行政院：現無恢復7天國定假日必要
〔記者陳鈺馥／台北報導〕民進黨在九合一選舉大敗，針對外界廣泛討論是否恢復七天假，行政院發言人谷辣斯‧尤達卡（Kolas Yotaka）今日澄清表示，國定紀念日的七天假已於「勞動基準法」第一階段修法時廢除，確立週休二日的明確法源，使全國勞工與公務人員國定假日一致，「目前並沒有恢復七天假必要」。
Kolas Yotaka表示，為落實勞工週休二日，讓勞工與公務人員休假一致，例如解決928教師節，有教師不放假、而勞工卻放假的問題等。所以在勞基法第一階段修法時，基於多增加勞工全年週休假日的前提，廢除國定紀念日七天假，因此現階段沒有重新討論恢復七天假的必要。

民進黨政府《勞基法》兩次修法，引起社會紛擾，民進黨立委許智傑今天呼籲「三修勞基法」，拿掉加班時數上限。

〔記者李雅雯／台北報導〕勞動部研擬修正「違反勞動基準法裁處罰鍰共通性原則」，讓違反「勞基法」情節輕微的事業單位可減輕或免除處罰，預計6月可上路。勞動部強調，該原則是各縣市政府勞政主管機關在裁罰時候所採的共通性原則，由於會議上意見分歧，現階段尚在彙整意見資料中，修正細節待研議。
「違反勞動基準法裁處罰鍰共通性原則」最近一次修正為去年10月，當時將上市櫃公司有違法加班、輪班間隔不足11小時和未有例假7休1等違法事實時的罰鍰5萬元起跳納入裁處原則。
不過，勞動部今年勞檢方針為「微型企業以訪視輔導取代勞檢」，違反「勞基法」情節輕微的事業單位，可以減輕或免除處罰，也併軌納入修正內容。
據了解，地方縣市政府與會代表對於修正內容意見分歧不一，有人認為每個案子條件都不同，需視情節而定，很難用共通性原則去衡量；另也有人指出，各情節案子判罰鍰會因為不同人而有不同裁處，有共通原則較好執行。

台鐵普悠瑪6432次列車於去年10月21在宜蘭新馬站前發生超速出軌，導致全列車翻覆釀18
人死、267人受傷，為台鐵近年來最嚴重的死傷事故之一，歷經近8個月追查，宜蘭地檢署
於今（6）日公布調查結果，包括肇事司機員尤振仲、前台鐵局機務處副處長柳燦煌，以
及台鐵局綜合調度所所長吳榮欽被以依「業務過失致死」等罪起訴、曾任台鐵局長的周永
暉、范植谷、鹿潔身等人則獲不起訴處分。對此，交通部表示「尊重司法單位的調查及起
訴的決定」，不過針對定前3任台鐵局長、宜檢雖認定無涉刑事責任不起訴部分，交通部
強調仍須應負起督導不周之行政責任，因此將在行政責任調查獲核定後進行懲處。
宜蘭地檢署今（6）日上午11時宣布偵結1021台鐵普悠瑪列車翻覆事故案，其中，僅司機
員尤振仲、前台鐵局機務處副處長柳燦煌、台鐵局綜合調度所所長吳榮欽等3人涉犯過失
致死罪，其餘包括曾任台鐵局長的周永暉、范植谷、鹿潔身共16人獲不起訴。對此，交通
部稍早前作出回應，表示尊重司法調查及決定；不過針對主管懲處部分，交通部長林佳龍
曾要求台鐵局重提事故責任調查報告，3任前台鐵局長皆被加重處分，目前懲處案已呈報
行政院。
交通部表示，林佳龍要求針對就主風泵檢修、ATP遠端監視系統、普悠瑪列車採購及驗收
等層面釐清問題及究責，展開行政責任調查，並加重並擴大主管級人員懲處，交通部強調
，宜檢雖認定前3任局長無涉刑事責任不起訴，不過仍應負起督導不周之行政責任，因此
交通部仍將在行政責任調查獲核定後進行懲處。
另，交通部也將全力支持家屬訴求，配合行政院「國家運輸安全調查委員會」成立後，就
本起事故重啟調查；期間，林佳龍數度與罹難及受傷者家屬懇談，家屬除主張提高賠償金
額度，也要求從優從速協助傷者賠償，協助傷者復原，目前也正在研商對車商求償及扣抵
保證金的談判，針對宜檢偵結所公布的資料，交通部將審慎檢視，作為接下來提升台鐵安
全及內部檢討之參考依據。
