson announced a potential interview with Volodymyr Zelensky only to have the spokesperson for Zelensky refute the assertion.

The people for Zelenskyy later denied any agreement for an interview. Per Politico: “Volodymyr Zelenskyy’s office denied Thursday that the Ukrainian president had agreed to a sit-down interview with American right-wing pundit Tucker Carlson.”

“The President of Ukraine has a completely different schedule, and Tucker Carlson is not on it,” presidential spokesperson Sergii Nykyforov said Thursday morning, while casting doubt on Carlson’s Ukrainian sources. (read more)

Given what I have personally witnessed and discovered about the conflict in Ukraine, I could not see Zelenskyy giving Tucker Carlson an interview. Almost everything we see about the USA/Ukraine -v- Russia conflict is through the highly controlled prism of the U.S State Dept.

Again, I would emphasize…. have we seen one front line report from any USA MSM outlet? One report from the trenches, bunkers or on-the-ground action from near the front lines of the conflict? No, no we have not. No reporters with helmets and flak jackets giving breathless reports from the fields and battlegrounds. Nothing.

Meanwhile, Hungarian President Viktor Orban is trying to end the conflict and the Ukraine officials do not want the ping-pong battles of drone warfare and guided missiles to stop.

(VIA AP) During his first visit to neighboring Ukraine since Russia’s full-scale invasion, Hungarian Prime MinisterViktor Orbán told President Volodymyr Zelenskyy on Tuesday that the war was Europe’s “most important issue,” and recommended an immediate cease-fire.

Orban is widely seen as having the warmest relations with Russian President Vladimir Putin among European Union leaders, and his visit was a rare gesture in a tumultuous relationship with Ukraine as Budapest has repeatedly leaned toward Moscow. (read more)

MOSCOW (AP) — Hungarian Prime Minister Viktor Orbán visited Moscow on Friday to discuss prospects for a peaceful settlement in Ukrainewith Russian President Vladimir Putin, a rare trip to Russia by a European leader that drew condemnation from Kyiv and European leaders.

Orbán’s visit comes only days after he made a similar unannounced trip to Ukraine, where he met with President Volodymyr Zelenskyy and proposed that Ukraine consider agreeing to an immediate cease-fire with Russia.

“The number of countries that can talk to both warring sides is diminishing,” Orbán said. “Hungary is slowly becoming the only country in Europe that can speak to everyone.”(read more)

Many people are saying that Viktor Orban may be one of only a few men capable of stopping the bloodshed in Ukraine. Perhaps that is true; however,I strongly believe that the ultimate decisionmakers who will end the Russia -v- Ukraine conflict is not an EU leader, but rather the American voters.

The day after Donald Trump wins the November 2024 election, everything changes.

The pathway to peace in Ukraine will immediately begin if President Donald

Trump wins the election.

“Peace is the prize” ~ Donald Trump

That’s the non-pretending reality of the situation…..

…. And every pragmatic and intellectually honest person in the EU says the same!

"He's toast": Biden's ABC interview flops with Hill Democrats

Andrew Solender July 6, 2024 (1 hour ago)

President Biden's interview with ABC News' George Stephanopoulos did little to tamp down mounting concerns from Democratic members of Congress about his ability to defeat former President Trump.

Why it matters:Four House Democrats have publicly called for Biden to step down from the ticket, with lawmakers saying they expect more to follow soon.

• "The drip drip is about to be more than that," said one.

• Another told Axios: "We'll certainly amp up the public pressure as needed."

Driving the news: In the 22-minute interview, Biden insisted he has the stamina to take on Trump and refused to take a cognitive test.

• The president rejected polls indicating he's trailing his Republican rival and minimized the extent to which his Democratic allies have pressured him to withdraw from the race.

• And Biden made clear he's not dropping out: "If the Lord Almighty came down and said 'Joe, get out of the race,' I'd get out of the race. The Lord Almighty's not coming down."

What we're hearing:"No one's mind has been changed," a House Democrat said, adding that a growing number of lawmakers agree "it's time" for Biden to step aside and are "hoping to give him space to do this on his own."

