Judge Orders Antifa Activist Yvette Felarca to Pay Judicial Watch Legal Fees for Her ‘Entirely Frivolous’ Lawsuit

MAY 21, 2019

(Washington, DC) — Judicial Watch announced that a U.S. District Judge in California awarded Judicial Watch $22,000 in legal fees in a case filed by an Antifa organizer in an effort to block Judicial Watch from obtaining information about her activities.

Yvette Felarca, a middle school teacher in the Berkeley Unified School District (BUSD), and two co-plaintiffs were ordered to pay Judicial Watch $22,000 in attorney’s fees and $4,000 in litigation costs. Felarca had sued the BUSD in federal court to keep the school district from fulfilling its legal obligation to provide Judicial Watch with records of their communications mentioning: Felarca, Antifa, and/or BAMN. Judicial Watch also asked for Felarca’s personnel file.

Felarca is a prominent figure in By Any Means Necessary (BAMN), a group founded by the Marxist Revolutionary Workers League that protests conservative speaking engagements. In 2016, Felarca and two of her allies were arrested and charged with several crimes, including felony assault, for inciting a riot in Sacramento. Earlier this year, Felarca was ordered to stand trial for assault.

U.S. District Judge Vince Chhabria, Northern District of California, who had previously ruled that Felarca’s lawsuit was “entirely frivolous,” wrote in his ruling awarding legal fees to Judicial Watch that Felarca and her co-plaintiffs’ First Amendment claims were “premised on the obviously baseless assumption” that the First Amendment condemns the speech of some while condoning the ideological missions of others.

Judge Chhabria added that “The plaintiffs also mischaracterized the documents under review” and that the plaintiffs “failed to grapple with the role Ms. Felarca played in making herself a topic of public discourse through her physical conduct at public rallies and her voluntary appearance on Fox News.”

Judge Chhabria’s order also states that “a significant portion of the documents the plaintiffs initially sued to protect from disclosure had been publicly disclosed months earlier in another suit brought by Ms. Felarca against BUSD, where she was represented by the same counsel. (See generally Felarca v. Berkeley Unified School District, No. 3:16-cv-06184-RS). The plaintiffs, therefore, had no reasonable argument to protect those documents from disclosure.”

Along with Felarca’s $20,000 payment, co-plaintiffs Lori Nixon and Larry Stefl were ordered by Judge Chhabria to pay Judicial Watch $1,000 each (Yvette Felarca, et al., v. Berekely Unified School District, et al. (No. 3:17-cv-06282-VC)).

“Judicial Watch is entitled to attorney’s fees because the plaintiffs’ lawsuit was frivolous, and their litigation conduct was unreasonable,” Judge Chhabria wrote in his order.

Additionally, Judge Chhabria’s order holds the plaintiffs “jointly and severally liable” to pay Judicial Watch $4,000 in litigation expenses.

In 2017, Judicial Watch filed a California Public Records Act (CPRA) request seeking public records information about Felarca’s Antifa activism and its effect within the Berkeley Unified School District. In her lawsuit aimed at keeping the Berkeley school district from furnishing the records, Felarca alleged that Judicial Watch was misusing the law for political means and the district should refuse to provide the information.

In January 2018, a separate judge ordered Felarca to pay more than $11,000 in attorney and court fees for her frivolous attempt to get a restraining order against Troy Worden, the former head of the University of California (UC) Berkeley College Republicans.

“This is a huge victory for Judicial Watch against Antifa and the violent left,” Judicial Watch President Tom Fitton said. “Ms. Felarca attacked Judicial Watch without basis and the court was right to reject her ploy to deny our ‘right to know’ because we don’t share her violent left views.”

Treasury Declines to Label China Currency Manipulator

WASHINGTON — The Trump administration on Tuesday declined to label China as a currency manipulator despite President Trump’s repeated complaint that Beijing has weakened the renminbi as a way to take advantage of the United States on trade.

The decision not to formally accuse China of manipulating its currency could avoid further escalating tensions between Washington and Beijing, which have grown heated following a breakdown in trade negotiations earlier this month.

China continues to be on Treasury’s watchlist along with the “currency practices” of Germany, Ireland, Italy, Japan, Korea, Malaysia, Singapore, and Vietnam. And the report continued to raise concerns about China’s activity in managing its currency.

