Vos como habitante y ciudadano del país tenés derecho a circular libremente en él. Ahora, y esto es importante, ningún derecho es absoluto. Ninguno. Todos tienen límites en la ley, y todos tienen que ser ejercidos respetando los derechos del resto de la gente (de ahí que te digan "con sujeción a las disposiciones legales"). Pero seguís teniendo los derechos, y la ley no puede ni suprimirlos ni regularlos de una forma que vaya contra su intención original. Vos tenés el derecho a circular.
Otro ángulo desde el que lo podés abordar es cuestionando la legitimidad de la normativa que te prohíbe salir. El Decreto 241/2021 (el que establece el toque de queda, por lo que tengo entendido) es un DNU, un Decreto de Necesidad y Urgencia. Y para la constitución hay muchos, muchos límites a lo que puede hacer un DNU. Primero que nada, la única situación en la que se puede dictar uno es cuando haya circunstancias excepcionales que hagan que el Congreso no se pueda reunir. Si se puede seguir el protocolo de sanción de leyes en la constitución, no puede haber DNU. Segundo, tiene que ser sobre situaciones que requieran una solución urgente e inmediata. No se puede dictar por cualquier boludez. Tercero, no pueden regular sobre materia penal, impositiva, electoral, o en lo referido a partidos políticos. Acá es importante lo de penal. ¿Qué significa en este caso? En reglas muy, muy generales, y para que te des una idea, si te pueden meter en cana por eso es un delito penal. Cuarto, tiene que tener la firma del presidente, jefe de gabinete, y todos los ministros. Dentro de los pocos días se tiene que llevar al Congreso y a la comisión bicameral permanente para que lo aprueben.
En definitiva, te podés defender diciendoque impone un límite excedido a tu derecho humano y fundamental a circular, o queel DNU que lo dictó es inconstitucional por no haberse hecho según las formalidades y dentro de los límites de la constitución.
Te va a funcionar eso? Honestamente, no te lo puedo garantizar. No sé si es más probable que te lo acepten o que te lleven a la comisaría igual y ahí decidan si lo que decís tiene algún mérito o no. Y como ya dije, soy choriboga en entrenamiento. Todavía no terminé la carrera. Si podés, buscate la opinión de un boga con más experiencia y conocimiento