• Another House Democrat said their colleagues feel Biden's interview was "not impressive" and that "he's toast" in November.

• Said a third: "The interview hardly inspires confidence. It changes nothing."

• A fourth House Democrat said they were "shocked" by Biden's "refusal to recognize reality" in terms of polling and his "failure to make an argument about why he wants a second term."

The other side:The Biden campaign painted the interview as energetic and eloquent, arguing the president laid out a clear case for a second term.

• They also pointed to statements of support and approval from lawmakers like Sens. John Fetterman (D-Pa.) and Chris Coons (D-Del.), and Reps. Haley Stevens (D-Mich.) and Sheila Jackson Lee (D-Texas).

• Rep. Brad Sherman (D-Calif.) said Biden did a "very good job" but that he wants to see an "extended live interview that focuses on where Biden plans to lead us over the next four years."

• More broadly, Rep. Frederica Wilson (D-Fla.) criticized colleagues who have pressed Biden to drop out as "undermining this incredible actual leader who has delivered real results for our country."

Reality check:No matter how Biden performed, the interview was unlikely to significantly strengthen his standing on Capitol Hill, members told Axios ahead of time.

• "Nobody thinks that having a decent interview is the end of the problem," one House Democrat told Axios before the segment aired.

The bottom line:"It makes mewonder what the Biden campaign is thinking, to build up so much expectationaround this interview ...and then serve up a 22-minute mixed bag,"one House Democrat said.

• "We needed more than that."

NGC 7789: Caroline's Rose

Found among the rich starfields of the Milky Way, star cluster NGC 7789 lies about 8,000 light-years away toward the constellation Cassiopeia. A late 18th century deep sky discovery of astronomer Caroline Lucretia Herschel, the cluster is also known as Caroline's Rose. Its visual appearance in small telescopes, created by the cluster's complex of stars and voids, is suggestive of nested rose petals. Now estimated to be 1.6 billion years young, the galactic or open cluster of stars also shows its age. All the stars in the cluster were likely born at the same time, but the brighter and more massive ones have more rapidly exhausted the hydrogen fuel in their cores. These have evolved from main sequence stars like the Sun into the many red giant stars shown with a yellowish cast in this color composite. Using measured color and brightness, astronomers can model the mass and hence the age of the cluster stars just starting to "turn off" the main sequence and become red giants. Over 50 light-years across, Caroline's Rose spans about half a degree (the angular size of the Moon) near the center of the sharp telescopic image.

Full interview with George, they swear, NO EDITS, NO EDITS

Bidan uses the excuse thathe usually sit's down and that was the problem. He's blaming it all on Trump because he insisted to stand up during the debate.

George: "Did you ever watch the debate afterwards?"

Bidan: "No I don't think I did"

Bidan: "He lied 28 times", meaning Trump (Bidan lied and messed up a lot more than that.So what if he lied, how did they interfere with you telling the truth, you didn't even notice, it was Clyburn gave you this excuse as soon as the debate was over, you didn't even notice the "supposed" lies)

This is even worse than what's been reported.

As expected, Team Trump notes Justice Thomas' concurring opinion suggesting Smith's appointment is unconstitutional.

Trump already has pending motion to dismiss case based on unlawful appointment of special counsel. It was debated at a hearing last month.

SpaceX targeting July 31 for launch of historic Polaris Dawn astronaut mission

July 3, 2024

The first commercial spaceflight mission with a spacewalk now has a launch date.

Polaris Dawn, part of a private human spaceflight program funded by billionaire Jared Isaacman, will launch no earlier than July 31, project representatives announced today (July 3) in a brief statement on X.

Isaacman and SpaceX founder and CEO Elon Musk, whose company will provide Polaris Dawn's Dragon capsule and Falcon 9 rocket, have not yet put statements out on social media.

The crew plans to conduct the first-ever private spacewalk with bespoke SpaceX spacesuits made for the effort, along with a raft of experiments.