Treasury said that it has “significant concerns” about China’s currency practices and criticized the Chinese government for lacking transparency in how it manages foreign exchange. It noted that the renminbi has fallen by 8 percent in the last year and that China’s bilateral trade surplus in goods with the United States grew to $419 billion as of the end of 2018.

“The outsized magnitude of the bilateral deficit is a result of China’s persistent and widespread use of non-tariff barriers, nonmarket mechanisms, state subsidies, and other discriminatory measures that are increasingly distorting China’s trading and investment relationships,” the report said. “These practices tend to limit Chinese demand and market access for imported goods and services, leading to a wider trade surplus.”

The report comes as the United States and China are locked in a protracted trade war following a breakdown in trade negotiations earlier this month. The United States raised tariff rates on $200 billion worth of Chinese imports and is considering imposing tariffs on another $300 billion. China has vowed to hit back with tariffs or other punitive measures of its own.

Justin Amash Attacks AG Barr: ‘Used His Position’ to Push Trump’s ‘False Narrative

Rep. Justin Amash (R-MI) on Tuesday once again attacked Attorney General William Barr’s handling of special counsel Robert Mueller’s report on now-debunked collusion between the 2016 Trump campaign and Russia, claiming that the nation’s chief legal officer “deliberately misrepresented” its contents.

Amash rocketed into Resistance folk-hero status earlier this month after becoming the first congressional Republican to accuse President Trump of “impeachable” offenses based on Mueller’s report on social media. In the same Twitter thread, the libertarian-leaning lawmaker also accused Barr of misrepresenting the special counsel’s findings. Mueller found no evidence of a criminal conspiracy between the Trump campaign and Russia during the election, and further, Barr and Deputy Attorney General Rod Rosenstein determined that the president did not obstruct justice based on the report. Amash aimed his critique directly at Barr shortly after noon Tuesday, one day after Memorial Day.

“Attorney General Barr has deliberately misrepresented key aspects of Mueller’s report and decisions in the investigation, which has helped further the president’s false narrative about the investigation,” Amash wrote on social media, then accused Barr of crafting a letter which “selectively quotes and summarizes points in Mueller’s report in misleading ways.” Amash later pointed out that Mueller sent a letter to Barr, stating that the attorney general’s summary of his findings “did not fully capture the context, nature, and substance” of his report. “There is now public confusion about critical aspects of the results of our investigation. This threatens to undermine a central purpose for which the Department appointed the Special Counsel: to assure full public confidence in the outcome of the investigations,” Amash tweeted, citing Mueller’s letter sent March 27 to Barr.

The Michigan congressman then expanded on the purported “false narrative” that President Trump has attempted to disseminate regarding the Mueller report, claiming that Barr played a role in the findings’ misrepresentations. “Barr has so far successfully used his position to sell the president’s false narrative to the American people. This will continue if those who have read the report do not start pushing back on his misrepresentations and share the truth,” he concluded.

Tuesday’s tweetstorm comes as Amash continues to face fierce blowback from top Republicans over his remarks. Michigan State Rep. Jim Lower (R) recently announced that he will mount a primary challenge to the congressman, saying his remarks on impeachment “show how out of touch he is with the truth and how out of touch he is with people he represents.” President Trump responded to Amash’s statements, calling him a “loser” and a “total lightweight” in search of media attention.

The House Freedom Caucus has also voted to condemn Amash, one of the group’s founding members, for his statements. “It was every single person who totally disagrees with what he says,” House Oversight Committee ranking member Jim Jordan (R-OH) said of the vote. “What concerns me is Justin was viewed as a leader, right, on protecting privacy rights first to First Amendment rights.”

The first is the so-called "Blood Libel." Border Patrol Creating A New Position To Stymie The Immigration Crisis

The U.S. Border Patrol announced that it’s creating a new position specifically tailored to processing and caring for migrants who reach the southern border, allowing agents to refocus their work on enforcement. The “Border Patrol Processing Coordinator” will assume certain responsibilities that have consumed the agency’s time as it deals with a surge of migrants at the U.S.-Mexico border, according to a Customs and Border Protection (CBP) press release on Tuesday. The new position is meant to bring relief to agents who have long complained that the humanitarian crisis has kept them from performing their main role at the border. Coordinators are to be tasked with feeding, cleaning, transporting and other general tasks for illegal immigrants in Border Patrol custody. Migrants in need of medical care will be transported to hospitals by coordinators, who will also be assigned to watch over migrants as they receive care.

