So, the dev said he would gave $ back to whoever asked for it and didn't comply.

You can try to escalate this to Kickstarter, IF it violates their norms.

But as far as I can see, it's just a blog promise that you can't enforce.

At least the project is not abandoned, although it's kinda creepy that in the Steam Greenlight site there are only two comments from 2015 and none from 2016.