Polaris Dawn's orbit will take the mission about 435 miles (700 kilometers) above Earth, in the highest-altitude crewed flight since the Apollo moon missions of the 1960s and 1970s.

For comparison, the International Space Station orbits at roughly 250 miles (400 km).

Polaris Dawn will be the first of a trio of missions of the Polaris Program, all funded and commanded by Isaacman.

The Shift4 founder also helmed and bankrolled the all-civilian Inspiration4 launch in September 2021, which raised $250 million for St. Jude Children's Research Hospital in Tennessee along the way; Isaacman plans to continue that support with the Polaris missions.

Related: How SpaceX's private Polaris Dawn astronauts will attempt the 1st-ever 'all-civilian' spacewalk

Aside from Isaacman, the mission includes retired United States Air Force (USAF) Lieut. Col. Scott "Kidd" Poteet as pilot and mission specialists Sarah Gillis and Anna Menon, both SpaceX operations engineers.

The complexity of the mission, according to project representatives, required delays during development from an initial launch target of late 2022.

The most recent major delay in February 2024 pushed the projected April launch into summer.

"The additional time continues to provide necessary developmental time to ensure both the completion of these mission goals and a safe launch and return of Dragon and the crew," the Polaris Program said via X at the time.

The training schedule has been evolving as well, Poteet stressed in a "Spaces" discussion on X on May 4.

"We've kind of piled on to what NASA has done over generations as far as identifying environments and situations that are stressful," he said, noting that part of the work has been learning about where teammates do well and where they may need help.

🔥Heck yeah! ‘MERICA: Grocery stores in Alabama selling ammo with AI-driven vending machines

A pair of grocery stores in Alabama are selling firearm ammunition via artificial intelligence-powered vending machines.

The machines, located in Fresh Value stores in Tuscaloosa and Pell City, use facial recognition to verify a customer’s age and ID to make it easier to get firearm ammo. The company, American Rounds, created the machine.

Ovzon’s debut broadband satellite ready for commercial service

July 5, 2024

Ovzon’s first fully owned satellite is ready to start commercial services following successful tests in geostationary orbit, the Swedish broadband operator announced July 5.

Company CEO Per Norén said the first full-service customer for Ovzon 3 will be GIGN (Groupe d’Intervention de la Gendarmerie Nationale), France’s elite police tactical unit, which plans to use the satellite for connectivity as the country prepares to host the Summer Olympics later this month.

According to Norén, Ovzon’s proprietary T7 mobile user terminal has also achieved 135 megabits per second download and 10 Mbps upload speeds with Ovzon 3, “significantly higher than our threshold and objective design specifications.”

When T7 was first deployed last year, the operator said it was receiving 60 Mbps and transmitting 10 Mbps using geostationary satellites Ovzon leases from other companies.

The Maxar Technologies-built Ovzon 3 has five steerable beams and a proprietary reprogrammable onboard processor that is designed to create a mesh network, enabling remote user terminals to operate independently of a terrestrial teleport.

The U.S. Department of Defense has traditionally been Ovzon’s biggest customer; however, the operator sees strong demand from government customers in Europe for what is also the first satellite owned by a commercial company in Sweden.

Years of launch and manufacturing setbacks forced Ovzon to twice get regulatory extensions for the satellite’s “Bring into Use” (BIU) deadline or risk losing priority spectrum rights for the 59.7 degrees East orbital slot.

Norén said Ovzon 3 arrived at this orbital slot May 26, after launching on a SpaceX Falcon 9 rocket in January, and started providing the signals needed to achieve BIU before the extended July 4 deadline.

He said Ovzon had notified international regulators through the Cyprus administration that the satellite had successfully arrived at its orbital slot.

The final step in the regulatory process is for Cyprus to re-confirm BIU 90 days after the satellite reaches its orbital position.

“Muslim Voters Support Is VERY TROUBLING” | Labour Loses Strongholds To Pro Gaza Candidates

https://youtu.be/ZpziZQmgpvc

--—-

6 Jul 2024 LONDON

Labour has lost several former strongholds to independent candidates campaigning on pro-Gaza platforms.