“I am committed to providing the men and women of the U.S. Border Patrol the resources they need to accomplish their border security mission,” Carla Provost, Chief of the Border Patrol, said in a prepared statement on Tuesday. “Border Patrol Processing Coordinators will take on processing, transportation, and custody responsibilities, which will free up agents for critical law enforcement operations.” It’s not clear how many Border Patrol Processing coordinators the agency plans to bring on, but CBP indicated it is currently developing the position and plans to begin hiring by early fiscal year 2020.

The announcement comes as Border Patrol agents are becoming inundated with tens of thousands of illegal immigrants every month — many of them family units and unaccompanied children that require special care. The result of the crisis has forced 40% of agents at the Southwest border to focus on the menial tasks that come with caring for migrants — taking them away from their law enforcement role. The crisis has not only forced migrant detention centers to release thousands of families into the interior of the U.S., but has also meant a lack of narcotics enforcement. Officials within the Department of Homeland Security are warning that drug cartels in Mexico are taking advantage of the immigration emergency that’s consuming agents’ time. “Right now, we are babysitting,” an agent stated in January, decrying the nursing role they’ve been forced to take on. “We’re supposed to pay attention to medical conditions that we’re not trained for. We are not machines. We’re emotionally stressed.”

They are also words that can’t be be taken for granted, because today nearly 30 million acres of U.S. farmland are held by foreign investors. That number has doubled in the past two decades, which is raising alarm bells in farming communities.

How did we allow this to happen?

And actually laws regarding land ownership vary greatly from state to state. Some states have placed strict restrictions on foreign land ownership, while in other states it is “a free-for-all”…

“Texas is kind of a free-for-all, so they don’t have a limit on how much land can be owned,” say’s Ohio Farm Bureau’s Ty Higgins, “You look at Iowa and they restrict it — no land in Iowa is owned by a foreign entity.”

Ohio, like Texas, also has no restrictions, and nearly half a million acres of prime farmland are held by foreign-owned entities. In the northwestern corner of the state, below Toledo, companies from the Netherlands alone have purchased 64,000 acres for wind farms.

But even in states where there are restrictions, foreign entities can get around that by simply buying large corporations that own land.

On May 13th, Reuters headlined “Iran insists on ramping up oil sales to stay in nuclear pact” and reported that “EU officials … estimate Iran needs to sell 1.5 million bpd to keep its economy afloat. A drop below 1 million bpd could bring hardship and economic crisis.”

Prior to US President Donald Trump’s cancellation of the nuclear deal with Iran and re-imposition of economic sanctions against Iran and against any companies that trade with Iran, Iran had been selling around 2 million bpd (barrels per day).

Furthermore:

Once Europe’s biggest supplier, Iran has seen its exports gradually cut off from European buyers.

China – Iran’s largest oil customer with imports of 475,000 bpd in the first quarter of this year – has also stopped buying from Iran after Washington chose not to renew sanctions waivers.

Therefore, companies both in Europe and in China are terminating trade with Iran. The likelihood is consequently that Iran will be forced back into its nuclear program, and that things will be like what they had been before Obama had struck his deal with Iran. Here’s what that was like:

On 22 April 2010, the Congressional Research Service reported to Congress that:

Iran’s economy is highly dependent on the production and export of crude oil to finance government spending, and consequently is vulnerable to fluctuations in international oil prices. Although Iran has vast petroleum reserves, the country lacks adequate refining capacity and imports gasoline to meet domestic energy needs. Iran is seeking foreign investment to develop its petroleum sector. While some deals have been finalized, reputational and financial risks may have limited other foreign companies’ willingness to finalize deals.

Trump seems likely to exceed the hostility toward Iran that had been in effect during Obama’s and Bush’s Presidencies. If Trump is trying to force Iran to retaliate, then the goal is to use such retaliation from Iran as an excuse for the US military to move in — to invade.

The Reuters article says “One year after Washington quit the deal, Iran announced on Wednesday steps to relax some restrictions on its nuclear program.”

So: that is already restarting.