Shadow minister Jonathan Ashworth lost his Leicester South seat, which had a majority of over 22,000.

Labour's vote dropped by an average of 23 points in areas where 20% or more of the population identify as Muslim.

Shadow health secretary Wes Streeting saw his majority in Ilford North cut from over 9,000 to 528.

However, Labour managed to win back Rochdale from George Galloway.

Despite a landslide victory overall, Labour performed poorly in areas with high Muslim populations, losing five seats—four to independents and one to the Conservatives.

In Leicester South, Shockat Adam declared "this is for Gaza" as he won the seat by 979 votes. The constituency, with around 30% Muslim electorate, had been held by Ashworth for 13 years.

Alex Phillips speaks with political commentator Charlotte Littlewood about what the muslim voters organisation.

==NASA's Parker Solar Probe completes 20th close approach to the sun=

JULY 5, 2024

NASA's Parker Solar Probe completed its 20th close approach to the sun on June 30, 2024, matching its own distance record by coming about 4.51 million miles (7.26 million kilometers) from the solar surface.

The close approach (known as perihelion) occurred at 3:47 UTC (11:47 p.m. EDT on June 29), with Parker Solar Probe moving 394,736 miles per hour (635,266 kilometers per hour) around the sun, again matching its own record.

On July 2, the spacecraft checked in with mission operators at the Johns Hopkins Applied Physics Laboratory in Laurel, Maryland (where the spacecraft was also designed and built), with a beacon tone indicating it was in good health and all systems were operating normally.

The milestone also marked the midpoint in the mission's 20th solar encounter, which began June 25 and continues through July 5.

Parker will fly around the sun at the same distance and speed one more time this year—on Sept. 30—before making the first of its three final planned closest approaches on Dec. 24.

At that point, with Parker's orbit shaped by the mission's final Venus gravity assist-flyby on Nov. 6, the spacecraft will zoom just 3.8 million miles from the solar surface, moving about 430,000 miles per hour.

Courts Assert MI SoS Jocelyn Benson Conducts Unlawful Elections

Per MCL 168.31

, the Michigan Secretary of State is the head election official in the state. If the head election official issues directives regarding the conduct of elections in Michigan that violate the law, is it reasonable to assert that the elections executed under those guidelines are lawful? No.

DISINFORMATION

In our society, we rely upon our judicial system to determine whether or not certain actions by elected officials are considered lawful or not. The 2020 election and every election since then has featured a significant number of lawsuits alleging that election officials were not conducting our elections in a lawful manner.

Whenever the topic of lawsuits and the elections is brought up, however, we are treated to social media and even Big Media quips similar to the following:

Image

Presumably, the basis for this assertion can be found in a July 2022 report called "Lost Not Stolen"

citing 64 cases filed by "Donald Trump and his supporters".

Image

The fact of the matter is that most of these "64 suits" were dismissed on the basis of "standing" not the merits of the evidence provided in the lawsuits. Those who push the 60 lawsuit narrative lean heavily upon the assertion that election results were not overturned as the result of these cases rather than whether or not the elections were conducted in a lawful manner. Unlawful election activities have the tendency to prevent any determination of the true election results through the failure to provide an audit trail or the destruction of election records. There is an overwhelming amount of affidavits and other court exhibits in spite of the unlawful practices of many election officials. In fact, I have first hand knowledge of the veracity of evidence that this "learned study" dismisses without serious examination.

A serious examination of election lawsuits was performed by John Droz. His compilation of 2020 Presidential lawsuits

reveals that in 24 of the 32 cases decided of the merit of the evidence provided, the Trump or GOP plaintiff prevailed. The Epoch Times shared a substantive article on the topic entitled "Trump Won Two-Thirds of Election Lawsuits Where Merits Considered

".

In Michigan, the case for election malfeasance is even clearer. The Michigan Secretary of State Jocelyn Benson has been found in violation of the law by SEVEN separate courts.

Of course, when someone attempts to bring this fact to light, so-called "fact checkers" in Big Tech rally quickly to prevent the release of such information.

Big Tech is not the only group engaged in disinformation. Big Media is also all in on the attempt to silence the truth as evidenced by the following article in the Detroit Free Press.

Image

Please note that the article did not address any of the lawsuits cited in this article. The court opinions for Cases #1-#4 below had been issued prior to the date of this article. In this light, it certainly appears that the purpose of the Detroit Free Press article was something other than setting the record straight on Benson’s misconduct.

According to Influence Watch, the GroundTruth Project is a “left-of-center media” organization. This project in turn is supported by the Boston-based GlobalPost organization.

Why would a Boston-based organization fund reporters in Detroit?

As a point of fact, Jocelyn Benson, Michigan’s current Secretary of State, has already been found in violation of the law by seven separate court decisions. Individually, each of these cases would be concerning, but collectively they indicate a pattern of lawlessness that needs to be addressed if we are to have any confidence in the conduct of our elections under her guidance.

ACCOUNTABILITY

Citizens are looking for accountability. To date there have been zero consequences for the unlawful directives issued by the MI SoS Jocelyn Benson.

Contempt for law

In case being found in violation of the law in seven separate court cases is not enough to demonstrate MI SoS Benson's contempt for the rule of law, listen to the following testimony by her lawyer before the Michigan Court of Appeals in the O'Halloran v Benson trial.

0:14 / 0:41

“I don’t think we would want to create a war between the branches and if there was something telling us to do something and we thought it was OK, we would probably do it. But if it really came to push this conflicts with Constitution or this isn’t something that we can really do because we couldn’t really control it or it’s a bad idea we might just choose not to do it you could leave that statute sitting there and we could continue to issue instructions and give guidance and somebody would probably sue us.” - Attorney Heather Meingast speaking in defense of MI SoS Jocelyn Benson.

Many more examples of contempt for the law where this came from. Stay tuned for another post providing details of Benson's yet to be prosecuted criminal exploits.

Contempt of court

So when do we get to see the consequences for the contempt shown by MI Secretary of State Benson for the rule of law? That remains to be seen.

There was an attempt to hold her in contempt of court when she refused to update her election guidelines per the court order issued by MI Court of Claims Judge Brock Swartzle in O'Halloran v Benson. Attorney Ann Howard filed a motion to hold Benson contempt of court which would have resulted in significant personal consequences for Benson.

Image

Prior to the election, supporters of the plaintiffs rushed to provide the following guidance to poll challengers and election officials in the wake of the inaction taken by the MI SoS.

Image

Despite this guidance, the unlawful directives issued by the MI SoS held sway with most election officials.

The Michigan Supreme Court further complicated the situation by intervening

in the case and placed an injunction upon the lower court to prevent such a motion from being adopted by the court. Notably, the Michigan Supreme Court did not rule that Benson’s directives were lawful. They simply prevented the lower court from filing charges against Benson effectively enabling her to execute an unlawful election. The damage was done, however, and election officials executed the 2022 election under the unlawful guidance of the MI SoS.

CRIMINAL COMPLAINT

Michigan Secretary of State Jocelyn Benson should be tried criminally for a growing list of statutory violations without remorse. The Michigan Attorney General Dana Nessel or a Biden appointed US District Attorney would need to pursue such action. How does a criminal complaint get traction when those sympathetic to the criminal actions taken are placed in the position to determine whether or not a crime has been committed?

CONCLUSION

The 2020 and 2022 statewide elections in Michigan were conducted under the guidance of unlawful directives by Secretary of State Jocelyn Benson. There is no reason to believe that the 2024 election will be any different until the court system holds Benson accountable for her lawless actions. It remains to be seen how or when this accountability will occur. Until it does, the citizens of Michigan will continue to have reason for concern in the results of any election conducted in their state.

=Regulating outer space after Loper Bright

July 5, 2024

It’s been a busy few weeks for the Supreme Court. Among the decisions that are being hailed as the most significant in decades, the court issued Loper Bright v. Raimondo, overturning the 40 year old Chevron Doctrine, which directed courts to defer to an agency’s interpretation of their authorizing statutes.

What does fishing for herring (the fact pattern of Loper Bright) have to do with developing outer space? A lot, actually. While space exploration began 67 years ago with the launch of Sputnik, the rules regulating commercial activities in outer space in many ways are just now being written.

Agencies from the Federal Communications Commission (FCC) to the Federal Aviation Administration (FAA) to the National Institute of Standards and Technology (NIST) all have open proceedings affecting outer space.

And without Chevron deference, all of these agency actions may be subject to challenge.

Loper Bright says that courts must determine what powers agencies hold when an authorizing statute is unclear. The decision does not say that non-expert judges will now have to make critical technical decisions, contrary to what some are saying.

Agencies will retain the ability to make factual findings in implementing statutes, especially on highly technical issues, and courts will give them great weight.

Administrative law nerds will note that agencies still retain Skidmore deference, the older cousin of Chevron, which still directs courts to provide substantial weight to an agency’s interpretation of statutes, based on the agency’s expertise, procedural due process and consistency in the way it has implemented its authority in the past.

Then there’s the Administrative Procedure Act, passed in 1946, after Skidmore but almost 40 years before Chevron, which directs courts to review rules under a relatively low bar requiring appellants to demonstrate that the agency has been arbitrary and capricious.

So agency deference is not dead, it’s just no longer a slam dunk.

This is important to the future of commercial space precisely because we’ve never had a National Space Act.

Congress has never passed a comprehensive statute clearly assigning authority to specific agencies to regulate commercial outer space development.

Agencies have been left to cobble together their authority from enabling statutes that, in many instances, were crafted prior to the space age.

And without clear congressional direction, agencies — some with sharp elbows — have crafted a regulatory regime for outer space that, as I wrote for Utah State University’s Center for Growth and Prosperity, is full of “gaps, overlaps, and stovepipes.”

Yes, the FCC has statutory authority over allocating and licensing spectrum for space communications.

But the FCC wants to regulate major aspects of in-space servicing, assembly and manufacturing (ISAM) that go well beyond simply spectrum use.

And the FAA has statutory authority over licensing launch and reentry of rockets. But the FAA wants to impose rules on rocket upper stages that will affect them after they obtain orbit, a domain over which Congress has explicitly denied the FAA authority.

Finally, NIST has been tasked by the White House to develop a framework around government march-in rights on patents developed using government grants.

Each agency was doubtless counting on courts to immunize these decisions from legal challenge under Chevron deference.

In April, TechFreedom filed comments at the FCC questioning their authority over ISAM operations.

We also filed comments at the end of June questioning whether the FCC even has statutory authority to issue orbital debris rules.

Last December, we warned the FAA that its authority over launch and reentry might not apply to what happens to upper stages left in orbit.

All of these comments contemplated what might happen after Loper Bright.

Chief Justice Roberts’s opinion also implicates Congress in this inter-branch scrum. It is up to Congress to make clear what powers it is delegating to agencies.

If it wants the agency to promulgate rules of a certain type, it needs to tell the agency to do so. And that’s exactly what Congress needs to do with regard to commercial outer space development.

We need a National Space Act that clearly assigns regulatory authority to the relevant agencies, but also provides the necessary guardrails against agencies making overlapping, or worse, conflicting rules.

Bills like H.R. 6131 are a good start but must be retooled after Loper Bright to better define agency rulemaking authority, when deference is appropriate, and how it should work. As I testified before the House Space Subcommittee last year:

Congress’s task is to find a balance on the continuum between “permissionless innovation” (where nearly anything goes), and the “precautionary principle” (where the government must micromanage and approve every activity by U.S. citizens in space).

This is a hard, but necessary, task if we wish to continue to be leaders in the cislunar economy going forward.

Here’s hoping that Loper Bright prods Congress into action to provide a clear framework for commercial development and American leadership on the high frontier.
